Some people suggested printing out screen shots of live chats as part of evidence of relationship, since that is the primary mode of contact for many of us long distance couples now. I just wonder if it matters whether they are in color or just black and white.

Also how many should be kept for the record. I mean, if we chat daily, that would be a lot of pages. But if it is recommended then so be it.

I am a dual citizen of UK/US and I am currently living in England with my fiance, who is British. I am in the very early stage of filing for the I 129F. I am confused as to how to pay for it. I was told today from USCIS to send an international bank draft from my local bank. Has anyone else done this? I am worried the money wont get to the right place, as they only said to send it to the US Depart of Homeland Security. Any thoughts?! Thanks :blush:


The check is made payable to the US Department of Homeland Security. It would be included with your I-129F Petition package, and the whole thing mailed to the address per the instructions - unless you were filing through the embassy over there and they had different procedures stipulated.

Guys, here is what is listed in the I-129F instructions. As far as the instructions go, it's not 2 petitions in 2 years. It's 2 petitions lifetime, 1 in the last 2 years. I don't know if the OP requires a waiver, as I don't know how many lifetime and I don't know if the previous petition approval was within the last 2 years. Again as far as the instructions go, it's not if they had two in the previous 2 years.

"If you have filed two or more K-1 visa petitions at any time in th past or previously had a K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver. To request a waiver you must submit a written request with this petition accompanied by documentation of your claim to the waiver."



Gash darnit, if only we read the first page of the instructions, we could've avoided all the drama and misinformation.

IMBRA regs state that you cannot file more than 2 I-129Fs in a 2 year period.
If you are filing #3 within that 2 year period, you must ask for a waiver, via written letter attached to the I-129F submittal.

The situations I read on here were this was an issue was because the couple had actually gotten there marriage license however in their religion/culture that only meant they were engaged and it was not til they had their ceremony was it official. There for when the marriage license was submitted with there k1 visa petition of course it was denied as according to US law they were already married therefore did not qualify for that type of visa. That is not was I was suggesting here, as there would be no license to obtain, and nothing to explain because they are not legally married.


Do you really want to have to explain that to the official? You want to prove something you don't have (marriage license, wedding certificate). Then you want to explain to all your guests that they are invited to your non-wedding. It's best to avoid both the actual impropriety as well as the appearance of impropriety. In simple terms, keep it clean.

What about this option. If you can cross the border when ever you want as you are coming from Canada. Then why don't you go ahead with your plans for your wedding and depending on if you have your visa the wedding will be a symbolic one meaning you are just having the ceremony but it is not legal, and return to Canada to finish waiting. Then once you have your visa you can just go to the justice of the peace and make it legal. Just a suggestion.



This sounds potentially problematic when you have to start explaining to the CO that you only had a symbolic wedding and not a legal marriage. If they suspect you have gotten married, which has happened to others from what I have read here, they may reject the application. I would just suggest to postpone your plans, wait until you get the visa and then first have a civil wedding performed in order to fulfill the visa requirements and then plan your religious/spiritual wedding celebration since then you will have plenty of time to plan that.

162 days since NOA1.

I understand that upon reaching NOA2, that I should send my fiancée my duplicate copy of the entire I-129F petition. While most of the documents I submitted to the USCIS in the I-129F were "original" documents, my birth certificate and my past divorce decrees were only photo copies.

When I send my fiancée the copy of this I-129F packet, do I need to send my "original" birth certificate to my fiancée in the Philippines? This is the birth certificate I received when I was born and it is the only one I have. I can't believe I should put this sole and original document in the mail.

Also: Are photo copies of my past divorce decrees still acceptable when I send her all of this stuff, or do I need to send my fiancée "certified" copies of my past divorce dissolutions?

You can order birth certificates usually from the county you were born. That's what I did.
You should send certified copy of divorce decree. Those you can likewise order from county where you divorced. Mine's got a nice bright red stamp and signature on it. Although that's only on the first page. Hope that's good enough.

Hey Everyone! My fiance Rick and I are trying to fill out our timeline to get a better idea of when the process will be completed- entirely. From our basic information input, it said that we are projected to be adjudicated by June 1-June 8th...Does this mean that he will be approved and we can get married then, or does he still have to interview and wait for social security paperwork??? We are trying to plan for a summer wedding and since it is bridal season, we are desperate to narrow down a date for the venue. Any help would be great...thank you so much for any responses!




Average time listed on this sight for Vermont Service Center and UK consulate is around 260 days from NOA1 to getting visa. Processing times change over time. That would put you in August, but that's speculative at this point.

You should only respond to an RFE with what they specifically ask for, nothing more, nothing less.


