K-1 Fiance(e) Visa Process & ProceduresGetting Married what happens if my visa doesnt come through in time???

1340279029' post='5469200']
Hey Guys,
Just found this website today, and it's a god-send. My fiance is American and I am from the UK looking to move over and get married on 26th October 2012. We filed the paperwork the middle of January, received acceptance of paperwork 6th Feb and have received the reference number to check progress 13th Feb. I understand it takes aprx 5 months...so we are eagerly waiting 6th July for more word. I'm hoping the process after this would be pretty quick and smooth, as I'm expecting to book a medical and with the results get an appointment with the embassy...and aiming for the process to be completed realistically by Auguest, September the latest.

My worry is that the visa wont be ready before we get married on 26th October 2012, what would happen if this was the case? Would I need to start a whole new petition, or would the existing one suffice. We did say we wanted to marry in October in our application, but Im sure this wont affect anything?

Thanks for any advice or similar experiences!:)

The applicable answer, and that which I suspect you do not want to hear, is you may need a plan B in case your visa does not come through. If you get married in GB your circumstance will change and so will your visa, meaning you will be back to square 1 almost.
One alternative, if you allow me, would be to have a religious ceremony, if that is your persuasion, so long as you make sure such ceremony is not legally binding. So long as you are not legally married as a result, you're OK with your K visa.
Good luck!

K-1 Fiance(e) Visa Process & ProceduresK1 applied for can I apply for a working visa while I wait and do I need to apply for a new driving license

1340632561' post='5480110']
Right, I knew that it's the US Citizen that applies for the visa, I guess with all the talk of visas with my boyfriend, I just never actually thought about Vegas before as an option! (crazy, right?) If we decided to get married that way (and then apply for the CR-1 as opposed to wait and apply for the K-1) ... all he would need is his passport? Or is there any other documents / paperwork that needs to be completed beforehand for the person who is not the USC? And I'm assuming they'd give us the marriage certificate right then and there?

Has anyone else gotten married in Vegas?! This may be becoming more and more of an option ... :)

I got married in Lake Tahoe because we did not want to wait forever, we wanted only a couple of friends at the ceremony and we didn't want to have a big party. All she needed was her passport. They issue the license and the certificate at the same time. You will not receive the actual certificate at the ceremony. It will be filed and mailed to you nd you should have it in about 2 weeks or so. The money we saved was better used on a couple of first class tickets to Honolulu!

Speaking of LV ... has anyone actually gotten married to their foreign significant other there? How does it work? All they would need is their passport still, right? And then how soon after would they need to leave the country so they can apply for their CR-1 visa? Just curious .... :innocent:

I know some people who got married in Vegas because it is easier and you don't have to wait. Same goes for Lake Tahoe. It is not the foreign national that applies for CR-1, so it is up to the US citizen to get the ball rolling. Once you have the original marriage certificate you can send in the papers.

Ha ha yes this has also been suggested ;)

I meant it as a tongue-in-cheek comment. I hope you have a smashing wedding ceremony, with all the drama, the crying, the drinking and family-bickering at which we Americans are so good! All the more reason for you to learn breathing exercises while you wait for the visa to be approved. You will be ok. As someone else said: Hang in there!

Arranging a wedding is hard enough in your own country, let alone when you're trying to settle into a new one and don't know where anything is. :)

I think that only applies to visitors and not residents.

Absolutely correct. I was going with the presumption the driver is not a resident yet...

Thankyou for your help :) If I can establish myself, I want to be self employed...but definately want to do things by the books! I dont want to give the embassy any excuse to reject my visa application. I'll check that link now - enjoy your day :)

Your British license is valid for one year. If you are driving someone else's car - i.e. not a rental - make sure their insurance policy will cover you for the period you will be driving.

source: http://london.usemba...gov/rctour.html

The U.S.A. has an agreement with most countries whereby the renter's full national driving license may be used for a period of up to one year in the U.S.A. This applies to the full U.K. driving license. Provisional licenses are not acceptable.

K-1 Fiance(e) Visa Process & ProceduresIs hiring an attorney necessary to apply for K-1 Visa for Dominican Fiance?

