You just need to show evidence that you have met once in the last 2 years, not that you have been having a relationship for the past 2 years.

K-1 Fiance(e) Visa Process & ProceduresI134
QUOTE (jrayl3 @ Dec 8 2008, 01:47 PM) <{POST_SNAPBACK}>
Hi everybody,

A few questions about the I-134 --- thanks in advance for any advice!

1). I've asked my parents to be co-sponsors and they've agreed to do the I-134 but my mom is a little reluctant to turn in copies of their complete tax returns. They're very complicated, lots of paper, and my mom feels uncomfortable turning over all their bank routing numbers, SS numbers, etc. I'm only doing the tax transcripts for myself but when I called the IRS, I noticed that they only do those for simpler returns (1040, 1040-EZ) and not for more lengthy, complicated returns (like my parents'). So what exactly does my fiancee need from my parents to show at the interview? If she does not feel comfortable with all the personal info (bank routing numbers, SSN, etc) she can cross it out (thats what I did.

2). When I go to the embassy here in Mexico to have my I-134 notorized, do I need to bring those tax transcripts, bank statements, etc., along, or is the I-134 alone sufficient? Just the I-134 is needed.

3). If so, is it okay to do it in advance? We're currently living in Mexico City but are about to move to a smaller town in January where it will be almost impossible to find a notary. So I'd rather do it here but I don't want them to reject our info (like my bank statements) for being out of date. We just got our NOA2 last week so I don't imagine we'll get an interview until the end of January at least. Is it okay if my I-134 and that of my parents (they're coming for Xmas and it would be perfect to have them bring their own I-134, tax documents, etc. when they come) are from mid-December and he doesn't go for his interview for another 6 weeks? I think the notarized statements are good for a year but someone correct me if I am wrong. Not sure how it works in Mexico. You may want to call some of the notaries and find out.

4). I definitely need to show bank statements for myself because my income will not impress them. I worked for 5 months at a private school at the beginning of this year but have no proof. I worked at another school for another 3 months but have no proof of that either. Now I give private lessons so I suppose I am self-employed. So how can I get a letter from a bank officer stating all of the things required by the I-134--such as how much as been deposited over the past year, etc.--from Mexico? Will an email suffice? Should I have a letter sent to my parents before their arrival? Call the bank and ask them. I am guessing that you will need to have this info on the bank letterhead.

Thanks again and good luck to everyone.

Jamie

K-1 Fiance(e) Visa Process & ProceduresPlanning a Wedding
Never plan for anything solid until you have the visa. There are so many things that can go wrong/get delayed that you would be throwing money away. If you want to plan a wedding, make sure you can get vendors that are flexible or will give you your money back.

Or, you can have the wedding and then petition for a spousal visa. Then you can have the wedding when you want.

So we spoke to an immigration lawyer today, and he confused me! He knows Im coming from Canada, so I qualify for the Visa Waiver Program. He told us that if we were to decide to marry while in the states, I wouldnt have to come back to Canada, and he can file on our behalf to have me stay there for good. I let him know I use the VWP, I dont get B2's, and he said you don't need a B2, that I can come in under the VWP.
How on Earth can he do that?
I told him everything Ive read, Ive read other-wise, and he just said "trust me.. it can be done"/

I wonder whats up with that?!

He aint a very good lawyer if he told you that you can marry while you enter on the VWP. 1 it's fraud if you have the intent to marry while you enter the USA. I would phone another lawyer or do it yourself.

Just to clarify, they can get married but if she had intent to immigrate and stays then it is fraud.

The marriage in and of itself does not constitute fraud.

Keith has just broken up with me, he cant take the let downs and the being apart anymore. He said goodbye , what do i do now? We are weeks from the interview but have no cosponsor and I didnt make enough to do it so I need to know what I have to do now. I am broken , I am lost and I am all alone. This hurts so bad and I cant take the pain. He is my life and without him I am nothing.

I am sorry he is doing this to you rose.gif

I don't know much about your story but you talk about letdowns and being apart. Here is what I see from your timeline:

You have both spent months together either here or in the UK
Your NOA2 came fairly quickly with no RFE
Your case is now at the embassy

I understand that separation is painful, whether you get to see each other frequently or not, we all feel that. Let me just say that the 2 of you have been very fortunate to spend as much time together as you have, not a lot of people get to do that.