Well, the RFE is asking for a statement as well as evidence. That's a good question, regarding what evidence to send. Especially since they acknowledged the proof of meeting in the two year period. So I guess you could send more records of correspondence, skype logs and screen shots. Do you have documentation of wedding plans? I realize it's hard to plan the actual wedding when you don't know when they'll be here. Maybe some vouch type letters from family members, from the priest/pastor (or other expected officiant) for the upcoming wedding. Phone records, fedex slips, etc. Records of other trips you made to see your fiancee that you might not have included in the first place. Seems odd to me because I thought this is the kind of stuff you want to have for the interview at the embassy. I don't think you can err by sending too much unless you send something that would suggest something to the contrary of your intentions.

Be sure to sign the letters of intent. Also make sure they are written properly. I almost forgot to change the wording for the two of us because it's so similar. (eg. fiancee vs fiance and upon her arrival vs upon my arrival, him vs her, etc.) Stupid stuff, but I am blonde.

Ok we have had an RFE and they are asking for the intent to marry, this was sent within the package but it dont seem to be there now ( we are using an attorney for personal reasons), the attorney is now saying Quote "We also recommend to include more details about your relationship as you did with the first relationship affidavit. In Tami's recent email she also included these instructions once more. If you have any other photos, emails, chat logs, money transfers, skype logs, facebook chats, or other proof of relationship we should include copies of these as well.". Advance Merry Christmas.

I just want to ask, if my interview is set for 1st week of February 2013, is it alright if i go for medical by end of December? or should I just go for medical by 1st week of Jnauary 2013?

Another thing, lets say my I got the Visa Approval on February 2013 is it ok if I'll go to US by 1st week of April? I've been thinking about this because if i'll get my K1 visa by February i'll be filing my resignation from the company where i'm currently working, but i need to file a 30 days resignation notice (as per company policy). Once the 30 days resignation period is over, i'll have to wait for few days (or weeks) before my company could process my gratuity. clearance & employment visa cancellation so that I could finally be allowed to fly back to Manila where I am planning to stay for at least 2 weeks to visit my family before flying to America and be with my Fiance. Is there any rule which says that once the visa has been issued, the person who has that visa should immediately go to US?

Since you got visa in Abu Dhabi, I imagine you didn't do the CFO Seminar that is required in the Philippines. Beware that if you go back home before coming to the USA, that they may check your passport when you are departing from Manila to US to see if you got the CFO stamp. This could be a problem.

Well I received the denial letter today. No surprise... basically it says I did not provide the proof needed. The attachment lists a few paragraphs and parts that say what is required to prove a relationship that I did not fulfill. It says I can appeal for $630, and it also included a I-290B form. Now my question is, should I appeal and provide all the info, or just refile with all the info??? What path would be quicker?


I thought with the I-129F you have to have evidence of having met within the last two years and at the interview you have to have proof of an ongoing relationship. Am I wrong? Do you now have to show proof of the ongoing relationship with the petition?

That's for the NOA2. Don't put any stock in that estimate, or it will drive you crazy. That date will jump all over the place between now and the real date. My estimated adjudication date as a September filer started in December then January, then February, skipped back and forth a bit, then March, and now early April. So I don't even bother looking at it, except for a laugh.

My fiance and I have plans to meet soon and file for K-1 visa later on.
I wonder if me going abroad to work (short term 6 months or so) while waiting for the K-1 visa approval will be acceptable and would not affect the approval. I understand that I must go to the US 3 months upon the visa approval.
If I am already in another country when the visa is approved, is it okay to go to the US not from my home country? How does it affect my entry to the US?
Any advice is greatly appreciated.

You will have to go to an interview at the US Consulate where your petition is being forwarded (assuming it's approved by USCIS). You'll have to take a medical exam and submit that envelope at the interview. You will have other documents to collect, like criminal background checks (you will need for your home country, and possibly for this foreign location if you go there). I don't know how you will do those things if you are out of the country.

On the other hand, if you have a longer term contract and you are considered residing in this other country, you could apply for the visa from the country you are working in. Your fiance-petitioner would list your address in that country rather than your home country. Seeing that the whole process could take a up to a year or more, you should plan on being in that other country at least that long if you wanted to do it this way.

The K-1 visa, when issued, allows you up to 6 months to enter the US. Then once you enter, is good for 90 days. You have to marry within those 90 days, then file for adjustment of status.

there is absolutely a requirement for listing residence since the age of 16, not just the last 5 years. You also need to get police clearance certificates from any and all countries the beneficiary has lived in since the age of 16. The police certificates are not needed until the NVC stage.



