I feel to vent our experience here once again. Few days back we got a notice of Approval of I-129F from the NVC and currently being sent to the US consulate but we cant get a response from our lawyer especially now we needed his cooperation with document gathering he only responded when we got NOA2 and he sent out a form an affidavit of support asking her to fill and return quickly. My other questions are:

1. Second, my fiancee needs to know if she can include her first daughter who she has in 2007 tax return as partially dependent along with the two others that are wholly dependent on her. But now, her first daughter is no more dependent on her and we need to know is it would be alright to not include her since current information should be included although she was in her last tax return as partial dependent. As I understand it, if her daughter is claimed on the tax return then she must be listed on the I-134. If your fiancee's income is really borderline, I would have her write a letter and get it notarized explaining when her daughter was no longer dependent on her. It may or may not make a difference, but its worth a shot.

2. Based on her income, she can meet the 125% for a family of 4 but will be like few dollars down for a family of 5. However, she earns more just that her official papers show only basic not including overtime. So now does she do whats on her last tax return or file based on her current situation? Can she provide documentation of her overtime and how much she was paid like time sheets, pay stubs or a letter from her employer to that effect? Her last tax return should have her total income. The consulate is going to be most concerned with her current income situation and so, anything documenting that would be good.

3. Then what do we do with the lawyer's nonchalant attitude? As we plan to have him coordinate my fiancee's (Who lives in the South) filling her affidavit of support and that of a co-sponsor (who is in NY) in the event of her not meeting the poverty line. We didn't hire a lawyer so I cannot tell you what to do. If the lawyer is not responding or doing things to your satisfaction then you need to get your fiancee to go to the office and get on their case, after all, that is what you are paying them for. Or, you could just fire them and go it alone from here. Do what you think is best for you.

4. Also, is it possible to for her to include income support (bank savings) and would it be necessary since a co-sponsor is sufficient? If she has enough assets to make up the difference then she can use that. For each $1 she is short she would need to show $3 in assets. You could also just use a cosponsor who meets the requirements instead of using assets.

One thing to keep in mind is that every consulate is different. If you want consulate specific answers then you may want to post in the regional forum appropriate to your consulate.

2. The forms can be downloaded from the consulate website or here: http://www.travel.st...forms_1342.html . Sometimes the consulate will include them in packet 3 but not always. You can also check with your particular consulate because sometimes you can send in the forms before physically getting packet 3 to get the interview date sooner. I outlined the forms needed in my previous post.

4. There is no time limit. Some people send the packets as soon as or before they get packet 3. Some people take some time to keep in line with their plans. Like I said before, if there is a time limit it will be stated in packet 3. In our packet 3 it just said "return the forms as soon as you have completed the checklist" or something like that. You may want to check with people who have gone through your particular consulate to see what the wording is.

5. Like I said before, some people do and others don't. Its up to you on what you want to do. Some people will do a ceremony in the beneficiary's country for the benefit of family there. The only thing is that you do not get legally married and then enter the US.

6. You do not need to have a date. There is no requirement to have a date. If you feel like you should have one then go ahead and have a date. No one is going to follow up on it.

I just want to get a feel of what people do. Some people do the religious/traditional ceremony abroad and then do the legal ceremony in the US. Some don't. Its up to you.

6) When the fiance goes for interview, is the marriage date have to be fixed? No.

I met my fiance as a pre-teen. We have been together now for 3 and 1/2 years now I am currently going through the first step of my K1 visa, and have a lawyer representing me. As long as you have proof(ie. plane ticket stubs, pics and etc...of you and your fiancee together) and that you have at seen(/met) each other within the 2 and 1/2 years you have mentioned when you file for your K1 petition then things should be fine. You can try to get USCIS to make an exception, but exceptions are granted only in extraordinarily rare circumstances which usually have to deal with religious practices or the inability for both parties to travel. You will have to document an extraordinary reason why you cannot physically meet her. If your answer is that it costs too much, you will be denied. Almost no exceptions are made for this rule, so if you can at all meet her again then you should.


