And if you're still married by that time, you would've had 3 years of residency. You can apply for citizehship. You don't have to wait for the I-751 approval. I believe you still need to get the stamp while waiting for your citizenship interview.

Removing Conditions on Residency General DiscussionRe-scheduling Biometrics
Thanks for the advices. My daughter and I got our biometrics processed without any problem.

We went to the ASC office around 10 am last Saturday, July 12 (My daughter's sched is July 15th and mine is July 26th) The guard asked if we have an appointment, and I said it's not until July 15th. He asked if we want to re-schedule. I said we were hoping they can squeeze us in. Then he asked for our IDs, stamped the letters, and gave us numbers and forms to fill up. My husband went in with us.

We weren't even finished with the forms and they were already calling our numbers. They said it's been real slow lately. They let my daughter re-take her picture several times until she's happy with the result. When it was my turn, they let my husband observe and they chatted for a while about how the fingerprinting machine works and what those numbers on the screen mean.

It's definitely a YMMV.

Thanks! We are going to try to get in before Tuesday. Actually, my schedule is on the 26th. If I'm lucky, I may be able to get my own biometrics done way ahead of schedule.

We were given that option on the biometrics form, any Wednesday at noon (except USCIS holidays they get that we don't) within 90 days of the assigned date.

I heard about Wednesdays but the letters I have don't mention anything about walk-ins or the 90-day period. It says "if you fail to appear as scheduled, your application will be considered abandoned". I was planning to try on Friday and Saturday, and if we're not able to get in, then I will mail the letter back on Monday. I'm afraid that if I don't mail it before Tuesday, it may be considered abandonment.

Should clarify, our latest biometrics was for the N-400 citizenship, but for the I-751, it was the same as yours, be there, or else. We were scheduled on a Tuesday morning in downtown Milwaukee at 8:00 AM early last year during the snow storm season that is over a 200 mile drive for us. We also have a daughter that was in high school with her planned schedule, but they made the appointment the same time as my wife that came in separate envelopes.

She resisted as well, but what is a parent suppose to say? If we don't show up, you may not even be here period for your school activities is all I could think of. The USCIS as well as the old draft board are the only two agencies I know of that make appointments without mutual agreement. Even the nasty IRS makes mutually agreed upon appointments. But when the USCIS says jump, we ask, how high.

Thanks for clarifying. I even asked my co-worker to go through the letters again in case my brain doesn't register what my eyes see smile.gif

You had to drive 200 miles! Okay, I'll stop complaining about the inconvenience of having 2 schedules. Our ASC is just a few blocks away. I honestly thought there's one in every corner smile.gif

Removing Conditions on Residency General DiscussionRe-scheduling Biometrics
I was so happy when I got my letter last week and my Biometrics schedule is on a Saturday - I don't have to miss work! I was so confident that my daughter's schedule will be on the same day, as it was in our AOS stage. But her letter came yesterday and her schedule is next Tuesday. As much as I am thrilled about getting it sooner than expected, she cannot make it because she has a group performance on that day - something she and her group has been working on for weeks.

If i want to re-schedule, I need to mail that letter out by tomorrow. I am considering walking in on Friday or Saturday. Any advice?

Thanks!

Removing Conditions on Residency General DiscussionPlan B
I sent 3 checks - $545 and 2 x $80. My NOA1 says they received $625. My daughter's 1st NOA1 is on a plain paper that says it verifies that she is included as a dependent in my petition. It has the same receipt number. A few days letter, a second NOA for my daughter came in the mail. This time, it is on the USCIS official paper and says they received her biometric fee of $80. This one has her case number instead of receipt number. We were able to track this case number online.

The next two letters that came in the mail are the biometric appointments. My daughter's case number is the same as in her second NOA1.

I've observed that some people get plain paper notices, some people just get the official paper. Our 5 letters arrived separately, several days and even weeks apart. Just be patient.

my biometrics are from July 07, then there was no contact for like 11 months other then the case was transferred to CSC, then the RFE asking for more evidence, mid of last month, and yesterday that my new card was ordered.

I have not applied for citizenship, i think i need to be a legal resident for at least 5 years and i have only been 3, and i am still thinking about doing it or not.

What real benefits do i get from being a citizen?

As an adjustee based on marriage to a USC, we need only 3 years of residency provided we are still married, including our conditional period. Some people apply for citizenship even before their removal of conditions is approved. I think the interview for citizenship can cover the removal of conditions.

Benefits? There should be plenty.

I'm interested in some jobs that require citizenship.

And a GC, even a permanent one, can still be taken away by the USCIS (on very serious grounds, I suppose).

There are things that are considered a "privilege" for GC holders, but are "rights" for a USC.

Your GC can also be revoked if you leave the country for a certain perod of time (6 months?).

