I would wait until you have it to send the packet. Chances if it being put into your folder at USCIS are slim to none. You also don't want to risk getting an RFE.

K-1 Fiance(e) Visa Process & ProceduresG-325A and I-129F forms
If you fill out the G-325A online it will automatically populate the fields that are the same. You do need all the 4 copies even though the information is the same. Each page goes to a different department (look at the bottom of each page and you will notice the codes).

The information for the G-325A is all current unless it says otherwise.

If you were married before, that is the information you put in the line asking for former husband/wife. If you were not, then put "none", the same goes for the line asking for current spouse. There is an example G-325A here: http://www.visajourn...Form-G-325A.pdf

As for what to include in the packet, check out the guides here:

K-1 Fiance(e) Visa Process & Procedurestwo quick questions about I-129F
QUOTE (happyman91 @ May 28 2008, 09:27 PM) <{POST_SNAPBACK}>
My citizenship status is Naturalization.

1. Question 10 in the I-129F, I just need to check the Naturalizaion Box, and provided the No. Date , and Place.
And I dont have to write anything else, such as the the YES NO Box below the Parent Box.
Am I right? Yes

2. Do I need to provide copy of my US passport with the copy of Naturalizaiton Certificate? You only need one to establish US citizenship. Either one will do.

Thank you

K-1 Fiance(e) Visa Process & ProceduresDoes marriage need to be conducted in US for fiancee visa
QUOTE (Ghorabaa @ May 31 2008, 03:15 PM) <{POST_SNAPBACK}>
Not sure if this has been posted before but I had a couple of questions that I hope someone can answer for me.
1.) Would there be any problem if me and my fiancee get married in her country before getting the visa ? Big problem. The K1 visa is so that the foreign beneficiary can enter the US for the purpose of marriage.

2.) If not would it be okay to get married in her country after she receives the visa and then we both travel back to the US together using the fiancee visa? Getting married outside the US nulifies the K1. It is for fiance(e)'s not spouses. If getting married in your fiancee's country is important then you may want to look into the K3 or CR1 visa.

Thanks in advance for any help.

K-1 Fiance(e) Visa Process & ProceduresTravel advice and proof of relationship
QUOTE (Pandora01 @ May 4 2008, 06:49 PM) <{POST_SNAPBACK}>
Hi everyone,

We are currently waiting to receive the NOA2 from CSC (K-1 petition filed in January). I was planning to travel to the US to see my fiance at the end of June but now that things have picked up at CSC, I'm not sure if it would be wise or not. I will have moved in with my dad just a few days prior to the trip (didn't want to renew the lease for a full year and have trouble trying to terminate it). That would leave me with basically just a letter from my employer to prove my intent to come back here at the end of my vacation. Do you think it would be enough proof? Are there any other proofs I could bring with me to show my intent to return? I can't think of anything else. A lot of people have suggested taking your K1 petiton NOAs and anything else to show the CBP that you have filed. Someone with experience can probbaly elaborate more.

I also read somewhere on this site that once the background check is done, traveling might mean an additional delay as they would have to do some additional checks. Any idea what the additional delay might be? A week? A month? More? Also, at what stage of the whole process is this background check done? Background checks are done at several levels of the process and no one knows how long they are....when they are done they are done. I have no idea what the traveling additional checks are.

I was hoping for this trip so we could take pictures of ourselves together since we didn't when we saw each other last summer (didn't know about the need for those). We talk on Skype just about everyday and e-mail as well. Can't prove the Skype conversations so would e-mails alone be good enough to prove our relationship at the interview? Take anything and everything you can to prove your relationship. You never know what the CO will ask for.

I really don't know what to do now and what to think and need some input from you folks. Hope you can help me see more clearly in all this.

K-1 Fiance(e) Visa Process & ProceduresHelp and advice on K-1 Visa
Your fiance can petition for you to come over to the US.

Once you become a US citizen (4-5 years) then you can petition for your brother to come over. There is no way for a USC to petition for someone they are not related to, and even so, a USC cannot petition for in-laws.

Like reeses said, your brother can try for a student visa, but that is not guaranteed. Even if he gets it, he cannot live in the US permanently.

K-1 Fiance(e) Visa Process & Proceduresassembly questions
Yes, make a copy of your additional page for each copy of the G-325A.

