Bear in mind that even if he were unable to apply for citizenship based on the 3year/marriage rule, he would be able to do so under the 5year/residence rule.

Simple. Use your UK passport at immigration upon arriving in the UK, as you have done all your life. On the way back, present your UK passport at the passport control desk at the departure airport. Then, upon embarkation, inside the jetway you may need to show your US passport as evidence you are who you are and you are authorized to enter the US. Upon arrival in the US, present the US immigration with your US passport, as you will enter the US as an American. At the check in counter, for the airline, show both passports.

As a rule of thumb, use the passport of the country whither you are traveling as you head in that direction.

You need not check both, even in the case they both apply.  Check nbr 1 so that they will only need paperwork from you.

Just last night we found out that my cousin might be a US citizen which is the reason I'm on here asking to see if he is indeed a US Citizen, what can he do to come back to the United States and what steps to follow.  First of all, His father is a born US citizen. He met and married his mother in Honduras but didn't bring them over legally until he was 6 years old. He has been a LPR since he was 6, his mother naturalized when he was 12. Although he never naturalized, I believe he might be a US Citizen since both his parents are right?  At age 18 he got in trouble with the law and was convicted of Armed Robbery w/ gang enhancement. He robbed someone for the "benefit of a gang" is the exact wording. He served 3 years and was subsequently deported with his green card taken away.  Is he a US Citizen and therefore he can come back as a US CItizen? Was he wrongfully deported?  Thank you all for any and all advice.

 

Failing his father reporting his birth to the US consulate in the country where he was born, he would have become a citizen when his mother became one.  It would have been automatic at that point.  I am not sure if he can still receive the benefit in arrears or if there is any recourse he might want be entitled to. 

 

I would recommend you contact an immigration lawyer because even if the answer to your question - is he a US citizen - can be simple, bringing him back to the US might prove somewhat more complicated.

I have my oath ceremony tomorrow and I wanted to know what I'll need to bring with me.

 

From what I can see, all I need to bring is my green card and the oath notice. I don't have any other immigration documents that might apply like an EAD or AP.

 

Also, will they want to keep my 2-year green card? I'd really like to hold onto that if possible. Surely they only want my current 10-year green card?

The notification and greencard are all you need.  You will have to surrender your greencard, for once you are sworn in you will not longer be a foreigner.

Hello fellow members,


I had my N-400 interview scheduled last June 7 and eventhough i received a cancellation letter few weeks before that day..i still went to the USCIS Atlanta office on the day of my interview( june 7th).

There were no government employees there except for the security guards telling the applicants who came there for their interview that it was cancelled.

Today i called the USCIS customer service center about my interview being cancelled and i was told the same thing to just wait for the rescheduling letter.


My questions are:

1. With the interview being cancelled would it cause any problems in the future?

2.Would it affect my eligibility for citizenship?

3. What should i do now? Should i just wait for that reschedulling letter they told me to come in the mail?


I am just worried about this ,anybody had gone through this same interview being cancelled?

4. How long before we will have our interview again? any ideas?

It won't harm you. Call them and get a new date if you don't hear from them in the next 90 days.

I am packing now, and by my window time, I will be in Texas for more than 3 months. I understand I would need to get a Texas ID to prove my residence there. Please notice I am not going to go there to settle down there. Thank you so much.

 

If you're just temporarily out of California then you should be ok.   Just make sure you can explain that to the IO in a manner that you won't come through as trying to beat the system...

You don't need to have filed 2014 taxes if your interview falls before Tax Day - usually 4/15 - or if you have filed for an extension, should the interview fall after that date.  In other words, you must be current with your tax situation at the time of your interview.

Wonderful -- thank you! We did his taxes and he owes $11 for 2010. :P  On the other hand, I am in an installment plan for 2009, a year when he made a loss but I did quite well, and we filed jointly. As long as I'm current on the plan (which I am), this will be sufficient, correct? I assume he'll need to bring proof I am current with the IRS for that year, since it was a joint ITR. The amount I have left to pay for 2009 is minimal, and though it probably won't be paid off completely by the time he files, it will be nearly there. 


Yes, if you are current on your payment plan for 2009 he will be fine - make sure he keeps copies of statements to show as evidence that you did good and are current on the payment plan. It really doesn't matter how much you owe, the important thing is that you're current with the payments. Have him start gathering copies of these statements on a regular basis and putting them on a file so that he will have the handy to show at the interview or earlier if required.

