At the I-130 petition all that is assessed is the petitioner's eligibility to petition the beneficiary which includes there being a petition-able relationship.

The Interview is the actual Visa Application where the beneficiaries admissibility is determined.

Yes, you are able to prepare a waiver letter yourself. I would recommend immigrate2.us as they are focused on waivers.

But, the first thing you need to do is call today and find-out if there is a Deportation to overcome. If not I would ask them about sending proof of your departure now as to prevent it from happening in the meantime.

IIRC, the way it will work is that you'll be denied at the Interview as inadmissible and then have to submit a waiver (I-212 I believe). If you want to be ahead of the game you can contact an Immigration Lawyer once you know that you were indeed Deported in Absentia and try to have the deportation reversed by the time you get to the Interview stage.

Being a single parent is hard enough (I speak from 10 years experience as a single father), I can't imagine having to do it in the Philippines...

If her estranged husband didn't want her to get the Visa he could have withdrew his Petition or Affidavit of Support prior to her interview. For whatever reason he didn't. Technically she meets the requirements for a Spouse Visa.

If she was simply looking to cheat the system and get here before the gig is up then she would have got on the plane already but she is taking the time to fulfill her existing obligations in the Philippines

FWIW, I've never heard of the interviewer in Manila asking the spouse how the marriage is doing.

Stupid question maybe -- but why travel all the way to the U.S. with no promise of a job and with your marriage effectively over? I guess, I don't really see what's in it for you. It's one thing if there was some hope of reconciliation with your husband--who btw, sounds like a real piece of work--but from your post, it doesn't seem like that's happening anytime soon.


Because her chances of being able to move on properly are much better here in the US. Unfortunately there is so much negative stereotype about single moms (regardless of if the baby was result of marriage or not) and potential to make sufficient income to provide well for the child on her own would be 2 reasons I can think of.

The kid is a US Citizen, sounds like Daddy doesn't care about it at all. Try to enforce Child Support order in the US from the Philippines (or even get one for that matter). Her and the child will be better off here, meaning no disrespect to the Philippines...

Finally, knowing what I do of Pinay wives (well the good ones anyway) I would bet there is a corner of her heart that would try to fix the marriage given half a chance and she could be hoping that her arrival in the US would be that half of a chance.

Visa Class is CR-1 in my passport. This was what we applied for since we filed 2007 when we were less than 2 years. Will I know at POE if I will be getting the 10-yr GC or the 2-yr GC or, not until I get the card in the mail?? This is important to me because, obviously, if I get the 2 years, I will not be able to remove conditions anymore because I will not be getting back together with my husband anymore.

You should get a 10 year but even if you don't you can file for ROC in 2 years without him, just be sure to be divorced before the time comes. I think the biggest hurdle for you a Removal of Conditions will be proving marriage in good faith. Since you've never lived together as husband & wife or co-mingled assets it will look like a sham marriage.

If you traveled to the US knowing the marriage was over then it might not work well for you if you need to remove conditions after 2 years. I don't know how you'd be able to prove that you traveled to the US in hopes that your marriage could be mended.

If it was me, I'd find the form to file change of address with USCIS now since you have time before you travel. I'd also call the USEM in Manila and ask them about the IR/CR status of your Visa. Just explain that when you started the process you had not yet been married for 2 years but at the time of approval you had passed the 2 year mark.

I'm pretty sure I remember reading a few posts on VJ where the beneficiary received the 10 year GC even though their entry Visa was CR-1 because at the time of POE (which triggers GreenCard Issue) they had passed the 2 year mark.

"Immigrant visas are valid for six months and are good for one entry into the United States."



The Visa is Single Entry but with the I-551 Stamp it becomes a temporary GreenCard good for 1 year. This will allow her to leave & re-enter the US even without the physical GreenCard as it is proof she's a LPR.

1. I have read here over and over again that even if you filed for a CR-1 Petition, if you are married for more than 2 years upon entry, you will be given an 10 year unconditional PR. You're correct, you should receive the 10 year GC, look on your printed Visa does it say Visa Class is IR-1 or CR-1?

No problem at all, at POE they will stamp I-155 (or is it I-551) on your Passport which is equal to a temporary GC it allows re-entry.

No they are not expecting her.

I don't know this one but you can contact USCIS within a few days of arrival to submit a change of address. Maybe get an infopass appointment to ensure your GC goes to the correct address.

No, she has immigrant intent so she must use CR-1 Visa to enter the US.

The fact that she had to apply for a B Class Visa to visit the US implies that she was barred from using the VWP already. Either that or she didn't know that she could use the VWP at the time. I think the Visa denial would prevent her from using VWP now.

They cannot hire you until you have your SSN, the I-551 Stamp on your Visa in your passport will act as a Temp Greencard for both SSA and any potential employer.

I would suggest you go the the local SSA office and apply for your SSN, it isn't uncommon for USCIS to "miss" sending the paperwork to them.

If you filed for CR/IR Visa then you've already paid the IV (Immigrant Visa) Fee to NVC. K-1 Visa applicants pay the Application Fee in the country of interview (some on Interview day some before)

Generally the only thing to pay AFTER any Visa APPROVAL would be delivery fees which are paid directly to the Courier Service and then only if you're not returning to pick-up in person.

She entered on her first J-1, met you and married in a short period of time

or

You and her were in a long term relationship before her first entry into the US, she entered on a J-1 and never followed the original intent of that Visa.

I wouldn't worry too much as this is her second J-1 and she didn't have intent to immigrant when she entered. Marry her & AOS.

Yep, filed the I-130 mid April, Received NOA2 mid August.

NVC Processing was September with case complete in the first week of October.

Interview was originally Scheduled for Nov 23 but she called and got it moved up to Nov 18.

Visa was issued on Nov 24, she was on the plane Nov 25!

