K-1 Fiance(e) Visa Process & ProceduresEnough Time?!?
While it may seem like enough time, you never know what little quirks USCIS will throw your way that wpill delay your petition.

It is true that VSC is a little faster than CSC right now, but there are still people waiting 4-6 months to get their petitions approved. There are no guarantees with this process. It may take longer or shorter than you think.

Just be flexible with your plans in case things don't turn out the way you want (not saying that they won't, but you never know).

Good luck!!!

K-1 Fiance(e) Visa Process & ProceduresNewbie with many questions. Please help.
Hello and welcome to VJ smile.gif

First I suggest you look at the K1 Visa Guide. That will answer a lot of your questions about what you need to file the petition. It will also give you a better idea of what is involved in filing the petition and whether you think you can handle it yourself. As long as your case is straightforward you should not have any problems doing it on your own.

Next, I suggest you look at the timelines for your service center and consulate. Filing in March and final visa approval in September would be pushing it since it is taking about 4 months to get the petiton approved. I think a better estimate would be 8-9 months for the entire process.

Just do as the instructions say. Most consulates will only want the DS 230 part 1 and maybe a checklist. The rest of the forms are brought to the interview.

K-1 Fiance(e) Visa Process & Proceduresmeeting for the last 2 yrs?
As long as you have some proof that you have met at some point within the last 2 years you will be fine.

If you have her boarding passes, passport stamps then that is the kind of evidence that USCIS is looking for. Photos are considered secondary evidence. We did not submit any photos with our petition and we had no problems.

K-1 Fiance(e) Visa Process & ProceduresQuestion 11 on I-134
QUOTE (studentInLove @ Feb 14 2008, 10:13 AM) <{POST_SNAPBACK}>
Hi All

I'm filling out this form and the last questions says:

I ___ intend ____ do not intend to make specific contributions to the support of the person(s) named in item 3.
(If you check "intend," indicate the exact nature and duration of the contributions. For example, if you intend to furnish room and board, state for how long and, if money, state the amount in U.S. dollars and state whether it is to be given in a lump sum, weekly or monthly, and for how long.

If we are planning to get married, what should I put. Other people who have done this has told me that they didnt have this question on their I-134.

Any advice.

Plus... I am a CS student, graduating in May, and have a promising future. I made $23.000 last year. I am not using a co-sponsor. That is enough, right?

Thanks

You can put "N/A ( K1 visa process for permanent residence )"

For your income, if you are only sponsoring your fiance and no dependents then you should not need a cosponsor.

QUOTE (Nusu @ Feb 14 2008, 09:14 PM) <{POST_SNAPBACK}>
Thnx now I am honestly wondering if it is even worth filing

This is a long process for anyone to go through. Right now it is taking 3+ months to get an approval. If you file, you are going to wait for that length of time before you know if you got approved or denied. Then it goes to the embassy and more waiting. Interview and more waiting. Possible background checks and more waiting. Take a look at some of the threads in here and read about the frustration and agony of going through this process.

The only basic requirement for the K1 is the meeting. That is it. To me, that is a pretty easy and simple requirement to bring the person I want to marry to the US. A lot of people save up and make that one trip if only to just meet the requirement to file.

In my opinion, trying to circumvent this requirement and reading denial after denial of the appeals on the USCIS website, I think wait, go and either meet and file a K1 or get married on your trip there and do a K3 or CR1. While there is a chance you may be approved without meeting, that chance is a very very very very very small one. And, if I were you, I would not take that chance. Its a lot of money to throw away on that slim a chance.

K-1 Fiance(e) Visa Process & ProceduresFiance Visa....Need Help
QUOTE (Nusu @ Feb 14 2008, 07:59 PM) <{POST_SNAPBACK}>
Hello Everyone,

I need some help. I am going to apply my fiance's K-1 visa but I need help in the "how we met" section. The thing is we both are muslims and we have never met. Ours is a poster perfect "arranged" marriage. We first "met" through our families in Jan 2007 and we spoke to each other till March and decided to get married. Yes we get along very well and our engagement was announced at my local mosque here in the US. Ever since then I have been sending him cards, letter etc...to prove that we are indeed in a relationship. The only problem is that we have never met in person. Part of the reason being that I was in college and then and still completing my internship...the other part being that since we both come from a strict family/muslim background we can't possibly meet and plus we both were busy with internships/residency (on his part) and plus we both are middle class families so financially it would not have been possible for us to meet. Now I have to write an affidavit regarding that. So far I have this written....but I don't know how to add the muslim part and how we can't meet etc due to our religion....I was wondering if someone could help me out...I would be ever so grateful.....

