for our relationship, we didnt spend too much money on it, coz we need money,
we both want baby so soon, so we are saving money for our baby girl
thats why he only came to france twice, we wanna do all ,but we dont have too much money to allow us
after interview, i already send 502 pages skype chat history,myspace and facebook comment, coz it got date on it,so i cant just make it up
he do sent me love letter, and i do , but the letter is mail with gift, and the paper about k1 togther, i got the letter, do u think i scan the letter then send to them,it will works?
during the interview, she ask me if i got phone record, then i give to her
our phone record was heavy like a dictionary,coz he call me at least 10 time for everyday, everyday, never stop!
and also send me text message to my phone everyday too

From Reading a previous post by the OP, it seems the petitioner wasn't very involved in the case and left a lot of the work up to the beneficiary. Not sure what is going on with that, but if so and as stated the petitioner didn't send any/much supporting evidence in then it is understandable that the VO would be skeptical. If I understand correctly the petitioner and beneficiary are actually in France which explains why the VO is asking about coming back to China.


for the OP. Let us know what was sent to USCIS and what the petitioner's involvement in the case is. Because of the foreign residency and presumably lack of evidence submitted, it may be time to talk to an immigration specialist.

our petition is made by me and daniel together!
why coz for him, he's not very good at doing paper work, im afraid of he gonna made mistake or something, then i told him, when u were in france, we do it together
then i can know if he do it right or not,u know once got problem, will take more time! so the petition we made together when he was in france to visite me!
for the petition,about evident part, we added our phone bill,the gift he sent to me and the gift i sent to him,and money transfer,i think this the problem ,coz invoved money,
but not big money, u know when u serious in relationship,u will share everything, thats what we do!
when he need money, i sent, when i need money ,he send, not little money, like hundrends,not like 100000

me now in france, he still live in usa, just came here twice to be with me

I agree with that, you should remain calm, confident, don't look away or seem nervous. The questions they ask are to prove your relationship is for real, so it should be a breeze. I'm sure you can appeal or reapply; I'm sure it's difficult, all of us here have gone through some kind of separation from our loved one, good luck to you.

i never nervous during the interview
as she told me she dont believe our relationship, i cant help that cry in fron of her
but she never really look at me once during the interview
since the first word i said to her, she dosent like me, i can tell from her face
i speak english since i was 4, i can use it very smoothly
i was thinking to send chat history, but all i can do is copy and paste
would they believe this truth not something we just made it up now?

What exactly had you and your fiance submitted before the interview? What, if anything, was collected by the interviewing officer at the interview?

me and my fiance didnt submit anything,
the paper she gave to me after interview is a paper have 3 reasons on it she marks the first one which said case been suspended
but she didnt mark any paper at below of it coz at interview i bring all they asked
all she said to me is to give anything that can proof our relationship is real!

the two reason case been suspended
one is she said my passport is not valid six month to entry usa, but my passport still got 7 years for valid
then she wrote down relationship appear to be for immigration suposes
and all the werid questions she been asked

K-1 is always challenging for it is hard to prove that you are going to get married and in a bonafide relationship and not just for immigration purposes. I understand your pain and also felt the same towards the US Embassy in Uganda when I spoke with the consular work working there. It is all routine and their goal is to discredit you and find reasons not to grant a visa. Also, they will never tell you everything to bring so you have to come over prepared for the unknown. The CO even asked my wife, how she knew to bring so much info?

VJ will help you detrmine how to go about it and I advise reading as much as possible to avoid this again. Your next option might be to get married. Good luck and don't give up cause that's what they want you to do...

i said he own it
then she said how he own it
then i said his uncle and aunt died, then give to him
then she ask me the address,
i didnt get it coz all the paper we send always has this address on
then i said it she couldnt understand, then i wrote down,

today i went to my interview,and the officer ask me so many question which has nothing to do with k1
she keep asking me that why i dont back to china
the most funny question is she ask me : why you go to usa!
oh my god, whats that mean? i apply k1 visa, and the she ask me that question?
that was an old lady,nearly 60, all she keep try to ask is why i dont back to china
and when i try to explain, she said: i dont wanna listen to it!

