K-1 Fiance(e) Visa Process & ProceduresI-134, Affidavit of Support
QUOTE (Ricca711 @ Mar 20 2008, 08:30 AM) <{POST_SNAPBACK}>
helpsmilie.gif Hi guys,

I have a couple of quick questions to ask while waiting for happy news from Efia smile.gif . I am going over the I-134 one more time before I send it to Samuel for his interview. I just noticed that under Roman numeral II. Supporting Evidence, its states, "the sponsor must submit in duplicate evidence of income and resources". This is going to sound like a really silly question, and I am probably reading too much into this, but does that simply mean to make several copies of everything I send? I sent one copy of my supporting documents but they did not even look at them. I sent bank statements, employment letter, paystubs and my tax info for 2005-2007. What the CO did was he looked over my I-134 and then asked for my tax stuff and glanced over my letter of employment. The only thing he kept was the I-134 and my 2007 tax pepers. He didn't ask for the rest. So, just send one copy because chances are you will get most of it back.

The next question is pertaining to #3 on the form which asks for the address where Samuel presently resides. On the initial petition we listed a p.o. box where we thought he would get his mail. However, as some of you already know, the mail never made it to that p.o. box. So, I am wondering if I should use the actual physical address of his house or remain consistent with what we initially used? I put Inusah's residential address because it says "presently resides at". I don't think they use it for mailing stuff.

Thanks for your help,

Erika

K-1 Fiance(e) Visa Process & ProceduresQuestion 18 of I-129F, Met on internet not personally
QUOTE (tashina @ Mar 20 2008, 09:41 AM) <{POST_SNAPBACK}>
that s wht he tells me that it is very hard for him to get US visa either i have to apply from here or i be go down to meet him.

Try meeting in another country then. Would it be easier to go to the UAE or somewhere in Europe?

The point is to have met at some point in the last 2 years, it does not matter where the meeting takes place.

Chances of getting an approval without having met within the last 2 years are slim to none.

Try and see if you can go and meet him. You can even meet in another country if that would be easier.

K-1 Fiance(e) Visa Process & ProceduresPregnant and Filing K1
Hi and welcome to VJ.

If you want your fiance to be here for the birth of your child you need to file ASAP. It is taking anywhere from 3-6 months to get the petition approved (that is with no probelms or requests for additional evidence) and then another 1-2 months for interview (I think that is what it is for Jamaica but someone who filed there can give a better idea). Best case scenario, it will take at least 6-9 months to get your fiance here. Take a look at the timelines for people filing through Jamaica to give you a better idea.

As far as using a service to fill out the forms, I don't know. Most people here read the guides and do it themselves. I set aside a weekend and just did it all. I didn't think it was too bad.

I paper clipped stuff togehter and then held it all together with a big binder clip. We didn't hole puch or anything like that.

We used USPS express mail so that we could track it. Whatever way you think is best.

My sisters sent letters and they were not notarized.

Like Jesse said, the only thing that needs to be notarized is the I-134.

If you are sending your 1040s you need to also send the W2, 1099 and any other schedules along with it.

You could also just get the tax transcript from the IRS and send that instead (it is free): http://www.irs.gov/i...=110571,00.html

K-1 Fiance(e) Visa Process & ProceduresDS-156K and evidence of engagement and financial support
QUOTE (phub11 @ Mar 24 2008, 08:08 AM) <{POST_SNAPBACK}>
Hi,

I have just looked at the DS-156K, and (surprise!) I need some clarification:

1) Does a signed statement by me (the beneficiary) stating that I intend to marry within 90 days constitute as sufficient evidence of engagement? All my receipts for the ring are in the States (I bought it while I was living with my American fiancee - on a J1 visa). I would say that was enough. We updated the letters of intent but were not asked for it at the interview. I think it depends on the CO about whether they ask for that or not.

As for other evidence you can include more pictures since you sent the petition, phone and chat logs, any plane tickets/boarding passes since the petition, stuff like that.

2) The London embassy mentions on their website that an I-864 (evidence of financial support) is not required. I have also read that my fiancee needs to complete an I-164 that I can just take to the interview. However, form DS-156K states that I need to file evidence of financial support. So, do I need to send any evidence of financial support when I send the DS-164K? If so, what (the I-164 is going to take a while to be done)? I think they probably mean the I-134 and the supporting documents that go with it. You will take that with you to the interview.

Thanks!

Might be a stupid question but hey might as well ask ... My fiancee doesn't have a middle name should I leave the area under middle name blank or fill it in with "none".. thanks. We left it blank.

Also, under Husband or Wife ( if none,so state) section ... do i need to put none across the entire row or just the first box? same for the next section Husbands or Wives. Just the first box is what we did.

And Lastly, All of the forms (all 4) in the G325A packet are identical right? Yup.

There is an example form here: http://www.visajourn...Form-G-325A.pdf

K-1 Fiance(e) Visa Process & ProceduresEngagement Ceremony
Hi Erika smile.gif

I think an engagement ceremony in Ghana is a family thing. We did not have one. But I have heard of couples doing them. As far as I know, its basically an opportunity for the family to meet you, eat, drink and be merry. You can make it as formal or as casual as you want.

