Thanks everyone! They arrived together and filed AOS together so just 1 I-751 and 1 fee for both! but they never received the a 1 year year extension. I thought they get the one year extension once they receive the packet and are still processing/deciding.


You're correct in your understanding, USCIS doesn't automatically extend the status for 1 year it only happens after they've accepted the I-751. The NOA1 for the I-751 contains a statement explaining that the NOA-1 serves as proof that your status is extended for 1 year.

Another question....how much relationship evidence is too little? we've kinda hit some rough times financially and havent been paying too much attention to this, we have pictures, phone bill in both names, auto insurance in both names, public wellfare (medical assistance) renewal app with all our names (me, wife and daughter) and thats about it. will this be enough? also will have 3 affidavit letters from family members, do they have to be notorized?

All you can so is submit everything you have an hope it's enough. If not then you'll get an RFE and/or interview. At interview time you can explain the situation.

Go ahead and apply but be absolutely sure that you are specific and accurate about your LPR Status. Don't let anyone else fill in that section or change it after you've filled it in.

I've heard of people thinking they'd be okay of the fudge a little but if you do it could be disastrous for you.

I don't know. That is why I am asking. I did not know if he could or not now that he is no longer a minor. And then what it just automatic? That I am continued his sponsor?

I was wondering because I was not sure how I was going to prove a relationship with him since I have not seen him in so very long. We used to have stuff like I was the co signer on insurance and college info. But now that he has been gone there is nothing.

The ROC is technically the immigrants petition not yours. My understanding is that the US Citizen only needs to sign the I-751 if they are the Petitioner SPOUSE of the immigrant but I could be wrong.

The Affidavit of Support Sponsorship is something totally different. As long as he maintains his LPR Status you are on the hook for the Affidavit of Support until he works 40 qualifying quarters, naturalizes or dies.

Also a little quirk, this single offense should not make you removable, but it would make you inadmissible. If that happens, it would mean you couldn't leave the USA safely until after you gain citizenship. Check this with the attorney too, I'm not always completely up to date on recent legal changes, but that's how it should play out.

How might this incident impact the OP's naturalization?

Actually this document is the Biometrics Appointment Letter and the stamp is his proof that he completed biometrics.

What you're needing is the NOA1 for the I-751 (For his Removal of Conditions filing).

What I have done:
- Posted certified mail, I have the receipt with post mark.
- I have initiated with the USPS an investigation into it (they should get back to me tomorrow, the 8th)

When sending something this important Certified Mail just isn't good enough. Spend a few bucks more and send it in a flat rate Priority Mail Envelope. Priority Mail seems to be scanned more often and thus tracked better. I've had First Class Certified letters that basically only show an initial scan after it's in the Post Office's hands and then nothing until it's delivered whereas my Priority Mail items always show just about every leg of the journey.

We just did my step sons I130, no signature there, he will have to sign when he gets ready to come to US and biometrics, unless i missed the point?

Completely different process.

Since your step-son is in the initial immigration process his first biometrics will be at the US Embassy with his interview.

For I-751 (Removal of Conditions) Biometrics must happen before the application can be adjudicated. I've heard of overseas biometrics for spouses of military but I'd be surprised if that could be done in the OP's case.

You can also go to your local USCIS office (schedule InfoPass Appointment) and ask for a stamp in your passport (on the grounds of lost GC). Then you can use a photocopy of this stamp instead of GC copy to send in with your I-751.

I never had my conditional GC (lost in the mail) and removed conditions with the stamp. I did have replacement application pending, and it got cancelled just as soon as my ROC was approved. Of course, I did not get the money back.

Still not sure if this will work? Ask if it is acceptable plan of action while getting the stamp at USCIS office.

Did you also mention your pending I-90 when you filed to ROC? I wouldn't count on this working without the pending I-90 as legally you are required to be in possession of the Greencard.

being "late" is the ONLY reason they rejected it. Also, they didn't actually open it until the 24th.

