Gosh - this is all so confusing. I thought I filled out the I-864 and my dad filled out the I-864a even though I live in Colombia and he lives in the US. This makes more sense I guess for us each to fill out our own I-864. Can someone else confirm that that is correct.

Also - I should use my foreign income on the I-864, even though it wont be counted?

it´s important to read the "purpose of this form" on the uscis website - "By signing this form, a household member who is not a sponsored immigrant, agrees to make his or her income and/or assets available to the sponsor to help support the immigrant for whom the sponsor has filed an affidavit of support."
as well as the instructions PDF which states under "who may be considered a household member for purposes of this form" it states that it must be a relative with the same principal residence (or 2 other conditions). if you live in colombia, russia, chile, or any other country, you aren´t sharing your principal residence (even though you might in the future).

VJ is great for offering previews of forms, but i recommend downloading them from uscis.go bc you might miss important instructions that way - http://www.uscis.gov...00045f3d6a1RCRD

my mom filed the 864 and we had no problems at nvc. my interview is wednesday, i don´t foresee any trouble with AOS part. once you read the instructions twice, the 864 is actually pretty easy to fill out.

your other question about the taxes, just order a tax transcript from the irs. it´s what nvc wants, needs, and prefers. it´s free and takes about 5 minutes to order online and have mailed to your house. to find it, just head over to irs.gov and enter their search bar. your transcripts should reflect foreign earned income.

Yes I do, and my Chilean address it he one I used on my petition..

So then I would fill out an I-864 and just claim one other person in my household - my husband... My mother would then fill out and claim my father, my brother, and my husband - BUT NOT me correct? correct, she doesn´t claim you as part of her household. as far as the deal with your dad, idk bc my mom is a widow, no younger kids so i am not sure on that part, sorry :blush: you would have to go back and review the tedious instructions.

you didn´t get expedited?? that´s too bad! did you put your chilean address on EVERYTHING? i think aug. 15th with the new immigration legislation and the change to the NBCs and all that changed everything (i see you filed in october)

turbo tax runs like $25, but if you need a previous year it can run up to about $45 i think. It´s super easy, and once you use it for one year, you can just copy the info from one worksheet and change it to another.

were you single in those years? if you have a pretty simple situation (just the tax exclusion) it´s not that hard to do by yourself.

He called the military helpline last night and the lady he talked to, said I could come to the US on a one-way ticket, tell the IO at POE that I'd adjust status and file in the US. Is this good sound advice? I have a tourist visa, we haven't filed for I-130 yet. I know I can visit for 6 months max.

Also - as far as reestablishing domicile, I plan on also using my receipt for payment of and the actual teaching certificate in my state. I wonder if other professions (lawyers, docs, nurses, cpas, etc) who are required to maintain/recertify, test or do other expensive transactions in order to practice their profession could use this as evidence of domicile. Why else would I have paid the amount I just shelled out if I was not going to actually go home and work? It´s logical to me, but that is not that same as being logical to the government. Thoughts?

Also - check with your local elections office about voting records. If I am not mistaken, the document asks for records, and not registration. In my county for example, I can print out a record of my voting activity (which elections with dates, etc) that shows I have been an active voter through for x years through absentee ballot. I can get mine online, but i called and they said they could also print and put an offical seal on it and then mail it to me no prob. I plan on bringing my card and my voter history, Ifigure it can´t hurt.

I had this question as well. I am filing from Chile with my fiancee. I know where to send the letters to, but I am not sure I should put my address as my stateside address because I don´t actually live there (fraudulent info). I have been living in Chile for 3 years now, and in out letter describing how we have seen each other, I intend to include that we live together. I also have my Chile address on my G-325a as my current address.

Krikit - I was under the impression that the cr-1 had to prove domicile or intention to reestablish, not the k-1? I just got confused :unsure:

My fiance and I are having the same issue - we both live and work in a foreign country, but our permanent addresses (where we are registered to vote, where his taxes go through) are in the US and the UK. If we put our UK/US addresses it feels like fraud? (since we are not living there right now) But if we put our Japanese addresses then it seems like neither of us has any residence in our respective countries (which is especially a problem for my fiance I guess). Do we put our home country addresses and then explain the situation in a letter? It's so confusing.


cookies and cream....i actually went home this last week to the us and visited the local USCIS dept and asked this question....she wasnt able to really give me a good answer to be honest, but she said "she would" (note she didn´t say "you have to" or "this is how you do it", so basically she didnt know) put the US address on the i129 or i130, but list the foreign address on the g325a. I am thinking about listing both of them as "present". I have tried called the 1-800-375-5283 number, but for my life can not figure out how to speak with a real person. It says that there are ppl 8-8, but there is no menu option to speak with anyone :S.

So basically, i know nothing more than i did a couple weeks ago.....however, if you read this thread, you will see that people living abroad are turning in their apps with a variety of addresses (all foreign, us and foreign, just us, some with explanations, some not). maybe in the end it doenst matter as long as your foreign post is reliable enough to send documents in?? http://www.visajourn...-living-abroad/

As far as I know, you will need to list a US address on the form. So, put your mom's address as the permanent US address and have your mom send you the documents you will receive from the USCIS there. On your G-325a list all your addresses with dates you lived there. They can see you currently reside in Chile from that form, and perhaps put a note about it on your cover letter as well.


