We never got ANYTHING on our first petition. The check was 'the cashier check' so we never got a trace of it. My Fiance called VSC but they said to wait some more time. He made sure they received the package but then...nothing. That's why I think it might be influencing our new petition.

Hello everybody,

As everybody here I'm worried about the wait and the whole process in general. In fact, our situation has been unusual from the beginning and I was wondering if we might still be influenced. The situation is that we filed our first I129F petition back in December of 2009. We really made sure everything is in place. My Fiance and I are both experts in any kind of paperwork (due to our jobs specifics). Therefore, I'm absolutely confident that we had everything needed in our package. Unfortunately we NEVER had ANY kind of response from VSC. The package seemed to went nowhere. Has anybody ever run into something like that? I would really appreciate your knowledge and experience guys! I started thinking that problems with our 'second' (we filed in September of 2010) paperwork might be related to the problems with our 'first'.

Please let me know if anybody has ever had something related to our situation.

Was the check ever cashed?
Did you ever get an NOA1?
Did you inquire at all with USCIS about that case?

The second petition:

Vermont is a bit behind, taking about six months+ to process petitions right now.
They are still working on September, and haven't started October yet.

Not yet.
Probably sometime in September, or early October, it's looking like right now.
I may have to plan around my parents going on some trips around that time, but we'll see.

Kata wants to invite in his parents and brother, so we'll have to see what we can do with that, too.

We don't actually have a date set.
However, I believe Kata put a date in the end of July on the DS-2001.
I don't know that it had any real effect.

I sent of my packet 3 this week and they should have received my medical results at the same time as the packet.

How long did it take you to get an interview date?


We sent in Packet 3 on 06/01, and it was logged in 06/15. (About two weeks).
The medical was 06/07 and logged in 06/10 (about three days).

We got an interview date by calling DOS on 06/17.

For those of you who have sent off packet 3.... do we need to call up and pay that interview fee before they issue you with an interview date or can it be done after?

I am in dallas until the 30th, and although i have all the forms with me and could mail them from here to London, i intend to wait until i am home as Ashley and I are in no real rush for me to move over here.

Getting packet-3 checked in seems to be what is taking the longest time right now (vs. the medical) in the UK. So even if you aren't in a rush, you might want to send it in early. We sent ours in almost two weeks ago and still no sign of it getting checked in. I think someone mentioned 'up to four weeks' wait in the UK forum. So...

As far as I'm aware, for the UK, you won't need it.
Check out the reviews of the embassy.
They are pretty straitforward and don't generally look at relationship evidence.

I am well above the poverty line, actually. I had read somewhere previously that I would need to fill in 2 of the sections related to finances so I wasn't sure which 2 I should concern myself with.


You can fill in as many as you need to in order to prove that you have enough income/funds.
It's my understanding that in the UK (London Embassy) they only ask you to provide two proofs of income/funds.

So, any two of the following would be fine:
- **2010 Tax transcript OR 2010 1040 + W2 and supporting documents/forms
- **Employment letter
- **Pay stubs
- **Bank letter
- Insurance information (if using life insurance trade-in value)
- Bond/stock information (if using that)
- (insert any other proofs to back up things you claimed)

The ones marked with ** are the ones I think are the important things. But that's just my personal view, not anything official.

When filling this in, in the section where it asks for the amount of stocks and bonds that you currently hold, should I list funds that are held through my 401k plan or would they be exempt from this?

How close are you to the poverty line?
Will this make an actual difference?

With mine, I had enough that I didn't need to list any of these kind of assets.
If you can cover enough with your salary / other funds, I'd say you probably don't need to worry about it.

As long as you have your LND# you should be fine scheduling it.

That has not been my experience in the UK, but hey - to each their own.


I'm just going off of what I've read on this site, on the UK forums, etc.
Everything says you can send in Packet 3 after the embassy has logged in your forms and sent out the instructions. You don't have to have received them, but they have to have sent it. I think the reason for that is that they need to have the information actually in their system. If you send it before they actually have the case logged in, then it could get set aside/lost/etc more easily.

