I have a friend who said his affidavit for himself just stated zero income and he didn't even include his tax returns, since his dad was co-sponsoring his.

I'm kind of in the same boat, with no income, but I've got sponsors from relatives, and I'm pretty much doing the same thing, filling out an affidavit that says I've got nada.

A "relative" not "relatives" may act as a co-sponsor.

Hah, well, that's good to know. Means I need half as much paperwork from them now.

ChinaPolice Record
My fiancee was with me in Chongqing when we needed one of these from her home city of Qingdao. Her father was able to get one on his own with just her ID Card number, wasn't a problem he said. I think he may have taken their household register as well, to prove their relationship.

It was actually the second one we had to get, as the consulate won't accept them more than 1 year old (we initially sent one with our petition package.)

It's just a paper printed out by an officer that says she's clear of crimes or any felonious record.

If she has friends in the city or family, see if they could get it for her. Hopefully you could do that, but who knows. There's no such thing as "similar" when dealing from one chinese institution to the next.

ChinaVaccinations
I'm a little confused on whether or not my fiancee should get her vaccinations before the interview or after.

The exam hospital says that she should come back after passing the interview to get her vaccinations.

The medical exam forms are a little confusing to me, and I want to be sure that we don't show up on the interview date and have them slam us with a reschedule because we didn't get the vaccinations at the right time.

Help is always appreciated.

ChinaNotary Services at the Consulate
I have an appointment at the consulate for the notary services. One of the forms (I'm sure) that needs to be notarized is the certificate of legal capacity/intent to marry that my fiancee must sign.

Does she need to be present in front of the notary officer? And if so, is it a pain in the butt to get her inside the consulate to do so?

I made our appointment on monday last week, (man it really bites they were taking so much time off this week, cause our interview is Tuesday and the only available day between last monday and next tuesday, was next monday.)

ChinaWe passed the interview, but should I be nervous?
First of all, thanks to this place and those that offered their help, it was certainly beneficial.

We went in today, she passed, but here's what's making me nervous.

I am not really in a great financial position, to put is bluntly, I'm poor as hell, so my mom offered to be a co-sponsor (I'm poor as hell, she's rich as hell, perfect balance.)

But, the chinese lady who took my fiancee's forms didn't take my mom's affidavit (even though my fiancee showed it to her) and the officer even approved the case.

I mean, I'm happy we passed, but should this be something that worries me? Or is the financial stuff just one thing that may not matter if everything else is in a row.

(I would think our relationship is more than bonafide, we've been living together for almost a year and have plenty of photographic proof of it.)

Thoughts?

ChinaPLEASE WRITE UP YOUR INTERVIEW REVIEWS
Is there any way to get a sticky on this thread? It'd be nice for all the chinese based visa cases to see an interview review thread right up top.

Here's ours:

First, I gotta say I recommend getting to Guangzhou at least 7-12 days prior to the interview. I think if I came down with 5 to go we would have been shot down.

The medical exam took us three business days to get back, but 5 actual days (she got her exam on a Friday.) And it seemed like almost every day I was finding something else that I should have included in our packet, right up to the day before.

Among those was what's called proof of domicile. When went to the notary appointment (speaking of which, make an appointment before you go, as early as you can for the notary service, because when I booked on Friday, they had nothing available until the Monday of the next week), anyways, the notary, the lady I talked to there looked over my intent to marry letter and relationship letter and mentioned the domicile stuff. Just an email from my parents saying they were providing us with a place to stay (I've been in china for two years), I printed out online bank statements, and had an uncle that owns a business write me an email with an interview offer (not even legitimate really, but how would they know?)

That's all to establish a kind of residency that we'll be going back to in the states.

Also, make the time to get yourself to the American Citizen's Hour every Monday at 2:30 (be there at 2). Now, this thing didn't work like I thought it would. I thought it would be a group Q&A session, but it's basically a one on one you have with a visa officer. Personally I would have preferred the group thing, because by the time I did this, I had zero questions, but I was ready to take notes on other people's inquiries.

My questions had to do with the proof of relationship and the support forms. About the cash: he said they look for 125% above the poverty level (at the time I went it was $18,213).

As for relationships, I'm sure overseas loves have a nigh on impossible time dealing with this, but my fiancee and I have been living together in china since late October of last year. And as the officer said, people living together, reasonably should have lots of pictures, which we did.

Our personal documents included more than a dozen pictures, air travel receipts (with our names on them), insurance tickets for some other tickets (when we didn't have the tickets), we even had a pair of tickets when we went to go see The Nutcracker during our Christmas trip to Shanghai.

