Maybe that is true for Monaco but the embassy instructions letter for USEM states clearly - tax return (and W-2).   They have no issue accepting a tax transcript but there is nothing in the embassy instructions letter stating they prefer a transcript.

 

It is not a rule, indeed.  The difference is that with the transcripts there is lass paper to be looked at, and the transcripts are official, hence their being preferred over the 1040s and W-2's.

What is better to provide at the embassy interview in Manila, 1040's or tax transcripts?

 

I am self-employed and plan to provide my tax transcripts for the last few years.  Due to being self-employed I always need to pay in April, so I always wait until April 15th to send in my tax stuff.  Because of that I will not have a tax transcript for 2013 for her interview, but I should have my 1040.  I will have my 2010, 2011, and 2012 tax transcripts.  My yearly income is well above the minimum, so would I need much more for evidence of support?  Since I am self employed I do not have a set salary or pay checks.  I requested a list of money transfers from Western Union that I plan to provide that will show what I have been sending her monthly to cover her living expenses and college tuition, which has been quite a bit.  Those transfers should show that I have already been supporting her for the last few years.

 

Her interview is April 10 and I am going there to be with her for it.

The USCIS and the consulates prefer Tax Transcripts.  You can obtain them online and print them yourself, FOC.

If you're flying coach, IMHO, choose the airlines wit the shortest flight.  Regardless of aircraft, service, livery, etc, all seats in coach are extremely uncomfortable and your flight from the PI will be a long one as it is.  The sooner it is over, the better off you are...

Hi again,

So many forms ask for the I-94 to be included. My fiance has been here twice and never got one. It hasnt' been a problem and it is my understanding that it wasn't replaced by any other form. Just that with the VWP and/or scannable passports it was a way of eliminating paper and it is all in the computer systems now. Can someone please elaborate on this for me? Specifically how it would effect him getting a SS number when he arrives here on his K-1 but before we are married. (On the vj guide it says the SS office needs a copy of it.)

Wendy, your fiancee will have to fill out the I-94 when he enters the US with his K-1 visa. So far he he has entered the country under the Visa Waiver Program, which only applies for non-immigrants, hence his never having to fill out an I-94. At the time he enters the US to stay, he will be doing so under a completely different set of circumstances.

Wendy, he will need to apply for AOS before he can have an unrestricted SSN. Having said that, there are two options: He can get the SSN with employment restriction - which when he becomes a full-time resident can be replaced by another card with the same number but without the restriction, i.e. his SSN will not change and he will not end up with two SSN as a result. Behind door nbr 2 you have the ITIN option. The ITIN is a nine-digit number - very much like the SSN - and it serves the same purpose as the SSN for bank accounts and other endeavors.

Once he becomes a resident he can then apply for a SSN, his ITIN bearing no prejudice on the latter.

Say, you mail a petition (hypothetically ;))

CSC or VSC get it and put it in "a box" ne'er to be seen again for 5 months. (or more)

How is it.....say.....that a 12/1 petition gets processed around the same time as a 1/31 petition. Now, I understand that different folks have different boxes and so I understand the idea of overlapping...some.... and I understand the idea of expedited. I just think some of the overlapping is a bit wide of a gap no?

The case at the top was not expedited, at least, I don't think so because she sounds so surprised.

For better or worse, the system is what it is.
I don't want to take your situation lightly, but fact is that the process takes time and you can't count on a y particular schedule. Plans can be rescheduled and tickets canbe changed, so just roll with punches and readjust your schedule to fit in with the process.
It is frustrating but if you give in to your anxiety it will only make matters worse, for it will not make it happen any faster.
Hang I there and in a few months it will all be over, for this leg of the journey.

If your immigration lawyer meant a Writ of Mandamus, then it is worth the effort, at 290 days. It is not really a lawsuit per se. A WOM is a court decision demanding that the USCIS make a decision in your case. It does not mandate what the decision should be, but it does make the USCIS - in this case - get on with your case.

Any other type of lawsuit would be a waste of court time and money.