I think he needs to put his situation in perspective. If I were you, I would send him links, or cut and paste some of the heart wrenching stories of those who:

- only get to visit each other once during the whole process
- have to wait upwards of 6 months for an NOA2
- have to wait 4 months for an interview at the consulate
- have to go through AP before getting the visa

Those are real letdowns.

Then maybe he will see all this in a different light and step up to help you figure this out.

Good luck with whatever you decide.

if you look at your NOA1...the timeframe given is 90-120 days i believe. your congressman prolly wont do much right now as your still in the timeframe. have patience, looks like your right around the corner.
also if you take a look at this site : https://www.visapro....vice-Center.asp
it will help you to see what month they are working on.
i know its hard, but you will have to wait til you hit atleast the 120 day mark before getting your congressman involved. there are ppl inline ahead of you since March, june, july, aug, still waiting, just give it some more time. I know its hard, but you will get thru it.

You need to pack a lot of patience for this process. Everyone is in the same boat and waiting for the same thing, to be reunited with loved ones.

K-1 Fiance(e) Visa Process & ProceduresAnyone been approved for K1 with only one visit
Are you talking about at the petitioning stage or at the interview?

For the petitioning stage all that is required is that you have met once in the past 2 years.

For proof of relationship it is a huge plus to have multiple trips not just before petitioning but also between petitioning and interviewing. It helps prove bonafides of the relationship and seeing that you are going through Lagos you will need all the ammo you can get.

In our case, there was the trip when we met (I just happened to meet him, ie, I was not there because of him) and then another visit after we sent in the petition.

Sorry you are in this situation.

I would focus your energey on getting a job and lining up a cosponsor. Once she gets her visa she can wait up to 6 months to enter the US, so maybe you can take advantage of that to save as much as you can and get a place set up.

Its a tough situation but you have some time to see what you can do.

Good luck smile.gif

I have been reading some peoples stories on here and I am terrified! We rec'd our NOA1 Sept 15 and now we are waiting.....along with everyone else. We are really hoping for Jan or Feb but some people have been waiting for like 8 months with NO NOA2?????? Is there a reason this would happen? I am stressed out right now and I want that NOA2! But I also want to know is it possible for this to not be the quickest route (K1) I am wondering if there was a quicker route we missed?

The K1 is generally the quickest route. But sometimes things happen to make the process a little longer. It can be at the petitioning stage or at the interview stage. Its really out of your control when it comes to some of the delays that can happen. Also remember that each case is different.

Just sit tight. Your case is not out of the processing times yet. Don't start stressing out yet, it just makes the process that much longer.

Hello

I'm from Venezuela and my fiance and I are planning on applying for fiance visa in a couple of weeks. So far I have heard of two friends of mine who have tried to get the fiance visa. They all said it was just a waste of money, that they waited and waited and they never got an answer and they also spent so much money on it. So My Question is: Is it really worth it to apply for a fiance visa? It would be great if anyone from Venezuela who is going/went through the process let me know their point of view of Fiance visa. Thank you so much!

How long have your friends waited? This process is about waiting. Check out the timelines and see what the average times are. It will give you a better idea on what to expect.

This is why I was hesitant to suggest anything to contradict the excellent Zee's first-hand knowledge. I gently suggest considering the inclusion of some relationship-proof evidence in the I-129F filing, if for no other reasons than these: Doing so will show (to the embassy) some initiative on the filer's part; and policies & personnel at embassies can change without notice, in which case the filer may be very glad that he included the evidence at first. Including some evidence now may not matter at all, in the end, but it cannot hurt and could help.

smile.gif

Its true that adding the proof of relationship cannot hurt. I just think that the OP needs to think about what proof they can provide and make sure that the bulk of it is kept for the interview. Sometimes Ghana embassy can be wacko.gif with relationship proof.

