I just checked an RFE reply I sent to the California service center via Express mail. I did not realize it was going to require a signature. Now they've left a notice in the PO box that the signature is required. Do they sign those and pick up express mail at their PO Box? I'm not sure what to do now, it has original documents they requested that I need to get to them.

Please someone tell me they sign for those the next day.

On June 24 I recieved my NOA2. Now my case is being passed from uscis to nvc..correct? How long is the average waiting peroid to hear from nvc with my case number, to be able to make medical appointments and an interview date?


The California Service Center has fallen way behind on processing approved petitions and getting them sent to the NVC. If the NVC is contacted they will tell you to wait. After 15 business days you can email a scan of the approval notice and they will inquire with the CSC as to where your petition is. I'm not sure if it helps, but I'm waiting also for the NVC to receive the approved petition from California. Approval date was 6-28.

we also got RFE today from CSC. They asked for three things: more details of how we met, final divorce cert (not just final order) and additional primary evidence that we've seen each other in the last two years. We already sent itineraries, pics etc. We have credit card statements of purchases made while visiting each other and letters from family/friends. There are no stamps in our passports. We did not keep boarding passes. Any other ideas for primary evidence? Thanks so much for your help!!

We got an RFE for meeting in person. We had met twice in the previous two years. The boarding passes for both of us together didn't prove it, I've told because there was no date on them. Even though we included itineraries that were dated. The dated hotel statements showing us together didn't appear to help either. I responded to the RFE with it all plus included the stamped pages in the passport and then all was good. Also added some dated photographs to, added the date at the drug store developer because they were digital, although that was supposedly only secondary evidence. It appears what they really really want to see are the stamps in the passport. Which to me means you could have seen anyone in the country, but its what tipped the scales for us on that end I believe. I got some good advice talking to the customer service people at USCIS. Took a couple calls to get a good secondary person, but it was worth it.

To give an example of the current time frame, my wife arrived last September 8th and we were married October 15th. On the 22nd of November we sent in the AOS, AED and AP. Just today we received the notice the Employment Authorization and Advanced Parole is in card production. I guess we have up to two weeks waiting to get the cards now. This is over the 60 days, but under the 90. Ours has been a little slow compared to many others we're tracked, but our biometrics appointment letter wasn't sent until we waited the 30 days after the NOA date, and called them up about no appointment letter.

They actual hard copies of your medical needs to be matched up with your petition and interview records. This ends up in the sealed envelope you carry to and hand over upon entry in the USA.

Scoliosis is not an immigration issue. Bad kidneys are not an immigration issue unless caused by some of the active infectious diseases they screen for. You would have been referred for treatment had you had one.

They are not going to let you do the report of marriage abroad at a consulate without jurisdiction over the location the marriage took place. People have tried before and been rejected. The Chicago consulate also is not every good at answering emails. Call them, you may have to call multiple times until you get the person in charge of the ROM, then you'll get the answer you've been getting here. Just do the ROM to the San Fran consulate by mail, it doesn't take long. The you'll be all set for when you do your passport.

Caryh - After going back over more old(er) posts, we also noticed that ROM and passport renewals were done at same time by certain individuasl.  Also, some posts showed individuals doing passport renewals at embassy which was not their jurisdiction.  Plus, we recently had friend who went to embassy that was not their jurisdiction and there, did ROM and passport renewal at same time.  So we were wondering if we could go to any embassy (either in our case) and to ROM and passport renewal at same time in order to expedite the process.  Caryh, we too are wondering if different consulate workers provide different answers (opinions) -- a common thread we have noticed during much of this whole visa process.  In contrasting respect, VJ has been a Godsend to us over the years, with so many helpful persons here having "blazed the trail"; hard to beat the word of experience!  Thank you all.

P.S.  We emailed the Chicago embassy directly, described our situation, and asked if could to boht ROM and passport renewal at same time at Chicago (or SF).  Until now have received no response.

 

There is no problem doing a passport renewal at any consulate. Its the report of marriage which they get picky about. You must do the report of marriage abroad at the consulate with jurisdiction over the location the marriage took place. This is presumably because they have the expertise to know the marriage was properly done according to the laws where the marriage took place.  The Philippines is very picky about getting married properly, and getting annulled or divorced properly. Which is also why a Filipino who is divorced in a foreign country, needs to go through the courts in their country to have that divorce legally recognised in the Philippines. Divorce papers are not good enough.

You're kidding!!   That is weird for sure.

 

 We had all the forms ready when we drove to Phoenix for the outreach event, when it was our turn we handed the consulate person everything he sorted through it, stamped this and that, then we were on our way home.  Week or so later the notated copy of one of the ROM forms arrived in the mail and about a month later the passport arrived.  Very quick service all done in one motion.

 

Next for my wife will be when she does dual citizenship.  We will watch for an outreach event for that as well.

