Removing Conditions on Residency General DiscussionApproval Notice
I DID receive an approval notice in the mail. No card yet.

First came the email that says "Card Production Ordered on September 5". (When I checked my status online, it says "Card production ordered on Sept 4".)

Today, I received a letter in the mail that says "Congratulations! Your request for the removal of the conditional basis of your permanent residence status has been approved. You are deemed to be a LPR of the U.S. as of the date of your original admission or adjustment of status. You should receive a new PR Card, Form I-551 (green card), within 60 days" , etc.. The letter is dated Sept. 4th. It's form I-797C Notice of Action.

It also says the green card will come with mailer form I-797D Notice of Action.

60 days!! I sure hope it's a lot sooner than that.

I didn't think that USCIS actually calls the green card a "green card". But there it was, on black and white, on an official USCIS paper, from the director, Christina Poulos.

Then at 8:15 pm, I received an email that says "Current Status: Approval notice sent. On September 9, 2008, we mailed you a notice that we have approved this CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED".

Oh well, we all know that USCIS can be inconsistent. As long as we get the actual card, it doesn't matter how many different ways they communicate with us.

I taped 2-3 pictures on each sheet of paper, then added a brief caption. I didn't put dates because I don't remember all of them.

I sent so many pictures, but mainly because I have extra copies from taking advantage of a promo, and because I enjoyed putting them together. That was the funnest part of putting together our application.

Thanks for the replies. I agree, it doesnt seem like a major error. And obviously USCIS's error.

I guess I should just hold on to it. I have only a 7-month wait to qualify for naturalization. Can't risk not getting it back by then if I request for correction.

I may have to travel. Oh well, I'll take my chances. And I'll let you guys know what happens.

Just to be safe, I think I would call the USCIS information (or mis-information) line to see if the "unknown" is a problem or not. You'd certainly hate to leave the country and try to return only to be turned back!

FWIW, there was a mistake on my husband's green card, too. We just sent in the I-90 and were told by the info line that it could take up to 6 months to get the corrected card mad.gif . So much for better service from our increased fees, eh?

I don't mind at all smile.gif I will type it all out exactly as written in the letter. Any comments from me are in red.

They requested as follows:

IDENTITY DOCUMENT: Please submit a photocopy of the Department of Motor Vehicle issued driver's license and/or identity card for each party to the qualifying marriage.

I already sent this with the I-751 application.

EVIDENCE OF GOOD FAITH MARRIAGE: In order to assist is establishing your eligibity for rempval of your conditional status, it is requested that you submit additional documentation. Please submit any or all of the following documents. This list is not all inclusive of the type of evidence that may be submitted for consideration.

* FINANCIAL RECORDS: In order to assist in establishing your eligibility for removal of conditiona; status, you may submit evidence of joint ownership of assests and joint responsibility for liabilities for the past two years. Such evidence may include but is not limited to the following:
I submitted a copy of our 2008 tax returns with original I-751 application.

*Copies of your State and Federal tax returns for 2006 and 2007. Include also, all required schedules, statments and any attachments such as W-2 records for conditional resident and petioning spouse.
* Copies of morgage aggrements or deeds showing joint ownership of assests or property or joint tenancy of a common residence.
I submitted a copy of our lease with both names on it with original application.

* Documentation showing commingling of fiancial resources such as complete copies of bank statments showing joint savings accounts and/or checking accounts.
I submitted copies of our joint bank account spanning over the last 2 years. But I only sent the fist page of the statments that had out names and addresses on it. I did not send complete copies of the full bank statments, thinking that was too much personal information... guess I was wrong on that one.

* Copies of loan documents such as car loans, home improvment loans, business loans etc.
We do not have any loans, so I wasn't able to send anything like this.

* Any other documentaion which shows that the marriage was not entered into in order to evade the Immigration Laws of the United States.
I really do not know what this means??

* RESIDENCE: In order to establish eligibility for removal of your conditional status, you must submit evidence of your communal residence for the past two years. Such evidence may include but is not limited to the following:

* Complete copies of rental lease(s) or rental aggreement(s) showing joint tenancy at a common residence signed by you, your spouse and the owner(s) of the property (or the property manager).
I sent them copies of our leases, but only the page that has the signatures and address, not the entire lease copy.

* Copies of utility bills such as telephone, gas, electric, water, cable etc. or other statments issued in both your names indicating your residential address.
All our utility bills are in seperate names, but come to the same address. Some are in his name and some are in my name. I sent copies of the bills anyway to show we are both at the same address.

* Any other documentaion which shows that the marriage was not entered into in order to evade the Immigration Laws of the United States.

STATMENT: Submit a statment in your own words describing how, when and where you met your spouse. In this statment, include significant details of your courtship, the events of your wedding including names of the guests and names of the witnesses. Your statment should include detailed information regarding memorable moments of your marriage. Please list the places where you resided together. In your statment please indicate the nature of your employment as well as the nature of your spouse's employment.