To seal the deal, we included pictures of our dog. From his puppy stages to the adorable demon monster he's grown up to be. You want proof people have a relationship? That they have a dang dog together.

Okay, enough with the preamble, here's the interview day stuff.

We got there about 6:30am and there were already plenty of people in line, and in typical chinese fashion, nobody respected personal space. Deodarant, gone in 15 minutes. At about 7:10am the building guards came out with rails to corral people and organized the mob into lines (some girl was trying to cut in front of us but we wouldn't have none of that, and neither would nobody else in the line, ha ha, back of the row!)

At about 7:20, they started handing out number tickets and letting people go in. They don't allow the any accompanying party (even if you're an American citizen) until after 9am. But I was way too nervous to be waiting next to my fiancee, so I just did it right outside the exit to the consulate.

We had all of our stuff organized very neatly in plastic folders using little post-it tabs and paper clips for each section we needed (like tax forms together, copies of passports together, that sort of stuff.) And we rehearsed every night for the 4-5 nights before the interview how she should present the information.

Things like saying "This is my fiancee's affidavit, these are his taxes showing his income for etcetera etcetera". Other stuff like going over our pictures, explaining my numerous visas (between my tourist and resident visas).

Now, I used to be an IELTS instructor here, so I'm very familiar with teaching people about interviewing with foreigners. So I made sure that she did a few things I felt were very important. The first was that she never ever refer to me as "my fiancee" that instead she used my name. Maintaing eye contact, smile, and keep her speaking in a natural flow. Anybody who's heard chinese people rehearse answers knows that they tend to come off sounding like a memorized robotic language, and if I were an officer, I would seriously scrutinize that tone when evaluating the validity of a relationship.

She's unsure of the time frame, since they confiscate all electronics before going in (who wears watches when cellphones work just as well?) and I did not see a single clock any time I was in the same building.

First she had to hand over all of our documentation, which was the first part of the weirdness, because on my affidavit of support, I do not make enough to support her, so my mom was ready to be the co-sponsor. But the chinese lady at the window seemed to think my stuff was enough. Handed her a number, called her up, had her testity to the validity of the submitted forms, called her number again, fingerprinted her, she sat down, called her number again for the interview.

I estimate that she interviewed around 9:50am, because she had passed quickly and I saw her roundabouts 10am.

The officer asked her 5 questions.

"What's your fiance's name?"

"When did you meet?"

"How did you meet?"

"What will you do when you go to America?"

"When will you leave?"

The first 3 answers she explained (private!), the fourth she mentioned she'd go to the university of our city, the officer asked if both of us would go, "yes."

The last one, her answer was "We have a dog that we have to get a travel certificate for, and after we do that we'll leave? You want to see our dog's pictures?"

He said "Sure" and that's when she showed our pictures to the guy, who mentioned that our dog was "cute".

He said, "Okay, you passed" handed her the pink slip, she walked over to the counter to pay for the 20rmb delivery fee (pay for the damn delivery but we gotta pick it up... America...)

Our interview was on Tuesday, we had the visa on Thursday, we've made our travel arrangements and are just waiting to jet on out of here.

Her thoughts were that it was pretty easy to pass, it was like interviewing at a bank, and that most of the chinese people's stories she read online about failed interviews, were obviously people that weren't prepared because they were morons or lazy.

(Not that America makes it easy, but they do that for a reason.)

She noted that one person she saw failed, didn't correctly answer the question "When was your fiance born?" I'm not sure how big of a criteria that is for pass/fail, but people that have a relationship remember stuff like that to the number.

My postscript thoughts: I think what got us through is what I learned from here. That the people that pass are the ones that are super-over-prepared. I was so paranoid in the whole run up to this thing, and I think, that if you're not paranoid, you've done something wrong.

While we were in line, I took stock of what people were taking with them into the interview, it's pretty obvious to know who failed and who passed. Those of us who have been there know the difference between the people walking either towards the law offices for the rejection petitions, or the ones walking directly to the travel agencies. And most of the people I saw walking out in failure were carrying little to no paperwork with them.

As many have said before, better to have too much rather than too little.

Man, I kinda rambled there.

Sorry I probably titled this wrong as this is just speculation on my part after reviewing the data. The data is all from USCIS web site that I used. I can't say this is the only or main reason for the visas, just my educated guess:innocent:

USCIS Service CentersThe recent CSC data shows why no visas are out.
Hello Everyone. Now I don't know this for a fact, but I noticed some information and realized why most of our visas are sadly getting shoved aside for other types of visas. Obviously if anyone was thinking this it is correct.