 

Well if you read the rules for a name change in a passport, the copy of the report of marriage is required to file. But in the past, most consulates have allowed both to be done at the same time. I wonder if this is a new rule, or a new person that didn't understand that reporting the marriage and applying for an updated passport can be done at the same time? Although the people working with the consulate have always been nice and friendly, I've also noticed often you get opinions and not real factual answers from some of them. Kind of like asking for directions in the Philippines, people will tell you how to get somewhere even when they don't know where it is themselves, they just want to be helpful.

For my wife when she renewed her passport it took about 4 weeks for her to get the new one after attending an outreach event.  I was impressed with the speed.

 

Took my wife's 6 weeks a couple years ago through a Chicago consulate, we applied at an outreach program in Minnesota. At the time they published it would take four weeks.

ROM in San Fran, this can be done via mail.

Passport needs to be done in person, you can't do this via the mail. So best to do it in Chicago. You will need your ROM copy returned to you before you can change her name in the passport.

I am finding out more about the PDOS situation in Cebu. We carefully read the requirements of what was needed and my fiancee brought everything that is listed on the website. Once there they started asking for information needed in the original visa application such as proof of our relationship. photos, my divorce records. All of these were attempts to get more money unless they could be provided. Luckily my fiancee is very organized and had all this material at her cousin's house where she was staying, but had to return the next day to get the sticker. After paying "extra fees" for getting one of the slots for each day (that are not reserved) even though she was one of the first in line.
 

 

There are no reservations for the CFO in Cebu. First in line is first in.

The part about the other documents and evidence comes under the "and all other evidence the counselor may need to determine the case" or some similar BS wording.

My wife has a friend who tried many times to leave the country to work abroad and was even prevented from leaving. And once that USA visa is stamped in the passport, you're right, good luck going anywhere without the CFO sticker. I suppose one could charter a boat then fly from another country, but odds of leaving through the airport are slim and none.

I'm looking for how many times a year they come to Texas.  I understand they post it up on the consulate page but they don't tell you until a month in advance of when they are coming.  I thought someone here might know how many times in the past they have done this in state.  My wife's passport expires next year and will need to get it renewed and I would rather not have to make a trip to a consulate to get it done.

Well thats not a very friendly way to do it. I guess they got overwhelmed with early questions and applications. 

A google search of last year shows they came to Texas twice, visiting both Houston and Dallas each time. It was in March and October.

No need to cancel the appointment. Your fiancee will just be given a 221g for the missing requirements, which she can mail via 2Go. The delay may take up to a few days or weeks, but still way better than waiting for an interview date, which who knows when they will eventually appear.

 

Yes definitely do not cancel. Go and get it completed. The odds of needing the LOI is very low, and worst case is you just provide it later.

That is exactly that I did.. for the most part.. as I forgot the LOI.  I had to make sure all the financial stuff to support the I-134 was there, as well as the photos I printed from my visit two weeks ago and other evidence of our relationship. We are under a serious time crunch because I foolishly accepted the first available interview slot I saw, which was June 18... and USEM didn't get our case until 6/8/2014.  I mistakenly thought that it was for the following week. D'oh!

 

So we have been scrambling to get things done. And it takes 4 days minimum for DHL to get packages from me in Arizona to Manila..  We have to ship to a cousin there in Manila because my fiancee lives 6 hours north and it takes 8 days minimum to get a package to her house, and that is with the fastest available option through DHL.

 

I called my fiancee at 4:30 in the morning (her time) today and told her she needs to go to Manila asap (6 hour bus ride) to go to do medical tomorrow (6/11) as the interview is a week later...  

 

What a crazy ride!

 

I didn't grab the first available date for my wife. I gave us about three weeks to get any final shipping completed and the medical done. Time really starts flying when you reach that point, after dragging forever before that date. Turns out there was no last minute shipments. I thought the first package sent Fedex was the only one I would need, while we were waiting for the NOA2. But my wife came up with another huge list, which I held off on shipping just in case she had more items to request. It was a smart move as she did come up with more items she wanted to have. She hit me with the comment one time, when I said she shouldn't need something, "Well if you don't mind a delay if I don't have something". Put my brain into an entirely different track of thinking. She didn't need a fraction of the stuff I sent, but I've seen women needing some of those things at either the interview or the CFO.

I just found the original one I sent with my I-129F, so I am just updating it.

The issue is getting the original to her before the interview date. It isn't likely now due to shipping times, even with the fastest possible by DHL. I sent out stuff yesterday that will arrive just barely in time, but I missed this document when I was going through the package I prepared. Hopefully a printed copy will be acceptable from me. She will sign and date and have her original with her.

That's what I did, just updated the old one on my computer and dated and signed that copy. I had two big Fedex bundles to my then fiancee, who wanted everything under the sun, then got asked for next to nothing. Front loading the petition made the interview easier on her, plus the documented 9 year relationship in the petition.