K-1 Fiance(e) Visa Process & Proceduresproof of ongoing relationship??
QUOTE (TBoneTX @ Jan 13 2009, 01:24 AM) <{POST_SNAPBACK}>
I respectfully differ. Because Ghana is known as an EXTREMELY high-fraud country, I would front-load your I-129F application with an amount of "proof of relationship" information that would convince a reasonable person of the validity of your relationship. This is because some consulates (or consular officials) will refuse to look at such evidence when it is brought to the interview. If the evidence is in the package that the consulate receives from USCIS, the consuls cannot ignore it or say that it does not exist. The extra information will not matter to USCIS, and you can freshen the evidence and add to it when the interview occurs. Also, plan and budget now to attend the interview with your fiance(e).

None of the above is to contradict the wise Zee, but it is prudent to consider.

The history of the Ghana embassy actually proves otherwise. Unlike other places they do spend time scrutinizing evidence that is brought to the interview and it seems that no matter how much evidence is brought to the interview they want more. When we went we were told that we were told that we had an "overwhelming" amount of evidence, but they still wanted more.

IMHO, from what I have read, and what others have gone through, I would save all the evidence for the interview.

Proof of an ongoing relationship is not required for the petition so I would not worry about getting the call logs now.

I'm not sure how you can get call logs for your calling card. You may want to call their customer service number and see what they can do. I use www.pingo.com and I can print my call logs at any time.

Do I really need to include a proof of ongoing relationship when I'm mailing the I-129f
I just currently don't have that since I've been communicating with my fiancee using a prepaid calling card I buy from www.ctacard.com We included a few e-mails and call logs. We saved the bulk of it for the interview.

Also:

Do I really need to attach a separate sheet of paper explaining how I met my fiancee within the last two years?
I just think there's enough space on the I-129f. I just returned last month from Ghana were we're both from.
How do I need a separate sheet of paper to explain how we met. Just a bit confused there. please help. Ours was just a few lines that fit into the space on the I-129F. When, where, how we met and who introduced us. No love story.

So my fiancee and I were childhood friends before I left for the USA. We grew up together in the same neighborhood. We had a crush on each other but didn't really date. I was about 17yrs when I left for the USA. While in the USA, I lost her contact info. 12yrs. later I got hold of her somewhere in april '08. Luckily she was still single. Apparently, while I did not have that thought in mind, She had the hopes that I'll someday come back for her. We communicated for about 2months, which I have no proof of our communication because I called her mostly with a prepaid calling card I purchased online.

2months later I proposed to her and she accepted. we got engaged in June '08. I didn't have enough vacation hours from work so I wasn't able to attend the engagement ceremony. My cousin stood in for me as a proxy. yup, it's all legal in africa.

However, I travelled to meet her for the first time in 12yrs and we have pictures of us together. I was there from November '08 to December '08.

Here comes the questions:

1. Will the fact that I'm not in the engagement pictures cause a problem? She took pictures with my extended family members. This can only help. It is always a plus to have the support of friends and family. In our case we submitted pictures of him with my sisters and friends for the interview. Don't know if it helped, but it definitely didn't hurt. IMHO, it only helps to show bonafides.

2. I filled out the forms ( I-129F) on January 10, 2009, and still putting things together. Is it too soon to apply for the k-1 visa? You only need to have met once in the last 2 years. This is not about how long you have been together.

Help please.

I know that this is thinking a little ahead but what hard evidence do you have? Ghana is notorious for asking for more proof of relationship, so I would suggest (if you haven't already stated) sending snail mail to each other, e-mails, cards and getting a calling card company where you can print out your logs (I know that it was not accepted in our case, but you never know).

Thanks for the shout out Kim luv.gif

We just started getting involved with the yahoo messenger, snail mails, and emails. Prior to that it was all phone calls with prepaid calling cards.
I currently have three pages of order history showing the INVOICE NUMBER, DATE, TOTAL, of all the calling cards I purchased online.

but ya, I've started sending her emails occasionally, I just sent her the first snail mail. I just printed our first IM conversation last night 01/13/09.
I'm hoping we'll have at least 5 of each evidence under our belts before the interview.

But current evidence I have to send with the I-129F is one IM conversation we had last night, one email, pictures of us together, and a print of my order history I just mentioned above.

Will this be enough to send with the application for now??

That sounds good. Its a lot more than what we had.

In addition I would include your boarding passes from your trip to Ghana and passport stamps.