In Aug 2010 almost 640,000 visas were issued that's over 100,000 more than the national average on record. So who got all the visas? unfortunately not us...

A recent spike in I-765 (some not major) and I-821 (major spike) shows what the CSC workers on I-129F and I-130 have been busy doing. They took the workers away from these departments more than any other (I'm assuming after noticed no other major drops in other visas being issued) and put them to work on I-821s. Sadly if you look at this chart the spike was still going up rapidly and who knows when it might stop. By the way I-821 are temporary protective status visas.

No maybe I'm missing something obvious and I apologize if I am, but I do not know the reason for this and unfortunately no end appears in sight. Anyway I'm not here to judge I just noticed this appears to be where the visa workers are concentrating on right now and it appears, at least from August data that this depart is growing extremely fast and will need to use many workers for a long time. I do pray I'm wrong and it had a major turn around, but people do need to be protect I guess for whatever reason.

Thanks for your time,

Best of luck to everyone!

Here is the CSC data

ChinaCurrent interview cost
So we got our packet 3 in the mail and sent it out, no problem.

My question is in the packet for our K-1 visa it says we need to pay CITIC Bank 131 USD and present the receipt at the interview. The problem is the website in Guangzhou claims the payment should be 350 USD. Anyone know the exact amount we need to pay? perferable someone who got a visa from Guangzhou recently?

Thanks for your time.

US Embassy and Consulate DiscussionDOS giving K-1 interview date?
Hello I am looking for some friendly advice, for a K-1 visa.

My fiancée sent her packet 3 back to the embassy about two weeks ago and we have been waiting for her packet four to give us the interview date. She recently read online you can call the Department of State to find out her interview date, so I proceeded to call. When I called the first time they confirmed her given and family name and our case number and told us our interview date is April 13th. The ladies accent was a little hard to understand. I proceed to call again later that day to 100% of the April 13th date before I buy my tickets.

The 2nd call was answer and told no interview date, confirming my fiancée name, our case number from the embassy again, and for some reason wanted my fiancée passport number. The new lady sounded upset and insisted we didn’t have an interview date. This is the exact same phone number as called before (202-663-1225). This made no sense; it was 100% the same phone number and department.

Waited a day to call back (3rd call), This new lady is saying our K-1 visa interview date is April 13th. She spelled out both our names case number and birthdays. I have no wish to call many times and be annoying.

Do you think it is safe to assume our interview date is April 13th and ignore the lady that said no date is scheduled?

Has anyone else called the state department and been given the correct interview date before their packet 4 is issued to them?

I found EXCELLENT prices on tickets and want to buy them today or tomorrow before prices go up as they keep doing.

Thank you for your time in reading my long message, Phillip

K-1 Fiance(e) Visa Case Filing and Progress ReportsOur K-1 was denied in Guangzhou
I do hope the best for you, but I do agree the 61 to 23 age difference is a big strech even in China plus the previous K-1 divorce from a Chinese girl. Still I am young and maybe I don't understand the situation very good myself. I do feel bad for you because your doing everything right on your trips to China and letters and donig the best you can. The fact is after a divorce for a K-1 visa and a 61 year old man to a 23 year old girl is just hard to accept to many people still, I do believe anyone can love almost anyone for who they are, but this age difference is a lot.

I do wish you best of luck sir. Just my 2 cents sorry if people disagree with me.

Igore's list on this site under "Immigration Timeline". Actually one got approved that filed on Aug. 26th like 2 weeks ago. I'm CSC too and mine was filled Aug 24th. We are hoping for early December now, but heard all K1 and K3 visas are a lot slower. (Seems like I-129Fs at CSC are the worst) maybe I only think this way because I'm a CSC I-129F but its really sad... hope and pray all we can do.

ChinaWhere can I get an AFFIDAVIT OF SINGLE STATUS

while researching CR1 process, I had to ask about this. Getting an AFFIDAVIT OF SINGLE STATUS is possible in NY, according to someone who got approved on CR1.
If you're single, write up a document stating your status. Get the document notarized. Bring it to City Hall or County Clerk's office to have it certified.
If you were married, get the document from City Hall/County Clerk's - make sure it's official & all.
Bring a copy of the certified document to the Chinese Embassy where they would approve & translated the copy.

I can't say for certain if other Chinese Embassy offices are willing to do this, as I was told about this process from someone who had it done in NYC.
But if it was me, I would try to get it this way while at home in NY, since doing it in China would mean having Shanghai as an extra stop. Worse case scenario, the NY Chinese Embassy doesn't do it, and I'd go to Shanghai by myself anyway.