You have heard of a visa being held up for lack of the LOI?  In the last 3 years?  I have not read of anyone even being asked for the LOI.

 

It was actually more like 5 years ago. Which is why I mentioned if the CO even asks for it. That CO may have had other doubts about the relationship, and that was just an excuse to check that they were still in contact.

I'd write one up, sign it, scan it and then drop the original in the mail as well as emailing the scanned copy. She can carry the printed scanned copy if needed. I've heard of them not being asked for it, and I've heard of the visa being held up until one is provided. It should be an original, but they might cut you some slack if its not, if you get a CO that asks for it.

 

Just say I "your name" intent to marry and spend my life with "her name" within 90 days of her arrival in the USA. Date and sign. its not a complicated document.

Hank is discussing this in the Philippine regional forum, with another going to the Manila embassy. His comments are not meant to cover all embassies, just what works in the Philippines. 

A copy of the I-129F is not required to be turned in by the beneficiary during the interview, but the beneficiary should be aware and know everything that was included in the form that was submitted. And that goes for any embassy. Do you really think they might not ask questions based on it?

Some of your points are true, and some are not. For example a whole copy of I-129F is not needed at interview. But you are wrong about the evidence of support. Tax returns only is not enough. They need something to prove continuous income to support. For example, check below what is required as evidence of support from US Embassy in Abu Dhabi: (Mentioned as Important Required Docs in the Interview Letter from the Embassy).

 

EVIDENCE OF SUPPORT: Evidence which will show that you and your children, if any, are not likely to become public charge in the United States.  An affidavit of support Form I-134 should be completed by the petitioner and submitted with all supporting documents - current salary letter, current bank statement and 1040 tax form for the most recent year.  A joint sponsor would also be required if the petitioner is unemployed.

It seems that you are generalizing your experience to all US Embassies around world. Requirements sometimes differ from one embassy to another, although they are all US Embassies. 

 

VJ website has done great job compiling anything might be asked by any US Embassy around the world. Hence, I think the VJ guide is amazing and what you consider redundant in it, is so required and important in other US Embassies.

There has been no change to Article 370 of the New Family Code, so its not a matter of the Consulates sticking to old ways.

When you get citizenship in the USA and the USA allows you to legally change your name, the Philippines will accept that name for dual citizens, even if it is not in compliance with Article 370. But as long as you're exclusively a Philippine citizen, you're stuck with the surname of your adopted father, unless you want to be known as Mrs "husband's name". That's your only legal way of dropping your adoptive father's name in the Philippines until you get USA citizenship.

I know I wouldn't and didn't! But some guys don't stand up to them either. We only had great experiences with the people there. Everyone we dealt with was an immigrant themselves. When my wife had her green card, we went to remove the note from her SS card, the agent even got USCIS to correct her name in their system. She had her green card in her married name, but somehow the system where other agencies look up the status still showed her maiden name. The SS agent said don't worry about it, he's putting in a request to correct it and we'd get her card as soon as it was done. He even got back to us when it was changed in USCIS's system. You don't see that kind of service from government agencies too often.

 

 

Who would send their wife to SSA by themselves... ?  

 

We had zero issue, but if someone does get a line of sh!t from a pimple at SSA they just need to push back some as they are voicing personal opinion not SSA reg.

As for petty bureaucrats at SS... ask to speak to their supervisor, there is no restrictions stated by SSA.

 

Unfortunately supervisors can be petty bureaucrats to. That and some people are afraid to stand up for themselves and just go with whatever bureaucrat they're dealing with says.

I remember when I first got my drivers license at age 16, the woman at the DMV said I couldn't use my signature and made me sign in a way I had never done before or since. I didn't argue, I just wanted that friggen license and did as I was told. So I can understand how a new immigrant can get caught the same way.

When we started this stage of our journey we completed the SSN right after our wedding, this was done in the traditional Philippine way (states have ZERO say so in how this is completed), then we started the Adjustment of Status using the name as on the SSN, once we received the EAC my wife got her driver's permit with the name as shown on her SSN card and EAC.    Following this process the states had little they could say about how the married name was done.  

 

I've noticed petty bureaucrats even at SS like to try and dictate how a name can change with marriage. We got my wife her SS card right after the wedding with more than enough time on the I-94. We chose the standard Filipino naming convention, but we also had the advantage of our state including the names before and after marriage right on the license and certificate. There's no room for a bureaucrat to treat their opinion as the law that way. The "You can't change the middle name with marriage" bias seems to be pretty common around the USA.

Article 370 does not control what name a Filipina can have after marriage.  It's only advisory.  If you'll notice, Article 370 states: "A married woman may use:"  For example, upon marriage, a woman may use her maiden name.  Case law has settled this issue.