I was responding to the fact the OP has a RFE coming on his petition (I-129F) package. Yes, when the beneficiary is applying for the visa (form DS-230), the State Department forms, require the address history back to age 16. The G-325A that accompanies the I-129F (USCIS forms) requires only the last five years. I figure you're going to freak out the OP to make him think he messed up something when he hasn't even gotten to that stage yet.

If you need extra space to answer any question, you can always attach a piece of paper, clearly titled with the petition type, question number, the question itself, and the answer.



I believe you should also put a header with your (Petitioner's) name and birth date on all supplemental pages. If you answer on a supplemental sheet instead of the form field, then type "see attached statement" or something to that effect, in the form field.

I don't see, from a logical viewpoint, how calling your elected official to help expedite your petition would be helpful when you are still within the normal processing time frame. Then everyone would be doing this, and so you would have USCIS responding to 1,000s of phone calls from reps, to speed up all these petition approvals? There has to be a compelling reason for an official to get involved AND for USCIS to respond.

As far as reason for the delays, I cannot help but to believe DACA is a big reason for it. I mean, an additional half million and growing applications to process thrown at USCIS. How can it not cause delays, especially when they are getting approved a lot faster than the I-129Fs.

I guess the reason doesn't matter, since we have to just wait, no matter the reason.

I have some questions on preparing the affidavit of support, I-134:

Do I enter my mutual fund and money market fund values on the line that is for stocks and bonds?

Do I enter my IRA account values on the line for "other personal property"?

Does anybody actually get a letter from an officer at Vanguard or Fidelity (or similar huge institution) stating the requested info per the instructions?

These statements from financial institutions - do we submit copies or originals?

The instructions don't specify, but should I provide copies of monthly/annual statements with detail,a and copies of checks deposited?

If self-employed as a partner, am I supposed to get a letter from another partner, describing my employment information?

Since I don't get a regular salary, I get a draw on an irregular basis, would this be a problem?

Where I need to list those persons that I previously sponsored for an affidavit of support (my ex-mother-in-law), would it help if I add a note that she left the country more than three years ago (which she has)?

You can't change the Consulate assignment until she has a new address. How to do that and how much delay it will cause depends on the status of the case at that moment. Chances are, there will be nothing you can actually accomplish until the case is in Abu Dhabi. Then you request a transfer which will delay the process a few weeks. You can TRY to change the address with USCIS, but don't count on success. Again, until she actually moves, you can do nothing.

Ok , ive learned some things the hard way. so, you need to call and ask to speak to an iSo, because the person you speak to first, can't help you. They may put In a service request, but you HAVE to make sure they get your new address...I tried , but the guy I got was nice, but sounded new. Anyway, you can only make 1 service request every 30 days, so make sure you give all the information you can n the first one...and be sure to ask for An ISO or transfer service. Learn from my mistakes, please. This is as far as I have gotten, I saw someone else who tried the same, and their stuff took a while in the shuffle, so better to take care of it ASAP or tell her to tough it out or find a new job in UAE In the mean time. Good luck! Let me know what you learn, please!!

Here is the advise of some VJ member to me:

Contact the respective interviewing embassies/consulates and inquire about having the interview conducted in Manila. Realize that adding more steps or complications to the process may only result in more confusion, delays, detours of the process.

Remember the statement after Part B, Question #20 on the I-129F petition:

"NOTE: (Designation of a U.S. embassy or consulate outside the country of your fiancé(e)'s last residence does not guarantee acceptance for processing by that foreign post. Acceptance is at the discretion of the designated embassy or consulate.)"


Thanks for your reply. It seems you were further along in the process when you were changing the embassy. My petition is still being processed at the USCIS California Service Center, not the State Dept. So trying to find out how to change the address there before it gets to the State Dept.

I am having the exact same issue with the UAE, but transferring to South Africa. I am also a September filer, but to Vermont. I phoned them and think i have a service request. Someone from there will be contacting me by the End of the month. Ill post results when I know.

I called USCIS and they just read some page to me with like half a dozen different circumstances, none of which seemed to fit my case. It seems I'm supposed to send a letter to the California Service Center with the old and new addresses. They couldn't tell how much delay this may cause or possible problems.

Doesn't anyone on here have experience with this situation? :(

My fiancee' is residing in Dubai, UAE. She may go back home to the Philippines due to her working conditions deteriorating. I filed I-129F at the end of September with the intent that her case would be processed at Abu Dhabi. If she goes back to Philippines, what do I need to do and how much delay would be added by her going back, if the file is still at CA Svc Center?

You got NOA2 in July and have heard nothing since? That don't seem right. You need to call the NVC or embassy.