If Samuel's family has done one beofre maybe you can get some ideas from them. On the same note, you can decide what you want the ceremony to include. Maybe his tribe has specific things that are done at an engagement ceremony. His sisters would be a good source of information for this.

Thanks for ur reply.

I called up the embassy and told them that i cant be there on 5th may.they said mail us when u r ready and we will reschedule.
Is there somethign else i shd do now?I can tchoose the dates, they said afte rthe mail they wil choose another date and let me know.

So did ur extension of NOA2 happen on its own.for me also they told it is upto the discretion,do i have to something or shd i just leave it assuming it will happen?

Please advise

I wouldn't worry about the NOA2 extension. All we did was e-mail and that was it. We had no other problems.

Do as the embassy says, when you get back then let them know. I think that at that point they will just reschedule you for another interview at the earliest time.

It looks like you are in good shape smile.gif

Hi All
I am in a huge problem and need ur help.

1) Basically, the embassy has scheduled my interview for 5th may and i cam to know abt it when i mailed them for extension of NOA2.
I nevere received any packet 3 and 4 ,so was not expecting any interview

I am now travelling to canada for 2 months and can defintely not attend the interview
WILL MY NOT ATTENDING MAKE THE PETITION INVALID?

You need to call and reschedule. If you just don't show up, you may have more problems than the embassy just making the petition invalid.

2)How do i get my NOA2 extended? The embassy said that it is upto the discretion of the visa officer.the problem is that my noa2 will expire on 26th june and i might be in canada till then..
Will this affect my petition

What do i do?there is no way i can cancel my going to canada as my company is sending me and i have no control and also i wont be able to fly back as i wont get holidays

Extending the NOA2 is pretty much automatic at most embassies. If you want, you can just e-mailing them to let them know (we did). They replied with the "extension is at the officer's discretion" blah blah. The wording is standard.

Please advise

Thanks

If your interview is after April 15, chances of being asked for a 2007 tax return are highly likely.

Tax transcripts are enough.

Print out of paystubs is fine. We included 6 months worth.

I-129F: use mailing address.

Hey, I'm wondering the same thing! Do you mind if I ask how you determined this?
Thanks a lot for the help,
Kathie

In the I-129F it just asks for an address. On the G-325A, it explicitly states "residence". The address on the I-129F is the address they will use to send the packet 3/4 to your fiance once your petition is approved.

G-325A: use the residential address.

I-129F: use mailing address.

After the petition is approved, it will be sent to the consulate in Kuwait. That is when you should receive instructions from them on how to apply for the visa.

In our case they just looked at them and then returned them to us.

But I am not sure if that is the norm at other consulates. If you want to keep the originals make a copy of them and take to the interview. Then they can look at the original and then keep the copy if they want.

K-1 Fiance(e) Visa Process & Proceduresuncredible!
Well, you haven'ty gotten your NOA2 yet so, I would say see what you can do about getting the ID renewed. As far as packet 3 goes, I don't think there is a time limit to return what they need but you can check with your consulate for verification. Maybe they will be willing to give you a little more time to resolve the situation if they know your circumstances.

But, I think, the first thing to do is start the process to get that ID renewed. Then you can have something to show the consulate if they ask for it.

Good luck.

A friend, also an immigration layer, told me that no change to win in the hearing since USCIS respects Consulate's decision. Besides, it ill be very time-consuming and costly. An alternative approach is to re-apply. We don't know which direction we should go. Hopefully can get some advice from you. Thanks.

Many on this website have managed to get a visa after the decision of a CO to return a petition to USCIS. What you need to do is take Pushbrk's advice. Once it gets back here, it becomes a million times harder.

I was hoping someone could clarify a few things for me.

1. How many copies of the I-134 and evidence (employer letter, pay stubs etc) do you have to send in? 1

2. When can you apply for a SSN? some people have said you can't until your EAD arrives and others have said that as soon as his arrival is in the computers they can give him an SSN. about 2 weeks after entry into the US

3. My understanding is that he cannot travel outside the US until the AP is approved and that will last until he gets his green card is that correct? Don't know how long AP is valid, but he needs either that or the greencard

thanks for all the help good.gif

K-1 Fiance(e) Visa Process & ProceduresHi...I'm a newbie and here's my story
I would not expect anything earlier than May/June. It is true that VSC is faster, but even so, there are some that wait longer than others. It seems your lawyer may be a little out of the loop wink.gif

Just so you know, if you signed up for e-mail notifications from USCIS, the only time you will get an e-mail is for an RFE or approval. Besides that, the touches are pretty much useless. Some people get a ton, others none.

Patience is the key in this process. Just sit back and wait for it. The point when you should be worrying is when it has been 6 months and you have heard nothing...then you can freak out.

Also, expedites are rarely ever given and the only cases I have seen are when the petitioner is in the military and about to be deployed. Besdies that, there is really nothing much else your senator can do, until you go outside the processing times.

Good luck on your journey.
