A marriage certificate is even more redundant in your case.  You wouldn't be divorced if you had not been married. 

 

But when filing an I-129F, they require a divorce decree for every divorce, so it appears they like redundancy.

Only if you're from Canada. :lol:

We included a copy of the marriage cert, it was on my wife's list of things she wanted. Although it makes little sense, as even they know you would not have a conditional green card unless you already proved the marriage.

No passport photos required. If there was, we're in for an RFE also.

Oh i remember reading your post about contacting the congressman in 2012 when I was so anxious and frustrated waiting for my AOS. If my memory serves me right, your wife case was approved in July or so. Mine just sat there forever. Then in December our congressman's aide contacted them. Not sure if it helped or it was just a coincidence, but my conditional green card was issued just a few weeks later. California Service Center seems to have revived since then. Let's hope so. 

 

Yep I was staying on them like white on rice to get that green card done. It kind of sucked that just a couple months earlier they were processing AOS in 4 months and suddenly just stopped doing any for months, letting them pile up. I don't know how many people ended up over a year because they did nothing. Recently noticed a post by a guy who applied to AOS back then where it went two years. He kept believing the disinformation live that said just wait. Two friggen years is crazy! 

I'm a little irritated with the post office today. I paid extra for tracking, but when I checked two days after mailing, it said not in the system. What the heck? They asked me if I wanted overnight or is two to three days OK. So I picked the two to three days as long as I have tracking because I figure its not a big rush. Well today is day three, we'll see if its being tracked yet.

Well if thats the case, next time you're in the area, slap one of them for me, for how long they took to get my wife's AOS done two years ago. :lol:

I'm hoping they've got it together a little better this year.

My GC expires July 6, 2014 so i guess im part of this thread. It's been. a while since ive been here in VJ. To start this thread, i have a question regarding the mailing part. My documents came out to he about an inch thick of papers, does anybody know if fastening the documents in two or three batches is fine? or shiuld i just use a clip binder on the side. I really cannot remember if i did this with my green card application two yearsago. please help and good luck to us all! :)

 

We just used a clip binder with a separate paper clip for the check.

I believe its ended up dd/mm/yy because the first person to enter a date entered it the way many countries do, even if in the USA we generally put the month first.

I hate to bring bad news to people but   Vermont is having a severe backoder now.  See the official interpretation below:

They narrowed down the flow since september 2013 and have processed 1000+ cases a month while accepting 9000+ cases/month.  

CSC is acting normal up to date.




 

 

That looks like what CSC did with green cards back at the end of 2011. The applications kept piling in while the number worked on dropped to a fraction of historical processing numbers. Took over a year to clear out the backlog I-485's back then.

My greencard was just Delivered, exactly 3 months since I filed my ROC! AWESOME timing and it Feels great to have it in hand!

 

Now the count down is on to Naturalization, October 4th 2014 only a couple of months to go, can't wait until this process is over  :joy:

 

I'm sorry to give you bad news, but you need to be a permanent resident for three years, minus the 90 days plus married to a USC for those three years in order to apply for citizenship. Its not all that much longer at least.

This is NVC we are talking about not USCIS. Yet yes both do lose paperwork, I mean I can't even imagine 10's of thousands of petitions on my desk and I misplace, spill coffee or the fan blows that paper away.  It happens. But the lawyer clearly said they didn't send it no mystery here.

 

I'm quite certain USCIS lost parts of our petition. I didn't even think twice when they asked for something already included, I resent it with more proof just in case.

NVC does make mistakes.. They lost my wife's passport pictures, they rejected my Affidavit of support co signer's Puerto Rican birth certificate because they claimed it was invalidated. It took me several days and several hours of arguing with the Department of State and supervisors and when I finally got the right person to verify the actual invalidation date was pushed farther out and that the birth certificate was technically still valid and they accepted it. Just to be safe I had him order a new pr birth certificate online through vitalcheck and we had the new one ready should they ask. So long story short though rare they do make mistakes, everyone makes mistakes. Lawyer or NVC. The biggest thing is to respond to the RFE ASAP.