This is a pain to deal with. Getting married right away will NOT solve any thing nor does it provide any more room for an approval. Away the receipt of the case and as suggested have the petitioner contact the DOS and get clearer details of the denial / why case was returned. Knowing these things will be important to a successful CR1 interview.

yes i think so! getting married is not perfect way to sovle this problem
and we will try to win on k1
coz apply another petition mean need to pay a lot again
considerate about our economy situation ,its better we win on one petition
of course if we have to apply CR1, then have to
but better we can win on k1

I have exactly same sitiuation i have gone through embassy interview on 21s Oct VO told me to submitt some docs and gave me 221g in first interview and she told me she want to talk to me when i come back to submitt it, but when i went to embassy for submitting my docs she was not available and clerk told me we will let you know.....after many days of emailing i found my case has been sent back to USCIS for possible revocation,,,,,,........since then i have been keep on cal NVC and USCIS they do not have my case yet and embassy says it is in transit i guess they sending by pegion way..., my fiancee mum contacted to seneator and they have taken our details and are checking with USCIS or whome so ever i m not sure lady told to my fiancee mum they do get these kind of request everyday do not worry he will get visa but it gonna take a while i m just hoping, and trust me US embassies ain't gud for any......

our situlation is same,but im from china, here is high fraud country and got a lot of spy sending to usa by government
from what i think in those long time, im 22 now, i can speak 4 languages,and recently it got news talk about a girl who is a spy but now wanna quit

The whole situation is confusing and over my head. Can't figure out what happened. It seems the OP also had similar experience with CO attitude in France. Maybe they need a consultation with a lawyer for some specific guidance on their case.

OP - did you have any new evidence to submit since your last interview?

we send a lot of proof after our case got suspened in france,i send it as soon as i back home from interview
and for the second interview, like i said, the vo even didnt ask see anything, just give me the result
i do talked with a laywer, and he did said that he can help us,but need to pay 4000 dollars
we dont have that much money, then i give up to use lawyer
we will fight with emabssy without lawyer
coz no matter what, we r real, truly in love, our situation not allow us to use lawyer with those big money
thats why i hope people here who has an ideal, even a little one, will be so apprciate!

I had similar situation like yours before. But it was when I applied B2 visa (tourist visa). They never looked up at a bunch of documents that I brought to consulate (bank statements, insurance policy, my credit card statements, etc.etc.etc). The CO lady - my guess- already decided when read," I am going to visit my boyfriend" on my form. They had issued 221(g) as well, but it was green paper. In my consulate website says," they are not refused my visa but waiting additional documents to bring in later". So, I have no idea whether your case is denial or pending to wait more additional documents.

thats all on that white paper
so neither me know they are waiting for more proof or not
but this my second interview, not first one,
the second interview never ask me any paper just give me that paper directily

yesterday was my 2nd interview,1st one was in france, coz fo my residence will be finished, so i transfer my case back to china
and yesterday i went to that interview, was a american man,he only ask me 2 question
1: when did you back to china ( Oct-3)
2: did he come to china to see u after you r here ? ( no, i was only back here for 1 month,no chance)
then ok, we cant give you the visa, and your case will be send back to uscis
then i asked: so you deny me !?
VO; no, not deny, send back to uscis i dont wanna handle your case anymore

VO: go to window 30, people will explain you

everythig finish in 1min, and i was took 21h on train to go to Guangzhou,and thats how he done the interview

i read a lot here, i know they will send petition back only whem embassy deny it,but he said its not deny,
and the white paper i got it wrote :

i do understand the co dont have too much time
but think about since the day they ensure you the interview time
you always have time to papering,the co too

embassy need time to review then sent u interview time

by guess the couple is true or not with some simply question

Hey all! I've been lurking around here for a little while and this is my first topic, so I guess I'll introduce the situation. I'm currently living and working in China. I met my fiancee over two and a half years ago when we were both college students studying in Japan. After Japan, I returned to the states and she to China to finish college. After college, I got a job as an English teacher here in China so I could be with her. I've been here since November last year. We decided to marry in December and I sent in the K-1 petition in January. So we were on our way until the petition is returned to me in February. I call USCIS to ask what's up and she tells me that somebody probably made a mistake and to send it back in. So I sent it back in March (two months wasted) and things are rolling. I'm still waiting for NOA2, hoping to get it soon.
Anyway, I've been preparing myself for the next step and I came upon the Affidavit of Support. I've never had a career in the States, only part-time work since I just graduated from college last year. Also, we plan to stay in the States once we get married there, so there's a chance I won't have a job at the time of our wedding. I will still be teaching here when she has her interview though.
Question: What do you suggest I put on the Affidavit of Support? Also, would it be possible (or wise) to use my parents as the support? Any suggestions are appreciated! Also any tips about the process (specifically in China).

I think I'll go with the note from my parents that says Nancy and I can live there. I think my parents would have to sublet to me and I don't know if that raises red flags in their eyes. Is a lease stronger than a letter from somebody saying I can live there?

