Thank you for your answer! I told him to order his tax transcripts but he says the ones for 2011 and 2012 aren't processed yet.. since he filed recently (like a month ago). This is why he is going to send the tax return instead :/ Do you think this will be a problem?


If the transcripts are not available, the tax forms will do, but he will have to send you the 1040, schedules and all the supporting paperwork as well. The only reason I suggested the transcripts is because they are the silver bullet, but the tax returns themselves should also be ok.

Hi.
My husband is a disabled army veteran and receives VA benefits above the poverty line. That is his sole income.
He filed his taxes for 2012, though none of his income is taxable. We are able to send the tax returns but we do not have W2 forms. Also, his tax returns show an income of zero (since he has no taxable income). So.. for the I864, will it be enough to send his tax returns and the letter from the VA stating his monthly benefits? Should he include some sort of explanation?

Don't worry about the W-2. Have him send in the IRS tax transcripts. They trump the W-2 and tax return - 1040 - documents. That in addition to a letter from the VA should suffice. Good luck!

If I made 54K in 2012, 56K in 2011, and 58 in 2010, does that qualify me for 125% above the poverty line for the AOS form? I'm a language teacher, not a math teacher. I hate numbers and don't know how to figure that out...that, and I don't know what the poverty line is. I feel like I'm in poverty sometimes.

The interview is only one of the many steps in the process at which they can call you on it.

iv - It is not a very safe idea because if you get caught you're deported never to enter the US again.

He can visitm but for no longer than what is allowed in his I-94. He should have means to show strong ties with his home country upon arrival.

  When you filled out the I130 it has a space for other names used.  Did you include that spelling ?   You need to get affidavit of sameness.   These are sworn statements that she is the same person ( both spellings are really her )

You don't need to do anything.  It is up to her to provide the USCIS with the papers they requested, in which case it may be unlikely she will need to hire a lawyer.

Just notice that if he were to claim you as a dependent or married filing jointly that would not characterize you as a resident. The IRS recognizes dependents and spouses who are not US residents.

When it comes to taxes, there are no borders or continents! We are all one big huge human family where all are welcome!!! :D

Hello everyone, I have read a few posts where people have given advice to be wary of what your accountant may tell you about how to do taxes, because at the end of the day they're not thinking of your visa journey they're doing their job. I'm the Australian in this situation and my husband is American. We've been living and working overseas for two years, he's currently ensuring all his taxes and income records are lined up with his family accountant, and the guy has just said that I should file taxes... What?!? This to me makes no sense, I've never lived in the US, never worked, never stayed longer than 3 months. I know we're married but what would my earnings have to do with the US at all, I'm an Australian citizen..

Is the accountant simply doing numbers and thinking as an accountant, or is there any merit to this suggestion.. This is really frustrating us because it's slowing us down with sending off the I-130.

Jajaju, your husband's tax situation should not depend on his tax returns much too early in the process which means that he can go ahead and file it. He will need to become current with his returns at some point in the future.

For the US Internal Revenue Service, from the moment he got married his filing status had to be either 'married filing separately' or 'married filing jointly'. Your income would come into play if he decided to file as 'married filing jointly', in which case the income of both of you would be considered. As a US citizen he must file taxes and report income, even that received abroad. If he brings you into his tax return then your income would also need to be reported. In a nutshell that is how your income comes into play, even though you have never lived or worked in the US. (However if you do not have a SSN or ITIN I am not sure how he can even file married/jointly but that is something his CFA is better suited to advise him.)

Having said that, dealing with back taxes is not really all that complicated and they will accept back taxes for as long as he is willing to file. The hardest part in the process is getting the W-2 and all the form required to file. The actual filing itself is simple.

However, you have misunderstood the instructions.

 

The old form will be accepted until 6/23 and only the new form will be accepted afterwards.  The USCIS is accepting and reviewing both forms currently, i.e. you need not wait until 6/23 to use the new form..

- Then we started looking at eloping and filing for the IR-1 visa while he was completing his most recent assignment.  However, I got scared off from that plan because I've seen some forum topics here that suggest that a person entering into the States with the specific goal of marrying a citizen is seen as fraud.

If you are certain you want to get married, you can do so while he is here, even if he enters the US on a VWP or B visa. That is not considered fraud.  If he were to enter the US on a VWP or B, to get married, and stay and AOS stateside, that would be considered fraud.

 

If the two of you are positive on getting married, go ahead and do so.  He will have to return home after you get married and wait for his visa to be processed before he can enter the US to stay.  In the meantime he can come visit.

my husband is usc born in the usa and my kids are usc through him. we are all living in ireland, we dont have any assetts or houses or savings and husband would like to work in usa but would nt  earn enough to meet  125% affidavit of support. and no family in usa for co sponsor. 

 

If you are speaking of moving your family to the US, in your situation, it would be wise if your husband headed to the US and got himself a job first so he could be your sponsor and you and could follow with the kids.

 

Assuming you have 3 kids, in order to sponsor you for immigration, your husband would need to make about $30k p.a. which is really not a lot of money for a family.  See link:  http://www.uscis.gov...00048f3d6a1RCRD

 

There is no way you will be given a visa to enter the US, or be allowed to AOS in the US, without meeting the sponsorship requirements.