I am in the US and can get my Marriageability Affidavit from the county clerk's office right now (August). I am getting married in January. Do I need to get the affidavit translated? And must it be at the Embassy or can it be done locally in Nanchang, China?

Since I am going to Beijing in January, if I have to go to the US Embassy in China, I will probably do it there.

If I do have to go to the US Embassy in Beijing, is there an advantage to getting the English copy of my Marriageability affidavit in the clerk's office instead of at the US Embassy in Beijing especially if I have to get it translated anyway at the US embassy in China?

Finally, how many hours does the process take to do this? The Guangzhou office said it was $50 dollars. Is it the same fee in beijing

I had my affidavit done through visarite.com. It worked for the most part except it needed more chinese translation of the english portion even though the form was bilingual. I forget the details but I think they wanted the translation of the US notarized part.

Do you know what visarite went through? Did they go through a US Embassy in China or a Chinese Embassy in America? How did you get your notarized translation and how much did you pay?

Since this was moved to another topic category, I had a heck of a time finding my post. I finally thought of searching for my username LightSear and I was able to find it. Does anyone know other ways to see your posts in visajourney?
Wow, New York's Chinese Consulate webpage is way more organized than Chicago's. It is much easier to find important information. For those doing the same thing as me, and in the midwest, here is the webpage for authenticating documents: http://www.chinacons...g/ywzn/qzhz/gz/ It is under the title, "Visa & passport" which is why it was so hard to find. Click on Authentication for information on authenticating. It looks like a three step process. Going to the local notary, than the State Notary, then the Chinese consulate in America. I'm guess they do it this way so that the Affidavit is bilingual.

I am no longer in the position to be able to get materials in the states. I will revert to plan B. It seems it will be less hassle anyway since I'm already going there for vacation beforehand with my parents and siblings.

Here's my plan:
Set-up an appointment to go to the US embassy in Beijing after international plane tickets have been confirmed for my family. They are coming to see the wedding. Go to the US Embassy in Beijing at appointment timeGroom (me)-Swear that you are not marriedPay $50 feeReceive Affidavit of Marriageability Go to the civil affairs bureau ??? Mínzhèng júin the district where their ?? Hùk?u is registered (nanchang)Bring:Valid PassportJustine's Chinese Residence permitAffidavit of marriageability.Three wedding photos of the coupleMoney for Registration Fee

Two questions for the community:
Does anyone know how much time the US embassy in Beijing will take processing the Affidavit of Marriageability?
Is the affidavit of Marriageability that I will receive from the US embassy in Beijing usually good enough for the local civil affairs bureau
??? Mínzhèng jú? Some have said online that it needs to be a translated copy, but I would imagine that the Beijing consulate would produce a bilingual copy that would be acceptable at local civil affairs bureau??? Mínzhèng jú.

ChinaGetting Married in China
Hello All,

It was suggested that I start a new topic on the legal aspects of getting married in China. I have discovered a few things, but a few things I'm not sure about with the process so I wanted to get some thoughts.

I will Marry January 19, 2013.
My Fiancee will come back from Australia (she is studying abroad) in late November, 2012.
I know I need to produce a Marriageability Affidavit in order to get a Marriage license in China. There seems to be varying opinions on this matter so I wanted thoughts.

So far I have two plans I have been considering:
PLAN A
August 2012-Purchase a $10 Marriageability Affidavit at my local county clerk's office in America.
August 2012-Have the Affidavit notarized at my local bank for free. (does it matter where?)
Jan 19, 2013-Marry, take at least 3 marriage pictures.
Jan 26, 2013-Go to the Chinese Civil Affairs Office of Nanchang with my wife, my passport, 3 marriage pictures, and the local registration fee (I still don't know what it is.

Are there any problems I might run into do it this way? It much less expensive.
Someone had told me that I need to have professionals translate the marriageability Affidavit. Others have said, they don't even look at the Affidavit. I'm sure it varies from city to city. Anyone have thoughts on that?
Does it matter where or how I notarize? Are they going to be looking for a US/specific seal? Are notarizations just an official piece of metal raising the paper in China?
There is a document that is available online from the Guangzhou website: photos.state.gov/libraries/guangzhou/47024/ACS/acsaffidavit.doc. Should I print this out, bring it to my county clerk office, and have them use this for my Marriageability Affidavit or will my clerk's office Affidavit be enough?
Does it matter that I am getting my Marriageability Affidavit 5 months before my marriage and when I will apply for the license?

