When we filed our petition we submitted NO PICTURES. No RFE, no probelms good.gif As long as you have proof of meeting some time within the last 2 years that is all you need (passport stamps, boarding passes, etc). Pictures are considered secondary evidence and are not really looked at during this stage.

Between submitting the petition and the interview I went to visit once. We took pictures then. We submitted 17 pictures at the interview and the CO was satisfied with them. Remember, pictures are only one part of proving your relationship. There is other proof you can add for proof of your relationship.

At the petition stage probably not. USCIS is only evaluating you and your fiancee's eligibility to apply for the K1.

The proof of relationship comes at the interview. At that point, having pictures with friends and family is definitely a plus.

The K1 is a visa that allows for the beneficiary to enter the US to get married and become a permanent resident. It sounds like you are not sure about what you want to do. The K1 process is very time consuming and can be very frustrating and stressful. Unless you are 1000% sure you want to get married, I would not suggest applying for it.

If she has a valid tourist visa then she can stay for the maximum time allowed at POE. Maybe you could do that and see how you like living together and where that takes you. While she is here on a tourist visa she may not be allowed to work or go to school. She may be able to volunteer.

There is no way to combine the length of stays of a K1 and tourist visa. Once she enters on a K1 you have 90 days to get married.

Once she enters on the K1 she can visit Chile with AP or the greencard.

If you want to be crude, you could always drag in the sheets of your marital bed [with appropriate allocation of food dye] and say, "See! These sheets are proof of our marriage!"

Have a friend that worked for the Consulate in Ethiopia up until a year ago. She had a man and woman come in and do that - after they had done a tentative denial. They set up a new appointment, came in, the guy was fuming mad, showed the "sheets" and asked the Consulate, "What do you need to see?!? Nude photographs of us copulating? Should we strip now and have sex to prove we love each other? You are sick! But we will do it if you will approve it!" Apparently, after holding in the laughter and fear, the Consulate approved it.

But what can I say? That really is not good advice... Stick with what there is before the crudeness and you might have a chance to fix it. If they seem sincere in that if you visit they will grant it - then go. But, honestly, I would contact my Senator first and throw an unholy fit, informing him/her that the Consulate is causing you additional cost, stress, etc and forcing you to go to Ethiopia against your will . . . when they should be able to approve your fiancee - WHO THEN HAS NINETY DAYS to marry you and PROVE that the relationship is REAL and FILE for an adjustment and PROVE AGAIN that it is real and then FILE AGAIN for removal of conditions and PROVE AGAIN that it is real. Yes, you have to prove your relationship is real at least six times before it is real enough for the government (initial CIS application, NVC documentation, Consulate, marriage/U.S. entry immigration, adjustment petition, adjustment interview, condition removal petition, condition removal interview) . . . what a pain in the ###.

The system is broke! Demand that your Senator work on fixing it.

Oh, and good luck.. Ethiopia's Consulate is one of the worst U.S. Consulates in the world - they have been cited for human rights abuses repeatedly, but never convicted. Rampant abuse by officers insisting on being bribed by sexual or monetary favors in order to approve a petition are excessively common in Ethiopia.... which makes it all the worse.

How do you know that 95% of the cases that go through Ethiopia are scams? There are VJ members who have gone through Ethiopia and other high fraud countries, without a lawyer, with no problems. It seems to be one of the more friendly consulates in Africa (try dealing with Ghana or Nigeria wink.gif )

I don't know what country you are going through but it sounds to me that you have issues with the Ethiopian embassy for whatever reason. I suggest you take it up with them instead of painting an inaccurate picture of doom and gloom for the OP.

To the OP: What you posted was her appointment letter, not the letter she got after the interview. First, you need to find out what paper was given to her at the interview and what it said because that will determine your course of action and you need to do this ASAP.

I don't know much about the refiling procedures. I would suggest reading up on that, you may want to get a qualified immigration attorney invloved because it is possible that this filing and the denial may come up at a subsequent interview.

I don't mean to be rude but this is not a case of being a bad liar, this is a case of plain lying. Being stressed about the process, not knowing much about the procedures etc is not an excuse for lying. It is stated in the I-129F that if any of the information is false then it is grounds to deny immigration benefits and criminal prosecution.

Would this I-130 allow me to live in Florida during the process? I don't need to be able to work, just want to live there...

I know with the visitor's visa I'm only allowed to stay in the US for 6 months out of the year. Is there a way for me to stay for the 6 months, go home for a week or two, then go back to the US for another 6 months?


There is no visa/petition that is going to allow you to enter the US and stay while the petition is being processed.

As for the tourist visa, it is up to immigration at the airport to decide how long you can stay. If you come, leave and then try to enter again, there is the possibility you may be denied. The tourist visa is meant for visits and if CBP deems that you are misusing the visa it may cause you problems come the visa interview.

A lot of us here use the guides and are fine without lawyers. As long as your case is not complicated you should be able to do it on your own.

When looking for a lawyer make sure you use one that specializes in immigration, an AILA lawyer.

Take a look at the guides. Some people still choose to use lawyers. But my advice is even if you decide to get a lawyer be sure you understand each step of the process.

While it may seem like enough time, you never know what little quirks USCIS will throw your way that wpill delay your petition.

It is true that VSC is a little faster than CSC right now, but there are still people waiting 4-6 months to get their petitions approved. There are no guarantees with this process. It may take longer or shorter than you think.

Just be flexible with your plans in case things don't turn out the way you want (not saying that they won't, but you never know).