 

They do, but this lawyer appears to have made the same mistake with all her clients, as she's saying the NVC doesn't need the police clearances. Its dangerous to have someone doing the work for you, and they're deciding the NVC is the one in error, and her clients need not answer the request from the NVC. 

At least the op is smart enough to come here and double check, her other clients might be waiting quite a bit longer.

I immediately contacted our Lawyer to express my concern regarding this email and her response is that everything she has submitted is correct and that this is a mistake on behalf of NVC who are apparently sending 'template' response emails to visa applicants. She said several of her other clients have also received this notice and she will contact NVC asap to 'let them know they are in error'

 

 

 

It appears your lawyer made the same mistake on all the cases she's done, yet prefers to blame the NVC. 

 

Hope you get this straightened out quickly.

I'll retry here. How was your name written on the original I-130 application? Part C has your name in the order Family name, First name, Middle name. Did who ever fill out the petition assume your middle name was the same as before marriage? Again this moving of the family name to the middle name, is not how it's normally done in the USA and at least one state actually has a law forbidding doing it. 

In the end, your green card should come in the name written in your passport. I know middle name spelling errors haven't been an issue with the embassy in the past. I can only assume this middle name mix up is something they've seen and handled before.

My middle name when I was single is Lumba, then surname is Sumagaysay. My husbands surname is Gomez. Now when NVC sends about our petition., why is it they are using Lumba as my middle name, and Gomez as my surname?, it should be Sumagaysay as my middle name and Gomez would be my surname now right? Will it be a big problem for us?, and what should we do about it? Anyone pls?really miss my husband., it's getting 1yr already since the petition started. ?? miss my husband so much.,
What's on my passport is Sumagaysay as middle name and Gomez as surname now that I'm married.

 

In the USA it is not the tradition to move the wife's former surname to the middle name position, when she takes on her husband's surname in marriage. Someone has made an error during filing of the initial petition, during transcription at USCIS, or at the NVC and assumed your middle name stayed the same. How was the petition filed?

USCIS has been forwarding the criminal records of petitioners who have been denied because of the AWA to the Philippines. The Philippines has been putting those petitioners on a blacklist and denying entry into the country. This leaves the couple's only option to move to a third country if they wish to be together, as the petitioner is neither allowed back into the Philippines, or allowed to bring the beneficiary to the USA.

He doesn´t need to live in the US, he just needs to prove that he will reestablish domicile.

 

There's a taxes section at VJ that may help him sort that out. But I would assume his Portuguese tax filings would be part of the way he shows both income there and taxes he paid there already.

I am curious as to items not listed on the CFO's web page. Such as, I've heard people have been asked for a photocopy of the foreign national's passport. Are there other items other than this that may be asked to be seen? I do notice they mention "Other documents as may be required by the counselors". What other items has been asked for?

Same here. I haven't actually filled out an old style form in over 10 years. Although I do get hard copies of my W2's still. The IRS has been attempting to discourage the old written form tax filing for years now.

The Embassy doesn't send any letter. You actually get the appointment letter from appointment web site. It emails it to you, and it has the 2D bar code on the bottom. The bar code shows the correct passport number, but above in the letter there is a field that shows the passport number, there it appears to cut off the last number. The interview is confirmed. She's just worried about getting in, or will it mess up her visa because they are not showing the entire passport number.

Her Passport is XX1234567

Form says passport number is XX123456

Bar code on form says $15000-XX1234567



We never even GOT an appointment letter, in fact, never got ANYTHING from USEM after NOA2. I say let her go, and if there is an issue, it will be resolved there. Is there a way to verify appointment online?

Just noticed on the appointment letter they've cut off the last number of my fiancee's passport number. Below at the bar code it shows the entire passport number. Is this going to be a problem? I've emailed the appointment web site the question, but the autoreply said it will be one to two business days before a reply. That makes it the day before she flies to Manila for the interview.

