Don't fill it out. They'll think she's in the US with you. Something to consider - some people might have to renew their passport for whatever reason between sending out the i-129f and interview, so that data might change.

It won't matter, you just need to say which state you plan to get married in in you letters of intent. Immigration is a federal issue, so Florida won't get a say in it. My fiancee lives in OH, so we're in the same situation.

We had a friend of ours go through the K-1 process last year, and they did that exact thing. They officially got married in a small civil ceremony as soon as her fiance got here on the K-1 and were able to apply for the AOS. Then, they had a traditional wedding for family and friends several months later. In fact, that's what my fiancee and I are planning on doing as well. :)

As i've seen on the site, I1864ez is used for the co sponsor and I 1864 for the petitioner. I'll bring my diploma and transcript of records as proof of my educational background. Better be prepared. Thank you so much for the help.

Then he can be your co-sponsor! Have him fill out the i-134 with a household size of 2 (himself and your fiance). You will also need to give them your i-134 with a household of 2 even though you don't meet the requirements.

 

I suggest you ask on the regional forum about whether Haiti allows co-sponsors first, and if they would prefer an i-1864 as well. Good luck!

If you're submitting any passport stamps as proof of having met in the last 2 years you'll want to add a copy of the bio page as well. On it's own I don't think it's necessary, she'll need her birth certificate for the interview.

1. No one can tell you what the wait will be. 5 months is their goal, after which you can file a service request and basically complain. From the Dallas lockbox they forward it to either California Service Center or Texas Service Center. If you get CSC you'll *probably* be processed in under two months, if not faster. If you go to TSC, well... no one can tell you. I'd say the average for TSC is about 3-4 months, but it's a lottery and varies wildly.

 

2. Not that I'm aware of, and it's against their policy.

 

3. No, but people have gotten RFE's because they wanted them to specify which state they plan to get married in. Just include that in your letters of intent and you'll be fine. We're in Ohio and haven't had any problems, just waiting for the interview right now

 

4. Read the guides. If you can't see the link on top look at the site from a computer. http://www.visajourn.../content/guides

 

5. They'll be less suspicious that you're just trying to get a green card at the interview stage.

If you get pregnant now (or during the K-1 process), you run the risk of your fiance not being in the US with you when your baby is born. Lately, the process has been taking around 5 months for most people, but if you have any issues, or if for some reason you get denied, you'll either have to have the baby in the UK, or you'll be having that baby alone.

 

As Novembro said, pregnancies will not expedite your case. And maybe just something to think about: if something like paperwork is stressing you out like this, you might want to strongly consider whether or not you're ready to have a child.

Update!

 

Called the embassy today and they were very helpful. The lady said they have to forward the petition to me by law (croatian law, I guess) and that the inadmissibility remark was there because my tourist visa was revoked and not to worry. My interview is set for the 15th.

 

We had actually sent a copy of the revoked visa with an entry stamp as part of proof of meeting in the last 2 years. I'm guessing whoever worked on our petition saw it was cancelled, but didn't know why. Looks like uscis can't see or doesn't bother to look up embassy notes.

 

I'll post if this is brought up at the interview.

Yes, there was a member here got remarks on her approved petition with handwritten. She then told me that she got denied F-1 visa and was freaked out that would affected her interview result. Turned out, she was okay and her visa was approved. So, don't worry.

 

Contrary happened to me though. After she told me her experience, I had expected would have same remarks after my B-2 visa was denied in 2010. Back then, they gave me a yellow paper stating "consider filing petition for K-1 visa".  Weird that after I checked my packet 3, I did not get any remarks on my I-129F about previous visa refusal. I then told her and she found that was weird as well. She is from the Philippines but her case was forwarded to the US embassy in Jakarta.

 

Thank you so much! That's such a relief. :D So they do send approved petition copies. Just to check - they wrote 'inadmissibility issues' on her petition? Or was it something else?

My packet 3 email said they'd snail mail a copy of my approved petition to me. Well, it arrived today and on the first page of the I-129f form under 'remarks' someone hand wrote 'inadmissibility issues'. Needles to say, I'm... not great. Anyone else ever got this? Is it really standard procedure to forward a petition like that?

 

Issues I can think of:

 

1) I applied and was refused a student visa last December. I actually went twice within a week. They asked who I'd be staying with and I said my girlfriend. They asked a few questions about her, then denied my application and revoked my tourist visa. The first CO said he doesn't think I'm a bonafide student but that I could apply again, the second said I don't have enough ties. We discussed our options after this and decided to get married and filed the K1 paperwork on Jan 3rd.