Please note - you have to prove up one of two things, aye?

1. proof of re-establishing domicile in the USA or
2. proof of domicile in the USA.

Do not mix these two, please.

to prove up re-establishing domicile, a lease is useful.
Don't have a lease but have a place to stay? A letter from the human who's house yer gonna be living in, is useful (I say required, but meh)

__so that's minimal stuff. Anything else you add, is more than minimal and a good thing.

I'm a little concerned. We got a RFE of Proof of US Domicile and we need to bring all supporting documentation to the interview. But we were thinking about bringing the same stuff you presented. Well, my wife is pregnant, do you think that could help?


I don't know if your wife being pregnant would help at all. From what I have read online the domicile issue varies from embassy to embassy. An immigration lawyer friend of ours was extremely surprised that they didn't accept what I had presented in the first mail out. Apparently, Guangzhou embassy is pretty strict with it which isn't surprising. I know some really care if you are looking for or have a job. I thinking health insurance that is only valid in America would help as well in my case.

My wife had a visa interview the end of Sept. and she was refused due to me not being a domicile resident. They gave us a the blue paper (OF-194) with instructions on how to re-establish domicile. As evidence I sent them, a letter declaring my full intention to return with her, voter ID, current Missouri driver's license, Missouri tax returns for the last 3 years, various bank statements from the last 3 years from my US account, mail delivered to my address in the states (my parent's home), expiring contract and visa.. Then we were refused again and sent the same sheet with the same instructions.

What do we need to send to prove I'm re-establishing domicile in the US? We plan on sending my job search correspondence, a one year lease between my mother and ,A plane ticket to America, and a bank transfer from my wife's Chinese account to my American account. I know it is different from consulate to consulate. Does anyone know if this would be enough? Any ideas for how I could strengthen my case? Please, help I really really really don't want to fail.

I have none on camera or memory disk anywhere. I do have 4 pics from emails, but we must go to ecuador consulate, 4 is not nearly enough... They are really big on proving relationship PRIOR to the filing of the I-129f.

Checked on sending hard drive off to recover. Cost im told is over $1000. :(
how am i suppose to show the our evidence of keep in touch with each other with no phone calls and letters?

I was wondering if someone had an idea whats going on with CSC in getting their paper work out. I know things slow down but I am looking and in August over 30 people answers on their 129F _getting a K1 visa) for their NOA2, but in September only 6 people have gotten an answer back. Also 35 more new applicants applied in September. (I got ours started in August) What happend to the CSC did a lot of workers get laid off with the economy finally or soemthing? It's almost like the process has come to a halt and I want to know why please if you have information (which I know lots of people are only guessing) Anyway news good or bad please let me know. New prices for I-129F were announced Sept 23rd, maybe this is old news but starting Nov. 23 the prices are being dropped back down to $340 for an I-129F.

Most of us recently had to pay extra when they raised it a lot to $455 in July. Now it's not the end of the world and I am thankful that USCIS was able to lower the price to even I-129Fs compared to other visas (almost all other visas are going up, except for a select few).

Anyway hope and pray I know a lto of us have waited a long time (mostly CSC others too) just wanted to share the news with everyone.

Are you filing your I-130 locally?

Yes, I am a resident in China, so I'll be filing it through the Shanghai consulate, which will then send it on to Beijing. Why, does that make a difference for one of my questions?

Hi everyone,

I have 4 questions concerning my application on behalf of my wife for a CR-1 visa. I appreciate any help that anyone can give regarding these questions.

1. We applied earlier for a fiancee visa for my wife (before we were married, obviously), but later decided to get married and apply for a marriage visa instead. We are planning on canceling the fiancee visa application, but cannot do so yet, as the Guangzhou consulate is currently on vacation for the Chinese national holiday. On the I-130, question 16, it asks the following (Checkboxes represented by a capital X):

Has your relative ever been under immigration proceedings?
X No X Yes Where _________ When _________
X Removal X Exclusion/Deportation X Recission X Judicial Proceedings

What should I put for this? Does our previous application for a fiancee visa for her count as "immigration proceedings?" If yes, what would you recommend I put for "Where" and "When?" How about the second line? Do I need to check any of those options?

2. Question 21: we are currently living together in an apartment in which we have been living since September, 2005. What should I put under "To:", as we are still living there right now? Will "Present Time" suffice?