I also read somewhere that if a LPR gets involved in a crime, they can be denied citizenship. We always think that since we have been law abiding people, these things will never happen to us, but you never know what cards fate will deal. Better to seal the deal as early as possible.

Oh, and the most important thing : with the way USCIS is inreasing their fees, you will save a lot of money if you file now.

US Citizenship General DiscussionDivorce after US Citizenship?
As much as I hated keeping a big drawer of old bills and other stuff, filing joint income tax returns when it was more practical to file separately, and constantly trying to get us both in pictures, I somewhat enjoyed some part of it. I enjoyed looking at our marriage from different perspectives. I was overwhelmed with memories on the day I went through our "INS drawer". I am thankful that we took a lot of pictures.

But I look forward to the day when I can continue to enjoy these things without the pressure - much like enjoying learning new things without the pressure of grades and teachers. I'll keep a "memento drawer" instead, I'll keep taking hundreds of pictures of my family and every once in a while stop to look at our marriage from a stranger's point of view.

US Citizenship General DiscussionHow stringent is the naturalization process?
This whole immigration process has been very stressful for me, despite the fact that I seemed to be breezing through the stages (so far). I am well aware of the weaknesses and strengths of my case and I tend to focus on the weaknesses. (Notice that I use "I" instead of "we". My husband is looking at the process from a different vantage point. I am alone in my pessimism.)

Some of the weaknesses will be evident if USCIS scrutinizes documents such as tax transcripts, vehicle registration and drivers licenses. There are inconsistencies in addresses because my hubby owns the house where his parents lives and declares it in our joint tax return, and he shares car insurance policy with them. I also share the same policy as my parents'. These arrangements were prior to our marriage and we were reluctant to make changes unless we really have to, like when we are ready to buy a house or replace our cars.

The rest of our evidences (bills, paychecks, health insurance, life insurance, bank accounts and credit card accounts) are addressed to the house we are leasing.

Up to this point, no questions has been raised. Do you think this will be a problem? We never misrepresented anything since we submitted all evidences as they were.

Does he just apply again like he did the first time or is there another process for people in his situation? Is this even doable? His foreign passport and U.S. green card has expired since. Is that a problem? Thanks in advance!

I don't mean to be intrusive, but why didn't your brother show up for the interview? And why didn't he renew his green card?

I'm one of the many people in this forum who is obsessed with our immigration journey, so what appears to be your brother's disinterest to it is mind-boggling for me.

I'm sure there's a very good reason for it. After all, he did take the time to fill out the application, have pictures taken, and pay the fees, right?

US Citizenship General DiscussionSocial Security office
I've given up on getting a SS card.

I should've kept the one that says "not valid for employment". I went to get a replacement without those words after I got my GC, and had to surrender the original. After a few weeks, I went back to follow up and made a couple of phone calls. I don't even remember what the problem was. That was almost 3 years ago.

My 2 reasons for not pursuing that card:

1) I don't want to give up vacation days to wait in line in a Social Security office.

2) Is it just in that particular office, or are all Security Guards in SS offices so rude? The one in Pomona, CA acts like he is a Prison Guard and treats everybody like sh*t. And I mean everybody. It doesn't matter if you come in business attire: nice slacks, leather shoes and LV bag, or clothes that haven't been touched by detergent for weeks. He makes you sit and stares you down like you've been caught red-handed with some stupid crime. I was turning off my cellphone as i was walking in, and he yelled at me to turn it off. I said that's exactly what i was doing. He said to make sure it is off and not just in silent mode. I said I was turning it off. Then he said he wants to see it. I showed it to him, but he made me hand it over. He played around with the buttons trying to figure out how it works until he was satisfied that it was off. mad.gif

Well, the interview checklist asks for additional stuff beyond what the application checklist required. So, while we submitted copies of the marriage certificate and our son's birth certificate, we hadn't submitted any evidence for marital union

I went back to the "Guide to Naturalization" to verify this, because I wondered why on earth did I include all those documents if it wasn't required?

In the Document Checklist section, there's this:

If you are applying for naturalization on the basis of marriage to a U.S. citizen, send the following four items:

1. Evidence that your spouse has been a U.S. citizen for the last three years:
• Birth certi?cate (if your spouse never lost citizenship since birth), or
• Naturalization certi?cate, or
• Certi?cate of Citizenship, or
• The inside of the front cover and signature page of your spouse’s current U.S. passport, or
• Form FS-240, “Report of Birth Abroad of a Citizen of the United States of America,” and

2. Your current marriage certi?cate; and

3. Proof of termination of all prior marriages of your spouse-divorce decree(s), annulment(s), or death certi?cate(s); and

4. Documents referring to you and your spouse:

• Tax returns, bank accounts, leases, mortgages, or birth certi?cates of children,
or
• Internal Revenue Service (IRS)-certi?ed copies of the income tax forms that you both ?led for the past three years, or
• An IRS tax return transcript for the last three years.

