Any of the NVC Receipts or Coversheet packets should work, they indicate your NVC Case number which in turn is the case number for the USEM.

If you are covered by your husband's medical insurance then our out of pocekt expenses should be minimal (a couple thousand if type is PPO or just a couple hundred with HMO).

Most medical insurance carriers should cover a spouse & child even before they are in the US.

I'll be adding Anna & Gabby to my Medical Insurance effective Oct 1 as we are hoping they'll be here by Christmas...

The form is designed to not allow you to save any data that you type in it, stupid I know. Also you can't save a PDF as a word document. I can't explain the problem you are having printing.

Here is a solution for you.

Go to http://primopdf.com and download the trial version of Nitro PDF Editor. It will allow you to put text into the fields and save the form while retaining the text.

He will need to file for a IR-2 Visa for her. It's the same process as CR-1/IR-1, just follow the guides here.

Use the search in this forum you'll find a few good threads about the issues involving a step-child from the PH. At the NVC level you'll want to "remind" them that as a single parent who never married the bio-father you have sole custody (find this info in the aforementioned threads).

The Us just wants to be sure she can legally immigrate and as bio-father has absolutely no parental rights in your situation this is sufficient.

Expect the process to take from 5 - 12 months on average.

As of today, October 9, 2009 NVC has finished processing my wife's paperwork! Our son Gabby's paperwork was completed 2 weeks ago.

We were worried that the single omission on her DS-230 would delay her interview as we had to resubmit a corrected DS-230. In fact it didn't since the NVC assigns Embassy appointments in the second week of the month for the following month.

As a bonus today is the 1 year anniversary of us meeting. I couldn't think of a better gift...

Now if it would just stop raining in the PH :'-(

Now regarding the "scheduling/financial losses" statement, I made no assumptions. I simply stated that they wouldn't accept being blamed for those extra expenses because the State Department, USEM etc have stated in many places that you shouldn't arrange travel etc until you actually have the Visa in hand so from their point of view you caused the loss not them.

FWIW, when asking how you should proceed next (which is what you are doing) it makes a lot of sense to list the steps you've already taken (such as called DOS) so that others won't suggest things you've already done.

This is exactly why they tell you specifically NO NOT SCHEDULE ANYTHING UNTIL YOU HAVE VISA IN HAND.

Call the State Department and/or your congressman.

BTW, request to expedite can only be approved for extreme hardship on the USC part and they won't consider "their incompetence" as such because you didn't follow the recommendation and scheduled things prior to having the Visa so from their point of view you have caused your own financial losses.

If he was previously married then he will need a certified copy of the Final Divorce Decree. This is usually 1 or 2 pages and is the actual order signed by the judge which dissolved the marriage. It must have the embossed seal of the Clerk of the court where it was filed also.

My understanding is that everything with those checked you were basically given a waiver for the requirement. This means that you shouldn't need to do them.

I don't understand why you're not already on your husband's medical insurance though. Getting married is a "qualifying event" which enables him to add you immediately to his medical coverage. You have a 30 day window after the marriage, if you miss it then you must wait until the next "open enrollment" when is the only time you can add someone to your insurance without such a qualifying event.

In the meantime, contact the local County Health Department, they can direct you to free/reduced cost clinics for any medical needs you may have until such a time as you are insured.

One of my greatest worries is that once Anna gets here she will get either homesick or bored.

I've asked her to plan to not work or go to school for 1 year. During that year we both have much to accomplish. She need to acclimate to life & weather here. We need to get Gabby to many doctor's appointments and repair his hearing. She needs to learn to drive. And the list goes on.

Sure she could work but it would have to be in the evening as childcare for Gabby (2 yrs old with hearing problems) would be expensive to the point it would cost us money for her to work. Also she could go to school but with the same restrictions for the same reasons. What would be the point of her being here if I still barely ever get to hold her?

I'm hoping that taking online classes to get the General Education requirements for her Nursing Degree will help keep her occupied during that first year and then she can do classes 3 days a week after that to get her degree. I figure in a few years when she's done Gabby will be older and hopefully the hearing issues will be a thing of the past so her working during the day won't be as much of a concern.

I've already introduced her to one Filipina who lives in the area and there's a Philippine Store next to the McDonald's by our neighborhood so I'm hoping she'll meet plenty of local friends.

All "original" court documents are photocopies. What makes them originals is that they have the court clerk's seal affixed. While this is usually an embossed seal it can also be a rubber stamp.