1339011012' post='5424797']
Thank you sooooooo very much. The attorney I spoke with charges $2900 plus all the filing fees = $3400.00. Thank you for the advice and I would love to hear your story regarding your hubby!

Many blessing on your jOURney! <3

Anyone can do it alone. You can get help here and the forms themselves are not too complicated. All immigration forms can be downloaded from the .gov site for free and as someone else pointed out you may need to read the instructions a few times but that is the extent of that. The biggest advantage of NOT hiring a lawyer is that the USCIS will get in touch I.e. mail the petitioner directly meaning there are no intermediaries upon whose desks important communications can sit for days.
Last but not least, you can do a lot with The money you'll save!

K-1 Fiance(e) Visa Process & ProceduresCo-Sponsor's Country

Hi,

I can't seem to find this answer in other posts so I had to put it as a new post. I am an American. I cannot find any US sponsor at all. My fiance' is from Canada. His parents and grandmother are more than willing to sponsor him. Can they be a sponsor even though they are not from the USA?

Also, how do I update my profile on here?

Thanks.

Not in this case. The co-sponsors may be foreign nationals, but must reside in the US.

What would be the prove of strong ties to Brazil since I have not been working for almost 1 year and dont have anything in my name like a property or car?

If you already have a visa on hand, there is little you can present at the POE, since you do not have a job. It will be up to him/her to let you in and there is no way of knowing until you are here.

If you don't have a visa, chances of getting one without a job are very slim, all the more so because you are in the process of getting your K-1 visa. Then again, you will never know if you don't try.

K-1 Fiance(e) Visa Process & ProceduresHas anyone travelled with conection in Dulles airport?

1341904476' post='5513729']
Has anyone travelled with conection in Dulles airport? the question is do you know if I have to pick up my luggage and then check in back even if is the same airlines? I will have like 1 hour betwen flight, is it enough? I read that somethimes takes like 3 hours to pass the customs and I dunno what to do, Can I catch the next flight?

Thank you all

If you are arriving at IAD on an international flight you will have to go through immigration, collect your bags, go through customs and re-check them with the airline even you are connecting with the same airline. one hour will not do, or at best it will be tight, if you're traveling with a US passport.
If you are connecting from a domestic flight onto an international flight, then you will not need to recheck your bags; they'll be transferred to the other flight automatically and one hour should be more than enough. All you need do is find your debating gate and board.Call United and explain your situation so they can advise you on what to do, if anything at all.Good luck!

If you were found not guilty then you have nothing to fear. If that should show up in your police record it will also show the accusation and the outcome or the ruling by the court.
Get the court transcripts and the ruling in its entirety and have it with you just in case.
Good luck!

K-1 Fiance(e) Visa Process & Proceduresso, what is involved?

i understand.

Lucy, you got some 'splaining to do...

and the sooner you set the record straight the better off your relationship is.

K-1 Fiance(e) Visa Process & Proceduresso, what is involved?

thanks.
yup, relationship is legit :)
could I also ask what is RFE?

RFE stands for Request for Evidence, and is a generic term for 'you missed something', 'you forgot something' or 'we need some explanation on something'. It is a way of the USCIS uses to tell you your application process has stopped pending action by the petitioner or the beneficiary.

If your DOB is not the same in all your documents, from birth certificate all the way to your passport, chances are you will find your process being stopped at some point.
JohnR!MaleMonaco2012-07-13 08:54:00
K-1 Fiance(e) Visa Process & Proceduresso, what is involved?

well yes of course but what if it were incorrectly filed in?

another question: does age difference matter? she is older than me - around 10 years.

I am not sure what you mean, but your official date of birth is the date which is on your birth certificate, and presumably in all documents you possess, including your passport. If the date on your birth certificate is incorrect and you wish to change it you need to correct it immediately and have all other documents corrected so they all how the same DOB, lest your application falls into the endless cycle of RFEs....

Age difference does not matter in principle, but it represents a red flag, in some cases. However, if your relationship is legit you need to be worried about it too much.

K-1 Fiance(e) Visa Process & Proceduresso, what is involved?

Use the DOB which is on the birth certificate.

