Have the party. send out a 'oops' note to your guests, tell them it will be a celebration but not the legal wedding. do everything as you have planned except the legal ceremony. Friends and family will understand and will probably be happier than if you cancel or reschedule. plans are made if you have guests from overseas coming. tickets probably booked too. And if all goes well for you, chances are, you could have your NOA2 by August, maybe even the interview date, that can be part of the speech, part of the toasts and even later, have the photos of your legal wedding be your thank you cards. Turn the distress into the wedding people will always remember. Get creative.

as for your fiances entry into the US, use the honesty policy, if you have your interview scheduled, you can explain to immigration the mistake you made, and that you have your interview date now, why would you run off and get married when you are so close to the end? He could have a copy of the interview letter, a copy of the cancelled or rescheduled celebrant/priest (whichever), a copy of the 'oops' message you sent to friends and family. even letters from all your guests! ask them to write a little note about it! it could work?

if you do it this way, then if by some small miracle your visa is approved before your wedding.. it wouldn't be too hard to quickly organize the legal side of things and make it a big surprise.

K1 is a fiance(e) visa right? so typically, to be a fiance(e), there has been an understanding, a question or an agreement to make plans to get married.

I think its 90 days, because its unrealistic to say.. 'you must get married in 10 days after POE'. Same thing as being given 6 months from the time the visa is issued to enter the US. Its being realistic.

I believe its the responsibility of both parties to make sure that this is the right path for them.

Put the first address you will be staying at on arrival into the USA, and then tell the immigration officer at POE of your plans when or if he asks you, he most likely will. I've done this before, they care about your POE address. If you write down Hawaii when you are flying in to Boston, they will be wondering why you are in Boston.

..And, then the consular office automatically sends Packet 3 to the beneficiary.

Since our file was lost, we never actually got an A number - I'm just wondering if we need it - but sounds like we don't.

Thats right, you don't NEED to contact them, it might be beneficial in some countries with really slow embassies, but Aus/NZ, not so much, I'd say if you didn't hear anything in 2 weeks or so, you could call them. In your case, I'd be calling them 3 times a day, just to be on the safe side. :lol:

The A number came on the NOA2 anyway.. with any luck, you will get one of those soon.

ETA: as loosely mentioned, I think the process for sending packet 3 out is country specific, I'd still check with one of the NZ K1 filers to confirm.

What happened in my case, I got an email notification as I had signed up for it on USCIS case tracking, no case number, just an email saying it was approved, my fiance didn't get an email. (20 August)

my fiance got the official notification from NVC about 3 days later (23 August). No case number, there was an A number though.

We didn't call NVC, there was no point as I couldn't do much anyway, I did look at the DHL tracking just to pass the time, but I had no idea really what i was looking at, then 2.5 weeks (6 September) from NOA2 date of email, my fiance got the packet 3 email with our case number on it from the Sydney consulate.

ha, I'm doing the reverse, POE in Hawaii, then wedding in Las Vegas, and then moving back to live in Hawaii. I can understand the confusion as its a fair distance from the mainland.

I have previously POE as a tourist via Hawaii, I noticed this the other day when I was listing my trips to the USA by going through my passports and noted that I had an entry stamp in Hawaii, but not for when we landed in San Francisco a few days later. took me a few moments to click, flights from Hawaii to the US mainland are considered domestic flights. no immigration. :)

in direct response to your question - what I did after receiving NOA2:

I did nothing between the NOA2 email and my fiance receiving the hard copy of NOA2. At that point, I booked my medical and looked at the I-134 that my fiance needed to complete for me, and investigated what supporting documents he needed to get. We did not call the NVC to get the case number, I know that this can be country specific, but my consulate, Sydney, sends me the case number in an email with packet 3 not long after it reaches the consulate. In OUR case, we did not have any reason to obtain the case number earlier than that. From what I have read, some consulates take a long time to send you packet 3, so obtaining it from NVC is beneficial. Check with other Nigerian filers for the best way to proceed.

It really does depends on the consulate, for Australia, the consulate emailed the link to packet 3 on the Sydney US consulate website, to my US based fiance, he forwarded it to me.

Packet 3 (for me) was a list of documents to complete (DS230, DS156, DS156k, DS157, I-134 and DSL1076), most of which is available on the USCIS website, in addition a request to obtain medical and police clearance, and other items/documents as applicable. Each country has their own process, but relatively the same documents.

check with a fellow Spain beneficiary to see how they received their packet 3.

I paper clipped.. only cos I couldn't find any glue and I wasn't comfortable sticking a staple through my head/photo. instructions say to staple or glue though. so I don't think it would matter if you followed the instructions.

So what your saying is that if I do get married immediately on the B2 VISA, will this not contradict my reason for wanting to go to the USA when I visit as a tourist in December?

If I am able to get married immediately, can we lodge the CR-1 immediately or will this also look suspicious? As I said trying to reduce the amount of time apart, Love is Love right, all people who are in love is want to do is be with their partner.

So based on my situation, what would you recommend doing?



