Now, from what I have read, they are paying $400 + in fees for this process. Good, but they still should fall in line with the rest of the other petitions by date submitted. And to me, it appears that they are working on late September or early October petitions for these cases.

At least it seems the inflow is tapering off. It's just a matter of time to get through these and get back to us K-1ers and others on here.

Yeah, you are right. They appear to be simply adding the avg time for each center and dividing by 4 (four centers) rather than a more complex weighted average based on actual cases processed at each center. The four centers avg times were 5 months, 13.2 months, 16.2 months, and 6.6 months (for Vermont, National, Texas and California respectively, for I-129Fs. This totals 41. Divide that by 4 and you get the 10.2 month national average posted. Not sure where the numbers for Texas and NBC come from - didn't know they were even processing any I-129Fs there either.

When I go to my My Case Status page on USCIS, there is a place to look at processing times from there. The numbers are different from the processing times accessed from USCIS home page. July 18th is not mentioned. Instead it says (for 129F) 6.6 months for CSC, 10.2 months for USCIS National Average, and 5 months for USCIS National Goal, all of these as of Dec 31st 2012. Thoughts?


Now it says 6.6 months for CSC as of January 31, 2013, whether I use IE or Chrome. Last night it gave different readings when I used different browser and was dated December 31.

I guess you haven't read the conversation here very closely. It's a browser issue. Chrome vs Internet Explorer was giving different results on that page. No we didn't click the wrong K version, sheesh!

I got 5.5 months yesterday evening, now I'm getting 6.6 today and 10.2 for national average... Like everything I think no one has any idea as to what is going on at CSC :wacko:



I'm get 6.6 on Chrome and 5.5 on Internet Extorter. But I used to get 5.5 on Chrome also. So they changed something and didn't finish the update job. That was a good observation though, and I find that really weird. Never saw anything like that, getting totally different results based on your browser choice. Kind of scary. I think that maybe the new estimate will be 6.6 months. The national average is a mystery. As someone did here, I also commented previously under a different conversation wondering about how can they get a natl avg that is greater than the avg of the two main adjudication centers?

Looking at the data on the USCIS website CSC only completed 1000 applications combined in Dec and Jan. Where VSC has completed 8800 applications in the same time span. I would post the link to where I got this data but VJ will not allow me.

When I first filed my application I was happy to see I was sent to CSC now I am very disappointed.


Yeah I just compared the two graphs. Yup, 8 to 1 processing ratio for the last two months, Vermont over California for K-1s.

yes, CSC is way backed up. when i last talk to someone at the call center i asked and they said they cannot even tell anyone when a petition may get approved. when i checked on the same page as processing, it says this:

you will see california has well over 250,000 petitions to get approved.

when we were in review, first they said give them 120 days, when i did a service request they said give the 6 months from the date they received it back from the consulate, after that it took over 8 months to get approved and reaffirmed.

be patient with california, their workload is more than others and they are short handed.


250,000 is the national quantity. California has around 20,000 pending. They been going down each month for more than a year. Look at the bottom chart on that page.

Yes they have, and before DACA, they used to be the most productive at K-1. I really think that the DACA cases killed the CSC ability to get anything else done. I still believe that given the time to get back on track, now that they've moved DACA cases to Texas, California will step up it's game.


I hope you're right, UK-USA-K1. My fiancee's contract is up in November, and then she has to go back to her home country if she doesn't get a visa by then. That will mean trying to get her file transferred to another embassy, and at the very least months more delays.

DAVIS BROWN LAW FIRM

One of the four main processing centers for immigration benefits applications has temporarily closed because of flooding from plumbing problems, USCIS announced today, March 26.

Deliveries by UPS and Fed Ex during the last couple of days have been delayed and the delay will continue to during the closure. US Postal Service deliveries go to a PO box off-site and apparently were not delayed per se, although USCIS does not consider USPS filings to be received until the PO box deliveries are picked up and taken to the Service Center (which is an odd rule given that both are federal government agencies).

The announcement did not indicate whether application processing would continue. Adjudicators are often able to work from home (and do so in the ordinary course of business), but how much work can be done while the center is closed is unclear.

As CSC is one of the two sites that accept and process H-1B filings, the closure is particularly concerning so close to the April 1 filing date.

However, the government is well-aware of the upcoming deadline and we will closely watch for any instructions regarding H-1B filings in light of the situation at CSC.

When CSC re-opens, it will be important to watch the receipt dates on I-797 notices if the date would affect your case. If the case was filed during the closure, you should retain your shipping receipts or print out shipping information on-line to prove when the application was actually sent and delivery attempted. Beneficiaries should not be harmed by the closure, which is beyond their control, but proof of timely filing will be needed to make this argument.

Premium processing has not been suspended, so applications filed in that manner should be adjudicated in 15 calendar days, or the petitioner is entitled to a refund of the $1225 filing fee.

