Hi there

Am new to posting on this forum, but I have been following one thread as a non member as my Fiance and I are having exactly the same problem

Twice we have had our K1 visa application returned with the wording Classification Sought

No one seems to know what this means, including USCIS. My Fiance rang them after our application had been rejected the first time and the girl he spoke to said she had no idea what it meant. He went through the forms with her line by line and apart from one little tick box that he'd missed he was told everything was fine

He submitted it again, only to have it returned with exactly the same message

Being apart is killing us. We just want to get married and start our lives together properly

I have thought about flying back to New York to just get married, then return and apply through the spouse route, rather than fiance route, but i have no more holiday allocation now until September. My Fiance can't come to England to visit as he is a carer for his former Mother In Law.

The stress of not knowing how to sought this problem is starting to turn me into an emotional wreck, my fiance is struggling too.

Can anyone help? Or give some advice?

I'm on the verge of going to my doctors to get tablets for stress over this.

How can they use this type of wording if they don't know what it means themselves??

 

Are you sure he filed a I-129F - and not a I-129 - for you?

 

The reason I aks is because many get confused with them - the names are close and the forms for different purpose.  Normally 'classification sought' indicates that no category was indicated in the form, where 'classification' means the conditions under which and the basis upon which one is requesting a visa.

 

Have him check that he has sent the documentation to the correct address and the payment was correct.

 

Suggestion.  Have him go over the document with you, so you can see what information he has entered on the form.

Hi lovelies, am so excited i received my visa today. it expires on the 16th of April 2014 and am planing to travel to the states on march 14th 2014. my question is, is the expiration date for my arrival alone or am supposed to get married Before visa expires? 

 

The expiration date is the latest date by which you must enter the US.  Once you have arrived, you have 90 days [from the arrival date] to get married.

If I accompany her during POE, which line does she go through?

Can she go through the "US Citizen" line with me?

Or does she have to go separately through the other "Foreigner / Green Card Resident" line?

I went to the tnt office in Romania to pickup my passport and visa documents today and the sealed envelope for the US immigration's is cut perfectly on 1 corner. is this normal? will this be an issue when i enter the US? i have a flight scheduled for this Saturday.

Please help.

 

That is precisely what the envelope should look like.  Don't open it.  Just leave it alone.  It should only be opened by the USCIS agent upon your arrival in the US.

Taxes notwithstanding, he can continue to work here without his EAD as long as his employer pays him in Italy.  The only restriction he has, until he received his EAD, is that he can't receive a salary derived from work, from a US employer in the US.

Airlines have different rules in regards to transporting pregnant women.  You would be best served by speaking directly to the airline you are planing to use and find out what their restrictions and requirements are.

 

More important than that, what does your doctor have to say?

Thanks for the advice but that other thread literally scared us to death and we decided to play it safe.  Who knows what will happen and I guess we will never know because we are withdrawing.

 

I received my hardcopy of the NOA1 yesterday and will be mailing a request to withdraw that along with a copy of the NOA1 to the Office in Mesquite Texas.

 

I will however; state the reason for my withdrawal and hopefully they will respond with some feedback; but I doubt it. It's the government after all and I know how they work. I am an ex-federal employee.

 

Here is an additional suggestion.  If you have the time, consider scheduling an InfoPass and speaking to someone at the USCIS directly about your situation.  You have nothing to lose, other than a couple of hours, if you have them to spare.

Hi guys, I'm so happy and excited to hear about your status. I'm from Brazil and my partner from Utah, state that does not approve gay marriage.  Do you think it will be a issue for us to get the K-1 visa? Have you guys hired an attorney or did by yourselves? 

I have another doubt about this: Brazil approves gay marriage so I was thinking to get marriage here with him then he takes all the docs to prove our relationship and try to apply to CR1 visa. Do you think it is harder than K-1?

Si, the K-1 process is the same for everyone, so it does not matter that Utah only celebrates some marriages.  All it means is that you will need to go to another state and get married there.  For immigration purposes what really matters is that the federal government does. (The states as slowly catching up with the 21st century...)  If you have never been convicted of any crimes chances are you will not need a lawyer.  If you guys are internet savvy you should be able to fill out the paperwork you need, send it in and get your process approved in no time.

The CR route you mention is also a possibility, with the exception that the law in Brazil is very complicated for foreigners to get married.   Other than that the process is the same as that for any other couple.

Yes, if your fiance/fiancee decides to cancel the wedding after your arrival to the US, you will have to return to your home country. If you do not do so you may become eligible for deportation.

