I might need to do the same thing, flying to the US for filing the reentry permit application. Both of my reentry and GC will expire in mid Oct. what I am thinking to do is flying to the US sometime before the expiration date, and file both of them, then go back to Japan in a few days or so. USCIS will mail the both NOAs (receipt) to my husband's parents home, which is also our us address. NOA(receipt)of GC would say my GC is extended another year(I heard this from other people who renewed their GC). I will fly to the US for the biometrics with my passport and NOA(I need to ask my parents in law to mail it to Japan) that says my GC is extended. After my biometrics they will send 10 year GC to my US address. I am guessing thats what would happen if things go smoothly....but I am not sure my plan works...

If you apply for the re-entry permit BEFORE your Greencard is extended how can they approve it with any expiration date other than your current Greencard's expiration date?

Also, you can't get a re-entry permit with validity date past the expiration of your Greencard. You need to have your status extended BEFORE you can get a new re-entry permit.

I did not mean for it to be fraud i understood it as we have to file jointly since we were not divorced at the time whenever i had to send me request to remove conditions and i did not have my divorce decree yet. How should i go about contacting them, sending my decree to them? the only other evidence i have is tax returns and possibly bank statements. i am extremely worried!!

You should have filed on your own noting that you were in the process of getting divorced. USCIS would have then sent you an RFE for the Final Divorce Decree and you could have responded in kind.

I would recommend you contact an Immigration Lawyer as you have basically committed Material Misrepresentation by filing a Joint Petition when you should not have.

yeah I guess thats all I can do, save evidence..my wife and my mother in all are both crazt and im just scared they might withdraw thr petition or call immigration and tell them not to allow me to enter the US when I go back to my home country next year..

They can't do either such thing...

Once the Greencard is issued the Affidavit of Support can't be withdrawn. They could call ICE and claim you married her only for the Greencard but then she'd need some kind of proof.

Cut off the gravy train, let her leave & file divorce. Whatever you do don't allow yourself to be alone with either of them again, change the locks on your apartment and limit communication to e-mails/texts so you can archive. If they call let it go to voicemail and then find a way to archive the messages. I would suggest getting a Google Voice number and telling them to use that number to contact you then change your cell/ landline numbers so they have to call the GV number. GV allows you to archive the voice messages and since they know they're being recorded when leaving a voice message the recording can be used in court or by law enforcement officials.

If you circle the wagons and look at her as a potential threat to your safety then take appropriate precautions then you'll be fine.

We just received our NOA1 Hardcopy yesterday and to our surprise there are two! Our Little Guy was included in my Wife's ROC filing and we already received his "Verification of Inclusion of a Dependent" Letter the day before, It references one of the Receipt Numbers on the Wife's NOA1s.

Receipt Number WAC-##-###-00010 is dated 10/13/2011 @ 14:88, this is the Receipt Number the Letter of Inclusion refers to.

Receipt Number WAC-##-###-00008 is dated 10/14/2011 @ 14:28.


I'm just wondering if anyone else has had this happen?

By not being a frequent user of V.J. it is normal not to know the procedures here.
On the other hand, allow me to tell you my opinion: if by not following the "right way of doing things" here, I am not entitled to an answer, that is fine with me.
Just have in mind, that besides, policies, "by the book" attitudes, tactics and guidelines, there is another (perhaps the greatest) factor in here that unites us all: the one that is named "SENSE OF HUMANITY".

Well if so and he is a know it all, he could have been more helpful in explaing what i did wrong instead of being so bold in my opinion it was a reprimanding way.

Before getting your panties in a bunch read what I said:

1) You have future dates in your timeline.

2) The Site uses timelines information to publish estimates on USCIS Processing & Approval times.

3) When people put bogus data in their timelines it throws the published estimates off.

Maybe you just need to not be so touchy and actually read what's said...

BTW, I noticed that your current :Filed for is "Naturalization" despite the fact that your near future ROC filing isn't even in the mail...

@OP, your timeline is really messed-up. You have future dates in there for Filing ROC. You do know that the site uses timelines to estimate USCIS Processing & approval times, right? Doing things like that messes with the estimates.

i had my biometric taken august 19th 2011

If your application was APPROVED then it's a done deal, you've removed conditions and just need to wait for the 10 Year Greencard to arrive.

Less than 2 months doesn't sound right for ROC approval though, what does your case status show online?

I think the main issue wont be the ROC as much as the stay in the US to keep the LPR condition.. If she's gone for 2 years, I think she might lose the LPR status

If I read the OP correctly the wife is the US Citizen Petitioner?

It is confusing though as a lot of Filipinos aren't used to gender specific pronouns (for example my wife often calls her brother's infant son her niece).

RonRon can you confirm you are talking about the US Petitioner returning to the Philippines for a couple of years?

Regardless I would think it will make proving bonefide marriage difficult at best of you live in 2 different countries after the Alien spouse moves to the US especially if the Alien spouse's relative was a co-sponsor.

Threatening to withhold your immigration documents or interfere with your immigration status is recognized as a form of abuse by USCIS. It sounds like they are happy that he married a house girl for them and her simply doesn't care about you as much as he should.

You need to decide if you want to remain in the US or return to the Philippines.

If you want to return to the Philippines then get out of the house now. Go to a woman's shelter and they will help you contact the Philippine Consulate. The Consulate should be able to help you get back home. Once home you can file for Annulment.

If you want to remain in the US still get out of the house now and go to a woman's shelter. They will help you file for divorce and get your life on track without him. Catholic Charities can even help you with the Removal of Conditions.

YOU DO NOT HAVE TO REMAIN IN A MARRIAGE THAT DOESN'T TREAT YOU LIKE A PERSON.

You need proof that you co-mingled your lives. Prove the following (the big 2): You lived together, you pooled your money together.