My Fiancé, *** ***** family and my family have been family friends for a very long time. His brother's family had visited Pakistan in November of 2007 where my Fiancé & his parents live. They mentioned me to the family, as is the norm in our culture. My Fiancé & I were given the opportunity by our parents to get to know each other before any decision could be made. Neither of us were coerced or forced and we spoke to each other for three months. In these three months we got to know each other and we discussed important things pertaining to our lives. We both got along well and by mutual decision we decided to let our families know that we would like to marry each other. In the month of April 2007, our engagement was announced in my local mosque in Allentown, PA. Both our families come from a very strict Muslim background, as it is the norm of our culture and religion, a guy and girl do not get to spend a lot of "alone" time together. Since I was in the middle of finishing my internship and he was in the middle of his residency, our families decided to take the route of applying for fiancé visa... (after this I don't know how to include the muslim part)....

CAN SOMEONE PLEASE HELP ME.....

Salaam smile.gif

I just want to point out a few things to you from what I have read on responses USCIS has given people when they have appealed USCIS's decision to deny their petition based on not meeting the "met within 2 years requirement".

(1) The fact that you were in school/doing an internship/middle class is not going to exempt you from the requirement. A lot of people take time off work/school and find someway/somehow to go and meet their future spouse be it borrowing money/saving funds/what have you. Their response is going to be that this is a hardship on everyone applying so it will not be seen as an extreme hardship unique to you. Also, there is nothing stopping you from meeting in a third country which may be cheaper than going to Pakistan.

(2) In your letter you say that "a guy and girl do not spend a lot of alone time together"...this word "a lot" is going to get you into trouble because it does not say "none". It also does not say that you cannot meet in a public place or with other people around.

(3) Now, I don't mean to be rude or anything, but I am not sure what Islamic source you are using to say that a man and woman do not meet each other before marrying. Maybe it is more cultural than religious, but as far as I know, there is nothing in Islam that bars a man and woman from seeing each other before marriage as long as they keep to the Islamic guidelines (in public, with family, yada yada). If it is cultural, you will need to do as Laura said and get a letter from an authority explicitly stating that it is against your culture to meet your future husband until you are married.

(4) I suggest you look here: http://www.uscis.gov...errFrameset.jsp
Go to "Administrative Decisions After 2001", then "D6 - Fiancye and Fiancyee s of US Citizens" and read the appeals there. It may shed some light on how easy or difficult this whole process may be.

(5) This is not related to your original question but just something to think about....don't you think, for your own sake, that it would be better for you to meet your fiance first? I know that you have talked and all but meeting someone is very different than talking to them on the phone.

If you were not working and do not have tax returns I think you need to write a statement to this fact and probably need to provide some proof (someone correct me if I am wrong).

If you do not make enough you can have a cosponsor who meets the poverty guidelines.

She would need to provide the same evidence to prove her income so letter from employer, tax info and pay stubs. The bank info is not really needed unless she is using assets.

Thank you! I also am waiting for a start date on my "dream" job. They are processing me right now. But I do have my copy of the contract I signed which includes their desire to hire me and my potential salary (which is so much more than what I make now!!). I want to include this as well.

If you wanted you could include that with your I-134 just to show them you are actively looking for work.

Welcome to VJ wink.gif

If your fiance moves during the process you can request that your approved petition be sent to Lagos. I know that people have requested a change of consulate after approval but I am not sure about before approval.

Before your fiance moves, make sure he gets a police certificate from Kenya like Nutty said. Sometimes getting them when you have left the country is a headache like no other.

Photos are considered secondary evidence. I would include a couple but leave the bulk for the interview. In our case we did not include any pictures besides the passport sized ones.

Our receipts were photocopied, no issues.

You do not need any financial information at this stage. When you fill out the I-134 for the interview that is when you can include all the info about your job situation.

BTW: I don't see on the I-129F where it asks for employment of the petitioner.