From what you've said, you aren't actually intending on getting married yet anyway, you are just keeping your options open in case you decide at a whim, so that is not fraud. Going over to spend time to get to know her a bit better before making the decision isn't a bad idea at all. If you so decide to get married while you were there, then so be it, just don't overstay the conditions of whatever visa you go on.

Sorry, I didn't explain myself properly, I meant, using that as a guide to get evidence of your relationship, if its used in the past for physically meeting, then perhaps it can be used in another context, like proof of an ongoing relationship, your friends and family writing letters about seeing your relationship evolve, from the beginning to now.

well just this past Tuesday, my appointment was for 8am, I got there at about 7.50am, and I was back downstairs and out the door by 9am. the actual interview took less than 10mins, some of it was waiting for those in front of me to have their turn, and some was dealing with the pre-interview paperwork. you should be fine with a 3pm bus back no problems at all.

NOA2 to packet 3 is just a few weeks, so from there is depends how ready you are to send it back in, the medical and police clearance can hold things up, but if you are prepared, then sending back your packet 3 information can be relatively quick. Interviews can be schedule from 1 week to 6 weeks, I think that depends on how busy the consulate is.

for us, it was exactly 3 months from NOA2 to interview, it took longer than I wanted as I am working in NZ and wasn't getting back to Sydney very often.

Yikes, they took 9 days to send it off, that is unusual.... but good to know. It would be a risk, but with the flight being refundable or I'm able to reschedule, then it's not a huge risk.
Looks like the Consulate will be closed on the 25th and 26th, so if they can at least get my Visa in the post before then, I would be right.....like A&B said, the biggest variable is whether I get approved or not and I guess the odds on that are about 50/50. Uugh, what to do, what to do??

I know, but they were closed for Thanksgiving, thats the only delay I know of, they may have been short staffed on the Friday too, who knows. Fully refundable fare, you can't go wrong. :)

I did! :) I booked my flight before my interview, interviewed last Tuesday, 20 December, got an email today that it is being sent out today. Should have it tomorrow.

If you want to book and you have no problem taking the risk, thats up to you, I took the chance and it paid off. But it was a chance and while I still had a few days, I was starting to think I might have to change my flight.

Public holidays are listed on the Sydney embassy website, so have a look to see when they are closed, that might help you figure out an estimate. Ask them when you have your interview and 'if' you get approved, whether or not they are likely to issue the visa before Christmas, Sydney is pretty good, I'm surprised mine took as long as it did.

I haven't heard of anyone having the medical in Sydney and having the results sent directly to their house.

I would check again with someone else there, I've also not heard of them allowing you to have your medical without your case number.

I would highly recommend delaying it for a bit longer, best rule of thumb for Sydney, would be to book when you get your NOA2 approval email, it takes 2-3 weeks to get your case number if you wait for Packet3, unless you call NVC for it, but it won't delay you. Up to you of course what you are comfortable with doing.

I also want to point out that, even if VSC is the "slowest" office right now, it may not remain so for the duration of your application's wait. When I applied (also to VSC) it too was the "slowest" and by the time my petition was approved (a relatively quick more or less 4 months after we submitted it), it was spitting out acceptances right and left and the CSC was the "slowest." The waiting times do seem to fluctuate quite a bit.



I was about to say the same, however while VSC is behind at the moment this might interest you (referring to the OP, not you 'virola')

in the last 2 weeks, since the 25th of October, until right now approvals for K1 between the 2 service centres, based on VJ filers is:

CSC = 12
VSC = 70

so.. VSC is faster at the moment, and that could switch at any time.

CSC filers on VJ, have seen 1 approval this week so far. thats right. 1. for now.. be glad you are at VSC as they are going to catch up very quickly to CSC's rate of approval.

The point being, this is a very unpredictable process, if you choose to make arrangements now, request that your caterer etc be flexible with your dates, tell them upfront, you should have a better indication once you have your NOA2.

I just traveled to and from Hawaii from New Zealand, I was there for 10 days - VWP and less than 2 weeks after NOA2. I was pulled aside for questioning, after my initial immigration screening and a second officer documented my responses and pretty much asked me all the immigration questions that I had already filled out on my entry card and entered them into their computer as I answered. I was honest about my visa status and they confirmed that I had a pending K1 visa, they did not ask to see my documentation that I had with me, they sent me on my way after about 10 minutes. No overtly probing questions, very standard, they just chose to be thorough.

I doubt I would have had a problem, but better to be safe than sorry, and to be completely honest.

Sorry for the delay, have been out of town. Wanted to inform everyone that we finally received our NOA2 on May 1st!

 

Was an exciting moment but a little hard to revel in due to the amount of time we had to wait..

 

Any of you that are still waiting, please write to both your State Senators and put in a service request. I did all 3 of these, and although I am not sure if they are the reason we got approved, may have still done something.

 

I know everyone says this, but just hang in there. Your approvals are coming and don't give up just yet!

 

Thank you for everyone that supported me and the others waiting for this long.. I hope the rest of the process does not take as long!

 

Finally! Congratulation :) You're one huge step closer to the end of this process!

Oh, the system is so confusing.. When we called NVC we were told the petition (with the new case number) was send to the Embassy here on 21st. And now I got the wild USCIS update:

 

"On February 25, 2014, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly."