3. We got married in China (she is a Chinese citizen). If anyone reading this got married in China, could you clarify for me what we need for our application in terms of our marriage certificate? We mentioned to the officer at the Marriage Registration Office that we would be applying for the visa, and he did the paperwork necessary to get a notarized notice officially stating that we are married, but he did not translate our actual marriage certificates. He said that the notarized notice is enough. Can anyone here corroborate this for me?

4. I assume that my mom will be sponsoring us later on. (We will need a sponsor later on, correct? I don't have much money of my own right now…) It's possible, however, that it will be my dad (my parents are divorced and live in separate states). As we don't know where we're moving yet, I plan on putting my mom's address as the location where my wife intends to live on moving to the U.S. (question 18). If I do this, and later my dad is the one who sponsors me, will that create any difficulties later on in the process? Would it be best to determine right now, before I submit the form, which of my parents will be sponsoring us later?

That's it, everyone. I know that's a lot of questions; I will greatly appreciate anyone who can offer me advice on any of them. Thanks a lot!

Have you looked into filing directly with the consulate (unofficially referred to as DCF). This may be what the person you spoke to was in a round about way referring to.

Thanks for replying, everyone. Sorry it has taken me so long to get back to you all—it's been a busy few days. I ended up doing the same thing as micky-sabry: I reapplied with an I-130, but directed them to our previous file, which will hopefully speed up the process some. To answer your question, aussiewench, yes I filed DCF. I work here in Shanghai, so I was able to file directly with the Shanghai consulate, who has forwarded my petition on to the DHS in Beijing. Hopefully I'll be hearing good news from them soon. Time is pretty tight for us!

IR-1 / CR-1 Spouse Visa Process & ProceduresUpdating a K-1 fiancee visa application to a CR-1 application?
Hi, everyone. I've posted on here before about applying for a CR-1 through DCF in Shanghai for my wife (recently married) and canceling our previous application for a K-1 fiancee visa. We applied for the K-1 fiancee visa in March of this year, and it's currently in Guangzhou (supposedly), although they don't have it in their system yet, as they apparently only update their information once a month.

I called Guangzhou on Friday to try to cancel our application (I had called once before), and the woman told me that I should call back in the middle of November to check whether it would be possible to update our K-1 application to a marriage visa application, or whether we would need to cancel the application and reapply for a CR-1.

This surprised me, because I had never heard anywhere before that it might be possible to update our current application rather than submitting a new one. I asked the woman on the phone whether this was possible, and all she was able to tell me was that I would need to ask that question when I called the next time, after they had our application in their system.

Has anyone ever heard of this before? Has anyone ever done this before? What is involved? Is it possible, or was the woman who spoke to me misinformed?

This is a crucial decision for us because our time for the CR-1 visa is very tight. We need to get over in time for my wife to start grad school in August or September, and we would like to get over early enough for me to have time to find a job in the area where she will be attending school, preferably in the spring so that I can look for teaching jobs in private high schools in the area before all the available positions are snatched up. If it would be possible to simply update our current application, it could save us a considerable amount of time. However, if it's not possible, or even if it's very unlikely, we will submit our application for the CR-1 this week so as to get the ball rolling on that as quickly as we can.

If you went through Vermont, there is a very good possibility that your fiance will have her visa long before September. Vermont approves fiance visas in as little as a couple of weeks. Then, you'll just have to do the medical exam and interview and she can move here right after getting the visa.

Is there a reason that you suspect she may not have her visa before September?

Well, everything we've read about the K-1 application process seems to suggest that it will take at least 6 months from start to finish. We filed in March, and then had to wait for a request for more information, which slowed things down a bit. Plus, from what I understand, the real time killer is going from Vermont to the Guangzhou office and then waiting for everything to go through down in the Guangzhou office.

Is it really as bad as zyggy suggests? I really hope not . . .

Hi everyone, my fiance (Chinese) and I began the K-1 visa application a few months ago and are expecting a decision from the Vermont center in a month or so. However, she just recently received word of an opportunity to study at a university in the US beginning this September (for various reasons she was originally planning on applying to begin study at an American institution in the fall of 2007, but this opportunity is too good to pass up). If she is accepted, she will need to apply for a student visa as the K-1 won't come through in time. This makes us really nervous, as from what we understand one of the biggest reasons that people are rejected for student visas is that they cannot prove non-immigrant intent. Will the fact that we have already begun the K-1 application negatively affect her student visa application? If so, what would be the best way to counteract that? Would we need to cancel the K-1 application before beginning the process of applying for her student visa? Has anyone on this forum been through a similar situation? I appreciate any help anyone can give me, as we are really nervous about the possibility of her getting rejected for her student visa.