IMHO it stems from people with too much time in their hands, which affords them the luxury of minding the sex lives of others... If everyone took care of their own sex life with the same gusto as they do others' the world might be a better place...
In the case of Muslims, in particular, it seems many still get perplexed by finding out that Muslims are no different than anyone else and there is a positive side to this obsession: it give us insight into a culture and religion that has been subjected to many unjust and untrue criticism. On a positive note, the more we learn about that which we don't know, the better off we are in that we begin to perceive that down here on the ground we are just people trying to make the best of/with our lives. The more we know the better we are at keeping ignorance - the mother of all prejudice - at bay.

Gather as much physical evidence as possible as to the nature of your relationship, in addition to what you already have. If you are currently together, obtain affidavits from family members, neighbors and others who can corroborate the legitimacy of your relationship.

In addition, remember that if your relationship is legitimate, your evidence, in principle should sufficed as it is backed by your demeanor before the interviewer and let your conscience be your ultimate judge. They normally can smell a lie from a mile away. If your conscience is clear you have no reason to worry too much.

I spent Ramadan in Qatar once, while working on a project for Qatar Airways. As a non-Muslim I was not required to fast but all the same, as they say, 'When in Rome...' so I tried and of course, I failed miserably. However, it helped me understand, sympathize and empathize with those who do observe fasting so we reworked our schedule completely to make best use of those hours when people were active and nourished. I need not say that that breaking the fast was the best part of the day and I have never eaten so much in my life. I was already a fan of Arabic cuisine and that was a feast for me. I was treated like king at the homes to which I was invited and certainly ate like one. It was a memorable experience and one I wish more people could share.

Wishing my MENA friends a Merry Christmas. This is my husband's second Christmas here with us in the US. we will be celebrating with my dad and his wife and family tomorrow, Christmas Eve we will host at home, and Christmas Day we will travel to Massachusetts to my brother's to celebrate with his family, my mom, and my family again. My parents are divorced so we always have several celebrations to attend. My youngest son's birthday is Sunday December 22(in 2 days)and my older son's birthday is January 6th so I will also have friends and family over New Years ever to celebrate their birthdays and ring in the new year. I am busy busy busy, Several years ago the adults in our family made a decision to stop exchanging gifts amongst each other and focus on the children. Instead the adults do a simple yankee swap, which is much more fun. It has made the it day more enjoyable and a lot less stressful. Now we focus more on the true meaning of the holiday instead of rushing around like maniacs to buy gifts to people who really don't need anything. My husband and I also decided that instead of exchanging gifts to each other we would take a long overdue trip to Amman to see his family in May. When we go we will bring my older son with us, my younger son doesn't want to go. My younger son has Asperger's syndrome and a central auditory processing disorder, so anything that strays from his normal routine is too stressful for him, he was anxious just thinking about going.
But I digress; I wish you all the happiest of holiday seasons, whether you celebrate Christmas, Hanukah, Kwanzaa, or none of the above. Stay safe and warm, and may all of your wishes come true.

As with all definitions, there is an arbitrary element to *how they are formed*, but once formed, they are solidified via convention. I'm asking because I am filling out a form W-4 for a new job that I just got. Someone told me that I should file as "Single" because there is no official document stating that my marriage is "official" in the USA.

For my 2011 Income Tax Return, I filed "Married filing separately"


Consider that at some point during the CR-1 process you will need to sign an Affidavit of Support. There are instances in which the affidavit should be accompanied by your pay stubs and/or by your last three tax returns. It would behoove you to change your status to 'married' and get that straightened out from the onset.

My wife and I are 100% bonafide, but we got married rather quickly. We met online on a facebook dating application in April of 2011. I visited her for the first time in June, 2011. I then returned back to Indonesia in September 2011 to marry her, and I have been here with her since we've been married. Is either marrying so soon/from a dating site a possible red flag? And what can I do to ensure that the VO doesn't misjudge the situation? Me and my wife are very real but I just heard some horror stories about visa denials and my wife and I do not want to experience this ourselves. :wacko: Any input or suggestions? While the quick marriage may be a red flag, IMHO the fact you have been living together for almost a year now and remain married should help dissipate any suspicions in the mind of the interviewer, if any there should be. Having said that, anything that might corroborate your story - pictures, special occasion cards, etc - might help.
It is also important to remember that regardless of what others may thing, be confident that you are not scamming the system nor doing anything wrong. Infuse your attitude throughout the interview with confidence.

My husband is in the process of immigrating to the U.S. I'm a citizen of the US, he of the UK, but he doesn't have his birth certificate. As a UK citizen, he uses his naturalization certificate. Will this document be accepted in lieu of an original birth certificate for 1-130 purposes? He doesn't have contact with his parents (hasn't for years and years) and hasn't been to his country of birth since he left. Their records are spotty and some were burned during the war. We're worried the lack of a birth certificate will prevent him from being able to immigrate to the U.S. Is there any hope for us?


