I'd just write the letter again. It worked with the 2 year green card, why would it not work with the removing conditions? They have the previous documents you filed. Everything you send to them, they do keep. Getting a copy back is not easy, but they can get to it if they have the need. You really should save copies of everything they send you in the future, but I think you're already kicking yourself for not doing that  :lol:

As you're probably not going to be filing a joint removal of conditions, you'll check the box for the divorce waiver. And as your divorce will not be final yet, you'll still need to file in the 90 day window before the your green card expires. You should be working on gathering up all the evidence of a valid marriage during this time. A divorce attorney should be able to assist you in getting the documents she is keeping from you. Your immigration paperwork is still your immigration paperwork. Although this might be a bit futile if she's destroyed them, she could still be held accountable for the cost of replacing some of these things, ie green card, passport etc... If its gotten this ugly, its certainly time to lawyer up and let him handle the divorce while you concentrate on getting things together for the removal of conditions.

Yes, I will do that, I did the same thing at first. I also ordered official transcripts from IRS by mail since online downloading and printing might be questionable.

 

You can't really tell the difference between what they send and what you print. I had ordered them before when you couldn't print them online and they look identical to the ones I've now printed from online.

I'm getting a lil bit nervous about this lol, what if still insufficient to them? are they going to reject it? or send to interview? I gathered more evidences like gift receipts, greeting cards, transcripts, w2 copies, photos, invitations, more cable/phone bills since I only sent just couple copies at first, another affidavit from a friend who witnessed our wedding and been hanging out throughout the years. still thinking what more to add.. if none, i'll send it by last week of this month.

 

Make a list of everything you're sending for the cover letter. Give an explanation of things like no lease, and note how each item sent shows what they're looking for. Sometimes the adjudicator isn't too bright and needs to be lead through what the evidence means.

I don't have any life insurance or retirement :/ I think those on the list is all I have right now. I'll make a cover letter explaining why we don't have mortgage or lease and about health insurance which we can't make adjustments till next year.

 

Not much you can do other than adding just more of what you already have then. Funny some seem to fly through this step with no issues at all and little evidence, yet you get an RFE. But a number of years ago Vermont was big on giving out RFE's simply because they were behind on ROC applications and it reset the clock, making their response time look better. People would be confused as what else to add, and send all the same stuff plus a bit more of it and get approved.

Anything else I can add? we do not have insurance on both names but we are going to combine it next year. We only went on travel once and I saved one hotel receipt but no both names on it, Does that count? how bout gift receipts?

joint title on a car is something we sent also. 

Mailings showing both living at the same address are good, even if addressed to you separately. Adding in those joint accounts and bills are going to help to. Sounds like you were just a little light on the hard evidence of living together and commingling of finances. Fill it in heavier and I'd guess you're going to be OK, and of course re-send copies of the things you did earlier just in case it didn't get with your file the first time. 

One thing I don't see that you might add, we had photocopies of cards we had given each other, and holiday cards that were mailed to us. Also every picture we sent had accompanying notes about where and when it was take. This was spaced over the two and half years since her arrival. All was put together with a cover sheet listing every item included.

Bank statements were picked at one every 4 months over two and half years. I think its good to make it clear the evidence is spread out over time, and not just what could have been grabbed in a tiny window of time.

Thank You! However at my NVC stage, i used my wife as my sponsore and also my sister in law as an additional sponsor (not household) for my petition.

 

Now the situation is that I work full time, my wife does too, so she will update the address too, but my sister in law does not work anymore, so does she still need to submit i865 - Notice of Change of address of sponsor ?

Until you've worked 40 qualifying quarters or become a citizen, she's required to still file a change of address.

So congress passed a law stating they should only get two year green cards, with the condition they prove they had a valid marriage when it was time to renew that card. When these conditions are met, you get a 10 year green card.

Thanks, everyone. I think we'll probably just file right away 90 days out and  then have her take the trip in March, hoping that the biometric thing comes either before March or after March. A little risky, but I imagine if you get the notice to come in for biometrics that there isn't an imminent deadline on it, right?

 

There is a deadline, show early and get in, or go by the date. Failure to show can cause issues. Are you applying to California or Vermont? Currently California is very fast, and Vermont is very slow.

My wife's ROC was approved before her green card expired. The new card arrived about about a week after her old one expired. There is normally a biometrics appointment which she will need to show up for. Interviews are not common on ROC applications, only a small percentage seem to get them.

