Not sure if this is the right forum. But I have a question that'll help me make a decision on the next step.

I have visited my finacee 3 times last year in the UK.

I plan to visit her (in Nigeria) but this time we plan to get traditionally weded (only family and friends, no registry, or court), and then get married (Church Wedding in the States)

I guess my question is:

1. Is this wise to get traditionally married (no court papers or church, only family) and File the K1 visa or,

2. Stop the plans for the traditional marriage and just file the K1 visa or,

3. Get traditionally married (no court papers or church, only family) and file for the K3/CR-1 visa?

Typically, its best to make a photocopy of ALL pages of the USC passport - at least that's what I did, but if you are going to make a copy of his passport, just make a copy of everything if you plan to include it - less questions asked in the future

Regarding giving them a lot of information, extra paper work is fine if you have the time - Its called front-loading, and occasionally it helps at the interview stage. So don't be afraid to send the supporting papers you have.

Placing a post-it note on the top of each attached document is not a problem but I'll advice you have a cover letter itemizing the attachments.

If you are the USC then yes your SO has to have this information at the ready during the interview along with the i-134 form that requires it

Typically the i-134 requires some proof of employment.

I sent them a Certificate of Employment (including company name, length of service, amount earned), W2's (3 years worth), Bank statement.

Expect to get the NOA1 letter, in my case it took about a week or two but it could vary. At the point hopefully you'll already begin gathering information to send to the fiancee. Then the NOA2.

But I'll advice you to read the "Guides". Its very helpful.

Hello Everyone

My finace and I are preparing the last of our paperwork to be filled and we have a couple of Questions we can not seem to find the answers to. The first one is that I am divorced and I am not certain if I need to include a copy of my marriage licence to go with the divorce decree to prove name changes. And the second one is that on the G-325A form there is a line regarding last occupation abroad if not shown above, He has never worked in any other country than his birth one which is Australia. If anything what should we put in that line ?

I just wanted to say that we are thankful for this site. As we are new here and just beginning our journey we have still so much to do. I am having issues with trying to download our Skype log. I did copy and paste it into a word document but I don't know if that will suffice. I also tried to use a a program that I saw from another post and have been unsuccessful in doing so. I am not the best when it comes to computers and was wondering if anyone could give me some added advice. I am willing to call or Skype anyone that might be able to help me.

Hi everyone, just have a couple of questions regarding application processing times that perhaps some senior VJ members could help answer. I do know that each case is indivudal and processing time largely depends on which officer is handling each application.

1. do VSC and CSC typically process applications quicker over the late winter/Spring months as opposed to other times of the year?

2. I have seen it mentioned there is an influx of applications over the Summer months, then they clear this backlog over winter leaving Spring applications to be processed quicker. What are people's opinions on this?

3. Does anyone know of any links to past statistical data that may shed some light on this?

Ok Everyone we have figured out that I do not make enough money to be above the threshold. I am a Hairdresser thet works on commission. I have done so for the past 12 years in the same salon and my yearly earnings are quite similar from years past. I am not sure if being on commission comes into effect at all. Here is what we know so far and the questions we have that will help us determine our next course of action.

1. Last year I made $27,500. I am about $5k below the threshold for a family of 5 so I am putting in applications for a second job.

2. How does getting a second job effect this? I may not get on right away which may mean I will not make over that threshold in this year for total earnings.

3. So does USCIS consider a year from Jan 1 to Dec 31 or how does this work?

4. Will it be based on when we apply in the sense that even though I may not make that $33k this year that from holding two jobs over the next year will put me above the threshold. Say instead of Jan 1 to Dec 31 would they look at Mar 2012 to Mar 2013 a year?

5. If I were to clean for someone independently and they pay me $150 per week by check would this be considered income? How could I show it?

6. If I were to take a serving job would I then claim all tips since servers here make about $3 per hour and rely mainly on their tips?

7. How far in advance would I need to show proof that I am working two jobs to be above the threshold?

8. If I do not have a second job by the time we get our NOA2 and we use a co-sponsor then but I find a second job between then and filing for our AOS will we still need to use a co-sponsor?


If we have missed anything that you can offer any further advise on in any way please to do hesitate to reply. There may be more questions that need answers that we may have missed that will come from these after they are answered.

Thank you all for your replies thus far. Although I am finding I have even further questions.

I am unclear if we will be considered 3 or 5 being that I only claim one on my taxes. If it is 3 we will be fine if not we will need a co-sponsor because I am just below the 125% threshold.


We were unsure of the guidelines before and did not factor that in to our original I-129F packet. Should that have been submitted then or do we only need it when we submit the I134 form ? Will we need an I-134 form from the co-sponsor as well as mine?

What if any legal obligations does a co-sponsor have?

Will this affect our application as of now or will we need to have it for package 3?

Will we get an RFE over this since we did not include this in our original I-129F packet?

WE just submitted our forms for the K-1 visa. We have noticed I am close to the poverty guidelines in terms of the amount of people we will have in household. I am divorced with 3 children. I have custody of one. Does any one know what the guidelines are and if it is for all 3 of my children or just the one that is living with me and I claim on my income taxes. Also are the numbers before taxes or after taxes. Gross vs net ? Please we need any ones advise on this.