That is not true. So long as you take a non-stop flight from/to the mainland she should be fine. It is not uncommon for CBP to carry out spot checks during boarding of some flights to the mainland, to prevent a wanted individual or someone who gained entry to HI illegally from getting to the mainland. So long as your fiancee has a valid I-94 she can travel anywhere in the US.

She will be handed the I-94 at check in or on board the aircraft. Worst case scenario, she can get one at the arrivals hall once she gets off the plane.

I just arrived in the US yesterday on my K1 visa and we want to get maried this coming weekend already so we can adjust for AOS as soon as possible.

I have a few questions:

Do we have to wait for a certain amount of time before getting married, or can we just get married this week?

Can we get married and apply for SSN and AOS afterwards, but at the same time (so these applications run at the same time)?

When we get married, do we recieve prove of this right away?

How long do we have to be married before we apply for AOS?

You can get married as soon as you wish and you can being AOS as soon as you are married and have the marriage certificate on hand, which varies from state to state. You can apply for your SSN at any time, just visit the SSA office closest to you.

If you marry him you will need to apply for a CR-1. He will no longer qualify for a K-1 visa once you are legally married.

Can a mod delete this thread? Either it's a troll thread or misguided advice. While patience is a virtue, relaxing gets old when people who filed at the same time and even after have their visas already. There are obvious problems with the service centers, CSC in particular and it's unfair to dub this a 'first world problem' when peoples lives an families are having to deal with this. There are people who have never seen their newborn children because of the delays, most of us will be apart from our loved ones for a year of our lives, how dare someone belittle the issue like that. If I live to 85, that's 1.2% of my life that I would have spent being unhappy because I coudn't be with my loved one. Can't imagine how it'd feel if there were kids in the equation.


Alas it is so. We all have/had the option to move to another country to be with our spouses, yet we chose to have them take the role of immigrants.

I am yet to see anyone here confess to their absolute exhaustion with the USCIS and declare him/herself an emigrant.

We make choices and they have consequences.

How long did it take to receive your visa? Just out of interest.


I never had one. We only applied for my spouse's visa when there was a change in paradigm and she could no longer make do with non-resident status. It took us almost two years from filing to her arrival in the US.

I filed for K1 in June 2012...

I knew, and I accepted the fact that it would be a long ride....

So I just waited... My fiancé' and I skyped several times a week, we sent text massages daily.. and we just waited... Of course I was upset at the 5 month mark.. we all are... but we just waited.. and we prepared our documents for the next step, and we spoke of our dreams for the future.... and in December we rec'd NOA2.... the prepared for our interview in Moscow in March.. and all went well..!!!

So please, relax... it will all be done... prepare your documents, work on your relationships....

dreams to not come true overnight.. sometimes it takes 6 months, sometimes 12 months....

make your time productive... I painted bedrooms, cleaned the house, did some gardening....

and all will be fine...


I think that is where you acted differently from most. You knew it was a long wait and you went for it in that frame of mind. That is a sign of a mature relationship.

I really question the integrity of any relationship that is threatened by or succumbs to the wait of a bureaucratic process. If one can't weather the visa process, how can one expect to face an entire lifetime together?

When I submitted my request over the phone I was told that I didn't need to supply any evidence until it was requested. Do I send another request via mail with all of the evidence? 

 

That might help.  It is fairly easy to say 'no' over the phone, without acutally seeing the reason for the request.

Call and make sure they have changed it in their system, else, set up a Infopass and get it done.  Do not wait until the process is further down the road to ensure the correction has been effected.

Our petition was rec'd by NVC on 5/21/13.  I called today to check if it left for Kiev, the woman told me that it is in administrative processing, I asked her if there was anything wrong, she could not tell me.  I started panicing.  Called them again, this other woman said that case is there and has not left for Kiev, did not mention anything about admin process.... should I be worried at this point???  or "admin processing" is the term they always use to explain that case has not left for the embassy?

You should not be worried.  Many cases go to administrative processing, however the COs will never tell you the reason.  All you need do is be patient and wait.  (Easier said than done, I know....)