K-1 Fiance(e) Visa Process & ProceduresRound trip ticket for arrival to US?

1342734478' post='5539730']
And I(and Dave&Roza above) am warning people that in the past someone was being denied AOS because USCIS told them that the intending immigrant used their return ticket to leave the US, even though they never actually left on that return flight. This doesn't happen all the time and I have not seen anyone mention having this problem recently, but the fact remains that it has happened before. Better to cancel it and be completely safe than stuck in the nightmare of trying to prove to USCIS that you did not really use the ticket booked in your name.

Do not know what happened in this case as they never updated, but here it is: http://www.visajourn...naccurate-info/

Duly noted! Posted Image
It goes without saying that such a glitch represents a breach in security and immigration procedures. If the airline is in any way responsible for this, it is a lawsuit waiting to happen.
Thatnks for sharing this!!!

K-1 Fiance(e) Visa Process & ProceduresRound trip ticket for arrival to US?

It isn't about helping the airline though. It is to make sure it is completely clear that the return ticket was not used by the K-1 visa holder. It has happened that the airline resold the seat but did not update the passenger list and it looked like the intending immigrant left the country. I do not think this happens often, but it has happened, so it is better to cancel and be completely safe about it.

The airlines only report to CBP the list of actually boarded passengers and that is done automatically by their departure control system, which is linked to the check in and boarding system. If a passenger does not board the plane, that passenger is removed from the list and is not reported to immigration. So the only reason to cancel the return ticket is to make it possible for the airline to resell that ticket.

K-1 Fiance(e) Visa Process & ProceduresRound trip ticket for arrival to US?

So we're all good to go, and just to tie up any loose ends we should have the return flight cancelled after she's arrived and we're sending off our AOS papers?

If you can cancel the return flight it would be nice, so the airline can sell it again.

Even if you do not cancel, there is no problem for the airlines normally overbook their flights to compensate for no-shows.

K-1 Fiance(e) Visa Process & ProceduresRound trip ticket for arrival to US?

Bottom line is if she has a round trip ticket will this cause her problems at customs at either exit or entry?

You need not worry, her ticket in a non-issue as far as CBP/USCIS is concerned.

Chances are she will not be asked about any return ticket because she is coming to the US with the intention to immigrate.

If they were to ask her, the truth should be more than enough reason. A RT ticket was cheaper and that is compelling enough.

K-1 Fiance(e) Visa Process & ProceduresTraveling when k1 visa is issued to get married in another usa state

Hello guys,

I was wondering if i can travel from Washington to Hawai to get married without problems when my k1 visa is issued.

To be clear, i will leave France to go to Washington where i will be living with my future husband, then go to get married in hawai and then come to Dc after a week.

Did anyone done this before with no troubles please?

Xxso

You will have no problems at all. The K1 carries no restrictions in regards to the State in which the marriage must take place. Your marriage will be recognized everywhere and you'll be in accordance with the terms by which your visa was issued.

Congrats and Aloha!!!

K-1 Fiance(e) Visa Process & ProceduresWorks for the government

I have a question and if anyone knows the answer I would appreciate it!:) My fiance works for the government in Russia and she is very worried about the DHS or US Embassy calling her boss asking about her. If they do she will get fired with no questions asked!!!So my question is do they really call their employers or do they just want to know how they make a living?
Thanks!

For all they know she might be applying for a tourist visa, however, she would be best served by bringing the issue with her boss herself and letting them know she is planning to emigrate.

If all you guys want is to get married - with no immediate AOS in the US - she will not need a tourist visa. She can travel on her diplomatic passport.

I can get her here on a diplomatic visa next week... If she comes and I marry her in Vegas, can she stay and have the baby here?

If she has no idea you will propose, before she arrives, that might work. (The reason being it would be considered visa fraud for her to enter the US knowingly, with the purpose of staying.)

What may complicate matters - and this is pure speculation - is that as a diplomat she has immunities which might work in her favor, on the other hand, she most likely will have to give up her diplomatic status at some point during her process to becomes a resident.

OK thanks. What about just going for a regular tourist visa for her?

If she can get a tourist visa soon she may be able to come over in time to have your baby in the US.. It is a long, long shot and it will depend on her financial situation and standing in Albania.