That generally covers "Good faith" Marriage.

You will not need to prove why the marriage ended or even wait for her to file for divorce. You can separate yourself from her life now (get the above proof first), fiel for divorce and file to remove conditions based on the divorce waiver all without her. The joint tax filings have nothing to do with support, she signed the Affidavit of Support for you to get your conditional Greencard and that remains in effect. The Joint Taxes help prove 2 things: First you're meeting the legal requirement to file taxes as a LPR and second you're co-mingling finances. Individual tax filing meets the first and joint bank accounts or bills at the same address proves the second.

Why bother with K-3 if you marry her in Cambodia? The CR-1 is superior and only takes about 1 month longer to Visa issuance than K-1.

Advantages of CR-1 over K-1/3:

CR-1 is issued Greencard upon activation at POE, she will be an LPR authorized to work and therefore able to get all of her documents and start her official life in the US very quickly.

CR-1 doesn't need to Adjust Status (cost $1,070 and takes 6 months). Saves time & money.

CR-1 can travel overseas immediately as stamped Visa serves as temp greencard until the actual greencard arrives in 4 - 6 weeks.

Nobody is saying you need to get all depressed or "drown in tears", just don't go rushing into anything. Maybe take some time to be sure you learned something from the "Pinay experience", that's all.

FWIW, if you're interested in learning about Indonesian Culture then travel over there and experience it but I don't think you can really explore any culture "through it's women" (hope that doesn't sound too harsh or degrading to either you or women of any culture, just saying).

When I found my wife I wasn't looking for a Pinay wife. Honestly I was planning a dive trip to the Philippines and looking for some local dive buddies as the Kano I was travelling with was very unreliable (and proved himself to be such as he abandoned me at the airport in Manila). Anna & I just happened to stumble across each other in the process.

I guess I'm being judgmental here (despite trying to not be), but your post just comes off like your shopping for an Asian bride. Finding the right woman has less (if anything) to do with where she's from and more to do with who she was raised & who she is as a person. Physical traits pale in comparison to the beauty you can find in the right soul.

My understanding is that the OP hasn't performed a court wedding which is what is universally recognized as the "legally" binding marriage...

It might be semantics, but I believe that the OP can defend this after a valid CR-1 is filed.

My advice is to file a CR-1 immediately. A K-3 buys you nothing but more costs and more time on the backend. File for the CR-1.


If they're not legally married then they cannot file for CR-1 Visa.

You are all over the place on this one. Are you legally married or not?

If you are legally married then you don't need to get married again.

If you are not legally married then you need to appeal the K-1 Denial.

BTW, the definition of "Legally Married" is relevant to where this ceremony in Dec of 2007 happened. If that ceremony & living as man & wife meets to local definition of legally married then you are regardless of what US marriage requirements are.

Please fill-out your profile so we know what processing you are going through.

For us, I'm going for CR-1 for my Wife & CR-2 for our son. For this I had to submit one complete I-864 Packet for each of them. I received her documents only 1 day before I received his.

I have just Sent both of the completed packets Next Day in the same envelope. Each packet is paperclipped with the Barcoded Coversheet on the top.

Call the NVC, the operators are very friendly and don't mind answering stupid questions wink.gif

The idiots at LBC did the same thing to us. The LBC Receipt has the 31 Rochester address on it but when they re-shipped it via UPS they used the 32 Rochester address.

Our first package from the PH was signed for at NVC on Wednesday and logged into their system that Friday.

The second Package (LBC sent to "wrong" address) was signed for last week Wednesday and their system showed it logged as received last week Friday.

You'll be fine.

Be careful with that "never" been to the US. It sounds like you're really saying that she has never been caught being in the US. If that is the case and you or she has represented that she's never been in the US then you are committing misrepresentation which has dire consequences if ever caught.

All it takes is for them to have one small bit of evidence that she has been here or if your "story" seems fishy and they decide to dig a little deeper then you coul dend-up having to move to Mexico to live with your wife.

First of all, if you're filing for K-1 then he's not your hubby *yet* and you need be be careful to remember that whenever you talk to anyone with USCIS, DoS, St Lukes etc.

Second, you husband's criminal record will only be a problem if it is for a specific type of crime: Domestic Violence/Abuse or Sexual Offense.

How to do this?

If the petitioner didn't meet the last two years but meets the recent year, is this ok? If there is $2,400 in savings, it is okay also?

If your income increase is properly documented then it shouldn't be a problem especially if it's because you finished school and started working full time.

The $2,400 amount is specific to this OP because her shortfall is $800 so she needs that times 3 to cover it (800 * 3 = 2,400).

Please don't misunderstand my question here, I'm just trying to understand....

It sounds like somehow over that last 2 years you've been able to:

Fly to Morocco twice.

Pay for K-1 process up to and including Visa Interview at the USEM which includes I-129F Filing Fee, Medical Exam and Visa Application Fee.

Pay for CR-1 process up to current situation which is I-130 Filing Fee and Affidavit Of Support Fee.

That sounds like there is some room for putting some cash aside.

Is there anything in your current budget that you could cut back on?

About your disability, is it a case were if you generate ANY income you will lose it? I know a few people who supplement their income by a couple hundred a month selling stuff on the internet or doing odd jobs here and there for people who just don't have the time for their own errands.

Again don't misunderstand me, just trying to throw out some thoughts...

Per this USCIS Page:

Income Requirements

I really don't remember if i did an I-864 for her siblings. All i remember is receiving a case number, it was WAC XXXXXX. Just when do they ask for the affidavit of support for relatives?

If they haven't reached the NVC yet then you didn't. First step at NVC is the Affidavit of Support. WAC is a USCIS Case number not an Embassy Case Number (which are assigned at NVC).
