My another problem is that, the agency that's been processing my i-140 application has stopped communicating with us for more than 3 years now since there was a great retrogression in terms of providing visas for this type and the current priority date is december 22,2005. I'm really worried with my K1 visa application.

I have a pending 1-140 employment-base immigrant visa apication since 2006 with a priority date of August 2006.

I met my fiance only last June of 2009 and has petitioned me for a K1 visa June of this year.

Is there anyone who can shed light regarding this issue...

Will my K1 visa application be denied because of my pending 1-140 immigrant visa application which was filed 2006?

Please... I really need your opinions and insiights on this matter.

What if in the case of legitimation under subsequent marriage of parents? Where an annotation of legitimation is noted in my NSO BC wherein my family name first was my mother's maiden family name, then when i was 2 yrs old, it was subsequently changed to my father's family name now.

I haven't used my mother's maiden family name as my family name eversince... Should i get an nbi clearance with this as my aka even though i haven't used the name?

Please help!

Hi!

Has anyone here have a PI NSO birth certificate with an annotated legitimation mark?

My NSO birth certificate has a mark of legitimation since I was legitimated via subsequent marriage of my parents. And this was when I was 2 years old. My question is that, does this cause a problem during the interview? And in our I-129f application We didn't put in my previous name, which has my family name with my mother's maiden family name because i never have used this name. All throughout my life including school records, i have only used my present name since I was legitimated when I was 2 years old.

Does this cause a problem during the interview? Does an annotated birth certificate a big issue with the US embassy? If so, how am I going to resolve this issue?

Please help!

Hi! We applied for our daughter's CRBA and US Passport just this year around July 29, and we were asked to do DNA testing due to legal purposes since I'm not married yet to my fiance. And we just got our daughter's CRBA certificate and US Passport this week...

To give you a picture on how a USC can avail of the CRBA for their children, as far as I have understood... My fiance also acquired his citizenship through naturalization. However, he has been a citizen since the early 90's. And as we have read about CRBA in US government websites such as USCIS and in US Embassy Manila, one can file for a CRBA only if you were already a USC before your child's birth, and requires proof that you have stayed or have been living in the US for at least 5 years before your child's birth as well. (please do check the US government websites for further info and for verifications) As to proving my fiance's citizenship status and his proof of living in the US, there was no question because he has been in the military for over 20 years now. The consuls are very strict with regards to citizenship of the USC and proofs of staying in the US (basing on experience). They are also very particular with your relationship status prior to conception of the child.

With regards to a K2, i don't know about this since you probably can't apply for a CRBA, maybe you can apply for your child's petition since you are the father. (not sure about this... sorry!)

My fiance and I have a 14 years age gap... Certainly my parents didn't approve of him at the start due to other reasons too, like he's divorced with 2 kids and that the relationship is long distance. We had our ups and downs moments but we're still together, going strong as ever. We're more than 2 years now and we have a 15-month old daughter already. We're currently waiting for our NOA 2.

Surely, at some pOint, yes, age does play a role in the relationship. But it is how you react and handle this difference that matters. One example I could give would be the songs that he knows, (to which I never heard of, but he's too fond of telling me stories about it So, I let him be, and then later on he realizes that he's speaking in alien language, so he makes crazy remarks about our age difference and ends up laughing... See, it's all about the attitude! But luckily too, he's a Filipino who grew up here in the Philippines and migrated to the US at age 17. So he still has some of the "filipino ways and preferences" which made us understand each other more.

You've been given some incorrect information.

The household size is the US citizen, plus all minor children regardless of where they live, plus the intending immigrant(s). From what you are saying that is a household count of 5 (petitioner, 3 children, plus the immigrant.

Minor children are considered to be wholly dependent regardless of living/custody arrangements.

Your child is not included on line 3 as that is for persons who would need to be sponsored. US citizens do not need sponsorship.

Oh okay... As to determining the household size in the poverty guideline of my fiance, should I be already counted or just our daughter? Will he categorized my daughter as partially or completely dependent? Since I also have a job here in the Philippines and I support my daughter financially as well.

He has 2 other kids in his previous marriage who are also dependent. Her ex-wife has a job too. And the custody states that they are 50-50 in terms of child support. Will he answer partially dependent in the form I-134 for his 2 kids?