In reality, unless your spouse is Canadian, it's nearly impossible.

Having a petition is solid proof of immigrant intent. Hide it or lie about it and you've committed misrepresentation which gets you a lifetime entry ban that isn't waiverable. How will you overcome the intent?

I married my wife in Jan-2009, filed the petition in Apr-2009, she landed here in Nov-2009. We both hated being apart but 8 months (and 1 day exactly) after her POE the pain of the separation has long faded.

The real question is how will you get into the US?

As you have immigrant intent you cannot legally use the Visa Waiver Program.

If you apply for another Visa (like B-1/2) the application will ask the reason for your visit and if you are honest ("To live with my USC Spouse") it will be denied.

If you use the VWP or lie on a Visa Application it can lead to a lifetime entry ban for misrepresentation.

So, I ask you again: How will you get here?

The Consular Section of the Embassy gave you bad advice about entering the US once a year to retain residence. If such a pattern is noticed at POE they can go so far as to make you have to appear in from of an Immigration Judge to explain your situation.

The Green Card is for residing in the US and the pattern of entry you mention isn't residing in the US.

When you are ready to actually live together in the US then you should file DCF at the nearest US Embassy.

This incident should have no impact on future DCF beyond them asking why she never used the previously issued CR-1 Visa.

Hi, my wife had an I-551 visa in her passport prior to our entry yesterday to the US. This immigrant visa has the "IV issue date" of 07Apr2010 and "IV Expires On" 11May2010. It says "Upon endorsement serves as temporary i-551 evidencing permanent residence for 1 year".


POE handled it properly, her Immigration Visa expired back in May for whatever reason.

Also as other posters have mentioned you shouldn't have filed for an IV for her yet as only returning to the US once a year on vacation doesn't fulfill her residency requirement.

The number one reason is because you just really never know when it might cause a problem (real or not) and by then it's too late to avoid the issue because you're already in it.

I can’t believe his insurance denied you. My insurance had no problem adding my wife to my policy even when she was still in the Philippines. They have no problems reimbursing me the cost of her medical treatment. All you should need is proof of marriage like your marriage certificate. I would really pressure your insurance company to add you.


From the way the OP is worded it sounds like:

They assumed that she couldn't be added before she was physically present in the US so they didn't attempt to add her within the 30 window after their marriage.

Now that she's here they want to add her but his open enrollment isn't until December and they don't have any other "Qualifying Event" to use as the basis for adding her.

There is nothing that can be done to pressure the insurance provider to add her. They have strict policies regarding this and will be in big trouble with the regulators if they don't adhere to them.

Sorry but the Health Insurance Company isn't stupid or even wrong in this case.

To add someone to Health (Medical) Insurance you need to have a qualifying event. You then have 30 days from that qualifying even to add them. Here is a list of Qualifying Events:

1. Birth
2. Marriage
3. Loss of Other Coverage
4. Open Enrollment
5. New Hire

Immigrating to the US or even obtaining any kind of immigration status is not a qualifying event.

Your husband could have added you after your marriage even with you residing out of the country but any benefit you are entitled to in another country would be minimal.

When we married I choose to not add Anna & Gabby to my insurance as we didn't know when they would be coming to the US. Once we made it to the NVC stage I decided to add them at the next Open Enrollment period which was October. They arrived at the end of November and had coverage!

@OP, neither of you should assume that your gf's 4 years of illegal presence left no tracks in the US. You need to find out how the original attempt to enter was handled by CBP to determine how deep your issues will be.

Also understand that during her visa application she will have to disclose here address history. If she lies and says that she was in Mexico during that time she can face misrepresentation charges which would result in a lifetime re-entry ban that can't be waived.

Even bigger issue is did she ever present herself as a USC? How did she work while she was here?

When I filed our I-130 Petition last year all I included as proof of Bona fide marriage was:

1. Certified True Copy of our Marriage Contract.
2. Statements for 2 Joint Bank Accounts (BCU & State Farm Bank).

We were approved in about 4 months without any RFE.

It seems like they really look hard at the co-habitation/co-mingling of finances after your alien spouse has arrived in the US so you should start preparing for ROC ASAP upon arrival.

A Ban would only be in effect if they charged him with Misrepresentation. I believe they would give him a letter notifying him of a lifetime entry ban if it applies.

My wife's visa was approved on the 18 of November and was delivered about 1 week later.

She called me the second she received the package, I got online (Expedia.com) and booked the first available flight which was in less than 10 hours! Usually you can't do that but since the flight was technically for the following calendar day they allowed it.

Actually I think the requirement is only 6 months...

I read the I-130 instuctions and my wife's kids fall into the part of the form for unmarried children under 21 and so no seperate I-130's needed for the 3 kids.


If you were going for a K-1 (Fiancee) Visa then you're right but you'll be filing for CR-1 Visa for your wife & CR-2 for each of the kids so you will need 4 each:

I wan't unemployed at the time of my wife's interview so I made sure she had copies of recent pay stubs to back-up the AOS from NVC stage which included 2 years of tax returns and an employment letter. The IO at the Embassy never asked for updated AOS information. I would agree that you should have a co-sponsor ready by interview day (make sure you wife has the co-sponsor documents in hand that day) but only offer it up if asked for updated proof of income.

Once "activated" the IR-1 & IR-2 Visas are no longer valid (i.e. the expiration date is irrelevant) as they are single entry immigrant visas.

Upon entry all 3 passports will receive an I-551 Stamp which will act as their temporary Greencards until the actual greencards arrive. Once they've clear CBP they're Legal residents of the US! No need to leave but they are require to maintain US Residence (of course living with you at overseas postings counts also).

If you paid the IV Fee to NVC then there is nothing to pay the Embassy except maybe for the Visa delivery.