On Monday, my fiance (or at least who I thought was my finace) sent me a message on Facebook and told me that she was not going to talk to me anymore, that she never loved me, and that she used me and nothing more.  I am heartbroken beyond belief, as I was sure that she was the real thing.  It always seemed so geniune, so real.  But I feel like a fool.

 

And we were at the final steps.... the Packet 3 was sent on Monday too.

 

I am sorry for that but in reality she was the fool.  If she never loved you she was the one who wasted all this time on this relationship knowing full well it was not going anywhere.  The fool is not the one who gets pushed over the edge of the cliff, so much as the one who jumps on one's own volition.

 

On a positive note, you are better off finding it before getting her here and dealing with the legal aspects of a marriage and sponsorship for a greencard.

Obamacare is a farce, it is the government telling you and me what to do! Obama was suppose to be a good president but all he has done is give away our tax dollars and divide our country.  His obamacare only helps insurance companies(more money for them because they will refuse to pay) and hospitals/doctors(which overcharge for everything i.e a meal cost the average patient 58 dollars..one meal!) and what does it do for us it takes more money out of our pockets..I checked on obamacare....just for me not my family is almost 400 dollars a month, that is a flipping house payment! I refuse to pay that much for something i may/will never use! when i added my wife to it, it doubled,,#######! affordable health care my a$$...it is legalized stealing of your hard earned money! I would like to know for the record one thing obama has done for this country that has not costed the taxpayer more money...just one. 

If you already have insurance through your employer you do not need to get insurance through the ACA. Obamacare is meant to make sure everyone has medical insurance, so people like me and others who have medical insurance don't have to pay 58 dollars for one meal, as you say yourself. The reason a meal cost $58 dollars is because there are millions of deadbeats in this country who belive someone else should pay their medical bills. They seek treatment when they need it and leave the bill for the rest of us to pay.

If the ACA were a bad idea, car insurance would be optional.

Personal responsibility sucks, right?

After a little....'discussion' ...where he wanted to amend it to single and i said no, they need widowed and divorced...i won of course...it has now been resent for the 3rd time

Stubborn #### won't let me check the form either in case i point out something else he's done wrong lol....male pride tut

He needs to check his 'current' marital status.  If he got married, divorced, married again and became a widower, only widower should be checked on question 6.  Conversely, if he got married, became a widower, remarried and divorced, he should check 'divorced'.   He will have a change to enter the names of previous wives in question 9.

Have had a quick look at form I-129. I'm almost 100% certain he didn't send that form cos there is nothing on there to ask about my children, and he specifically asked me for that information.

 

Here is another suggestion.  He can call the USCIS and schedule a INFOPASS appointment during which he can speak with a USCIS officer face-to-face.  It might be the easiest way to find out what the issue with the application is and he should not have any trouble finding an office in the city.

Am new to posting on this forum, but I have been following one thread as a non member as my Fiance and I are having exactly the same problem

Twice we have had our K1 visa application returned with the wording Classification Sought

No one seems to know what this means, including USCIS. My Fiance rang them after our application had been rejected the first time and the girl he spoke to said she had no idea what it meant. He went through the forms with her line by line and apart from one little tick box that he'd missed he was told everything was fine

He submitted it again, only to have it returned with exactly the same message

Being apart is killing us. We just want to get married and start our lives together properly

I have thought about flying back to New York to just get married, then return and apply through the spouse route, rather than fiance route, but i have no more holiday allocation now until September. My Fiance can't come to England to visit as he is a carer for his former Mother In Law.

The stress of not knowing how to sought this problem is starting to turn me into an emotional wreck, my fiance is struggling too.

Can anyone help? Or give some advice?

I'm on the verge of going to my doctors to get tablets for stress over this.

How can they use this type of wording if they don't know what it means themselves??

The reason I aks is because many get confused with them - the names are close and the forms for different purpose.  Normally 'classification sought' indicates that no category was indicated in the form, where 'classification' means the conditions under which and the basis upon which one is requesting a visa.

 

Have him check that he has sent the documentation to the correct address and the payment was correct.

 

Suggestion.  Have him go over the document with you, so you can see what information he has entered on the form.