Ah the wonderful extension letter, which doesn't come on any type of NOA form, but came on a standard white piece of paper that anyone could type out and print at home. But people do re-enter with them with their expired green cards. Personally it would make me rather uncomfortable, but presumably CBP can look up her status in order to know the letter isn't a fake.

I'm assuming you've filed for the ROC, please fill in your timeline.

The NOA 1 extension letter for a ROC application, does not have a case number that can be looked up. Your case number will change when you get your biometrics appointment letter, and that number can be looked up online.

What seems to me to be missing from this thread is your wife's desires.  Not that you are obligated to her to indulge them, but she has rights.

 

Remember that your I-864 obligation only applies if she receives means-tested government assistance, and as an undocumented immigrant that will be harder.  I don't know anything about special status for Cubans, but if she has a way to stay in the USA other than as your sponsored spouse, that could extend the I-864 obligation.

 

If you don't go for biometrics and don't reschedule, the I-751 will probably be deemed abandoned and she will lose status.  I don't see how that's different than getting biometrics and getting ROC denied later on.  Either way she'll have status revoked and be placed in removal proceedings.

 

The big question is what does she want.  If she wants to go back to Cuba, that's probably your best solution also.  Let the whole greed card thing go, she returns to Cuba, then with no status and she's not here, how will she get back?  But if she wants to stay, she has lots of ways to stay.  It seems likely to me that if they try to deport her at some point and she wakes up and says she wants to stay, she'll probably get a chance.  If I were an immigration judge and a non-driving, non-English speaking defendant came before me and said (en espanol) "I didn't know what was going on, my husband didn't take me for the fingerprints, I didn't know what was happening, we were getting divorced and he just wanted to make it harder on me" I might well give her another chance.

 

Your best bet is clearly to encourage her to leave and make it possible - if that's what she wants too.

 

It appears to me from what the OP has said, he does care about what she wants. He even mentioned if she wants to return to Cuba and not return. He also mentioned in reply, he would not like to see her deported. My guess is currently she's not speaking with him over some argument, and he's not currently getting much about her wishes right now.

As amazing wrong as this might seem, a former legal resident who loses legal status and stays illegally is still the responsibility of the original I-864 signer.

I think that is pretty correct, but how long are removal proceedings, and when do they start (i.e. deportation)?  I do not want that to happen in any case.

 

That is kind of what I was looking for (in an informative way...not negative).  Would Sponsorship end if conditions aren't removed, and residency expires?...Thank you.

 

Cuba is a problem though, as they are the only country that has "wet foot - dry foot" policy.  I'm not really concerned about that though in our case...she misses Cuba too much.

 

They may not even bother with removal proceedings. But if they do, it will not be until some time after the petition is adjudicated. If you don't want her deported, get her to the biometrics appointment and let her finish removing conditions. You've paid for it after all. If she wants to return to Cuba and not keep legal resident rights, then get her a ticket before the case is adjudicated. 

Given the special status given to Cubans, she may be able to change her legal resident status based on her nationality even if removal proceedings begin. But if she wants to stay, why not do so based on the ROC, its already paid for?

I just called USCIS, a tier 2 officer said now the process could take 6-9 months because of the backlog, other than that, there is nothing more about my specific case. 

 

I was like "What the hell? You are telling me 9 months now?!", I don't know how some people on this thread could find out the EXACT whereabouts of their cases. What I got was "nothing new, sit tight, shut up and wait!".

years ago when we got the NOA2 for my wife's K-1, the CSC suddenly started waiting 30 to 60 before sending the case to the NVC. CSC had been really fast at that time on K-1 approvals and just a couple weeks before people were getting their embassy case number within a week of the NOA2. As it dragged on waiting, it had reached a month, I had a USCIS support person ###### me out for asking when they would forward my case. Apparently since CSC had processed it in only a little over 3 months, it was perfectly fine if they took another 3 months to send it on to the NVC. She then hung up on me. I've never had a more surly customer service rep in my life, in fact I started laughing my butt off about it and just called back to get someone slight more helpful.

Services requests do nothing but generate return letters saying yes we have your case, wait longer. Unless for some reason they don't have you case, in which case they just tell you sorry we don't know what you're talking about. If you're more than 30 days over the published processing time for a service center, getting a congressman or senator involved is the thing to do, as a service request will just say to wait longer, resetting the clock on when you can get a representative involved, who do often seem to be able to make something happen. Not because they really have any control over, but USCIS doesn't seem to like getting their attention.

yep its a privacy issue. only the petition can talk to them unless you've specifically filled out a form for someone to act on your behalf. Or the petitioner is there and says the person talking is acting as their interpreter. 