If in the end, you can't get her here in time for the delivery, make sure you register the birth with the US Consulate with jurisdiction over her place of abode in Albania. In that manner you guarantee that your baby's birthright to claim American citizensip, so when you begin the visa process for your fiancee or wife, you will have one less person with whom to worry.

K-1 Fiance(e) Visa Process & ProceduresI-94 Arrival/Departure Form

Hi Gegel and A&B,

Am I reading two different opinions here? Gegel, you say USA, but A&B, it seems by saying "not living in the now, not the future", she would put China down.

A&B, BTW, waiting for interview date, but Ying did send in the P3 now, so should know very soon.

Thanks

Oops, meant in the present, not future.....

Yes you have two different opinions and both are correct, i.e. it doesn't matter what she answers in Q8, really. She will be allowed in and that is what counts.

We can make the case for either the US and China successfully, on this one.

K-1 Fiance(e) Visa Process & ProceduresI-94 Arrival/Departure Form

AT POE, K-1 Fiancee will fill out the I-94 "White Form" - Arrival/Departure Record, which they will need later for other things like SSN and AOS. Have you noticed, it has a question 4. Country of Citizenship, which of course, their home county would still be the answer, but the usual confusing and ambiguous US form question, is question 8. "Country where you live" - would they now put "US" there, even though they haven't actually started living here yet. They will no longer be living in the country they are entering from......Thanks

Q4 - Country of nationality - normally the same country that issued the passport with which the beneficiary is travelling.
Q8 - USA.

Since the K-1 visa is kind of a halfway house in terms of status, the presumption is that you will be entering the US to take up residence.

Good luck!!!

K-1 Fiance(e) Visa Process & Procedureschurch wedding

Hi all! If your filling for a fiancee visa can the petitioner & beneficiary marry through a church wedding ceremony in the philippines before they leave for US when the visa is approve? and upon arriving in the US they will marry through a civil ceremony. Any thoughts?

Anything which results in a 'marriage' certificate is a no-no. Play it safe with the USCIS. If you wish to have a faith ceremony before you leave, can you get a priest to do a simple private blessing for the soon-to-be-married couple, for a send off? Nothing official in the laws of men but very kosher with the one up above? Just an idea...

I really think this is just a lot of useless complaining. Yes, we all want to be with our loved ones as soon as possible. And there are thousands of people waiting for visas. Are some of them rushing into things? Well, probably. But how many people rush into things and get married without the need of a visa? Love and the emotions around it are intense. Relationships don't always work. Telling someone they should think more before they apply, or they should try harder because a relationship fell apart...just seems silly to me. We all have to wait, we all spend the money and it shouldn't be anyone else's business. We are free to do whatever we want, get married to someone I met tomorrow, or apply for a visa and get married whenever the process is over. Yes waiting sucks, but everyone does it and it will not change.

Nicely put! If It works for one couple out of a thousand, then it is worth it. In the long run, anyone who rushes into a K-1 visa and gets burned will end up paying the price anyway.
Freedom is not free.

K-1 Fiance(e) Visa Process & Proceduresneed advice

1342929946' post='5545112']
I need some advice regarding my situation. My fiance is from Yemen living now in Saudi Arabia. I live in the USA. We met on a muslim marriage website and we both like each other and want to get married. We have been in contact via phone, webcam chatting, letters in the mail, blah blah. I want to bring him here so that we may get married. Although his job back home pays very well I wanted to stay in america and he agreed to come here. The problem is I dont know what visa to apply for. We tried the k-1 and the requirement state we have to have met in the last 2 years. we have been trying to meet but are finding it extremely difficult without him being able to come here to visit. First, the culture in Saudia Arabia men and women cant mingle and travel without a male family member. Second, I tried to apply for a visa to Yemen but no visas were being given out because of the civil war there. Third, I have epilepsy and my doctors find it too dangerous for me to travel without a companion and even to travel period.

Is there any way to get around the 2 year requirement? What other visas would we qualify to apply for?

Any help is appreciated..