So if my fiance has 2 kids from previous marriage and has 1 with me, what household size are we going to look at in the poverty guideline? -- 3 (2 kids and my fiance), 4 (2 kids from his ex plus our daughter and himself), or 5 (to which i already am included in the basis for the household size for the petition).

His latest w2 and pay statements states that he earns around $44,00 net annually. Is this good enough for the petition?

Yes, you will put your daughter's name on both. No it is not redundant. It is for 2 different purposes. The 1st question refers to who will be accompanying you when you travel to the US. The 2nd question refers to the size of the petitioner's household, which is used to determine the poverty guideline. In the petitioner's case who is a member of the US Armed Forces, 100% of the poverty guideline is used. For 2011, the poverty guideline for a military member and a household size of 2, it is $14,710.00. I am pretty sure the petitioner meets this assuming it is only the petitioner and the daughter.

My fiance and I are going over the affidavit of support (form I-134). We need help in properly filling out the form. We have a 15 month old daughter who's with me here in the Philippines right now and she just received her CRBA certificate and US Passport. My fiance is in the US navy and has already included our daughter as her dependent even before the CRBA has been approved. He declared there that our daighter recieves monthly remittance.

As for the form I-134, my daughter will surely be travelling with me to the US once i get my K1 visa (fingers crossing). So for question no. 3 in the form, we have to write our daughter's name there, right? Since she will be accompanying me and will be supported by my fiance as well, though she's already a US citizen and her father is the one filing the petition.

And then in page 2 of the form, do we still need to write our daughtet's name in the box indicating that she's also my fiance's dependent. Won't it be redundant to puy our daughter's name in those 2 different boxes/questions?

The child's presence will have no bearing on your case with the CO. They have most likely already determined if something is awry with your case file even before you've entered the US Embassy.

On the other hand, if your child is misbehaving or just wanting to monopolize your attention during this important and often stressful time then it could cause you additional and unneeded stress on top of the normal things you're dealing with as you make the final push to complete the Visa process.

In short, why over complicate things by bringing her along? Leave her with Lola so you can focus on your interview.

Your daughter would be welcome to accompany you to the interview as she is a US Citizen (she'd be permitted even if she wasn't because then she'd be a K-2 derivative).

Your mom most likely will not be permitted admission as she is NOT a citizen and has no "official business" to conduct with the Embassy

Are you sure you want to take a young 15 month baby to the interview? It can be a long wait and 15 month children are not known to have much patience for waiting...

"Your inquiry has been received at the National Visa Center (NVC).
The NVC recently received this petition. The appropriate agent

So they already received the petition. Why didn't they give me our MNL case number yet? From this email, how soon can we make another follow-up email?

Just did my interview yesterday and everything went well. I was prepared to give them copies of all my US credentials (Ca lic/NC lic, VScreen, ielts) but they didn't even mention my other EB3 petition.
Pre-screener only asked the usual questions, asked for some forms and was asked to go back to seat and wait again.

Consul didn't ask for any more docs. Just asked me these:
So, i see here that you have been to US. What did you do there?
Who is ur petitioner?
So you met him in US university. Does that mean u have known each other for 11 years?

That's all. Just 3 questions and we were done. Then he said, "your visa is approved. wait for ur no. to be called for final instructions."

I guess this requirement "pass -the-nclex-first" depends on a lot of factors. If u have enough ongoing relationship proofs, petitioner is beyond the poverty guideline requirement and all other requirements have been complied with, i think you'll be just fine. It happened to me, it could happen to any other colleague.

I recently met someone who has the same status as mine. We both have pending approved I-140 cases as Registered Nurses in the US but haven't withdrawn the petitions.

Last Oct 21, she had her interview for K1 but was given a 221g because she haven't passed the NCLEX yet. Something which I don't understand as to why was it connected even to a K1 visa... I haven't taken my NCLEX too and do not have plans yet of taking it here since I don't have plans of working as a nurse yet when I'll get to the US because it's difficult to work on shifts if yoi have a 15 month old baby.

I really don't get it... Merely applying for the NCLEX will take several months and passing it even without ample preparation is much more difficult.

Has anyone had the same issues with the US Embassy Manila? Please help!

I noticed that the DS-157 form will expire on Nov. 30, 2011. Do they usually update the form a week before it expires or earlier than this? I have my interview scheduled on Dec. 1, 2011 and I don't have any idea on how to go about what form to use since it will already expire at the end of this month.