 

2) I got pulled into secondary when I visited her for 7 weeks during summer break last year (I was still a student). We were still only casually dating at that point and not really in a relationship so I said I'm staying with a friend. They didn't ask any more questions about that, but seemed concerned that I would work, which I didn't.

 

3) In Croatia we distinguish between permanent and temporary residency. I was stupid and only put my permanent residency on the G-325A, even though I was a student in another city in the same country for much of the last 5 years. I'm scared they'll think I wasn't a student and lied (even though I of course had to bring paperwork from uni when I applied for tourist visas), or that I purposefully lied about my residence. I plan to bring an updated form to the interview but don't know how much that will help.

 

Our relationship is genuine and we do have lots of proof: 4 visits, skype chats every day, cards, emails, texts... She's coming to the interview with me.

 

I don't even know what to ask. Has anyone had a similar experience? Any word of advice?

hmm don't you think they can denie me at poe if i don't mention the ed at the medical ? or does cbp not ask about or pull out the record on previous visits? last time i was there they question me but not about the ed so i don't know if i should just not mention it at the medical since i was never diagnosed. i worry to much

 

someone that knows what cbp look at when u arrive with a k1? to they go through ur medical  answers and so? do they watch the tape of your secondary screening since its recorded i mean i don't know hehe maybe my fantasi is to wild lol i just want to be over prepared and have no surprises

 

I'm neither a lawyer nor a cbp officer so I don't know. From what others have said they don't look at your medical results at the border, just ask you a few questions about your petitioner and put you in the system.

Ah, I see. Well either way, an eating disorder won't be an issue. You could try your luck and just go to the medical, or you could request an evaluation from a psychiatrist. You could also try calling the doctor to ask what they'll want to see for the medical.

i was never diagnosed by anyone i know i had an eating disorder tho but i never looked for help i got through it with help from friends and family.  we dont have  a family doctor. is it any other way to get the note ? 

 

You could contact a psychiatrist privately, but seriously, I just wouldn't mention it. You were never diagnosed. No diagnosis, no history of illness. Why complicate things for yourself?

If you're set on answering yes, I recommend getting an evaluation done at a psychologist or a psychiatrist. You might even be able to get it for free, if you talk to your family doctor first. A K1 could be done in 4-5 months if you're lucky, but she'd have to go back to Canada for the medical and interview. That would probably be two separate trips. Would she have a place to stay? Could you afford the trips? She would need a mailing address in Canada, too. There's also the issue of what the CBP officer would say if she tells them she's going to live with her girlfriend for 6 months while her fiance visa is processed.

 

Iono, sounds to me like she needs to lower her expectations of what her living standard should be. There's nothing wrong with renting a cheap room for a few months while you wait for a visa or even a few years while you're going to school. Not everyone gets to have an apartment. I understand wanting to protect her, but you could be screwing yourselves over so much more than if she just sucked it up for a little bit while the visa goes through.

Wow, I just read this thread! Looks like I'm getting a RFE, but I hope not. The only possible reason that I can think of to receive a RFE (but im sure that they will find something else) is because on the I129F and the G325A for my beneficiary's middle name I wrote N/A in stead of NONE

you need to send the detailed version. our rfe was because of it. maybe you might be ok..lets hope! otherwise, get a long version ready just incase you'll need it.

Hi everyone !

 

My fiancé and I are about to go to our interview on February 20th !

I am sure you all know how exciting/stressfull this is.

 

So, if we get approved for the visa it will then be sent to my home which is located 11 hours flight away from the Embassy. I would very much like to avoid a trip to pick it up then come back to France to travel to the US.

Now my father lives closer to the embassy and it would save us money and time for the visa to be delivered here. I am trying to figure out the best approach for this to happen.

 

  • Put my father's address as mine right away. Will they bother me at the interview for doing this ? (like rushing stuff without even knowing if I will get the visa or anything..is this even possible to change my address at this point ?)
  • Keep my address until the interview date and then ask them to change the address of delivery (but I don't know if I can do it the day of the interview or if it has to be done prior to my visit)
  • Keep my address and have my mother pick the package up and send it back to my fathers address (Is it risky ? I cannot stop thinking it is but she would also use Chronospost)

Any advices will be very much appreciated !