USCIS California Service Center Has Reopened

The USCIS California Service Center (CSC) has reopened on March 27, 2013 following a temporary closure due to plumbing issues. Deliveries have resumed and USCIS does not anticipate any delays due to the closure.

Well I don't think 7.2 months is realistic. But of course if its the wait, it's the wait. Nothing we can do :) but still really no need to jump from 5 months to 7, they should keep up at least the same work movement. But things can speed up later or slow down..only time will show!



Yes the data was updated on February 5th, but if you look right above the chart it says "Field Office Processing Dates for California Service Center as of: December 31, 2012". So it's more than a month old data already.

USCIS electronic records indicate the referenced I-129F case, WAC-12-904-97443, was filed on 8/22/2012. Our current processing time is approximately 5 months from the date the petition was received. However, please note that our office has received a high volume of submissions in this workload. There is a current backlog and the petition is currently located with the adjudication division for the assigned I-129F workload (pending action).

If you do not receive a notice of action by April 12, 2013, please let me know and I will follow up with USCIS.

I hope that this information is helpful and that it will clarify the situation for you. If you have further questions, or if there is any way the Senator's office can help you in the future on other federal matters, please contact us again.


OK, so my file was removed from the file room and into the Adjudication Division pending action as of March 1, 2012. Supposedly if I do not receive an NOA2 by April 12, 2013 I should follow up. Today is April 17. On April 1, I received an email from USCIS saying my address was changed. I do not know what to conclude.



I heard someone say that the address change notice is a way they indicate a "touch" of the file, so it may be a good sign. But since it's past April 12 then you should follow up, I guess.

ChinaMy Fiancee Just Told Me She Cannot Marry Me

Yes you read that right, my fiancee just told me she cannot marry me... after I arrived in China to marry her as we agreed. And after I have been patiently waiting for her for over two years.

She says her father will not give his permission for our marriage, so she cannot marry me. A fantasy story, in my opinion.

So now I know I proposed to one of the insane ones. I feel like I'm watching myself in a Korean Soap Opera while in China.

I am in alot of pain but I would be in alot worse shape if I hadn't been chatting with several women online recently who have expressed interest.

I started talking with women online while in China after my fiancee started playing games and saying strange things (like she needs to get her father's permission, after he already gave it to us two years ago).

I'll still be in China for another two weeks.

So I have a couple of questions now:

1) My fiancee (ex-fiancee) recently let our K1 Fiancee Visa expire before saying we can pursue the CR-1 route, so if I find another lady I want to marry while in China now and she agrees, do I have a choice of the K1 Fiancee Visa route, or is my only option a CR-1 Marriage Visa? In other words, isn't there a period of time that needs to go by after filing one K1 Fiancee Visa before being able to file another one?

2) Is there a certain period of time that needs to pass before I would be able to file for a CR-1 Visa, considering the K1 Visa recently expired?

3) I just spent $7,000 for this trip to China. To allow myself the fewest trips to China as possible for marriage to a Chinese lady, what would be my best plan? In other words, do I try to meet with the parents of the lady I choose now? Should I propose now with a ring, or during my next trip, etc?

On the one hand I don't want to waste more time, I've already wasted over two years on this crazy lady. I also cannot afford to waste more money at this time. But on the other hand I want to make sure I don't rush things and choose another crazy lady; so I need some time to get to know the lady, and her family situation, her motivation, and so on.

You calling your former fiancee crazy, but by your words and purported actions, she seems to be acting prudently. You should take a break and do some soul searching in my opinion. Are you Chinese yourself? Why are you in need of a Chinese spouse. Aside from slowing down on your rapid fire replacement of a fiancee, you should stop and look a little farther afield at the possibilities out there. For me, I was married to a Chinese, and after our long unhappy marriage came to an end, I have found a lovely and warm Filipina lady. We share the same religion, and related values. I cannot say that about my former Chinese spouse. I could not see eye to eye with her. She just did her own thing without regard to anyone else. Not saying you can't find a good one, just wondering why so intent on that particular ethnicity.

There might not be any restriction on filing another petition so quickly, but I would think that possibly the CO might wonder about that when he sees the file.

In summary, please slow it down and think about it for awhile. She just called off the marriage and you're already communicating with other girls. She probably sensed something awry. That's my two cents.

I was married in China then filed the CR-1 4 years ago when there was no electronic filing and it took all of 9 months to have the visa in hand. As soon as I got back from my trip getting married I researched coverage for my wife on our benefit plans as a "life event aka married" and was told the second she was here she would be covered. With that said I will stress what others have said. It takes a long time and effort to go through the immigration process and is horribly stressful even when you both are physically and mentally well. If you think you can get through with the added worries (when you did your internet search about liver problems with limited information and panicked immediately, think of that exact moment and that stress will be multiplied)
The most important thing is finding out facts and not letting worry and imagination run away. I have to be blunt.. You say you care deeply for her but define that you don't want to have to pay an arm or a leg for treatments. I guess I have to ask.. Does money really matter when it comes to health? I mean is that even worth considering for the person you want to marry to be well? Money is only money health is the only thing that matters.
I really think positive thoughts your way please please take care of her and find out what is going on. You are in the place to be for medical treatment. Good luck and we all are with you hoping the best!

