I have a part time job that I do for fun and a full time job as well. My income from my full time job is more than enough to meet the poverty guidelines so that is the income I included on the I-134 (along with other documentation for my full time job). We had no problems.

What the USCIS employee is talking about is primary evidence to prove you met in the last 2 years. That is what USCIS wants.

E-mails, phone calls, chat logs, etc only establish an ongoing relaitonship and are considered secondary evidence. They do not prove you have met in the last 2 years.

2) Since Gracy is from China, her native language is other than Roman letters. Towards the bottom of the 325a form, in the box below the Signature, it says "If your native alphabet is in other than Roman letters, write your name in your native alphabet below:" However, I'm not sure exaclty what "below" means. There is some room within the same box, but smaller than I would expect to write a name in non-Roman characters. "Below" could also mean the box outlined by heavy border at the very bottom of the document. Does anyone know which is the right place to write her name in her native language on the g-325a? It would be the box in which the question is contained. I think it looks sufficient to write one's name. Maybe its just me. Either way, it is not the box with the heavy border.

Since you are going for the K1 I am assuming that your fiance lives in Mexico..

When you apply for the B2 for his daughter they are going to ask for the reason for the visit. If there is no reason, then I don't think it will be approved.

I say better to wait until your fiance gets here and then apply for the B2.

At the petition stage the only pictures you need are the 2x2 passport pictures of you and your fiance. We did not include any pictures of us together and we had no problems getting the petition approved.

Flying to the interview may help. I'm not sure if they let the USC in with the beneficiary for the interview in Pakistan but I am sure the Pakistani members here can help you out on that. All the same, I think you should take a few pictures when you are there and have them ready for the interview. A lot (if not most) people are asked for pictures during the interview.

The waiting period after getting a divorce to remarry should not be a problem. The US is going to be concerned with the legal aspects of it, ie, when was the divorce finalized. As long as the divorce is legally finalized BEFORE you file the petition you should have no problems. The only requirement is that you have met once withing the last 2 years, it does not matter the circumstances of the meeting.

The pictures will come in handy when you are trying to prove an ongoing relationship at the interview stage. In most cases the CO wants to see some. At the petition stage they are not really important because they are considered secondary evidence and do not prove your meeting in the last 2 years.

FYI: Sometimes the case status will not change but you will get the RFE in the mail. It can be inaccurate at times.

There is a way you can disable Java so that you can write in the fields but I am not sure how to do it. I'm sure someone more tech savvy can tell you. But you can just fill those parts out by hand if you want.

4. I am filling out the paperwork now, but will not be able to visit my Fiance again for another 4 weeks or so. I would like to submit the petition now so that we don't waste the time. I have a scanned copy of her signature....what are your thoughts if I use that on the forms?? As far as I know the signatures all have to be original. I don't know that scanned signature will cut it.

Your fiancee's family getting visas to come to the US totally lies in their ability to prove to the CO that they have no intention of immigrating. That means bringing proof of their ties.

As for when to apply, you may want to take a look and see how long it takes for processing vistor's visas in their country. I would do it after your fiancee has ahd her interview so that they can put on their application the purpose of their visit. Thats just me though.

Thanks for your response, however, i had the interview done in London already, only need to provide the police clearance from nigeria. Since i will be in Nigeria for a long period of time, i am thinking i can obtain the document and submit to the US embassy in Nigeria so i could leave to the US after the funeral. Do you have the police report already? I would submit it ASAP, and then get the K1 in London before going to Nigeria. The K1 is valid for 6 months, so once you have completed all your duties in Nigeria you can just fly to the US.

I don't know that the consulate in Nigeria will accept the police certificate on behalf of the consulate in London.

Have you asked if this was possible in London?

To be honest this whole process has me now slightly overwhelmed. I never expected to find a lawyer who wouldn't take a case just based on that. My best advice is to read the guides ( K1 Guides ) and then decide whether you can handle the paperwork. Most people on VJ follow the guides and have no problems with the process.

I have done a lot of research on the process, but I still have some unanswered questions.
Does anyone know the minimum financial requirement my fiance would have to make in order to sponsor me? (anyone know anything about the co-signing option?) Check out the ( 2008 Poverty Guidelines ), those are the monetary requirements your fiance has to meet. If not, then you can get a cosponsor (either a US citizen or legal permanent resident) who meets the guidelines to sponsor you. This information is not required until the interview.

( I have heard you need income tax forms for the past 3 or 5 years? what if you don't have them for that long? I haven't been working since I was 13). Tax information is not needed from the beneficiary, only from the petitioner. If there is a reason the petitioner does not have tax returns then they should state that when filling out the I-134.

What type of primary evidence is required? and how much? Primary evidence: boarding passes, ticket stubs, credit card receipts, hotel/other receipts, passport stamps. Provide as much as you can to prove without a shadow of a doubt that the 2 of you have met once in the past 2 years.

I have saved things like boarding passes, some itineraries, and we could always take more photos when we see each other next (this summer). Anything else that might be helpful? Pictures are considered secondary evidence. You can include a couple in your initial petition but I would save the bulk for the interview. In our case we did not include any pictures and we were approved with no problems. Stuff like boarding passes and itineraries will go much further in establishing that you have met in the required time frame.


Don't worry about what the lawyer said. It is up to you to prove to the CO that you have a valid relationship. They cannot deny you on age, but you want to make sure that you have a lot of evidence to back up your claims that you have a true, bonafide relationship.