We were notified on May 15th that my petition was approved.  Documentation subsequently sent to CDJ Consulate, and we have since been waiting for the packet to arrive in the mail.  Well, enough was enough, after 6 weeks of waiting.  We had an attorney inquire with CDJ Consulate, and after all that waiting, they EMAILED(!) the 1-page invitation letter, requesting that we bring that to the interview.  Finally, finally, finally we have medical and then interview scheduled for August.  To go through such a process, being dependent on the mail...just painful.  To think we could have had attorney contact the consulate two months ago...ugh.  Nevertheless, this feels like progress finally, and we're counting down the days til the interview.

maybe he was a just covering his firm if i went through them and it took some time. i have a friend that had to wait he says 9mos from start to finish. she has no violations of bans on here current tourist visa.

 

what all do i need her signature on? i will email her those docs to sign and mail to me with pictures and plane tickets and such

after talking with the lawyer this morning to ask him questions i decided that i can do this on my own. it was nice to get the ideas from him, and some stuff that he explained made sense.

 

I will be talking with my fiancé tonight to see which she would prefer. i know that she wants to be here quickly, but she also wants to be able to work soon after arriving so she can stay busy after leaving her family. so that might sway her to go with a spouse visa. i can still go visit her in that process at least. i would guess that she would not be able to travel to visit me here if we went that route though due to her being married to me already at that point?

So I recently went through the traditions of asking my Mexican girlfriend to marry me, and had the traditional family thing with that.

 

I drug my feet longer than I wanted to for some reason, and now I want to get the process of getting her Visa in her hands as soon as possible so that next year she can be here in Ohio with me. I need help. I have been reading, and reading, and reading, and reading about this stuff, and it all seems overwhelming. I had a consultation call this morning with an immigration lawyer in Cincinnati, and he gave the options that I have in front of me- K-1 Fiancé visa or a Spouse Visa. 

 

I want her hear as soon as possible with me so I am choosing to go the route of the K-1. I have looked at the i-129f, the i-134 and a couple of others. I have a blank i-129f and i-134 printed out to begin filling those in. Are there any tricks? 

 

The immigration lawyer said that this process with Mexico can take some time, and I would like to make it as smooth as possible.

I work there for 2 years from 2007-2009, and now I am working here in Singapore for 3 1/2 years, Is it I still need to get a police clearance from Saudi even I am no longer resided here for almost 4 years? Because what I read on the website is "The police clearance from Saudi Arabia is unavailable for the third country national who is not resided anymore in the kingdom".

Help! My fiancee has her interview tomorrow in Athens, Greece. We did not know the i-134 forms had to be originals so we made copies (with the signatures) and put them in her binder. We have my i-134 and my parents i-134 as a co-sponsor, along with tax returns for both forms, and a current pay stub for my parents form as co-sponsor.

 

Would something as small as this really throw a wrench in the plans? I have been in Greece for awhile and mail is notoriously slow, so I had my parents scan the i-134 form and send it.

 

We have heard that sometimes they don't even care much about proof of support for a young, health, educated person from the EU (she ha a college degree, speaks English fluently, etc). Would they really deny the visa application because of having a copy of something?

 

Should I freak out all night about this or find a way to overnight my form to the interview? Travel to Athens tonight with the forms?

 

So far the process has been smooth but very long and a bit stressful, but for the past week we have both been in panic mode :(

We have our K1 in hand (finally!) and are getting ready to fly back from Greece to the United States on Friday. We will be entering through Washington-Dulles. I have heard some people say it was possible to get an immediate work permit on entering at some POEs. Does anyone know if it is possible to get a work permit immediately at IAD? For obvious financial reasons it would be better to be able for my fiance to work immediately, though we were planning on waiting until after the adjustment of status.

We got an RFE for 2 things for the K1 visa

 

1) We forgot to include our letters of intent. This was our fault! 

 

2) They wanted more evidence of last meeting - despite sending many boarding passes and passport stamps. My fiance was in the US at the time on the VWP so we wrote a letter stating that we are currently together in the United States and both signed it and got it notarized. We also included the same copies of our most recent plane itinerary and passport stamp, as well as a few more pictures of us together on facebook that showed the date they were posted. This seemed to satisfy them :)

I sent out my I-129f last week USPS confirmed it was delivered, but now I noticed that I-134 was listed among the other K1 forms on one page. I had thought that that was needed later on in the process, did I mess up will this cause me any problems or further delays? Sorry if I'm a bit panicked its just the whole process already seems to take forever and a day and if I delayed it even longer because of a dumb mistake I'll just kick myself :(

I had a similar situation.  My fiance moved after we filed the I129 petition and before the NOA2.  I called the USCIS helpline and I was advised to write a letter with the receipt # and his new address and to send it to the Service Center processing the petition.  I did as they said, mailed the letter (to Vermont at the time) and got notice about 3-4 weeks later that his address was changed.  Best of luck to you rolleyes.gif

I'm hoping someone here could give me some more concrete information. This past month my fiancee moved to a new city and begun a new job interning. Our K1 visa is still under review in California, now I have called the Visa hotline and the Customer Service Rep. told me all I needed to do was to write a letter to the California center with the changed information and add our receipt number to the letter and they would update this. Then I did some searching on this site and I read that I should actually send that information to the Embassy once I get my NOA2. If anyone has some insight to this I'd greatly appreciate it, thanks!

Thanks for all the indo guys.. I guess I should clarify I was employed last year working full time while attending school full time so according to my taxes from last year I did make much more than the required 125% over poverty level it's just these past 6 month this has not been the case :( but a co-sponser usually works as well or is there still stigma against this. Also thanks for the info on 1 month time delay by then I hope to have 2 paychecks under my belt and can get a letter from my new work. Thanks again guys you all always are wonderful!
