K-1 Fiance(e) Visa Process & Proceduresrouted to vermont ??

My fiance lives in southwest Texas and our application got sent to Vermont. It makes no logical sense to me, I wonder if there is any actual way to know where the applications get send to.

Just to make it clear, no matter what, you send your case to the Texas Lockbox.
They sort it to the correct service center.

As Blob18 said earlier: "Despite what they say, they base it off of what they used to do."

In general, K-1s are sorted to service centers depending on where you live, based on the same system they used before they started using Texas as a sorting center. This is the list from the old K-1 instructions. So far, I haven't seen a single K-1 filer that hasn't fallen under this sorting method.

NOTE: Other visa/application types will not fall under this sorting method. They are sorted differently. Please, don't pop up with a CR/IR-1, AOS, some other application saying 'mine went somewhere different!' This is a list JUST for K-1 sorting.

If you live in Alabama, Arkansas, Connecticut, Delaware, Washington, D.C., Florida, Georgia, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Mississippi, New Hampshire, New Jersey, New Mexico, New York, North Carolina, Oklahoma, Pennsylvania, Puerto Rico, Rhode Island, South Carolina, Tennessee, Texas, Vermont, Virginia, U.S. Virgin Islands, and West Virginia.

K-1 Fiance(e) Visa Process & ProceduresFlight isn't nonstop... Problem?
I can't speak for Boston, but as for landing in Chicago O'hare (which I assume you would for Illinois), the last time I went through customs (and that was in the citizens line which was shorter) it took nearly 45 minutes just to get to the immigration desk. It really varies depending on how many flights are coming in.

K-1 Fiance(e) Visa Process & ProceduresVisa Transfer ??

I see alot of people saying that their paperwork was transferred to California Service Center and they recieved an approval shortly after...is that possible for anyone to do? Could I have it transferred myself?

You're confusing processes.
AOS applications get transferred to California usually to get an approval without interview.
This isn't the case for K-1s.

K-1 Fiance(e) Visa Process & ProceduresLondon K1 fees

We were charged the $350 USD ahead of time for the K1 interview in London and then when my fiance went for the interview, we were charged another $350. Were we over charged? If so, who would I call?

The good news is that our Visa was approved!!!!!

Usually you pay the visa fee in advance, through a phone service.
Did you bring verification of having paid it?

That may be why they asked for a second payment.
I would check in about it, definitely.

K-1 Fiance(e) Visa Process & ProceduresHow do you know when you're "touched"?

I see a lot of "touched" updates in signatures and such - how do you know when your case has been touched?

I signed up for email notification the USCIS website - but when I check my status it just gives a general "your in review"...am I looking in the wrong place?

When you log in to the USCIS website (you need to have signed up for an account and entered your case #), there will be a 'last updated (mm/dd/yyyy) column. That is the last time your case was accessed/touched. When the date changes, you've been touched.

Keep in mind, some people never get touches.
And touches don't really /mean/ much.

For instance:
I got the approval e-mail the 04/28 with an approval date of 04/27, but had no touches since the 22nd of February.

hi everyone! I'm just curious about something.. how would you know if your documents or your petition was touched? thanks, god bless us all..

Sign up for an account with the USCIS.gov website here:

Add your case to the portfolio.
Look at the 'last updated (mm/dd/yyyy)' date.

K-1 Fiance(e) Visa Process & ProceduresChange of plan - help!
I would say that your best option is #2.
There is no reason to get/use a K-1 if you're not planning on staying in the U.S..
Later, you can file the CR-1/IR-1 if/when you decide to move back to the U.S.

K-1 Fiance(e) Visa Process & Proceduresuk police record

With regard to the application form for UK Police Record, it states that the required passport photo be "appropriately endorssed on the back by the Guarantor". Does this mean it should be signed by me?

:luv: thank you

Check the instructions.
http://www.acpo.poli...0Form%20v15.pdf

It has to be signed by someone of an 'official' position that has known you for a minimum of two years.
The instructions has a list of acceptable 'official' positions.
They also have to sign a form as well, verifying their information.

Oh, where can I read reviews?

On the menu at the top, there is a link: Reviews: Embassy/USCIS.
Click that.
Then select United Kingdom from the list.
And there you go.

K-1 Fiance(e) Visa Process & ProceduresSo if I don't have photos of us together....
If you read through the reviews of the UK London Embassy, they have never asked for proof of relationship.
It's actually one of the easier embassies to get through.
Check out the reviews and see for yourself.

Of course, you can still /bring/ whatever proof you want, but... 500 or so reviews can't be completely wrong about the process and what they ask for.