Are the children Removing Conditions at the same time as your Wife? If they are then you only need one I-751.

Part 4 naturally requires the info of the original petitioner as they all gained their LPR Status through you.

Listing LPR children in part 5 gets them included in the ROC if their Greencard issuance date is within 90 days of their alien parent's.

Don't forget to pay the fees: once for the I-751 and a biometric fee for each LPR who is ROCing.

As long as you can prove you entered the marriage in good faith you're fine with just getting divorced and filing based on the divorce waiver.

If you can't prove good faith then even VAWA won't help you.

If you want to claim abuse in your divorce or call the police on your husband and get him arrested that's all good and well, he should suffer the consequences of his actions against you. I don't understand why you'd want to add a layer of complication to your Removal Of Conditions filing.

You already have enough going on in your life, your ROC can be simple and painless or it can become yet another pain in your backside. Just take the simple route there is no benefit to the more complicated route.

Divorce and file for ROC with the Divorce Waiver, no VAWA involved as you already have your conditional greencard.

If you just use the Divorce waiver then all you have to prove is that you entered the marriage in good faith by showing you lived together and co-mingled finances.

If you file ROC with the Abuse Waiver then you have to also prove the abuse which is a much higher standard of proof to meet.

Save yourself the trouble, just use the Divorce Waiver for ROC.

Nol pros is different from nolo. The case was nol prosed on the grounds that there was not enough evidence. 2ndly we didn't do trial I was just told by the state attorney that it was nol prosed. Thirdly I didn't commit the said crime I was only unfortunate to be at the wrong place

Okay, so basically the case was dropped by the prosecutor.

The arrest will remain as you were arrested.

It would be a good idea to get a court record of the case being dropped.

I will concede you that point, I just didn't want anyone to read this thread and get the idea that a NoLo means innocence or wipes the accused's slate clean. NoLos remain on your record so that if you do continue down that path they have an easier time establishing a pattern of behavior the next time you're in front of a judge.

Hopefully the Op has a more complete understanding of NoLo and now knows that if it doesn't affect their naturalization it surely will come into play if they are arrested for the same thing again as Law Enforcement can see the prior record.

You seem to still be confused about noelle pros. In America, people are innocent until proven guilty. Did the OP commit a felony? I have NO CLUE. But there certainly wasn't evidence or ability to convict him as one so he does NOT have an actual felony conviction and as such we can't say for sure he did it. I'm not sure what the point of your unhelpful comment was.

While you're correct about there not being a conviction that doesn't mean the accused (in this case the OP) is innocent. In criminal trials, and in some common law jurisdictions, it is a plea where the defendant neither admits nor disputes a charge, serving as an alternative to a pleading of guilty or not guilty. A no-contest plea, while not technically a guilty plea, has the same immediate effect as a guilty plea, and is often offered as a part of a plea bargain.


NoLo Pleas are often times used for first time offenders to allow them to not get the brunt of a conviction but still have the ability to impose punishment including fines or probation.

If the accused is confident they can beat the charge in court then they shouldn't take a NoLo Plea because it isn't a vindication. They would be better served with a judgment declaring them no guilty.

NoLo is a compromise where neither side is sure they could easily win so instead of throw a lot of resources and time at it they agree to disagree. The prosecutor get the accused punished (even if only lightly) and the accused gets to avoid a more serious consequence of their actions.

IOs are aware of this and will consider the charge accordingly knowing that the applicant didn't dispute the allegations against them.

Thanks everyone! They arrived together and filed AOS together so just 1 I-751 and 1 fee for both! but they never received the a 1 year year extension. I thought they get the one year extension once they receive the packet and are still processing/deciding.


You're correct in your understanding, USCIS doesn't automatically extend the status for 1 year it only happens after they've accepted the I-751. The NOA1 for the I-751 contains a statement explaining that the NOA-1 serves as proof that your status is extended for 1 year.

Another question....how much relationship evidence is too little? we've kinda hit some rough times financially and havent been paying too much attention to this, we have pictures, phone bill in both names, auto insurance in both names, public wellfare (medical assistance) renewal app with all our names (me, wife and daughter) and thats about it. will this be enough? also will have 3 affidavit letters from family members, do they have to be notorized?

All you can so is submit everything you have an hope it's enough. If not then you'll get an RFE and/or interview. At interview time you can explain the situation.