I was aware of how much they want originals. I sent originals of darn near everything. I'm not sure if I can prove I exist now until she gets here. lol

We tried to pass of a scanned and emailed I-134, but the CO wanted to see ink on the document. Actually felt for "bumpy" paper to verify. My fiancee gave the emailed copy first, but it was a no-go. Then came the ITRs... she wanted originals of those, too!! Now, how the heck is that gonna work? I have filed my taxes online for the past 5 years, and the only thing I have ever signed was the direct deposit authorization! I guess I could have printed and signed the ITRs, then mailed them to the PI, but why not print, sign, scan, and email them? What's the difference, exactly?

At any rate, they accepted the ITRs as they were, but my fiancee had to tell the CO that I sent them along with the I-134 for her to accept them. As if it matters...

Just posting this so people know that to some COs, signing the docs means something.

Looking for firms that will ship packages from Davao City to the US. So far she has had two firms say they would not ship her her breakable items. She has a collection of angels she wants to ship here. There's not enough room in her bags. I've never heard of a shipper turning a shipment down, just maybe saying they're not responsible for breakage and wanting a waiver signed.

But does anyone know a shippers down in Davao? I really don't want her to have to give up her collection, it means a lot to her, its a bit like bringing some of home with her.

Turns out they didn't ask for any of them and she flew right through the interview. CFO seems to be even worse demanding original documents and making them return to.

Your packet wasn't lost, your packet wasn't sent yet. We ran into the same thing. Many cases are taking over 30 days after NOA2 to get sent on to the NVC. After the NVC receives it, call daily asking if they have the case number assigned yet. Once the case number is assigned, you can pay for the interview, then get the date set. While you're waiting for the date to come, get her to her medical. You want to try to get that done early, so there is enough time for it to arrive at the embassy before her interview. Get the CFO out of the way to, so she just needs to get the stamp after she has her visa.
We did every thing we could to rush our case to. We wanted to be together after all. It worked out and all our tight timing worked out. But it was rather stressful trying to rush everything. BTW the 90 days starts counting when she enters the country. She had until February to actually fly here and our NOA2 was June 28th. But we did know many couples who did not get their visas in time for their hoped for flights. If I had it to do over again, I might not have tried to set the flight so close to the interview, we were pretty lucky ours made it in time. I'm pasting our NOA2 thru departure time line, maybe it will help you out in planning. Do not get an airline ticket you cannot change, because our time line is probably close to the fastest you can hope for. Like I mentioned, we knew others trying to do the same and it took them a couple weeks longer before visa was in hand.

I did something slightly similar to my wife of two months. I told her I'd take her clothes shopping for Christmas. What ever she wanted she could buy. Now that might be something nice to do, but its not exactly the same as a Christmas gift under the tree. The secret was I had a Christmas gift ready for her for on Christmas eve which she wasn't expecting. Turns out she was getting all sad when Christmas eve began in the Philippines, so she got her's a day earlier than she expected. She cried to because she wasn't expecting it plus it was the perfect pick me up just as she was getting hit with a wave of homesickness. It was not an expensive gift at all, but it did show how much I know and understand her, which is one of the biggest presents you can give someone.

If you were married in the USA, the NSO in the Philippines has no way to record your marriage unless you report it. The Philippine government expects you to report it, but other than denying any benefits your husband may have in the Philippines as your spouse, I don't think there is any detriment to not doing it.

What does it mean? That we are married here in the US and not in the PI so we had to report our marriage?

So they pretty much send it right off after they print it ?

It was about a week for my wife to get it between printing and delivery in Davao City. We were pretty quick on that compared to others at the same time last September. 2go never was able to track her visa, and even the day she received it, calls to them said they didn't know where it was or if they even had it. Some other's waiting at the same time waited two weeks from printing to delivery. I know we were all set to rebook her airline tickets if it didn't show up by the day after it did. I should mention there was a 2 day holiday in the Philippines between our approval and printing to the delivery, which kind of mucked up the timing and knowing exactly when things happened.
