Hi all,

 

I applied for the first part of the K-1 visa at the start of April of this year. We are being processed at the Texas Service Center. After reading some of the other posts on here I am worried that the first part of this process at TSC is going to take far longer than expected. If all goes according to the estimated processing time on USCIS website of 5 months, then I am hoping that my fiance will have his visa in hand by end of October/early November. 

 

I understand the requirements of marrying within 90 days of him coming over. My question is this: if we were to marry immediately upon his arrival in, let's just say early November, how likely is it that he will be able to return home in December for the holidays? Being home for Christmas is a very important item for him and would be heart breaking if he is unable to be there because of admin details over here. Can we file the permission to travel document prior to him receiving his visa? I asked this same question a few times to USCIS and got mixed responses from them. 

 

Thank you in advance to anyone who can answer this question! 

 

Just a suggestion: Play it safe and have him come over after the holidays so you don't have to worry about getting AP for his return.

I went through primary. The hall was full of people, after 3 flights landed from overseas. I was pleased to see the new immigrants line was open for that reason. On our Kiwi thread in that forum, there was a post to advise anyone heading that way to look for it. I went through it as described above, picked up my bags and left. Not everyone has to go through secondary inspection. I saw people being sent to secondary, they were being directed to a line to my left.


Secondary is not a place, a line or a room, necessarily. It is a group of separate agents that take care of special entries, whose purpose is to keep the other lines moving. All immigrants go through secondary inspection. The line you went through took you to a secondary inspection agent who collected your K-1 pakage and allowed you into the country. In most POEs - if not all - secondary inspection also takes place in a separate room because many who go into that room are taken directly to the removal and deporation hall, to wait their return flight back home.

I went through the line with the sign hanging over it, "new Immigrants", and I was the only one in it.  The person there took the envelope, told me to be sure to make the 90 day window to get married, did fingerprint, and sent me on my way. Might have taken 5 minutes. 
 
If things have changed, they have done in the last month, as one of my friends on a K1 just arrived. No secondary.



The 'new immigrants' line is the line to secondary inspection. In some airports it helps expedite the processing by removing any new immigrants from the regular visitor lines.

K-1 holders are sent to secondary inspection for further processing, therefore depending on how many other persons were in the room waiting to be interviewed, the wait could have been a good couple of hours. Consider that before this person went to secondary inspection, she may have been waiting for her turn, in line, with other non-US citiizens for quite a while already. The non-US citizens/residents is normally the line with the longer waiting time.

It is inlikely that one person was interviewed for three hours, so my guess is that Nextlix didn't quite tell the entire story. Under normal circumstances, on a busy day, it would not be completely unfathomable that someone shouldl take three hours to go through immigration, secondary and customs.

Waiting time will vary according to airport, day of the week and time of the day. The more international flights you have arriving at one airport concurrently, the longer the wait at immigration.

If I understand it correctly, from talking to ordained ministers, not only are they vested with the powers, but it is illegal for them to do it without also doing the legal aspect of it.    

 

I have encountered these cases with immigrants living here in the US who want to get married religiously but can't for this reason.

 

The only reason I would advise you not to consider it is because when you are face to face with the IO at the consulate there is little room for recourse.  Regardless of what the law is or says, the IO has the power to deny your visa on any grounds and the burden will fall on you, in the recourse.

Just because you don't see how the US Embassy will care about this doesn't mean they don't care.

Just because you think its illogical doesn't mean the US Embassy agrees with you.

Many people in your position came to the same conclusions and were unpleasantly surprised when the US Embassy denied the K-1s based on the religious weddings.

The advice is to stay on the safe side and don't do it.

If you choose to have a religious wedding, then don't be surprised when you are treated like others who got rejected K-1s for having religious ceremonies.

This seems right or logical to me.  I know that the relationship between religion and state vary by country, and it is changing all the time.   I just want to know how the USCIS views this issue.  

 

In the USA, if I get married by an ordained Christian minister, he or she is required by the state to register that fact.  I believe he commits fraud if he does not do so.  But what about in the case of gay marriages where the state does not recognize them?   Nobody in that case has said those ministers are committing illegal acts by doing a religious ceremony, but they don't report it to the state because the state doesn't recognize them anyway (this was the case almost everywhere in the US until recently). 

 

If you go through a personal or religious ceremony in a country where the state does not recognize the validity of that ceremony, how does the USCIS view it?  

 

I know multiple people who did things like that, plus I read about it on VisaJourney, but I've never found it clearly addressed.   