Is there some requirement to have phone bills originating in both countries? I call my fiancee by far the most because I have a more affordable plan, plus I make a whole lot more so can afford it. Also her phone service don't give a bill. It's a prepay service. It's really expensive to call US with her phone. If both our numbers show up on my statement isn't that good enough? The CO checks to see that both parties make calls or something?

I was updating the intent to marry letters for the visa interview.  The first pair of letters were addressed to the Dept. of Homeland Security.  Should I address the updated letters to the  Department of State, to the specific embassy, or to both the Embassy and the Dept of Homeland Security?

 

I also plan to give some testimonial letters for my fiancee to take to the interview.  Same question there too - who to address the letters to.

As a follow up, we went to the interview on the 12th of August, and everything was fine through the submission of forms, payment of fees, and fingerprinting.  But then, after another hour of waiting for the actual interview, about four or five applicants were called up, including my fiancee'.  They were told  that due to technical problems, they couldn't be interviewed today and that they could come back on Wednesday.  Seeing that Abu Dhabi is about 2 hours away from Dubai, that was not exactly convenient.  My fiancée took it in stride, was able to change her work schedule, had to work a double shift on Tuesday, so got zero sleep Tuesday night (worked til 2:00AM,  and had to be back out the door to catch a taxi at 5:00 AM).  We got to the Embassy on Wednesday an hour early as our driver sped the whole way.  We were first in line this time.  The upshot, within an hour, she had her interview and was given a verbal approval.  Only several simple questions, and they didn't even ask for any of our evidence of relationship/intent to marry. My 20 pound file all for nothing.  hehe   So I think that the prior week's closing probably had to do with that 2 day delay.  But oh what a relief after the additional time and hassle.

Typically they only reschedule the interviews on the days the Embassies are closed.  They keep the current interviews on the days the Embassies are open and reschedule the interviews on the days the Embassies were closed at the soonest availability when slots are open.  Everyone else who isn't scheduled for interviews gets backlogged.

 

Thanks for the encouraging reply.  That sounds good for my fiancee and me, but that stinks for the others scheduled on the closed dates and and those pending interview dates.

I just read that the US Embassies in the mideast, north africa, arab peninsula are closing until August 10th.  My fiancee' is scheduled to have her interview on Monday August the 12th.  I don't know how this will effect her, whether they may close additional days, or even if not if they will change her schedule due to the back up of processing.  I'm supposed to fly to see her on Wednesday. crying.gif

OK - so get the 1040EZ forms on the years , each year, that you did not file.

Then file each one in one packet, altogether.

You SHOULD FILE, you know - as you'll probably get some refund on the taxes withheld by your employers.

Your wife might be able to help you - filing taxes is dead easy, if you have all of the instructions in front of you.

Since this is your first year, expect to file the paper returns, not anything electronic - but you should be able to get the refunds back via ACH bank deposit (usually... and if not - you get a nice paper check) .

I suggest you include a cover letter stating that for those filing years, you were unmarried.... Just in case, aye?

Shouldn't she be filing a 1040NR or 1040NR EZ for those periods? Nonresidents aren't allowed a standard deduction, but get the exemption of around $3,800. They can take itemized deductions, most likely any state income tax that you paid would be the main one.

You called her fiance in one post and then wife in another. If you have had some kind of marriage that would be recognized as such by the US government, and then you try to get married again in some other way to make things happen quicker, it could be construed as fraud.

Oh, I know. The only reason I was asking is because I know with a work visa, I would be able to bring my wife here sooner under a dependent visa.
I have another question. My wife and I are having a civil union due to us wanting to be to apply for a spouse visa as soon as possible. Does anyone know if we can apply for a copy of the marriage certificate after getting married? Also, does anyone know if the email method for receiving the marriage certificate is accepted as a document for the us visa? Thanks!

Hi, thanks everyone for all the replies. I am definitely interested in applying for US Citizenship but when I read the requirements, it says the following "Have continuous residence in the United States as a green card holder for at least 5 years immediately preceding the date of the filing the application" Since I have only been living in the United States for only the last 3 months (Was living in Canada my whole life previously and just completed my University education April 2012), I don't think I can yet apply for it. Please tell me if i'm wrong. Thank you.


How can you still have a valid green card if you haven't been residing at all in the US?

the insurance covered everything after copays.. :P (at the time it was $15 for regular docs and $30 for specialists) but we didn't have copays for blood-work and other tests..


Some people get co-pay and co-insurance mixed up. Copay is usually a nominal upfront fee to see the physician whereas co-insurance is where you have to pay a percentage usually up to a specified ceiling.

The other thing, as a small business owner, my insurance premiums are outrageous. I'm paying over $500 per month for myself. When I eventually add my future wife, with maternity coverage (that's a lot extra), I'll be paying well over a $1,000 per month in premiums.
