If you choose to go the divorce in the US route, you'll be committed to the AOS within the US totally because if your fiancee returns to the PHL then she will need an annulment. As noted before, a foreign divorce between two Filipino citizens will not be recognized by the Philippines and the Dept of State is bound by regulation to recognize the law of the place where the marriage occurred. So if she married in the Philippines, then no visa will be issuable until it is annulled. There is nothing wrong with the divorce in US and AOS in the US approach, just know that is she is not allowed to AOS then you'll likely need to shell out for an annulment in the Philippines as well.


The Philippines is the only place in the world she will be considered married if she divorces in the USA. It only becomes an issue for them if she attempts to return the Philippines. Filipinos regularly divorce and remarry outside the Philippines, even to each other. That marriage is just not officially recognized by the Philippine government, while the rest of the world recognizes it.

For The Philippines to Judicially Recognize a Foreign Divorce it must meet certain conditions:

1. One of the Spouses MUST be a citizen of another country,

2. The Philippine Citizen must be the respondent (meaning their Non-Filipino spouse is the Petitioner or person who filed for divorce).

Without this the Philippine Government won't recognize the divorce.

I'm not sure how much she wants to return to the Philippines, but there are issues that could, not that they will, but could come up. She will always be married there, unless she gets the annulment. Getting married to you would make her an adulteress and a bigamist, both of which are crimes in the Philippines and she could be jailed. Neither of these crimes are generally prosecuted unless a family member makes a case against them, but cases are made when someone is looking for a pay off or just mad because someone gained a new and better life. Her husband may not care now if she remarries, it might be very different should he return to Philippines and starts to get teased about his wife having a new husband, or she returns there and suddenly he decides this is a good way to make a few Pesos. Theoretically you could also be charged with adultery and jailed in the Philippines. This might or might not be something you care about, but she could never get a passport in her new married name in the Philippines, and your marriage could never be recognized in the Philippines. If neither of you never intend to go there, and she intends to get USA citizenship and give up Philippines citizenship, then none of these issues matter one bit. But you should be aware of them if you choose her getting a divorce instead of following the annulment process the Philippines allows their citizens to use.

The same thought went through my mind. How did it even get to the embassy? But looking at the instructions and the form, you're only certifying you're legally able to marry. In many places you can legally marry when not yet 18. Might require parental permission, but it can be done.

At age 17 you cannot enter into a legally binding contract. So you will need to sign a new I-134 dated after you turn 18. For an I-129F the CO has a lot of discretion to accept a co-sponsor or not. They also have discretion to accept your income or not. Even if they accept the co-sponsor, they still need you as a legal sponsor, and at 17 you could not sign legally sign the sponsorship form. Hopefully they will hold this long enough at the embassy for you to get the new I-134 to him and the pay stubs.

Hi everyone , quite new here . but i really like this site it really helps a lot .

I need help :(

We applied for a K1 visa . the NVC already sent my fiancee a letter that has my MNL# and that they already sent it to
the USE (manila) . but we did not receive any confirmation letter from the embassy that they receive the files from the NVC , by the way
its been 2 weeks since NVC sent the documents . my question is . do we still need to wait for the confirmation letter from the embassy ?
or , we can now set an appointment for the medical , visa application and interview ..whats the next best step to take ?

Many don't get a letter from the embassy. Use your MNL case number to schedule your interview. Use the interview appointment letter to take your medical. Mogambi gave the links to schedule and preregister for the medical. I never got a letter from the NVC with the case number nor did my fiancée get a letter from the embassy. Had we waited on them, everything would probably be expired by now.

PhilippinesName Changes after wedding...

Thanks all. I think what confuses me, and this wouldn't be different from a normal American wedding between Americans, is where does the name change 'happen'. Like, who is the first that it gets reported to.

I mean, OK, we get married. Then we file for Adjustment of Status, we put down her new name. But we're using her old passport. I guess that's where the 'maiden name' or 'other name' fields come into play on the forms and stuff...

I'm not going to worry about it just yet. Good to know we just file a name change with the Social Security people.

But thanks, her passport expires in 2014, so we'll just get it renewed in her new name anyway I'm sure. Curious, I've never actually seen a 'Green Card', is it like a visa that is adhered into the passport, or is something like a drivers license?


