In the Philippines the mother has sole parental rights to any child born out of wedlock, see the link in my signature for the details.

Even if the biological father signs the birth certificate acknowledging the child he still has no parental rights unless he specifically seeks them in court and is awarded such.

The bad news for you is that if she files for divorce then the Philippines will never recognize it. If her USC Husband is the petitioner in the divorce case then she can file to have the divorce recognized in the Philippines.

Her only other option is the get annulled in the Philippines.

You can't get her back her on a K-1 if the Philippines still considers her divorced.

Of course the wedding plans are not going to get you expedited, USCIS & the Embassies all warn you to not make any plans until after you actually have a US Visa in hand.

Regarding the business, why can't he just complete the sale regardless of his Visa timeline? Does the buyer require he move out of country as a condition of the sale?

Regardless, expedites require the hardship (financial, health or otherwise) to be on the US Citizen's side.

At most Embassies if they keep the applicant's passport it's because they are leaning towards an approval. They probably just need to check further up the ladder to be sure that it doesn't trigger a waiver requirement before approving & printing his Visa.

The USC applies for permission to Sponsor them.

The Beneficiary will be the person applying for the Visa at the US Embassy.

You do realize that since the mother is/was married to the child's father she doesn't have sole custody of the child under Philippine law?

If she ever returns to the Philippines before obtaining US Citizenship she can have some problems with leaving the country.

BTW, Philippines local police clearances are worthless for US Immigration purposes, she will need a NBI Clearance.

Immigration wrote a letter to my ex (in August 2009) telling her to come in for biometrics almost a year after we got divorced. I wrote a letter back to immigration saying that we are no longer married.... .here is a copy of the divorce paper and letter i recently received in regards to her biometrics.

Immigration sent a letter back saying case closed. time for my question. Is my past relationship with her going to come up during interviews? is this why it's taking more than six months to sponsor my new fiancee?

This was a refusal of admission due to admitted immigrant intent.

First CBP did the right thing in turning him away.

Second, he now needs a Visa to enter the US since he has been refused entry he can't use VWP (correct me if I misunderstand).

Third, he hasn't been deemed as inadmissable but he has admitted to having immigrant intent so his chances of getting a Non-Immigrant Visa are slim to none.

I don't see wy there would be any waiver required for him to receive a K-1.

This is only partially correct...

The Visa can be valid for up to 6 months but cannot exceed the validity of the Medical Exam. In some countries the Medical is good for 1 year, others it is only 6 months.

If the Op's SO had their exam in Jan, 2011 and Egypt's medicals are only valid for 6 months the the visa would expire sometime in June unless she got a new medical in which case she could get a Visa with 6 months validity.

I'll go you one better, examples of Humanitarian Reasons that have been approved for expedite:

Terminal Illness of the USC Petitioner's parent or close relative, thus allowing the USC to have their other half meet the ailing relative.

Disability due to recent injury or medical procedure of the USC, having their spouse at home would assist with daily care while they recover.

Apparently the OP and at least one member replying in this thread have missed a very important point when requesting an expedite:

Regardless of the reason, it must be on the US Citizen's side of the situation.

The Beneficiary losing money because they will delay the sale of a business doesn't meet that requirement.

The US Citizen planning their weddings and putting down large deposits before the Visa has been issued doesn't meet the requirement (albeit for different reasons).

The Beneficiary living in poverty doesn't meet that requirement.

@OP, if you're sending $200 -$400 monthly to the Philippines then they are living far better than the neighbors.

Proof of ongoing relationship is a big concern for me as well. Since we went from being fiances to now possible newlyweds. We don't jointly own anything (or kids) - so the only thing we'd have is our visiting photos, affidavits from sworn parties (medical professionals most likely who are both family and friends), and a newly created joint banking account.


I filed the I-130 for my wife 2 months after we were married. For proof of on-going relationship all I provided was 2 Joint Checking Accounts, Proof of her as beneficiary on my 401(k) at work & Proof that she was added to my Life & Medical Insurance Policies.

With CR-1 and a new marriage they will expect a lot less than a long term marriage. At Removal of Conditions 2 years after POE you'll need to provide more proof of co-mingling lives (finances, co-habitation etc).

If your child is also the child of a US Citizen and the US Citizen parent has met residency requirements (Lived in the US for 5 Years, 2 of them since turning 14 I believe) then the child has claim to US Citizenship and you must use CRBA (Consular Report of Birth Abroad) to get the child a US Passport so no Visa would be needed for the child.

If not then the child would need a K-2 Visa.

Yes the CO can require a co-sponsor if they don't feel comfortable with your ability to support her on a long term basis.

Father paid hospital staff to sedate my wife (keep her groggy) and then spirit the baby away after birth and finally lie to her about the death. The relationship with the father was over before the birth and his mother was excited about the Grandchild. He told his mom that Anna abandoned the child so his mom was sending money to support her first & only grandchild. After learning the child wasn't being proper cared for the grandma contacted Anna, only then did they both discover how they'd been deceived by the father. Luckily in the Philippines Anna has all parental rights and the father has none so we're reclaiming him and bringing him here.

I said this only to illustrate the point I'm trying to share:

NEVER give USCIS, NVC, DOS, the CO or anyone else involved in this process any more information than they ask for. If they want to know something they'll ask you about it, trust me. On the other hand if you give them too much information it can actually raise more questions that it answers.

My wife and I are in a situation (kind of complicated) where we're applying for her first son whom she thought died in childbirth and wasn't included on her original Biographic data documents. We pondered including the explanation and maybe even DNA test results with the I-130 petition fearing that they'd cross-reference her earlier case file and deny his I-130 in addition to possibly looking to deport her. Well we received his I-130 approval just a couple of weeks ago! We're not out of the woods yet as we're sure either NVC or the US Embassy in Manila will question the circumstances but we'll face it when the time comes.

So in short, always be honest during the process. Always answer everything they ask. NEVER offer anything they didn't specifically ask for either on the forms or at the interview.

First, what country are you from. With that info people can reply with common Red Flags.

As far as I have heard having a vasectomy isn't a Red Flag by itself anywhere and I don't see how the CO would even know about it. Also the USC having children is generally a Red Flag by itself but either of these could be mitigating factors where other Red Flags (such as large age gap in certain countries) exist.

FWIW, being charged with drug possession is related to drug use.

Since he doesn't have 3 convictions then the answer is no but you should have copies of the court documents showing the outcome of the cases as it isn't uncommon for the interviewer to ask a Fiancee about the USC's criminal history at interview if they find something in the background checks.