K-1 Fiance(e) Visa Process & ProceduresDS-156 photo - London

Hi everyone!

Sorry if this seems obvious. My fiance is ready to send his packet 3 documents to the London Embassy. Does he need to attach a photo on the DS-156 in the box for a photo or is that something they do later?

Thanks!

They do it later.
You don't need to attach or send a photo with.
This is covered by the photos you bring to the embassy for your interview.

We tried to call 3 times, each time they told us to wait for the mail...so annoying...

Did you ask for a tier 2 officer?

Tier 2 have more information.

I was just wondering if there's anyone who filed I-129f for their fiance and while waiting for NOA2 got this email below instead... I just wanted to see if someone managed to get to know what does it mean? What was mailed to you?

I'm pretty sure that's your approval notice.
I've seen some others get it phrased like that before.

You can always call up the phone line and double check what the status is in their system. Ask for a tier 2 representative and tell them about the e-mail.

K-1 Fiance(e) Visa Process & ProceduresHow much does the K1 visa fee cost?

Hello!
We are ready to send our package (!!!) but we noticed that there is a bit of confusion concerning the actual amount of the fee to include in the package (with a cheque or a money order). On USCIS they say 350 USD.
Is that correct?
Thank you
Lana & Mauro

I think you're confusing two very separate things.
The I-129F, which is your Petition for Alien Fiance(e) form costs $340.
This is NOT the same thing as a 'visa fee'.
When your petition is approved, it will be sent to the embassy in the beneficiary's country.
When the beneficiary is preparing for the interview, they will have to pay the $350 Visa Fee.
Two separate fees at two separate times.

Please read the instructions, here:

It seems to me that somewhere, some lines got crossed.
This is a previous post from the OP:

http://www.visajourn...70#entry4233670

It doesn't appear that this issue was ever resolved.
They got a letter from NVC that claimed they were applying for a K3.
It looks like, based on the result, that the embassy /still/ thinks this is the case.

K-1 Fiance(e) Visa Process & ProceduresVisa Denied - Cairo (Age Difference)

Actually, I think it's critical to know the actual age difference. The answer to what to do next will be different depending on the age of the beneficiary. For instance a 20 year difference is viewed differently for an older male than a younger one. 60 and 40 is not the same as 40 and 20, even though the gap is the same.

Right.
But they'd said the beneficiary is 27. So we at least have a starting point.

K-1 Fiance(e) Visa Process & ProceduresVisa Denied - Cairo (Age Difference)
So...

You've told us that he was denied due to your age difference in your first post.

Multiple people have asked just what kind of age difference are we talking about?
Yet as a response, you continue to say 'age isn't an issue'.
Apparently it is if it is the reason you got denied.

If you don't feel comfortable giving your exact age, how about an age-difference range?
< 5 years?
5-10 years?
10-15 years?
15-20 years?
20-30 years?
30-35 years?

K-1 Fiance(e) Visa Process & ProceduresK-1 online couple/evidence of ongoing relationship

Hi everyone. Great site here.

I am wondering if there's anyone who started as an online relationship that could offer some advice.

As we're starting to put the petition together, I'm starting to get nervous if we have enough acceptable evidence. We've been in the relationship for a year now. I've got original chat logs dating from a year ago, but the names are not our RL names. I can easily prove my account by verifying with payment records. I don't think he does though. I've got some emails as well as chat logs using gmail and skype. I'm figuring out how to extract skype to skype calls (on a MAC), as this is our primary form of communication. I've been to visit him and his family for the holidays, but it was only for 2 weeks. So, I've got pictures, boarding passes, hotel and flight itineraries, etc etc. We wanted to send in the petition sometime between now and spring time. Is this sufficient? I was planning to go again this summer, but I may not have the financial means when taking into account our future wedding and the whole visa/AOS fees. I'd prefer not to wait out another year or half year before filing a petition...but I'm starting to wonder if the 2nd one month trip in the summer would be a better insurance for our case.

Any advice from people who've been in a similar situation?

...Also as a note. I know a lot of people are weary of online relationships. We've been at this for a year now. We don't hide things from each other just because it's over the 'net. And it's amazing how many mannerisms/habits one picks up spending with someone 24-7 in as short as 2 weeks. lol The time we spent in person was just as we always do (only better and not between computer screens). We're willing to wait a bit longer to file if we have to. But, we're both at a point in our lives where we're ready to settle down and start our life and family together...like everyone here :) But I guess...I'm just getting nervous cause we didn't meet the conventional way.