I didn't send photocopies of our driver's licenses. I didin't know that it was required. Uh-oh, should I expect an RFE?

So, you are going to send :
-photocopy of driver's licenses (already sent in the original submission)
-2 year's tax return (original submission has 1 year)
-Full bank statements (original submission has first pages only)
-full lease agreement document (original submission has signature pages only)
-utility bills
-other documentation (did u send pictures? affidavits?)
-statement


I didn't know that they need the information in the STATEMENT part. This is good info for those who have not submitted. They can take the extra step to avoid the inconvenience of an RFE.

I wish USCIS inlcuded this in their list the first place. I'm sure everybody is willing and happy to write their stories (most of us have been doing it in these fourms anyways smile.gif ). Really, if they know what they want to see, why don't they just spell it all out and save all of us and themselves a lot of time, money and work.

Oh well, that's what makes this journey so bumpy and stressful and exhilirating.

We have until August 8, 2008 to submit everything. I read here before about how USCIS prefer to have the paperwork, but after searching and reading many posts I can not find what the way is. I 'think' it should be in a folder that binds all pages from the top instead of the side. Is this correct? And if so, what is that type of binder called?

So now I have to go find all the info they want and get it together. If I had only found this forum before I submitted the I-751 I would have been way more prepared to begin with. But at least this time I can hopefully get it as they want because of all the helpful advise here.

Sorry, but cell phone use is not allowed in the waiting room. The guards at the Denver office are usually pretty laid back, but they had a zero tolerance policy regarding cell phone use.

I read somewhere that another reason for descheduling is if the files are not expected to get to the DO in time for the interview.

Members of this forum are so familiar with the word 'descheduled". Just for the heck of it I looked it up and found out that there's no such word in the dictionary. My interpretation of the word is that the schedule has been cancelled versus re-scheduled which means the schedule has been moved.

And it's just so typical of USCIS to send a 'deschedule' letter instead of waiting until they have a new schedule to save ink, paper and postage, and most of all, spare the applicants the stress.

I called again and was able to talk to 2nd level officer. She said the local DOs mail out the letters.

She also said my DO mailed my letter last Tuesday (June 2). I still haven't received it though. Maybe tomorrow..

My Interview is on July 30th!! kicking.gif

I called the 1-800 number and got through a person by choosing the "haven't received the notice sent out, etc.". When I reached the CSR, he kept repeating what was on my online status. I told him I need to get escalated to another level because I was worried that my Interview Letter and/or Request for Document Letter might have been stolen because we had mail theft in the neighborhood last week. After a 10-minute wait, the 2nd leverl CSR asked for my Alien Number and told me that the letter just went out today, and that my interview is on July 30th smile.gif I asked if there was a Request for Document, and she said there was none.

Time to study smile.gif

Why don't they include all future filings in one post? It'll give a better timeline for analysis, especially since USCIS went to filings at the lockboxes earlier this year.

I end up going to the previous months forums ie MAR, FEB to get a gauge on my own situation.

It doesn't seem like the biometrics has anything to do with the interview schedule. Some applicants get interviewed while the results are pending. I suggest not to delay the biometrics.
If you cannot postpone your trip, have someone check your mail. If your interview date falls within your trip, I guess you have no choice but reschedule.

Walk-ins don't change priority dates, so application processing time isn't affected what it affects though is that it gives a head-start to the fbi name-check



Exactly. There's been a lot of cases lately where the interviews are scheduled while the name-check is pending resulting in 3 scenarios : re-schedule to a later date, interview without final approval, and the worse is the applicant shows up but the IO refused to interview her/him.

I figured I cannot go wrong with a few days head start.

My biometrics walk-in attempt this morning was successful, although i had to wait for an hour for my turn smile.gif

I came in at around 8:20 am and was told that it's a pretty busy day so they do not encourage walk-ins. I was willing to take my chances, so I filled out the application and waited patiently. The security guard waited until there's absolutely no one waiting in line before he let me take a number. I guess that's just fair smile.gif I got what I came there for, so no complaints smile.gif

I went to our public library for this. When I called to inquire about their closing time on a Saturday, they gave me a list of documents I should bring. When I said I'm getting one for my daughter, the lady said to bring a US birth certificate. I told her that my daughter was born abroad, then she said I should bring her naturalization certificate. I told her that my daughter doesn't need one, that she can use mine. The lady insisted that my daughter needs her own certificate. I recommended that she should research the subject, then call me back with the results.

She called me after an hour, admitted her mistake and all. But when we got there, she said she cannot accept both applications because each one has to have an original certificate. If my daughter uses mine, then my application will be denied because I will not have a certificate with it.

It was getting late and I was tired of arguing my case. I decided to just submit my application. My daughter's can wait until I get my certificate back.

It is convenient that there are plenty of places that accept passport application, but I must agree that if it is not a straightforward case, the employees receiving the applications are not very well-informed of the rules.

Ooops, I take that back. My passport book, passport card and naturalization certificate came in the mail today, but my status remain the same.