How you go about changing you name after marriage varies with location. In some places you specify it when you get your marriage license, which will show the name before marriage and the name after. In other places you just start changing all your ID's to the new married name. What some places have an issue with is the Filipino tradition of moving the paternal last name into the middle name location. Some places want to tell you that you can't do this. But if you don't follow Philippines standard way, you may find you're using a name structure they will not allow on the Philippines passport.

My wife didn't feel at home until she had a Filipina friend. It didn't take a lot of them, just one good friend she could relate to and talk in her native language with. We get together with her and her husband somewhat regularly and I get along great with her husband to. We've met quite a few Filipinas since she got here last September. Some were just plain a bad influence, back biting, gossiping, trying to get her to do everything separate from me. Personally I believe a married couple should spend the majority of their free time together, even if you are doing things with other friends to. Marriage is about building a life together, and not about building a life apart. Just my own view, I know other ways work for other people and that's fine to, it just doesn't work for us that way. There is another couple we'll get together on occasion to, and one divorced Filipina who is desperately searching for a man lol. We have many of my previous friends we also still do things with to. And my wife has become friends with them. So I guess we have a fair blend on it all. But mostly its the two of us living and enjoying our lives together no matter if we're with others or alone.

So a person must have at least 6 months remaining on the current to leave the US and return to the PI, or any other country.


So you're basically saying I can leave my country with exactly 6 months left on my passport. Now lets say its a two month trip, I'm now stuck there and can no longer return to the country of my citizenship because there's now only 4 months left on my passport?

I also would not leave my wife destitute dealing with debt I left behind because I'm more worried about my kids after I'm gone. I have an obligation and duty to my children to help them grow and stand on their own two feet. I have an obligation and duty to my wife to be there for her forever, even beyond my death. Are you going to hand a quarter million dollar life insurance policy to a six year old and leave your spouse struggling over debts you helped incur? That money would be wasted, in no time in the child's hands. Put it in my ex's hands and she'd find reasons ton convince herself things she wanted were in the interest of my kids. My wife after my death could pay off the debts and see to it the support I'm no longer there to pay is paid so her and my kids live's can continue without hardship. She could also hand out the money for their education in the manner I would have, had I still been around. Given even state law where I live states I must have her written permission to have an insurance beneficiary other than her, I'd say there is most likely a majority that agree with me. I trust my wife to do what is right in regards to my children if I were to die. We've actually discussed this topic, so she knows exactly how I would want things done. If she were to die, her family back in her home country would also not be forgotten. She trusts me to do what she would want done and I'd do it.

Spouses do tend to come and go when you put others before them. Just an opinion, I'm not trying to offend, but offer another point of view. In my own view, making a great relationship with your spouse benefits your children. Going from spouse to spouse hurts your children, but so does staying in a bad relationship. My wife knows my wishes, she'll see my children are taken care of per my wishes if I should die. Even if they're not her children. I know this because I trust her and put her first.

Talking with her on occasion is something that is going to happen. They have children in common and a certain amount of discussion needs to happen, that you'll have to learn to accept.
But....
Daily chit chat is not right.
The ex being a beneficiary on insurance is not right.
Payments beyond what is ordered by the court is not right.
Good for you for standing up for what is right, your husband needs to wake up and smell the coffee, and respect his wife's feelings.

When my son was getting a state ID for Texas the lady said the rule here is to go with the race of the father.


So what does Texas do when the father is mixed race also? If the father was say Native American, and Caucasian, and the mother was Filipino, would that not make the child more Asian than anything else? There was a time they tried to label Americans by which country in Europe they came from. That has faded away just as what race they are will eventually fade.

While she's there for the medical, have her get the CFO completed. She'll get a certificate, which she later uses to get the stamp in her passport. That way if you run into a problem with them asking for some obscure document during the CFO interview, you can bring it by when she returns for the embassy interview.

For the petitioner on a immigrant visa, I know they can go with. The K-1 is treated as an immigrant visa. I think local family members are not allowed in for visitor visas though. At least I know some people that have applied and had family members stuck waiting outside. Still nothing really surprises me when its in the Philippines.

As I said, my SIL will be going with mama anyway as she has never been to Manila before, so she can just wait with her until she gets inside and maybe shop a bit until she gets done.

And before anyone says it, we know mama may be unhappy once she gets here, but with the track record for tourist visa, we felt it would be simpler to go the family visa route. Then if mama got homesick she could go home and still have the chance to come back to the US if she doesn't stay away too long. We are bless to have a large Filipino community here so she will have some friends she can visit with.