 

For instance, I know of a couple who married in Colombia in the Catholic Church and then came here on a fiance visa and did the civil ceremony here.  But, they hid the evidence of the wedding in Colombia for fear it would damage their fiance visa.  (This is all hearsay, but I believe it is what happened.)   I am not sure, but I am guessing that Colombia is like Mexico; the religious ministers do not have legal authority, so when they do a marriage ceremony, it is not recognized by the state.   Mexico is like that.   Is this an actual case of fraud, or does the USCIS not care about this?  That's what I would like to know definitively.  I just can't find this information anywhere.

 

In the US a religious marriage has no legal binding.  In order to eliminate the need for a second ceremony, oftentimes the person performing it will be vested by state with powers to perform legal weddings.  It all depends on the person performing the ceremony.

I have a question that I have been asking people for about a year now (including my lawyer) and never have really gotten all the information that I need.

 

I have figured out that, if you apply for a Fiancee visa, you can't get married until you receive the visa; otherwise you are considered as committing fraud.

 

Okay, so, then I've noticed that a lot of people have religious ceremonies in their home countries and then come here and do the legal.  Is that okay?

 

Finally, what about in countries where the religious ceremony is not recognized by the state?  In some countries, the religious minister does not have power from the state to register a marriage.   So, if the religious minister does the wedding, it still isn't a legal marriage.   How does the USCIS view those situations? 

 

If the religious marriage is not recognized by the state [where it was performed] is should not affect the K-1 process.  However, bear in mind that some religious representatives are empowered by their countries to perform legal ceremonies and they oftentimes bundle both religious and civil ceremony in one.  If you're going down that route make sure you are clear as to what is being done, get evidence to it and be prepared to address it at the consulate come time for your interview.

SV, it seems your main concern is how your spouse will be treated by the US Consulate in El Salvador.  The directive from the Dept of State is clear in that regards.  K-1s are all the same, regardless of applicant and beneficiary.

 

You are correct in that his approval hinges on the interview in SAL but the only thing the interviewer will be concerned is on the documentation presented and his personal documents.  The interview is a one-to-one and done as a private matter, so chances are nobody else will be aware of his business there either.

 

In general terms, the local employees of our embassies and consulates are bound to abide by the rules of the US, these outfits being sovereign American soil.

 

The consulate will not be concerned as to where you will get married, for the K-1 does not mandate that the wedding take place in the state where the applicant resides.  With a K-1 you can get married in any of the 50 states, so that will not be an issue.

 

Hopefully someone else will be able to comment on that consulate specifically, but you should not have to lose sleep over having your sexual life play a part in the decision of your application.

Again, as I said, it may not sound fair for those who have to choose between the K or CR route, but it is perfectly legal to do so.

 

 

It's not illegal, it's just trying to circumvent the immigration laws and requirements.

Yes the visitor came here without intent to stay but they intentionally got pregnant (meaning the male and female both purposefully did certain things so that she became pregnant...or purposefully didn't do other things to prevent that from happening).  To use that as basis of the argument to stay and AOS just doesn't hold water.....there is no reason the foreigner can not go back....wanting to have the baby born here in the US isn't an argument to circumvent the normal process.

 

IMO, since there is no compelling reason why they can not go through the normal process, why would they be allowed to AOS?

It doesn't matter about intention at time of POE.  Someone can not just come here on a VWP and then change their mind to AOS.......and creating a pregnancy doesn't automatically allow one to circumvent the process.....the same as suddenly deciding to become married....doesn't allow anyone to circumvent the process.

 

The pregnancy came into being by two adults willingly allowing it to happen....it doesn't happen automatically without thought (or does by lack of same).

In that we agree, however imho it is a bad idea because of the financial implications.  Proving fraud is very hard and the burden falls on the USCIS.  If the relationship this couple has is a real one they should be able to get her AOS approved without incidents.

 

 



 

I say this is a bad idea....if determined at AOS to be visa fraud, a possible lifetime ban could be in the picture....I personally would not want to gamble that large.

Considering she is still in the US, the easiest way, if you really mean to marry her, is to get married and file for AOS.  She will not be here illegally and your baby will be born in the US as you wish.  The only concern you may have is that it is almost a certainty that your insurance will not cover the delivery, which under normal circumstances may run you in excess of $20k in medical bills.

 

Having said that however, even if she were to return to Chile and have the baby there - where she might have better medical services than an uninsured person would in the US - the baby would still derive US citizenship from you, so it would still be a US citizen as you want.  On the flip side, chances are she would have to wait at least 6 months for a K-1, or 12 months for a CR, depending on whether you marry her before the leaves the country.

Ok.. That is the USCIS line and you go through that before you get to customs.