I agree with mox. Unless you can provide some convincing, irrefutable, solid reason for not meeting this requirement, chances of getting a petition approved are slim to none.

I would save the money, go, and then come back and file the K1.

We were basically in the same situation when we filed our K1.

-We only met for 4 days (by accident) and did not decide to pursue a relationship until I had been back in the US for a few weeks.
-We didn't get officially engaged until after we had filed the K1 when I went back to visit.
-We had no pictures together and so I could not include that in our petition.
-By some divine intervention I had my boarding passes.
-I didn't have my passport stamps because my passport was being renewed.
-I did have my sisters write affidavits stating that we had met and that they saw us together.
-I had some phone records (try and use a phone service that will give you easy access to call logs) and text message logs and a couple of e-mails that I sent to prove that we had talked since I had come back.

It looks like you have more than I did good.gif

All in all some pretty scrappy evidence but it met the requirements. No pictures, just boarding passes, and with the help from VJ, no RFEs smile.gif

For the K1 you fill out an I-129F. The I-130 is for spouses.

The service center addresses are listed on the I-129F. For CO it is the California Service Center.

and the other is i am in the show business and i work on different films all the time so the way we get paid is different than a regular job. this is how we get paid everyday we fill out a voucher and turn it in at the end of the day but we get to keep a copy of it which contain the hours i worked that day and how much i make a day then those vouchers are forwarded to a company called Media Paymaster Plus then the company processes the vouchers and mails me a check so can i send my fiance the copy of my vouchers along the I-134 form and the employer letter and should i also send bank statements since i dont have paystubs yet? I would send copies of the vouchers that you have. If you could get copies of the checks, that would be good too but I don't know how easy it would be to get those. As long as you have something stating how you get paid and how much it is, you should be fine. You could also send in copies of your bank statements highlighting the deposits for the checks and the corresponding voucher.

I have like three weeks worth of copies of my voucher. Thanks in advance guys.

1 : proof you intend to marry, statements i get ( i assume its one each) but it states it is strongly recommended that wedding plans are already in process. hense you can provide ect. unsure.gif i've not seen a mention of this on here before and as there is no garenteed period for the process it would be difficult to have a venue booked already.? did anyone else have this asked? The advice is that you have no marriage plans for a wedding until the visa is granted. A lot of people plan the wedding soon after approval of the petition or the interview. We have no plans as of yet.

2: interviews at pertition stage. do you always have them? is it just for him or will i also have to attend? Only the beneficiary is required to go to the interview. The petitioner can attend as well depending on the consulate.

3: q 12 on form if foreign fiancee is in usa when filling petition ... arrival/departure record (1-94) number. although i will only be there two weeks we will proberbly want to post it asap so if im still there im guessing this aplies to me? thing is if it does then where do i find this number if im on visa waiver? No idea.

and finally

4: on the form g-325 list all residences in last five years. through out the last five years i can count my current as my home ( is with parents) but when at uwni i had others asell. in the time frame i spent under three months studying in france and rented a room in teachers house. i cant remember the address do i need to provide it on here and also my flat in another town for my last year at uni even though i came home each weekend. do i include it? Do not leave any gaps in the residence. If you do not remember the street address then put the city and country.

As far as the I-134 is concerned, they are looking at current income. Since you qualify under the poverty guidelines I should think that you would be OK. On the other hand, depending on how strict your consulate is, they may require that you have a cosponsor since you have not been at your job for a long time.

What you can do is have a cosponsor fill out the I-134 and get the other docs. At the interview, you can just present your current situation and if they ask for a cosponsor then you will have the info (so that you do not get delayed). If they do not ask for a cosponsor then no worries smile.gif

Many on here have said that the space is for people who got citizenship thru naturalization though and that is where you put the naturalization certificate number.