Your husband will be able to travel as soon as he enters the US and the rule of thumb is that as a 'resident' he is expected to spend more time in the US than abroad. In other words, he can travel for business and pleasure but his travel pattern should not suggest as though he were using his green card as a replacement for a tourist visa. Makes sense?

That would work, for you will be stateside at the time he arrives. I can understand that you are worried, but the USCIS will not check on your whereabouts as he is processed upon arrival. They will be busy getting him admitted and having him sign the card which will become the basis for the issuance of the actual green card. You are fine.

I have friends that live around Los Angeles so they would be able to come pick me up, I could stay at their house, go back to the airport the next day to get my husband.

I would die if something went wrong and we had to start all over from the beginning. I am not going through this process again! It has taken us a year and a half to get this visa and so many dramas, I could write a book about what we have gone through to get this visa.


You can be on the same flight as your husband and if you are, you can accompany him to secondary and wait for him to be processed. You need not get here one day before him.

Upon arrival you will be taken to secondary inspection. They will collect the package you received from the consulate, endorse your I-551 and process your entry into the US. It should take no more than 1/2 hour, in addition to the waiting time, which depends on how many persons should be ahead of you.

If you want to save some time, upon your arrival go to the line reserved for US Citizens & Residents to avoid the lengthy wait associated with the tourist visa.

Anecdotally, haven't heard the automated SSN process to work for anyone.  If you don't get an SS card in the mail a month after POE, go to the SSA office.  You'll just need to bring your husband's passport (with Visa in it) and a filled out SSA application (to save you time at the window).

 

Also, make sure your husband's name is on the mailbox (or inside the mailbox if you live in an apartment complex/condo and have one of those clustered mailboxes), as the SSA people have told me sometimes the cards get sent back to the SSA office, if they see the wrong name on the mailbox.

It's a combination of the visa and a standard entry stamp that allows the visa to act as temporary green card until the actual card arrives.  Not the stamp in of itself.

Normally, the SSN is requested as part of the IR1 admission package but also it hardly ever works...  If he should not receive his SS card within 4 weeks of his arrival, take him to your local SSO and inquire. He can seek work even as he waits for his SSN.

 

The I-551 stamp on his passport is as good as his greencard, which means once he arrives and is admitted to the US he will be able to work.  The I-551 authorizes him to work and he can use it as evidence of that until his greencard arrives in the mail, which should happen 4-8 weeks after his arrival.

The OP is not in the US. If she overstayed and never left, then she would not be subjected to a ban and her overstay would be forgiven.

Since the OP overstayed more than a year and has left the US, she has a 10 years ban. Thus, her visa will be denied and she will need a waiver.

Big difference. This is why the general advice for an overstayed spouse is not to leave the US. Once a person leaves, it's harder to get back in.





 

We are speaking of the same thing.  It is evident that she will need a file for a waiver.  It is also true that in the case of spouses of US citizens the waiver is a mere bureaucratic procedure, the very nature of the CR/IR, being the evidence of hardship, in a bona fide marriage.

Hello everyone, Sorry if I'm posting on the wrong topic. It's my first time posting but I always read this forum.

We are about to send the I-130 package with my husband and I'm quite scared and worried and nervous. I?m trying to take it easy though.

I overstayed a Waiver Visa more than one year; I got married in the USA before the Waiver Visa expired,  being my husband a permanent resident of the USA (2008). I left the USA voluntarily on March 2011. My husband got his citizenship though naturalization on April 2013. He will come to visit (finally) on October of this current year.

I have most of the required documents and evidences ready for the I-130 package, but I decided that I want to add an evolution of the relationship letter.

Please help me with this topic, but I think it will be better to clarify why we are not living together at moment (I had to return to Argentina, my country due serious health issues of my father and I needed to finish my bachelor degree). Would it help to send this letter - simple, focused on the dates, not many details - for them to understand our current situation?

My concern is that if I do so, it will be so evident that I overstayed my Visa Waiver in the past. I know that they will be aware of that sooner or later, but what I mean is, would it be wise to just show it on the evolution of the relationship letter?

You should disclose all the details of your relationship.  Your overstay will be forgiven, for you are now married to a US citizen.

 

In dealings with immigration, honesty is always the best option.

I read that they want ALL children included which would be the two that will live with us AND one that lives with her ex and two that live with my ex even though I do not have custody.


Is there a way to only have the two that will live with us?


Then we can make the income.


I also just read that she will get a work permit before the adjustment of status that has the I-864 SO she can work so we have more income.

For the purpose of household size, in the context of affidavit of support, your minor children always count, regardless of custody or with whom they live.    Your future wife will not be able to use her income, derived from work once she is stateside, to complement the required minimum.  Be proactive and have a co-sponsor lined up.

She may not have to pay taxes but she has to file a tax return for the last three years at least. Filing taxes does not mean she has to pay taxes.

If your wife's income is not sufficient she will need a co-sponsor. However, as she is the petitioner she will also have to sign a I-864 and she will have to show her last three tax returns. As a US citizen or LPR she must file US taxes, even if she lives outside the US.

Once you arrive and have your immigrant visa endorsed (stamped) at the POE you will be able to seek employment.  The endorsed visa on your passport is your authorization to work in the US until you receive your greencard.  You will also need to apply for a SSN once you're stateside but you can take employment while you wait so long as you have proof you have applied for it.

Hegel is probably right. But again you also need yo check on your passport for the date stamps on your exit and arrivals. It will probably help you give accurate or close to accurate dates.