I don't understand why you would have added "Certified" on top of Priority Mailing. The Priority Mailing already gives you tracking and delivery confirmation but that's a moot point. Ironically Priority is better than Certified because it is trackable and gives you confirmation of delivery whereas Certified only gives you proof of delivery.

FWIW, Priority mail does not come with delivery guarantee, just an estimate of delivery times which usually is stated like "2 - 3 days". When time is of the essence you should either mail early via Priority Mail (giving at least 1 week) or pay extra for Express (overnight) which is guaranteed.

I assume that by rejected you mean they didn't accept payment? That's good for you. You should be able to resubmit the packet providing the reason for your late filing (I'd include the tracking info and a copy of your USPS receipt with that info on it to show that you simply erred and sent it just a wee bit later than you should have.

That's good news, cashed check means they've accepted your packet.

Usually for late filing without the required explanation of late filing they just return the whole packet as rejected.

And no, it's not 2 years and 9 months from the day you were granted Permanent Residence. It's 90 days to the 3rd anniversary of your Permanent Residence (if still married to the USC that sponsored you)or otherwise 90 days to your 5th anniversary.

In fact there have been cases posting on VJ where after 1 year there was no decision on the ROC so they filed for Naturalization and that forced USCIS to decision the ROC so they could process the Naturalization!

What they want is proof that you've entwined your lives. The two big things for that are cohabitation & commingling funds.
Prove you live together, we provided joint leases, utilities some in her name some in mine and copies of our Drivers Licenses with the same address.
Prove your money lives together, we provided a few months worth of bank statements for one of our joint accounts.
An affidavit from your mother regarding your living situation would be helpful. Also get a few affidavits from friends about your marriage.

Seems USCIS liked my package I sent - no interview, no RFE -

"The USPS reported that they picked up mail from USCIS containing your new card on March 2, 2012. You should receive your new card within 7 days."

I normally checked their site each day - but the last week - I figured to wait till the 6 month kicked in.

Congrats!! Was that the notice on USCIS' status website? That's a new one- never heard it before! But anyhow, that's great!

We received the same notice via e-mail and text as well as the status updating on USCIS's website.

When you file a change of address at the post office, they forward your mail for several months. I'm sure you could work things out with them. We've done it and been fine (from a mail received standpoint).

Some Government mailings are prohibited from being forwarded, AFAIK this includes mail from USCIS.

Is it normal not to have any touches since I sent in my wife's I-751? We did get a biometric notice which we went to but there hasn't been any touches since October.

Both of our ROC Cases never showed any activity online until the approvals this week...

Here in Illinois Anna's Drivers License was issued for the same length as a USC would get.

I'm wondering when is the best time to apply for citizenship based on marriage (3 years). is it within that 90-day window or after 3 full years?

Hit the 90 window, no benefit in waiting 3 months...

I have to say lol at the serial murderer...I mean I know I oughtn't but the way you put that struck a direct hit on the funny bone.

Then my aim is spot on as my intent was to share a laugh (which I think everyone going through ROC, including us USC Spouses, could use).

I bet we're going to get years of good chuckles from that photo once the card arrives...

She said they would not expect me to come for a third try, but had no idea what they would do. She seemed a bit surprised at the lengths they have to go to if this lot fail.

I was worried that we weren't going to be able to get Gabby's fingerprints. He's 4 and deaf with cochlear implants so he's seen a lot of medical personnel and latex gloves generally mean something painful is about to happen to him. He freaked out when he saw the tech put the gloves on. It took every ounce of strength I had to hold him still enough for those prints which only took like 8 attempts! He still managed to kick the ####### out of my knee in the process.

I can't wait to get his 10 year Greencard, he was so pissed when they took his pic I'll be surprised if he doesn't look like a serial murderer on the card.

I didn't know this - What happens if you don't apply to renew?

Technically once Conditions are removed the LPR STATUS never expires, just the card which is your proof of said status.

This means that you're not applying for anything except a new card (I-90).

So what happens is if you're in a situation where you need to prove status you won't be able to and can be detained. Of course you'll eventually be able to prove status but why have to deal with that possibility and expense?