Thanks in advance for any replies.
I really really realllllly enjoy this forum. There's a lot of positive vibes and it's open my eyes to seeing that any road blocks are not impossible to overcome...just requires more patience and perseverance. :)

-J

I think in some ways you're preaching to the choir when it comes to this forum. I'd say that quite a few people here have relationships that began on the internet and extended into real-life, myself included. So no worries about having to convince us about it.

For the I-129F, all you have to do is prove that you have met sometime in the past two years. Passport stamps, boarding passes, flight itineraries, photographs, hotel receipts, etc. are really the way to go with this. A single visit is enough as long as it's well documented.

As for continuing relationship, that would be something you would need more at the consulate level at the interview. You can always send it along with your I-129F, but it is not required documentation at that point by any means. Sometimes they ask for it at interviews, sometimes they don't. My suggestion if you are going to use chat logs is to write a letter/attachment signed by you both stating your full name, and your online identity. You can use chatlogs to show continuing relationship, but edit out any bits that might be a little too private for the eyes of a stranger.

K-1 Fiance(e) Visa Process & Proceduresdo i need a lawyer for k1 visa processing?

I emailed a lawyer. He charges 1800, plus filing fees. That's quite expensive. Is it bettr to have a lawyer? Because I will hire him if its faster or better. Please help. I really want my fiancee with me. Also, about how long would it take to have him here? Some say about 6 months. Is this true?

It really depends on how comfortable you are with reading through not only the instructions for each form, but also the guides here and filling out the information yourself. I would say that if you are reasonably organized and you read all the information provided, it isn't a big deal to file them yourself. If you have an overstay, or an otherwise unusual or complex case, then you might want to lean towards getting a lawyer.

As far as I'm aware, it doesn't improve your chances of getting approved, or improve your speed through the process. Either way, I suggest you read the guides and the instructions yourself so you are familiar with the process and what needs to be on each form. That way even if you do get a lawyer, you can double check everything yourself.

You are correct.

K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List

Hello There!

Please, i need help here... I was told that it is better to submit the I129F packet via installment basis (1-2 forms at a time) and wait for RFEs than submit everything altogether. Is it true? Im not sure about this coz personally i think it's absurd but that's the advice given to us by our paralegal who is helping us put together all the requirements. Please, anybody who can help me decide on this, i need your help, please.

Thanks so much in advance!

To put as nicely as I can, I think your paralegal is full of #######.
Each time that you get an RFE, it slows down your case processing by at least 2-3 weeks.
Send the entire packet together, with all supporting evidence and all forms required.
And consider firing your paralegal. :bonk:

So, I am understanding also,... that another recent-past change is that you ONLY NEED TO SEND ONE (1!) G-325A for each, you and your fiance? (Three years ago, you had to send 4 COPIES! for each person)

And, also the passport-type photos,... Now, they are only asking for ONE? (Also, they use to ask for 4.)

Thanks, TwoCats, for your help.

I live in Louisiana.
Is there a way to tell where your Application goes? California? Vermont?

I'm guessing California, as that was where mine got routed to the last time, from Mesquite, Texas.
But,... oh! How things change.
So, ?

And, with this all said and done, then.... likely, I have few-to-no-more concerns, and my app should be zinging westward in a few more days!

Yes, one G-325A for you, and one for your fiance'. (So glad it's not four like before.)
Same for the passport photos.

You send it to the Texas Lockbox.
The address is in the instructions.
The lockbox will forward it to either California or Vermont, but you don't send it there directly.

K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List

Initial K-1 apps from the USA gets sent to either Dallas or Lewisville, Texas?
(for me in Louisiana, 3 years ago, it was 'sent to Mesquite, Texas)

Or, can you take your K-1 package to Regional offices?
(like I know there is one in New Orleans, a few hours away from me)

There are two addresses in the instructions.
One is for US Postal Service deliveries, one is for courier (dhl, fedex, etc.)
I would suggest just sending it US Postal Service - Priority Mail with Delivery Confirmation.

I generally wouldn't suggest using signature confirmation.
There isn't always someone there to sign off for it, which can delay delivery.
TwoCatsFemaleUnited Kingdom2011-03-11 14:49:00
K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List
In addition to the I-129F form, you need to file the G-325A form (one for you, one for your fiance).
I don't know anything about a G-325B.

The filing fee is $340.

Depending on your service center, the processing time is about 5-7 months just for the approval stateside.
California is running about 5-months.
Vermont is about 6-7 months.