My ex has been eligible for citizenship for some time, but for the fact that he didn't file his 2010 return (I know, I know). Anyway, he's going to be completing it in the next week. He's filed every year besides 2010; this year he filed for an extension, which was accepted, and he will file the return by October 15th. So my question is this: will he be eligible to file the N-400 after he files the 2010 return next week, or after he files the 2013 return in October, given that he is in an authorized period of extension?

 

 

He will be able to file provided his tax situation is current, which means, he can file once he has taken care of his 2010 taxes.  At the rate the USCIS is moving with citizenship interviews chances are that his interview date will fall after the extension deadline for 2013, so he may be best served by filing as soon as he can.  (The rule is he needs to present the transcripts for the last three years, except in case he spent 6 months or more outside the US in which case he needs to produce five years worth of tax evidence.  I would recommend transcripts.).  Have him prepare a written explanatin as to why he failed to file his taxes for any past years, even if he has filed late, just in case.

 

In addition, if he owes the IRS any money as a result of any filings - current or past years - he will need to present proof that he is current with any payment plan he has agreed upon, so just filing past taxes will not suffice if he ends owing Uncle Sam any money. 

 

In essence, he must be current at the time of filing, which he is until his extension deadline.  He will have to be current at the time of his interview, which means he will have to provide evidence he has filed all years, current and past if his interview falls beyond the extension deadline.  He will have to present proof - communications, agreements, account info, the lot - if he owes any backtaxes during the process.

Technically your line of thinking is not far off but you must look at the summons in the context of your current situation.  You will not be a US citizen until you are sworn in, which means that at the moment you received the summons, as a LPR, you're not qualified to serve.

 

Write the court and decline the privilege on those grounds.

 

Hello to all,

 

first and foremost, I am not sure if this is the right forum for this topic, so if it not in the right place and you are a moderator, please move this topic to the correct place.

 

After researching the forums for a similar issue, I couldn't find anything so here is the situation:

 

       - My situation: I am an LPR. I had my naturalization interview on 07/07/2014 and it was approved. I received my appointment letter for the Oath ceremony for 08/27/2014. So I am NOT a US   citizen yet.

       - What the jury summons says: "report on 09/09/2014"

 

I see 2 ways of looking at the situation:

 

1) If everything goes according to plan, I will be a US citizen on 09/09/2014 and therefore should report for jury duty.

2) As of the day I received the letter (08/15/2014), I am not a US citizen and therefore disqualified from performing jury duty.

 

The letter states that I have 10 days to respond if not qualified. Should I send the letter back saying I don't qualify since I won't be a US citizen within the 10 day window or should I just wait and report on 09/09/2014. The problem I see with waiting is if something happens (cannot attend oath ceremony for instance, or ...) and I don't become a US citizen on 08/27/2014, then it is too late to send the letter back.

 

Any advise welcome

Sorry, I misread your post... Ask your interviewer if you can get sworn in in time to apply for a passport, otherwise ask that the ceremony date be set on a date after your return.

Once you're sworn in you can apply for a US passport immediately.  Call the passport agency closest to you and set up an appointment.

Optionally you can write the USCIS back and have your oath ceremony rescheduled, and you can have it once you're back stateside.

You can apply for citizenship based on your marriage at the 3-year mark, regardless of his military record.  Concerning taxes, the only thing that matters is that you tax situation is current at the time you submit your application and anytime thereafter, and that is the impression I have from your post.

Most cars sold in North America meet the standards for both the US and Canada. One quick way to check is to look under the hood for a sticker indicating if the car meets these standards and if they apply to all 50 states.
If you live in California the car must meet emission requirements for California specifically.

My husband has come over every weekend since we met (2 1/2 years) We only live 60 miles from each other. He comes as a visitor each time. Kind of funny they all have names but rarely does anyone actually use it. Hell I have yet to ever hear anyone use the term "The San Gabriel River Freeway" in my life ha ha. Why bother naming them.

Here we have the "Valley Freeway", and if you ever say it, not a single person will know what the hell you're talking about...


It does however, give us insight as to how places evolved and developed... At one point I am sure the name 'San Diego Freeway' meant the road that took you from LA to SD, however, today it is almost impossible to discern where one ends and the other begins...
