Hello guys,

I called uscis customer service and received a mail saying that my biometrics is current and not necessary for me to appear at an ASC.

and they will contact me for any needed info, so waiting time now starts hope not longer. 

 

From your timeline , your last bio was

Bio. Appt. : 2011-12-20

 

That's over 2 years, and the previously published time for a bio to be current was 15 months. Something must have definitely changed in the middle of April.

I spoke to a Tier 1 person and she said that my case number would be the same as the receipt number (on the NOA) and that it would eventually be searchable on the website.

What format are people's case numbers in? The receipt number on my NOA is in the format: EAC-XX-XXX-XXXXX.

The Tier 1 person was actually pretty helpful compared to other experiences with Tier 1 personnel. I did ask to be put onto a Tier 2 person, but then she explained what I mentioned above. I am not convinced that she is correct.



 

Yep your actual searchable case number comes with the bioleter. That is unless half the people here are going thru some new change in policy about the biometrics not being needed it you went thru AOS here. My wife did the AOS here, and she had to do the biometrics last month. I put it down to customer service people lying again just to get people off the line.

My wife and her Filipina friends call us Americans foreigners  :lol:  I understood it back in the Philippines, but its so funny to hear it when they're all here in the USA now.

Thanks for your comment. I actually checked May threads a couple of times and I found out some of May filers got their bio letter even though their NOA1 issues after us. I wonder my AOS experience matters or not. Your wife got her bio letter even though she went through AOS, right? 

 

Yes she did. She came on a K-1 and we adjusted her status. Her AOS biometrics was on January 5th, 2012. We got the bio letter for her ROC and already finished the biometrics in april. I believe we were the first in this thread to get the biometrics completed, as we went early.

This seems to be the case with all the people who got their status adjusted after coming to USA.

 

Correction, this has been the case with some in this thread reporting they do not need the bio. My wife adjusted status in the USA and she did receive the bio appointment letter and we have already accomplished the bio for her ROC. If such is the case, this is a new development, as a biometrics is only valid for 15 months. And if you're applying to remove conditions, you've have a green card for at least 21 months before you can apply to remove conditions.

Update!

I rang the USCIS after 30 days of receiving the NOA and the Tier 1 person put in a request. The next day I got an e-mail saying that my Biometrics were current and that it is not necessary for me to appear at an ASC at this time.

That is good news, I think.

I don't have a case number to check the status online though. From reading this thread it seems that you get that number with Biometrics correspondence.





 

Yes you do. I'd call again and ask what the case number is so you can track it. This whole your bio is current when its two years old is really surprising me. Something must have changed just in this past month. Or USCIS customer service has taken to lying like rugs.

I don't see any problem if Nevin and Nene815 stay here. They clearly sent their application on April & it's not their fault USCIS messed up. I think they belong here with us. :)

 

It wouldn't hurt them to watch both threads, as they're close to both. I know I intend to be keeping an I on the March thread, as we mailed on April 1st.

Ok. Did you trying talking to Tier2 people?

 

I ran into the same thing during my wife's AOS, when the bio letter never arrived. Had to wait 30 days from NOA1 until they could put in a service request. Another person at the same time did the same, and the bio letter still didn't come, and they had to wait another 30 days again to request a second time.

Well! i think i'll have my wife call USCIS.

 

I wasn't aware of these scenarios where people adjusting their status in USA do get exempted from BIometrics.

 

Unless they're just now making a change to that, then this is not the case. My wife adjusted status here in the USA,  and we were just required to do her biometrics for the ROC. We mailed off her petition in April also.

Ohhh! Interesting. In that case why USCIS told Peterandrobin they don't require Bio? I was suggesting Nevin based on that.

 

I find that interesting to, and have no idea why they do not need the bio. Unless for some reason its less than a year old, or maybe someone just screwed up.

@ Nevin- I totally agree with Peterandrobin. You should call. I will suggest call today, make a service request from tier 1 people then ask for tier 2 department.

 

Ask your case # from them. I don't think you will ever going to get your Bio letter. I'm assuming those who (Adjust their Status in USA) already did  fingerprint

 

here so USCIS already had their fingerprint in the system. That is the reason you are not getting your Bio letter. On the other hand, those who immigrated from

 

another country had to do Bio since they didn't do their Bio in states.