Thank you

IMHO it will be difficult for him to get a visa. Considering the constraints you have, it might be easier for you to meet at a place where you can satisfy the requirements of the USCIS whiteout putting you at risk. Dubai, IMHO would be a good place should he not be able to get a visa for a western country. You would be allowed contact to get to know each other and also you would have adequate medical facilities if you should need attention while on the road. Make sure you get international medical insurance and secure a chaperon to travel with you. Although epilepsy may be debilitating at times, many do travel and lead normal lives while keeping their condition under control.
Good luck!

Hello,
I want to tell you my story,i came here in the US on 14th Jan, and my I-94 form allowed me to stay here until 13th Jul, but the problem is that i found out that that i am pregnant and i decided to stay over visa and find a solution to my problem.
My bf is working in the Army and he will be deployed in Afganistan next year, and we need to know what steps we should do.
We are planning on marrying but not right now, but now being pregnant i will need to go to the doctor, and i don't have a SSN and i don't know can i get one in order to help me with the doctor's appointments.
Please, i really need some advises because we cannot afford a lawyer

Even if you get married, chances are his insurance will not cover your pregnancy because it is a pre-existing condition. If you're not planning to get married right away you are best served by returning to your home country so he could apply for a fiancée visa when you decide to marry, knowing that your overstay may delay the process. If you want to marry right away, you can also return home after the wedding and he can fill out a petition for you to return to the US as a legal permanent resident.
Staying in the US with your expired I-94 renders you in the category of illegal immigrant, which is not a good idea, especially if you're pregnant.
I wish you well whatever decision you make.

Gegel you are quite right. But its taking a big chance and he may change his mind about her as well. The right thing is to tell him immediately, but is it the smart thing to do considering welfare of OP?? Very personal decision....

it was 2 years ago and i search in google and ive seen so far that doctors or ob cant tell..but just like you said.. doctors especially when you are pregnant ,they have to know all your medical history.. yes im a afraid..coz i dont know what will be my fiance's reaction..so i will either hide it since he embasy wont mention about it. but if my fiance ask.i will answer without any lies..but for now,im really scared.

This is a very delicate and personal situation, so please forgive me for intruding, but I wanted to interject the male point of view in the mix....

If you are planning on having a family it would do you a lot of good letting him know in advance. In the event you get pregnant again you may - or not - need special care or even undergo treatment before getting pregnant. If will be hard on you to do it alone, and may end up putting a strain on your relationship. It will be much easier to do it with the help and support of your husband.

From a man's perspective, he will most likely want to take care of you and protect you and most of all, participate in your life, so consider not shutting him off from this very important step. Let him be a part of your life and share all the pleasant and unpleasant stuff as well.

If this piece of information is something that might make him change his mind, you are better off not marrying him, for he is not ready to make a commitment as serious as the one marriage requires.

Good luck!!

Now we just need to figure out how to move a sole trader company to the US so it will be a US company/sole proprietor lol

After going thru a K1 process chances are he will find it a breeze...
Wish him luck and congrats to both off you!

K-1 Fiance(e) Visa Process & ProceduresMy fiancé income will continue in the US, can he use the income?

Yes, since he is a sole trader and has no employees all the money from the apps (which are sold world wide on various phone app markets) goes into his UK bank account.

Another question, until he is a resident he will pay his taxes to the UK as normal even though he is living in the US, then once he is a resident he will pay taxes on the app income in the US not the UK? Is that right? I intend to do more research on this :)

1/No problem. His UK money is his and he can use it as he sees fit.

2/Once he is living in the US he will have to include any foreign income in his yearly tax returns filed in the US. I am almost sure - i.e. I may be dead wrong - he will also have to file taxes in the UK, for the money is counted as income there too; and he will still be a British citizen. Let's see if someone else had a first hand experience on a similar situation.

If his income is being derived from the UK he can use that money, no problem. As soon as he becomes a resident he will have to include that in his tax returns though.

Until he receives his EAD he cannot be hired in the US or be involved in any working activities that would require his employer to report his income to the Fed & State government. In other words, he cannot accept work in the US or receive any monies in the US related to work performed in the US.

If I understood correctly the money of which you speak is being deposited in the UK and he is drawing from his UK bank account. Is that correct?