Good luck bringing her mother over. Since my wife got here and I've gotten to know many other Fil/West couples locally, I've noticed a lot where the mother has followed over. I haven't been in the community long enough to watch and see how happy they are long term though. The big problem I've heard is they feel they're a burden if can't make any money. One woman brought her father and mother over. The father returned home to work, where he feels useful. For now the mother is staying to help with the children. Your plan sounds pretty good. If it turns out she doesn't plan to stay, voluntarily turning in the green card might look better for future visitor visas.

If they don't let a citizen in, I doubt they're going to let your SIL in. But I could be wrong on that. Hopefully someone who's tried will speak up.

Is it a visitor or immigrant visa? It might make a difference.

You can bring recent x-rays, but they will still take their own. Better to just leave them behind, if your x-rays show you're clear they won't believe it. If they think they see something in your's, that is the only time they're going to start believing it. I had my wife get a physical when we first applied for the K-1. She would get persistent coughs regularly and if she did have TB, we wanted to start treatment early if she had it. They found nothing on the x-rays or a sputum test but did tell her to quit burning the grass they cut on the lawn. Her persistent cough went away never to return after that. She still worried like crazy that something would show up in the medical, so I guess its natural to worry about it. You've been through your own doctors, you're going to be OK in your medical, just like my wife was. Also I told her not to bring her recent x-rays, as they could only cause confusion and problems.

Maybe it is BS or maybe not? It is a stereotype after all, and GOD only knows where it originated. A generalization is just that. For example, people who live near the water know how to swim. This assumption would seem logical, but this isn't a matter of fact, obviously from this thread alone. I have never lived near a body of water (although I would love to), and I have known how to "swim like a fish" since I was 8 years old. My fiancee lives in Davao and didn't know how to swim!


My wife grew up in Davao and literally lived over the water growing up, yet she didn't know how to swim when I met her. I've been to Davao a lot and it seems like very few there know how to swim. It might be a regional thing, where some areas people are more likely to know how to swim than other areas.

Thanks to everyone who responded to my anxious plea over the weekend! Of course, the fee was withdrawn yesterday (5.5) and I called VSC who said an NOA is on its way dated May 1. They received it April 2. April filers who are still waiting, hang in there! 

 

Vermont is just crazy slow right now. I'm so glad we have California. We finished the biometrics before people with Vermont are even getting NOA1's! Thats gotta really drive the frustration level.

Thanks. You are a CSC filer, right? As per your status, you received your NOA1 pretty quick. Only 2 days after sending it, right? I am also a CSC but Its been 4 days and nothing yet. Hmmmm.

 

The date is the actual NOA1 date on the I-797. It arrived about 5 days after the notice date. The NOA1 date was the same date their received the petition, per tracking on the mail.

First guy on the list got his NOA1 the day after the NOA1 date, but lives like 20 miles from the CSC so regular mail is only 1 day.

Morning VJers!  Still waiting for NOA1.  But I have a question.  Early on i had some fun with border crossings and I'm pretty sure they already did my biometrics at that time.... fingerprints and mug shot (face pic).  Does that still stand or will I have to do a new one?

 

You will more than likely be sent to go again. Border crossing, although still the department of homeland security, its a different unit than USCIS.

It's been a while since I posted. In any case, my wife and I applied for ROC on April 12th, 2014, so please add me to the list.

 

I have one question: My wife's GC will expire on May 8th, 2014 and so far no response from Vermont. Does anyone have any suggestions regarding what action to take if her GC expires and we have still received no response from from USCIS?

Wow you cut it close! I'd avoid any border check points. Technically she can't work, and is no longer here legally without the letter after the card expires. Did you get a delivery confirmation or see the check cashed yet? Which service center did you send it to, and how? California has been pretty quick to get the NOA1 out, but Vermont has been pretty slow.

You need to wait until you receive the bio appointment letter, u need to use the case number which is on that letter

 

That explains a lot. So the case number changes from the NOA1 case number when you get the bio appointment letter? Can't look up my wife's case either and although we filled out the form to notifications via email and text, none of those either so far.

Check cashed last week, but still no signs of NOA1 in the mail, is this normal? 

 

Not really, got the NOA1 on Monday, check was cashed on Tuesday. You mailed the same day as us.

A marriage certificate is even more redundant in your case.  You wouldn't be divorced if you had not been married. 

 

But when filing an I-129F, they require a divorce decree for every divorce, so it appears they like redundancy.