 

Note: I noticed you and peterandrobin both did Adjust of Status. So you both should fall in the same category of no Bio required.

 

My wife adjusted status in the USA, went through the biometrics here, and still had to bio for ROC. I had heard, a bio is only good for one year. I can understand the photo part, but why the fingerprints to? They did take my wife's finger prints again, which is why I joke they're verifying I didn't swap her out for another.  :lol:

Just a small UPDATE: I called USCIS this morning to verify if there is any problem with my fingerprint & signature. USCIS confirmed me there is NO problem with my fingerprint and signature as for now. Feeling a bit relax and happy. :goofy:

BTW, I was on the phone for 3 hours to get to talk to Tier 2 representative. :sleepy:

 

Its so fun when you have to wait so long, then get a no answer from customer disservice. Glad you at least got an answer. My wife will ask me to call for her, then an hour later will ask why I'm on the phone.  :bonk:  :lol:

So we show up and leave and then what is the next step? They see if we should come in for an interview and if not we'll get the 10 year card? Am I missing anything? :blink:

 

I've heard when Vermont is far behind, historically they start throwing out RFE's as it resets the clock and keeps their processing time look better. Just respond with more of the same stuff you first sent, and then the approval follows. But make darn sure its not a legit one where you did miss something.

Interviews are not that common for the ROC. 

So its mainly a waiting game for RFE, or approval, and the occasional interview for some. Looking at the VJ stats, maybe 1 in 20 get an interview.

So what now? Any preparation? Or just show up? What are they testing for?

Online says the whole thing takes up to 6 months for both Vermont and California. Wohoo. 

 

The wait for biometrics letter begins.

That is your NOA1 and your one year extension letter. Keep that document safe, it's what proves your legal until your new card comes, after the current one expires.

 

I may be having a nervous moment here, but I was so happy to finally receive my NOA1 (or what I think it is) but then I read it and I'm confused:

 

Is this considered the NOA1??

Your conditional resident status is extended for a period of one year...blah blah blah.

You are right they wouldn't be that nice. I'm assuming since they chased his check they might accept or made a decision. He may find out within this week.

 

This would be a bad thing if his petition is accepted outside the 90 day window. He may have to prove he had good cause to file outside the window, and being mistaken is generally not considered good cause to USCIS. Or possibly they have cashed his check and denial is already coming giving him time to reapply in the window? I'd say make that infopass now. By the time he gets in, whatever is happening with his petition should be in the system for them to look up.

 

 

(2) Period for filing petition.- 

(A) 90-day period before second anniversary.-Except as provided in subparagraph (B), the petition under subsection ©(1)(A) must be filed during the 90-day period before the second anniversary of the alien's lawful admission for permanent residence. 

(B) Date petitions for good cause.-Such a petition may be considered if filed after such date, but only if the alien establishes to the satisfaction of the Attorney General good cause and extenuating circumstances for failure to file the petition during the period described in subparagraph (A).

I would say don't do anything and wait. If you don't hear anything from them this week then book an infopass next week. Who knows they might overlook your early filling OR they realized since they didn't send you any response on time & now you fall in the 90 days timeframe, they might accept your case.I might be wrong but I would say wait this week. Call USCIS today and ask them what's the update on your case & if they send your NOA yet. :)

 

You think they might be nice enough to have hold his petition, and issue a NOA1 once the 90 days started? Would be nice of them to do that, but I wouldn't be holding my breath that USCIS would actually do something like that.

:(  Not good news. Yes you should be calling to find out what to do. Applying early leads to a denial, but you'll still need to apply within the valid time span. I'm not sure how you go about that with an open case now. Maybe make an infopass and speak with your local. Somehow you need to withdraw and refile. But your money is gone if they cash the check.

Well thats at least a positive, you want them to return it all to you, and not cash the check. You filed at Vermont, and given how slow they are to get out NOA1's, returning a petition is probably worse.

i sent my ROC i751 packet few weeks earlier than my actual eligibility date. 