I just put everything together, put the check in an envelope, put a cover letter on top and then used a binder clip to put it all together. I separated each section with a piece of colored paper and labeled them. We had no problems smile.gif

The baggies are only for the passport pics. If you are using some pics for evidence I would just tape/staple them to blank sheets of paper and label them. We didn't include pics, but that is what I would do.

Good luck smile.gif

HI GUYS!!
I have another question regarding the fees. How much does it cost for the work permit application? My fiance wants to work as soon as possible here in Washington State. I'm also REALLY excited that CSC is starting on Febz because soon it's going to be March!! innocent.gif After he arrives to the US, he applies for AOS/SSN/Work Permit at the same time? Can someone please clarify that for me smile.gif THANK YOU!! Mucho amor a todos!! rose.gif

You need to apply for EAD with AOS or after you have filed AOS. If you apply for it before it will only be valid for the length of his I-94 (90 days after entry).

The other alternative is to try and have him get the temp EAD at POE but there is no guarantee that he will get it.

Once the beneficiary enters the US it is up to you when you file AOS. Just remember that the beneficiary will be out of status until AOS and will be unable to work and travel until it is filed.

K-1 Fiance(e) Visa Process & ProceduresI-129F Fiancee Address Questions
QUOTE (Michael&Guli @ Jun 4 2008, 12:04 AM) <{POST_SNAPBACK}>
hi - my fiancee lives in mongolia, has a home address, but for her mailing address we will need to use a friend's mailing address at work (there is very little mail delivery directly to addresses in mongolia, so the friend's work address is our only option).

in doing research here it looks like for the G-325A we'll use her home address, and for the I-129F we'll use the mailing address.

Q1. is that still correct as everyone understands it? fiancee's home on the G-325A and the mailing on the I-129F...

on the I-129F there are two places for my fiancee's 'address': first in part B with question #2, then in question #15.

We put the mailing address on the I-129F and the residential/home address on the G-325A with no problems.

Q2. will i enter her mailing address in both these places? or is one for a mailing address and the other for her home address? just making sure! smile.gif

her mailing address is VERY long - so i will have to use an attachment.

See answer to Q1.

Q3. should i enter in the address field(s) "See Attachment" - and then label the attachment as "Fiancee's Address", or should i label the attachment similar in form to the supplement for question #18, such as "I-129F supplement: part B, question 2: Fiancee's address"?

I will also have to do an attachment to write out the address in her native mongolian cyrillic (question #16)...

I would put "See attachemnt" and then on the attachment put "Q __ Part ___: Question here".

Q4. can i just do the english version (for questions #2 and #15), and the mongolian cyrillic version of the address (question #16) on the same attachment? seems logical, right?

so in the end, i will have the I-129F with two extra sheets stapled on - the supplement for the meeting face to face (q #18) - and the english and cyrillic versions of her address (q #s 2 and 15). does that all sound about right?

Sounds right smile.gif

MANY MANY thanks... and sorry for being so detailed, i just want to make sure this thing sails through as effortlessly as possible.

michael

Another question then, is the visa part of the application doable on our own? I know the waiver(s) will be difficult and would probably require an attorney.

You can file for the K1 on your own. Take a look at the guides and see if it is something you feel you can handle: http://www.visajourn...mp;page=k1guide

Whether you file for the K1/K3/CR1, you will probably have to file the waiver after the interview.

I don't think so. She left before her visa expired and complied by all the rules so she should be fine.

There are checks that are done on both petitioners and beneficiaries during the K1 process and the length of time it takes to complete the checks is dependent on many factors.

Welcome to VJ and good luck on your journey smile.gif

You may want to take a look at the timelines to get a general idea of the wait times. But as some else said, there is no hard and fast length of time. Each case is different and can be held up for multitudes of reasons.

I'm not sure if I have special circumstances or not. I've been told if you've been married previously it's a pain, which I have. I also have been told I might have issues with the affidavit of support since there's a good chance I might be going on SSD in the near future and have had help through DSHS for the past year as I've been putting myself through school. While I do have someone who should qualify for the affidavit, I'm still under the impression that me having a "history" of state help is a possible hinderance. Any ideas on this part?

Having a previous marriage does not complicate a case. All you need to provide is the divorce decree. Plenty of people who go it alone are divorced and have no problems.

As for the SSD, as long as you have a qualified cosponsor, I don;t see why you would have any issues with the sponsorship part.

Good luck.