After that, the wait time to interview/visa depends on your country/consolate.
TwoCatsFemaleUnited Kingdom2011-03-11 13:48:00
K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List

never mind; I figured it out, Request for Further Evidence.
My evidence was about an inch and a half thick, when I sent it initially, and so I guess maybe that's why there was no RFE. ... The interview consequently, was about 2- 4 minutes long; visa granted.

But, I need a little help, with a few questions about changes, this time around.

Go ahead and ask your questions?
I went through this process once before, myself.
Can't answer questions you don't ask.
TwoCatsFemaleUnited Kingdom2011-03-11 09:27:00
K-1 Fiance(e) Visa Process & ProceduresThe RFE Master List

Another question here. If you get a RFE can you still be denied on your application? Because technically the application is approved right? They just need the missing information or evidence, right? I'm just worried that after all this wait and after sending back the RFE I might get denied on my application.

First, you need to correct your assumption.
An RFE does NOT mean that the petition is approved.
What it means is that the adjudicator got to your petition and you were missing something that they need to continue the review process. Your case is effectively stalled until you reply to them with the missing information.

It does mean that it made it to an adjudicator, and as soon as you provide the information they request, that they will proceed with the review. The result of the review could be another RFE, Approval, or Denial based on the additional evidence offered.

After almost 5 months of waiting USCIS sent me an email saying that I have a RFE. I have not received the hard copy yet. I just want to know the pros and cons of having a RFE?

Pros: Your case is sitting on someone's desk.
Cons: Your case is stalled, waiting on you to reply with the requested information. From the time the RFE is issued, to the time that the reply is received back at the Service Center, your case is sitting, doing nothing. Which can extend your wait time a minimum of two weeks.

K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary 2011 Filers!!!

I was able to check our case online and it had January 10 as their acceptance date, would this also be the offical NOA 1 date that will be listed on the hard copy?

I believe that that would indeed be your NOA1 date.
You can verify it when you get the hardcopy, but I'd assume it safe enough to put on your timeline for now.

K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary 2011 Filers!!!

You guys sent them the wrong fee as well? Im so sorry to hear that :-( But congrats on getting your email, Im happy for you guys!
Im wondering, why are you upset over having your petition sent to Vermont? Ours got sent to VSC too and based on what Ive read here Vermont shouldn't be any slower than CSC? It seems to me that any little thing makes me worry so much more

thanks! Eve

Right now, Vermont is actually behind California in getting approvals out. California is processing August, while Vermont is processing July. You can see the historical trends for approval wait time here: K-1 Historical and see what month each is working on here: Igor's List . Overall, they are both past the 5-month wait time on average.

Okay.
I think I updated everyone's service centers to what they've reported.

I didn't add NOA1 dates for most people since it depends on having a hardcopy or access to the online status to see the date they received your package. The date you get the e-mail/text is NOT your NOA1 date. It's probably either the day your package arrived at the lock box, or the next day after that.

When you know for sure what your NOA1 date is (either through hardcopy or online status) please feel free to post it!

Personally, I'm still waiting on getting access to the online status for our case. Have any of you who got sent to CSC been able to check yours yet? Not too worried about it just yet. The last time I went through this process, it took about two weeks to get in the system online.

P.S. With others reporting in the weird times they got their notifications, I am pretty certain it's just some automated process run in the evening.

K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary 2011 Filers!!!

I too am from Chicago, so CSC it is :) That can be updated into the list if needed

Nice to see others from Chicago, too!
Make sure you update on your timeline page, as well.

That goes for everyone.
When you find out what your service center is, make sure you update it on your timeline.
Texas doesn't do K-1 petitions anymore. Just California and Vermont.

Updating the timeline with some of the new folks.
Welcome to Mike & Allen, James and Oksana, and raidetta.
Welcome to the wait!
Hopefully we'll get some e-mail notifications soon, and some NOA1 dates after that.
Just remember folks, your NOA1 date is on your paper copy.
It's NOT the date of the e-mail.

K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary 2011 Filers!!!

PS - CSC/VSC? Which one do I put? I sent it to Texas.

It depends on where you live.
I don't have a list right off-hand with which states go to which service centers, but I know I read a thread with it recently.
For instance, I'm from Illinois so we go to CSC.

If you don't know for sure which one you're going to, just leave it blank for now and fill it in when you get your e-mail notification or your NOA1.

I'm not sure that has anything to do with Vermont, but more to do with Texas which is where the application is received (and payment is processed) before sending off to the correct service center.

Not sure.
Could be just that the two petitions we have electronic notifications for were sent to different desks and one is faster than another. Who knows.

Just making conversation on what little we know to pass the time.