I misinterpreted the notification from USCIS which was sent almost a month before my eligibility date.

 

 Its been close to a month and I'm expecting them to send my package back.

 

How long does USCIS take to send the packet back??  I hope they don't take more than 2-3 months.

 

MycConditional GC expires on Aug1st.

 

 

I've read of cases where they do not notice that until they actually go to adjudicate the petition. Have you received a NOA1 or was the check cashed yet?

Actually I know someone who was visiting friends in Canada from the UK. They were going to help with a few renovations in their home, CBP questioned the guy and he told them just that, no payment of any of the sorts.  He was told that no matter what helping is still considered work if he wants to visit he must stick to visiting no helping or he will not be let back in.  

 

Yah I'm sure if he showed up with a toolbox full of tools, all sorts of alarm bells would go off. After all they could hire a Canadian contractor to do that work.

Actually they cannot come to Canada to help, it is illegal and can lead them to a ban also. Just because they haven't been caught doesn't mean it's allowed. 

 

I kind of thought so. I've heard of people in my line of business getting into trouble crossing the border into Canada to work.

I'm certainly learning a lot by reading this thread. However, I am Canadian and familiar with Canadian laws, not US laws. In Canada if someone comes up here from the US to help someone without being paid, there isn't a penalty for it. I personally know many people who have helped friends and family do renovations etc from England, USA and other countries and they can still come back to Canada.

 

My friend in the US wasn't aware of this law either, and he should have done some research and informed me from what I'm gathering here.

 

Nonetheless there's nothing I can do. I can file a 212 waiver, but from what I researched it's like basically making a $585 donation because getting the waive is next to impossible and even with the waiver they can deny me entry without a valid reason.

 

It seems that no one can make a mistake and everyone from other countries needs to know US law before visiting the US. And you have no rights in the US if you aren't a permanent resident or US citizen.

 

That sounds about right actually. Not being aware of the law, I kind of doubt would get me off the hook if I visited Canada either, if I got caught breaking one. 

I think visiting someone and giving them a hand in their personal home is a lot different than visiting someone, helping them set up a business, including professional documents about your professional standing and certifications to display in that business, is just a slightly different can of worms to. Too bad you didn't scan them and email them. You probably wouldn't have set off all types of red flags at the border.

USA law enforcement officials are allowed to lie to suspects in order to get a confession. This is standard operating procedure now. 

The work you intended to do, was work that could have been paid for had you not done it, and you yourself admit one day you hope to work for him. You cannot do work for free that takes work away from a citizen or legal resident. You also cannot do work that would normally be paid for in the hopes to one day be working for pay when you can legally work. Your chances of fighting this and winning are equal to zero.

Similar thing happened when my wife went through her K-1 interview a few years ago. She had about 4 inches worth of evidence, they only took a couple sheets from her and didn't even look at anything else she brought. Our petition was fairly front loaded so the entire interview seemed more a formality than a real interview, with the CO making comments rather than asking questions and my wife confirming them. He didn't even look at a single photo she brought, and she'd done such a nice job laying them all out with descriptions and dates. She was really relieved it went so easy on her though, she was very nervous before hand.

Yes you want to have the biopage included. They actually say to copy the entire thing, but I just copied the biopage and the entry and exit stamp pages. I was visiting her in her country though.

They don't really care about this type of evidence at the petition stage. The proving ongoing relationship comes during the interview. The photocopies of your passport proving meeting in person during the two years previous to filing is very important though.

They will continue to attempt delivery for so long. With the USCIS it is standard procedure to note delivery attempt one day followed by signing for the letters the next day. I guess they build up a list of all the letters requiring signing and one signature is used for the entire list then. It could be your embassy has the some process, and Monday it will be signed for.

My form is exactly like you said above. I was wondering because I read through the medical thread and no-one else had raised this issue, so I thought it was maybe nothing to worry about.
Just wondering why she put I had to have the boosters in 8 weeks? If I don't have to have it, that would be great I hate needles :)

The need for boosters are the vaccines are not fully effective unless the booster is gotten after the required time. That is a medical issue, I'm not sure how USCIS sees it, but if you want the full effect of the vaccines, get the booster regardless.