PLAN B
January 8-I go to US Embassy in Beijing (I will be visiting there anyway) Pay $50 for obtaining and notarizing the Marriageability Affidavit. Pay for someone to translate it.

Jan 19, 2013-Marry, take at least 3 marriage pictures.
Jan 26, 2013-Go to the Chinese Civil Affairs Office of Nanchang with my wife, my passport, 3 marriage pictures, and the local registration fee.

Like I said before, I'm not sure about getting it translated. Plan B dodges any problems I might have with getting my Marriageability Affidavit 5 months before my marriage.

Any thoughts would be greatly appreciated.

K-3 Spouse Visa Process & Procedures5 Month Anniversary
My husband filed the case in January. My NOA1 from CR1 is Feb 11th and K3 is March 10th. After 7 months waiting, there is still nothing, very deppressed by VSC's shitty work. My husband said he wants to go down to Huston to talk to the immigration director there, but I think it's just going to be a big waste of money and time. I want my NOA2 crying.gif

K-3 Spouse Visa Process & ProceduresWeek of August 18
I see so many people in CSC got approved, even thogh they applied so much later than us. And after almost 7 months waiting, I still get nothing. Not even a touch. I lost my student visa when I come back with my husband to China at the beginning of this year and have to stop my college. I was planning to go back to school after a year, but now I really feel confused about this whole process. I am so worried that I cannot get back and going to miss another semester. My husband and I were separated one month after our marriage. We found out that I cannot go back to US because on Christmas Eve. The only reason they cancelled my student visa is that I married an US citizen. How on earth could this make any sense? Moreover, I thought the longest waiting for NOA2 is going to be 6 months, but now it seems to be endless. I really feel that I'm going insane. This immigration law has no humanity. Where are all these human rights, which politicians talking about all the time? I guess they just do not consider people who are trying to immigrate as human beings and of course neither are their Citizen-Spouses. I just want to cry out in front of the white house that "we are not chimpanzeens!"

Sorry for all the complains.
Hope everyone votes for the political group who support less painful immigration laws!

K-3 Spouse Visa Process & ProceduresK3 PROCESSING TIME
Hi everyone,
I sent out my application on Jannuary, and got NOA2 in August 26th. It took 7months and half. I was furious with the VSC and feel hopeless. Then one day I wake up from the call from my husband, who told me "we got it". I couldn't believe it is true until I saw the website.
VSC sucks but those who filed in Feb should receive it very soon now.
Good luck for everyone and waiting for more people get on the NVC waiting que!

Waivers (I-601 and I-212) and Administrative Processes (221g)State Dept - Pending Security Clearance

Is that number strictly for fingerprint checks or will they also give you information about FBI name checks?

yes, that no. is just for fingerprints check, they won't give you information about name check. but you can contact DOS visa office to know your case status directly. 202-663-1225. good luck!

Waivers (I-601 and I-212) and Administrative Processes (221g)State Dept - Pending Security Clearance

We waited 18 months (yes the Dominican Republic is tough) for a K-1 consulate interview, which I attended. We were interviewed separately by two different men --- and our answers were right on. They said they believed our relationship, but needed to do further administrative processing. They were very vague. Although the taking of all 10 fingerprints was a clue.

After speaking with the State Dept visa specialist, he is pending security clearance. She says his fingerprints have cleared and that the security clearance takes ON AVERAGE 3-4 months. His started in late April.

I'm pretty sure he has a "false hit" on his name. This is what I get for falling for a Latino with a "common name".

Does anyone have experience with passing State Dept clearance, recently? Any ideas of how to track progress --- besides calling the visa specialist monthly?

Thanks for sharing knowledge.

hi, I'm sophia from China, I have the same issue with you, after interview in January, the consulate asked me to wait for background check, andllater they told me that my namecheck is completed in April and asked for for fingerprints check end of April. I think it's cleared in the same day since my husband called FBI about it. now I'm waiting for the security check to be done. hope it come fast,Good luck for us! write to me if you got any good news, thanks!

Hello! I have a question regarding how your husband called the FBI. How did he do it? Is there a specific number he called? My fiance and I have been stuck in AP for the last almost 3 months now. I keep on calling the Department of state and keep on getting the same answer that your case is still pending security clearance. It would be great to find out in what phase of the security clearance his case is in. Thanks!!

hi,dos told me my security check is pending, I emailed the consulate about my status, they said my case is under name check security, don't know how long do I have to wait.
the No. we called is as follows, when you call, you also need to tell them you alien Number, which is on the approval notice I-797C I think, and is better you can tell them you name and date of birth. best luck!