For the I-134 you will need down the line at the interview stage,


Jay-kay - thanks for the response, but as far as the address goes, there is no place to distinguish "permanent US address" from others. On the G-325a there is simply a table for present and former addresses. So how do I list the US address as my present address and also my address in Chile (where I am presently)? Can I list them both as "present"? -OR- do I put my US address on the I-129f app and put just my present chilean address (with the formers) on the G-325a? I have tried calling the customer service number on the instructions pages (1-800-375-5283) but I just get an automated menu, no option to speak with a real person.

I know I don´t need the I-134 yet, but I happen to be in the US this week so I am trying to get all my stuff together now. I have the forms, but they don´t say how exactly to go about the co-sponsor process. IE - do I just send in one for me and one for my mom, or should I mention in mine that there will be another? etc....

Dear Fellow VJers -

Beginning my k-1 process I came across a couple questions...

For the G-325a (and all other forms for that matter)-
I am not sure what to put as my (the petitioner) address. I currently live in chile with my fiance on a temporary visa (3rd year there, with only short visits back to US), and i have exempted u.s. taxes based on the bona-fide presence residency test (residing out of the country for the majority of the year). In addition, I mention several times in my "circumstances of meeting" letter that I "live" in chile.
However, a lot of people are saying it is better to put the U.S. address (my moms house since i was a baby) since that is my "legal" residence (for example, that is my address for my voting registration). In the case that I should list my US address as my present address, how do I list my present chilean, or former college or other "temporary" residences?? I don´t want to get into trouble for saying I presently reside stateside if my physical residence is obviously in Chile.

When sending in proof of our relationship - my fiancee and I don´t write/speak in english....does it do any good to turn in our emails? or would we just need to have them translated??

Looking ahead at the I-134, I will definitely have my mother co-sponsoring with me. So, do we each just fill out our own I-134??
for question 11 (intention to make specific contributions) how would be the best way to word it, since we will not necessarily be covering "specific" expenses, but rather ALL expenses. How can one quantify that to appropriately answer the question?

The OP asked where in the instructions did it say to use black ink and I replied per the instructions.

The op (as previousl quoted by you) asked where it says to SIGN in black ink...we all know we need to write (print/type) the information such as names and addresses etc, in black (as correctly quoted by you in line 1, general instructions). I was simply clarifying for the OP that it in no place does it talk about the actual signature. (Not that I have heard of anyway).

And you are absolutely right, some get approved with black signatures, some don´t, and it is frustrating for all of us trying to take the best steps to be with our loved ones. I was simply trying to answer the OP´s specific question.

All signatures must be originals...photocopies are NOT accepted (hence the RFEs when the caseworker thinks that black ink is a photocopy).

Forever Waiting - line one asks for typing/print in black, but we would never type/print our signature - it would be an oxymoron. hence allowing signatures in blue.

Now to split hairs further :).........with a little VJ research we can see that blue sigs are accepted, i assume the date may also be in blue?

Hi marta - Congratulations on getting approved! isn't it great to know the longest wait in this part of the process is over? I actually have no clear idea of what will happen after this...I found this number on for NVC on the visa journey website 603 334-0700...but I haven't called it so I don't know what will happen with that....I haven't received my approval in the mail yet (i just saw it online), so I haven't seen any instructions for what happens next - all I know is that the petition will go to NVC, hopefully only stay there a couple of days, and then be sent to the embassy in the country of the beneficiary (for my fiance that will be ARgentina)....then the emabassy will contact the fiance and tell them what to do for the interview...so I'm sorry I'm not very much help - but there are a lot of other people on this website who are full of information so I'd suggest just posting your specific questions in the K1 visa forum and I'm sure you'll get some answers soon. i went all the way to the embassy yesterday to notarize the affidavit of support, just to be told that they JUSt changed the rules and it no longer needs to be notarized. so i asked fo for a copy of the DS-2001 and it says it need to be notarized. i always feel like they are sending me in circules and playing games. You might want to find out if you really have to go before you waste your money and time to get there.

It saddens me to hear your story. It will help that your wife is going to visit you in April, it must be great to see her after all these years.

I would try to used the fact the she didn't come in your favor. Was is a money problem, health, security, work? Think about it, it could help your case if you have a legit reason. The embassy will take that into concideration if you can present it clear and with some proof.

I know how rejections are, and separation its heartbreaking, and when you try to do everything right, but the final decision is out of your hands, can make you feel useless, powerless, and alone, BUT you got to fight, and becareful what you say, what you do, and how you do it.

I said the visa would be denied, not the petition. Denial will come at interview.

As pushbrk says it will come at the interview, so unfortunately you will have to wait out the cr-1 process then get denied :(

well ryan , wouldnt you think it would have been better to leave it in the generall area rather than in the i-601 , to catch more views, ???, so seeing as you have to power to delete, could you delet my question in the i-601 forum , so i can re post it where i wish to ask a general question

actually, I think that it is better in this forum, seeing as the advice you want is from people who are involved in waivers...and those people check this forum. a waiver isn´t something you want just any tom ####### or harry helping you on.

if you still haven´t found your answer...try PMing one of the senior members that you might have noticed has experience/wisdom about waivers.