I honestly doubt the GB naturalization papers will suffice in this case. He might consider going to the consulate of his former country of citizenship and ask them to help him obtain his birth certificate, a copy thereof, or in the least, an affidavit from that consulate that no birth certificate can be produced for whatever reason.
Although he may have become a GB citizen, he may not have lost his previous citizenship.
Can you disclose the country of which you speak? If so, you may be able to hear from applicants from that country with more accurate first-hand experience or even have someone who is local get this document for him.

Yes, she can visit you and she will not need a visa provided she does not stay more than 90 days at a time. For longer stays she would need a visa.
She will however have to convince the officers at the POE that she is panning to return to Korea at the end of her allowed stay.

That decision should not affect the current application, provided the reason(s) she was denied a visa then should not prevent her from ever entering the US. In other words, if she was denied her tourist visa due to lack of ties to her home country - 214(b) - she should be OK.

THANKS for replying.. she did not fill up schedule C or any of the forms I think.. because she was not self employed last year.. she was still working in the hospital with paystubs/w-2/1099.. just this year she decided to work as a PDN so she dont have paystubs for this year :( what to do? i think thats the major proof that I need to show to them that she can provide support because she is earning monthly/weekly as seen in the paystubs :(


She should be ok, because they only ask for the last tax transcript, however, as someone pointed out some consulates may be more demanding. In this case, have her send you her last bank statements, if she can't produce pay stubs.

I am from the Philippines and my boyfriend is an American guy living in the US. He is flying here in 2 months. We previously planned on processing a Fiance Visa. He is currently receiving Disability benefits because of an accident years back. He is only 38 and I'm 28. He very much wants to work again but prefers to fly here and marry me first and then we can start planning our life together when we have the Spousal Visa instead. Unfortunately, he doesn't get much benefits.

He is now staying with my aunt in IL. I feel like it is an advantage that he knows and lives with a relative of mine. She is very willing to be a co-sponsor. We still need to follow-up on her citizenship. If she is only a green card holder then we have her husband to co-sponsor. Can I have a relative of mine co-sponsor with him?

I just need help with getting things ready like documents to get or any other steps to do. What are our chances with a situation like this.

Anyone over 18 and residing in the US - citizen or LPR - can be a co-sponsor.

Hello and congrats to all married or in the process.
OK so here is a little about my case, i got married in June 2011,in the US and have married certificate,(married as a tourist) she is a Naturalized US citizen, then we moved to Europe to study and we are going back in the next few weeks to States, me as a tourist with B1 or B2, I have never over stay or anything in the several times as a tourist, so i am planing to do a master degree in the US and i was wondering what is the best way to approach the situation, taking into account that i need to start my studies ASAP, that means not waiting for a year without doing nothing in Colombia, so the main question is: should i get a J-1 visa and then somehow start a CR-1 process, or should start a CR-1 process then get a J-1, or should i start a K3 and study on a K3. thank you in advance.

Based on that statement, IMHO, you might wish to consider pursuing your studies and leaving the CR-1 alone for the time being. Once your circumstances change, i.e. you have obtained your masters, you may look into the available legal options to become a LPR.

Au contraire, joint accounts are always positive. If you file taxes together make sure these are mentioned in your returns.

Hey Journiers, Anyone know how they determine where the POE is? My husband is from a country that only connects to the U.S. in like 2 cities so I was worried. Thank you all for all your inspiring positivity and of course, all the super helpful info!


It is you - or him - who needs to choose it. Consider that he may travel with an airline based elsewhere, with more options for destinations in the US.

Suppose he is coming from Australia, for instance, if he flies Qantas, his POE will be either Los Angeles or San Francisco. However, if he flies with KLM, his choice of POE will multiply tenfold.

It should take about a month for you to receive the actual card in the mail. Considering the current situation of the USPS with cutting and reducing routes, it may take a little longer. Give it another week or two, if you can.
At the POE they may have annotated your passport to the effect that you were admitted as a resident and authorized to work. That should be proof that you are legit to any employer, but you will need to present your green card to HR at some point. Employers can also use e-verify to check your SSN is good for work.
Having said all that, there is nothing that should prevent you from looking for a job while you wait for your green card. Unless you have a job lined up already, chances are it will take you some time to find one. (I hope to be wrong). Make sure you disclose your situation to any potential employer so they know you're playing it clean.

Hello

Filling out the affidavit of support forms this weekend but ran into a problem.

I was wondering if we need to fill out the last 3 years of tax returns as joint OR if my wife (the USC) just does them as married filing seperatly?
I had a greencard but 'abandoned it' at the end of 2008 so do I even need to file for foreign earned income if I am no longer a US resident?

So long as you remain legally married she needs to file either as joint or married filing separately, in which case both of your income should be reported.

If you already divorced she no longer needs to include you in her returns.