 

Entering the US with a K-1 visa you will probably be sent to secondary inspection, in a separate room, where they will collect the sealed envelope you received from the consulate.  The process may be longer than that when entering as a tourist but they know you're entering the country with the purpose of staying, so there are less hurdles to overcome.

 

Don't worry too much.  It is just another step in the process and you should be out of the airport in no time.

 

Relax and take it easy.  It is just more paperwork.

 

 

well i was just referring to that thing all people flying in the US go thru, both citizens and non-citizens, different lines. where you get called up by an officer and come up to his little "booth" and give him ur passport to check and he asks you questions about your US visit. I've only before only gone to either participate in an exchange program or to visit and not on a visa quite as k1. My friend said they stopped her to ask more questions than already do when they check you. They also take fingerprints and a scan of ur eyes

If you're a LPR or USC customs will not open your bags without reason, but a tourist with a ton of luggage might be a different story.

As of lately customs officers will check passport, visa status and other immigration papers vis-a-vis the declared intended stay.

 

A tourist, arriving in July, for a 3-week stay, will most likely not see the outside of the airport if his/her baggage contains heavy winter coats, books and other personal effects that might indicate a longer intended stay. 

 

 

 

Not sure customs would know you were a k1.

My same-sex fiance and I have just started the K-1 fiance process. Although our marriage is still several months in the future, it is something we would like to have some definite plans for before he goes to his embassy interview. Since neither of us have been married before, we need some ideas on how to proceed. We will be living in upstate New York after he gets his K-1 visa. My fiance is Catholic, so getting married in church is pretty much ruled out. We both have researched on the internet for answers on where to get married, but we are no further ahead than when we started. Where we have the ceremony is not important to us - we love each other, that's all that counts to us. Can we get married at the courthouse?  We would love some insight from some of you who have been through this before.

I have never heard of this before? What is the D/S? He said he had a visa type R and class J1.. a student visa. Not sure if this helps or not...


Duration of status means that he was authorized to stay in the US as long as his status remained unchanged. In other words, as long as he remained a student he enjoyed the privilege of staying in the US. It all depends on the type of program through which he came to the US initially.

However, he was not banned and the U.S. Embassy in Sao Paulo said he could reapply in three months or try the fiance visa.


In that case, I would bet you will not need to file a waiver, otherwise the consulate would have not suggested he try again in three months.

Not at all, so long as you were not required to file taxes. Just in case, add a note that you have not filed taxes for 2009 because your income was not enough to warrant it.
Also, it may be additional work, but consider requesting transcrips of your tax returns from the IRS. It is not a requirement so much as additional peace of mind.
If you did not file and were required to, I would recommend you do at once. It is not difficult and you can get the forms and instructions online.

So I am willing to sue them because of that since its my salary and I have worked. What I wanna know is If I could actually have any problems with the K1 visa because of that. We are now awaiting the final meeting at the US Embassy in Accra for Fiance Visa to be placed in passports. We have to purchase ticket for fiance to come here with his tree children. The question is: what is cheapest way to purchase tickets from Accra to US/California? One way? Are there any restrictions? (someone said that one-way tickets require that the passenger have a Green Card).

I cant tell you what the cheapest way to purchase tickets is but I would look up the travel sites, such as expedia, opodo, travelocity, etc. Other than that, you can try the sites of those airlines that fly into Accra and that can take you to California from a connecting point.

In general, you would be better off buying a round trip ticket, because they tend to be cheaper than one way tickets. Make sure you check both, so you can compare prices.

Your fiances can purchase a OW ticket, for it is presumed he will remain in the US as an immigrant upon satisfying the conditions under which his K visa was issued.

Hey Guys,
Just found this website today, and it's a god-send. My fiance is American and I am from the UK looking to move over and get married on 26th October 2012. We filed the paperwork the middle of January, received acceptance of paperwork 6th Feb and have received the reference number to check progress 13th Feb. I understand it takes aprx 5 months...so we are eagerly waiting 6th July for more word. I'm hoping the process after this would be pretty quick and smooth, as I'm expecting to book a medical and with the results get an appointment with the embassy...and aiming for the process to be completed realistically by Auguest, September the latest.

My worry is that the visa wont be ready before we get married on 26th October 2012, what would happen if this was the case? Would I need to start a whole new petition, or would the existing one suffice. We did say we wanted to marry in October in our application, but Im sure this wont affect anything?

The applicable answer, and that which I suspect you do not want to hear, is you may need a plan B in case your visa does not come through. If you get married in GB your circumstance will change and so will your visa, meaning you will be back to square 1 almost.
One alternative, if you allow me, would be to have a religious ceremony, if that is your persuasion, so long as you make sure such ceremony is not legally binding. So long as you are not legally married as a result, you're OK with your K visa.