 

Its a bit weird when you think about it, we have to prove we're husband and wife, living a life of joined responsibilities and trust, yet they say our spouse can't be trusted  :lol:

Please add me filed on April 07 2014 to Vermont Service center. I called today and mentioned it is more than 6 months, the guy told me that a USCIS officer is reviewing my case right this moment??? And If I didnt hear anything by next week Wednesday to give them a call back

 

It was strange, how does he know if an officer is looking at my application right that moment?

 

They get rated on how long a call takes, the shorter the better, and he got you off the phone fast.

The RFE letter will give you a deadline that you must respond by. If you wait until after, likely your denial will already be in the mail to you.

So I just want to confirm that with the extension letter, can my husband travel out of the country? What about renew his state ID? The DMV can be so dense when it comes to dealing with these issues, we had a problem getting his ID with a greencard, so renewing it I'm sure will be an even bigger ordeal if at all possible. 

No trouble traveling with the extension letter and expired green card.

The ID is an entirely different matter though. States control who can get an ID under their own laws and rules. Get a poorly trained person at the DMV and it can be a real headache to get something done. Too often when they don't know, they just say no. I would arm yourself with the rules on ID's and Drivers licenses, printed out, before going in if you've had trouble in the past.

What I am missing here. I never called in and followed up with my case. I only made two appointments and talked to the agents at infopass in May and June 2014 and one of them told me, too early for my case. And I looked up my case online, I could not find it, not in the system. I am so worried now, since I have not received the bio letter, nor anything from them. I have my driver license renewed from the one-year notice letter. what should I do? thinking to make infopass appointment again?????

 

On the list it says you filed with Vermont. Vermont is many months behind California on removing conditions. The number you get on the NOA1 letter can not be looked up. Until they make a determination on you needing a bio-metric appointment, no case number that you can look up is available. Calling and getting to a Tier 2 agent may get you the case number, if you don't get a lazy one.

CSC is awesome! ROC filers dont have to go through this hassle.

 

It was close, my wife's approval came a few days before her two year card expired, but the card didn't show up until a few days after it expired. Luckily our state removes the immigration status check requirement once even the two year card is obtained. I'm not sure if they'll double check her green card on the regular license renewal, but I suppose we'll find out in a couple years. At which point she should be a citizen.

Thank you for all of your replies and suggestions.

 

He went to get his driver license renewed yesterday and they asked him for his most recent I-797 form.

 

He did not have it yesterday, so he took it with him today and was able to get his license renewed.

 

Funny how none of the other papers showing his legal residency, such as our house deed did not matter nor his social security card, just the I-797.

House deed does not prove legal status in the USA. Even people with revoked legal status can still have their SS card. Only an unexpired green card or I-797 can prove legal status in the USA.

Really sorry Vermont filers, this looks like really bad news. Saw the link posted in the March filers thread. 

Vermont is processing about 1000 I-751's per month while taking in near 9000 per month. No wonder they're so far behind California right now.

I found it strange my wife's card wasn't extended to 10 years past the expiration date on the last card. Sure it was only three days short, but I thought is would be ten years added to the first two years. I suppose it makes sense if the approval comes after the first card expired though.

Tracking my wife's green card in the mail. Current status is it reached the local post office yesterday afternoon, so we should have it in our mailbox today  :joy:

 

Strange thing on the USCIS tracking page, after the card was approved, the indicator never went to approved, they're all the grey now. Just looks weird, but maybe it goes along with the plain paper approval letter  :lol:

Don't worry too much. I got mine on plain paper too. Plus, my full name was not on it, just the last name. All the extension letter, biometrics appointment and approval notice came in my last name only. I didn't bother to question. 

 

Green card came in my full name. 

 

I'm not worried, just thought it was really strange. Also not her full name, first initial and last name only.

I'm guessing they'll be done at California, before even the first Vermont applicant gets the approval. I feel bad for the Vermont folks, but at least we're all with our spouses and everyone has their green card. Its just getting throught he worry of will you get an RFE or interview thats the big issue waiting.

My wife got a letter from the local confirming her approval. It really weird though, as its on plain paper and not the usual 797 form. I don't think we've ever received any letter from USCIS that was on just plain paper. We were worried until we opened and read it as it seemed so strange to have a plain paper letter from them.

it Would be great if we had the situation where CSC and VSC were at least processing the same month. Looking above, CSC is processing in less than 3 months,  couldn't they take some of the backlog from VSC and make the field a little more even :-(

But when those Dream Act kids start renewing their EAD's shortly, I think these numbers are going to flip pretty quickly.
