egarding question number 2: I did the translation myself, it wasn't notarized and I had no problem at all. That was for a K-1 and AOS in 2010.

There are many reports on VJ of either the Petitioner or Beneficiary translating their documents. As long as they include a statement of who did the translation and that the person is fluent on the original language and English they've not had any problems.

Something you need to understand is first that K-3 is pretty much dead and are being administratively closed at NVC now but let's just say that isn't the case look at your situation:

A K-3 Visa requires approved I-129f AND I-130 petitions, your wife can't submit a second I-130 petition for you while the current one is still in the process of working through the system.

In light of this how would you expect to get a K-3 issued any sooner that the CR/IR-1 you are currently working on?

I'm wondering why you're defending the Op when there has been no attack?

Your average petitioner wouldn't need to file Quarterly Tax Returns but someone who is self-employed in the US should be used to having to provide additional documentation for their on-going income.

Besides it's just a small bump in the road, they'll get the needed documents and be fine...

I don't see the point of notarizing printing copies of the Philippine Family Code, the Embassy can easily verify it if they need to.

To get the Solo Parent ID you'd need to be in the Philippines and go to the Municipal Hall where you live. It's basically an ID that would provide your child with some education benefits since they have a Solo Parent. The reason I mentioned it is because in order to get it you need to prove that the bio-father has abandoned your child so the Solo Parent ID is actually proof that the Philippine Government accepts your proof the father is out of the picture.

Use the links in my signature, print the relevant sections of Philippine Family Code and order your CENOMAR now. Since you never married the father you have sole custody under Philippine Law.

If you were interviewing at Manila the CO would know this already, since you are in Thailand I would suggest bringing the Law and CENOMAR with for the interview so you can demonstrate your sole custody. Also if you have a Solo Parent ID that would help.

Do you have an interview appointment with the USEM or has she already completed the interview?

Visa isn't issued until after the USEM Interview and the medical has to be completed before the interview.

Vaccinations should be handled as part of the Medical Exam. It might be an extra fee (in the Philippines it is included in the fee) but they should fill any voids in her vaccination requirements. In the case of shots that are a series she will get the first at the medical and be expected to follow-up here in the US.

Yes a six year old will need to have the medical exam and vaccinations.
You will also have to prove that the child is the son/daughter of the K-1 beneficiary, birth certificate usually does this.
Finally you will need to prove that the child can immigrate to the US, either demonstrating the K-1 beneficiary has sole custody of the child (no other person with parental rights) or a signed affidavit from the child's other biological parent granting consent for the child to immigrate.

At the I-130 Petition stage all we provided was a copy of our Marriage Contract (certificate) and a bank statement from each of our 2 joint bank accounts (one in the Philippines and one in the US).

The chat/phone logs and other stuff like that was a ll prepared for the interview stage but never asked for.

FWIW, the child doesn't prove anything about your relationship beyond the fact that you had sex at least once. Doesn't hurt to provide documents of the child's existence but you've already had to prove the parental relationship for the baby's CRBA & US Passport, right?

Not difficult, it's impossible to get divorced in the Philippines so annulment is the ONLY option and it can take years!

But wait, there's more...

If a Filipino is married to a foreigner and gets legally divorced in the foreign country the Philippine Gov't will only recognize the divorce if it was filed by the foreign spouse not the Filipino! Then even that recognition requires legal filing which can take a considerable amount of time.

There have been cases where a K-1 Visa was issued to a Filipino who had initiated (and completed) divorce against their foreign spouse but they still couldn't leave the country because the Philippines requires a "CFO" (Commission on Filipinos Overseas) endorsement in their Visa to leave the country but they won't issue said endorsement to a fiancé/fiancée Visa holder who is still legally married in the Philippines...

There is no other US Fee after the Interview Fee until After you're married and file for Adjustment of Status. Then it's $1,010 for her and around $600 for the child.

Air21 deliver fee varies depending on where it's being delivered to, expect 200 - 400 Php each.

Since you referred the the child both as "Her" and "Our", which is it?

If you're the Daddy then the baby should go through CRBA & claim US Citizenship instead of being issued a Visa.

Be aware that at her medical they might refer her for psychological review due to the recent birth & adoption.

If they do then don't let her freak-out, she just needs to visit the psychologist & be completely honest about what happened & why she's giving up the baby.

Also, expect a tough interview. Since she got pregnant with another man's baby after getting engaged to you it will have the appearance of Visa Fraud on her part.

Actually what she needs to do is attend the CFO Seminar and get the CFO Sticker for her Passport. Since she doesn't indicate her age or which Visa she has:

If K-1 she will need to show her CENOMAR & final divorce decree(s) for her USC Fiancé (if he is divorced) for any previous marriage(s). If under 24 then she'll also need to present a written consent letter from her parents stating she has their permission to get married & move to the US.

If CR/IR-1 she will need her Marriage Contract & final divorce decree(s) for her USC Fiancé (if he is divorced) for any previous marriage(s).

Without the CFO Sticker in her passport they will not allow her to board a plane to the US with a K-1 or CR/IR Visa in her passport.

Just think about how much you're gambling on that assumption. Not only is there a lifetime ban for the alien SO but I believe that DHS can charge the USC criminally in Federal Court with punishment being several years in prison and fines in the tens (if not hundreds) of dollars!

Even if you get away with the lie once, you have to remember it and continue it flawlessly at every step of the process. Even once naturalized if they discover fraud they can revoke everything that was based on the fraudulent statements and shatter whatever life you've built up to that point.

IIRC, an overstay would use I-212 Waiver, I-601 would be for a lifetime ban for such things as EWI. It's irrelevant in this case though as he is currently admissible since he served out his re-entry ban.

WRONG! The Visa hasn't even been applied for yet. The interview is where he officially applies for the Visa and is either approved or denied.

Approval of the petition only means the the Petitioner has been deemed able to sponsor him which includes the determination that there is a sponsor-able relationship between them.

1099 is for self employer persons. Basically they didn't deduct taxes as you worked as an independent contractor and are responsible for paying your own taxes.

He is a USC, so he can file for a divorce here in the USA. One can get a divorce anywhere as long as the country where it is filed allows divorce.

The question wasn't "Can they get a divorce?" It was regarding the fact the The Philippine Government doesn't recognize divorce for a Philippine Citizen and how that would impact a Filipino who is now a USC but divorced filing a K-1 for a Filipino.

The answer is that since they have naturalized the Philippine Government will accept the now USC as single due to divorce.