 

Also, RA 8239 does not address the issue.

Actually I do. They took a married name form in the USA that is not allowed in the Philippines. They were not allowed to get a passport in that name. This has most commonly happened when someone in the USA refused to let them move their old surname to the middle name position, resulting in the the maternal name being kept as the middle name in the USA, rather than replacing it with the old paternal surname. Usually they've ended up keeping the Philippines legal name as the old maiden name in the Philippines. And yes I'm aware, case law gave a woman the right to use her maiden name after marriage, but wrongly formed names are still not legally allowed without a court order. 

 

RA 8239 gives the conditions under which a passport may be amended to a changed name other than the birth certificate name or when an AKA may be added to a passport.

I don't agree with you.  Once a woman is married she has only one legal name, and that is the name she uses on all her official documents; SS card, driver's license, U.S. PASSPORT (!) .   Now to use this name on her Philippine passport she will need to report her marriage in the Philippines, then she can get her new passport issued in her MARRIED name.  

 

My wife did this process just a few months ago.

 

Article 370 of the New Civil Code controls what names a Filipina can have after marriage. 

Art. 370. A married woman may use:

(1) Her maiden first name and surname and add her husband?s surname, or

(2) Her maiden first name and her husband?s surname, or

(3) Her husband?s full name, but prefixing a word indicating that she is his wife, such as ?Mrs.?





 

The Philippines is not supposed to issue a passport in a name that does not follow Philippine law. I have heard of occasional cases where a name other than specified by the law have slipped through, but also cases where its been rejected. Like many Philippine laws, sometimes its followed and sometimes its not. 

You can say a woman has only one legal name, but she can end up with one legal name under USA law, and another legal name under Philippine law. My wife went through the process of registering our marriage a year ago, then renewing her passport under her married name. But we made sure we followed the Philippine naming convention and laws so there would be no conflicting issues. 

 

Republic Act (RA) No. 8239 controls more of what can be the name on the passport. But basically it comes down to the full legal name, under Philippines laws.

I was originally meeting my fiance in Cebu for a couple weeks, to meet her family and her in person.  However, she took a job in Macau to help pay for her siblings school, it pays about 4 times what she'd make in Cebu.  Her new job is great, but turns out they don't give much time off. 

 

Does this complicate things if I meet her in person in Macau instead of Cebu?  From what friends told me, meeting family is important. 

 

I just want to make sure after I come back, I'll have no problems with the k-1 visa.

:yes:  ... Whenever one renews a passport, a NEW passport number is given. The OLD passport number will be cancelled / removed / invalidated in the DFA system. It's easier now that they use RFID, they can simply scan the electronic passport and once accessed in the system, all the information therein can be deactivated in the database.

 

The physical alterations mentioned by Yannix are just old tricks by Philippines (DFA and Immigration) for them to easily see that a passport is no longer valid.

 

Her old was not an electronic passport, and it was not defaced in order to invalidate it, is all I was saying. Her new passport does have the electronic RFID chip, and biometrics.

Figured out the difference in the two different types of maroon passports. The old ones we machine scannable, but had no RFID chip or biometrics. The new maroon passports has an RFID symbol on the cover, are remotely readable and contain biometrics data.

They never take your old passport away. They will only "cancel" your old one. The cancellation methods have been different throughout the years. They used to use a two hole puncher (sometimes all pages, sometimes half, sometimes only the covers). The last one, they cut a nice size triangle on the back cover.

Did your wife happen to have the new maroon (the one with an RFID chip supposedly)? Maybe they invalidate that without leaving any physical damage to the passport.


 

Both of them are maroon, but they're different also. Without having them in front of me, I couldn't explain the difference. The new one is supposed to be the RFID one, her old one supposedly did not have the RFID tag and was going to expire in less than a year, so she'd last renewed it 2008 I believe. The one before it was green if I remember correctly. We renewed her passport at an outreach program, they did not punch any holes or cut the cover or anything. I also saw nothing that would have been able to disable an RFID chip anywhere that the old passport was looked at. This was an outreach program, and they were only using folding tables, so it would have been tough to hide anything.

Regarding "New passport due to change in name" or "Renewal of Passport"...(specifically for the Philippines Consulate General in San Francisco as they have jurisdiction over Seattle, WA (ours), one has to make an appearance IN PERSON. As for ourselves, this wouldn't be feasible, economically or otherwise. Obviously I/we don't know which consulate has jurisdiction over your area, so check their website. My understanding is that this requirement applies to ALL consulates but I/we could be wrong.

 

 

You're correct that all consulates require a personal appearance now. I believe all the consulates have outreach programs to reach their far flung citizens in their respective area of responsibility. And I'm fairly sure I've heard of the San Fran consulate having those in Seattle, WA. As long as you keep tabs on where they're gonna be, there's usually not the need to travel quite so far.