Based on #4, I submitted updates on our I-751 evidences. My file was half an inch thick blush.gif . I won't be surprised if I still get a yellow letter despite of that.

Just bring a ton of bills and banks statements, etc.

Good luck!

QUOTE (jsnearline @ May 26 2009, 03:02 PM) <{POST_SNAPBACK}>
We got my wife's interview notice today. I have a few questions.

The notice says the proceeding will take about two hours. Is this standard on all the interview notices? What on earth do they do for two hours? Our AOS interview only took 20 minutes.

The checklist that came with the notice says my wife has to bring "proof of marital union as well as proof of residence". Since joint tax returns, marriage certificate and birth certificates of children are listed as separate pieces of evidence, what is "proof of marital union?" Is it the same proof of marriage stuff we sent in for the I-751?

The checklist suggests bringing two additional passport photos to the interview? Why? Is this just in case the IO doesn't like the photos in the file?

1) I believe 2 hours is just a standard. If your application is pretty much straight forward, it should take a lot less than that.

2) Proof of marital union and residence can be utility bills, bank statements, insurance, payslips, etc. Did you include these in your application?

3) My mom was also asked to bring another set of passport photos, original birth certificate, driver's license and tax transcripts, but the IO never asked for these in the interview.

Does anyone know how to get a hold of the CD? I'm not sure we can just go back to the field office and ask for it, although you'd think we should be able to. I've looked online, too, but it's not around anywhere.

I got one from the ASC. It looks like they just started giving it out because some people who had their biometrics done already came back to get their CD and booklet. They showed their stamped Biometrics Letter to the guard to claim it.

It's worth it to get the CD. Or download it from the internet and burn it. I listen to the CD on my way to work. After a few days, I've memorized all the answers. I haven't even opened the booklet.

Perfect, it's not the same situation. Your son may have been over 18 yrs old when you became a USC. The OP's son is only 15 yrs old. If the son was included in the OP's AOS, he automatically becomes a USC when the OP becomes one.

Filing N600 is optional and expensive, IMO. The OP can apply for a US passport for the son and it will serve as proof that the son is a USC.

Hi everyone,

My question is I got married in 1993 to a US citizen who is the friend of my mother-in-law. He was the boyfriend of my mother-in-law and he wanted to help me stay in the US. I have no information about him when I married him legally at Las Vegas. At that time, I was young and I just wanted to stay in the US. Of course, the marriage was never consumated. However, a day after the marriage, I felt guilty of my wrongdoing and just decided to forget it and go back to my country. By twist of fate, I got a H1B visa in 2000. I applied immediately for an annulment when I reached the US. It was granted. However, I have no information about his whereabouts since 1993. The annulment went through even without his presence. My mother in law is dying and too sick to give me any information about him. In my permanent residence application, I did not mention him. I got my 10 year green card recently. I now want to apply for US citizenship and worried on how I can get information about him or INS might see the discrepancy and why I did not report him in my immigration application.

Thanks,

In Naturalization, as well as Removal of Conditions, INS expects a joint tax return since your GC was granted based on marriage. So it doesn't matter if you are not employed.

Hello! I Hope that everyone is having a great day! Well I had my interview today and I feel really dissapointed and almost heart-broken. I arrived to my interview on time, answered all of my questions correctly, and passed both the English and the History/Civics tests. The Interviewing officer was really nice and everything seemed to be going well when suddendly he tells me:

" A decision cannot be made today" and he gave me a paper saying that they need to wait for my FBI Name check to clear.

As I exited the office I saw that all of the other people who were in that same waiting room made their way to the oath ceremony except for me. I thought that the USCIS schedules interviews once they get all clearances from the FBI and after they complete all of the necessary background checks. I really don't understand what happened and I feel like I will get denied. I have read all of the nightmares about the FBI name checks being delayed for years and my gut feeling tells me that USCIS is going to deny my petition. I feel so lost right now and seeing the other people take the oath today really got to me. Perhaps I have to start getting used to the idea that I won't become a US citizen anytime soon.

Good Luck to the rest of You!

P.S. Something tells me that the Immigration Officer was not being completely honest with me.

I'm so sorry to hear that. I read somewhere that the biometrics results has got nothing to do with the interview schedule in some cases.

Keep your hopes up. Anything can happen as far as FBI name checks. Do you have a fairly common name?

US Citizenship General Discussionapprox time to get interview for California?
My application stretched 124 days between receipt of application and oath ceremony, a few days over 4 months.

My DO is Los Angeles and my case is typical of that DO. Other DOs are normally much faster, like San Diego, I believe.