In any case, my point was -
The OP had said that the embassy had not logged in their case yet, and were wondering if they could send in what they 'think' goes in packet 3. I advised against that, since they didn't sound sure of what they needed. Not all embassies work the same way, and they all require different things. UK is one of the strait-forward ones where you can find everything on the web. It isn't that way for a lot of other places.

Okay thank you. in our case the embassy DID sign for it on May 31st (It was May 30th in the states that was the Memorial Day, not the 31st - it is always the last Monday of May) AND still no packet 3 and we cant get through when we call! Arg! If we send what we think goes in packet 3 how do we know what address to send it to at the embassy?


I wouldn't pre-send anything, even if you know what goes in the packet.
Even in the UK, where packet 3 is on the web, you still have to wait until they issue the packet 3 instructions before sending in the reply mail, and different embassies ask for different things.

Kata had a doctor's appointment today to get some of his vaccinations, but they told him that they would not give him an 'unnecessary' MMR vaccine (he had the full doses of it as a child). We'll see how that plays out at the medical (if the medical insists on him getting another one or not).

Do people think past visa denials/overstays would fall within the remit of the I-129F background check?

I overstayed on the VWP last summer by 4 days, and was denied a B2 visa in December. Slightly anxious that this might be the reason we appear to have been delayed.


I'm not sure if they come up at the initial I-129F background check, but they will definitely come up at the embassy. You have to provide information on all visits, how long you stayed (in days) and also provide information about any visa denials.

Did you find a DS-156 that does not expire may 31? The Department of State site still shows me the old one.


From what I've read, you just use the existing one until a new one is available.
And a lot of times they accept previous versions anyways.

The I-134 is also expired right now.

Which makes us - my goodness - third in line for VSC filers, and fourth overall.

I'm not sure about with your embassy, but I know that in the UK you don't send any photos with packet 3. Everything is collected at the interview. Maybe check the regional forums and see if there is information for you?

ALWAYS good advice!
Every embassy is different and requires different documentation.

Mostly, I'm just offering personal experience. The last time through this process, when I used a 1040 instead of the transcript, I got an RFE for not providing 'supporting' tax documents (1099s and worksheets used to fill out the 1040). This was at the AOS stage, so I'm not sure how strict the embassies are about these documents.

Just make sure that if you are using a 1040 that you have all the tax worksheets, w-2s, 1099s etc. Better to have them if needed than get stuck having to wait on approval because you didn't provide them. Also, if you have time, request the transcripts anyways! They come in /fast/ and you'll need them at the AOS stage anyways!

No, the 1040 is not the same as a tax transcript. If you want to use the 1040, you also need all the backup documentation. W-2s, 1099s, and any other forms used to fill out the 1040. Your fiance can request a tax transcript for free using the information here:

Hey my Fiance sent off for his ACPO on Friday. Can I ask how long it took to get yours in? Just a time gauge really. I think his might take longer cause he was born in Scotland and lived there till he was 18. Also did they ever email you or did you just get your cert one day in the mail?


I'm not sure ours would be a good estimate for anyone else. We got the expedite service on it, and I'm not entirely sure when it got sent in, since his friend who was authenticating the pictures was the one to send it in. He got an e-mail when they received it, and he called and was able to get the date it was sent out from them, but I'm not sure if that's standard, or part of the expedite service/extra. It just arrived yesterday, no other notice than that.

I went ahead and updated the list of January filers again. We've got a few people who aren't updating on the timeline page and I'll admit, I'm not keeping up with posts lately.

This is Kata's last week here with me before he goes back to the UK. Right now, it's not looking too good with his boss for him to be able to continue to work remotely, which kind of sucks. He's got the medical a few days after he gets back, and will be sending in packet 3 forms soon.

After the interview, if all goes well, he'll go back up to Scotland for a week or two to figure out what he's sending over and what he's giving away to his family, and then he'll be over here hopefully before the end of summer.

Fingers crossed.
Not looking forward to next week Tuesday when I have to say goodbye again.

Ok I have a question concerning number of k1's allowed. And please respond with regard to my question, no judgement as to why all this happened, it just did.
In 2000 I had a fiance from China on a k1. All was approved and she ended with a 10 year green card, but unfortunately it ended a divorce. Then in 2005 I partitioned another k1, it was approved and sent to NVC but the process was never completed beyond that point, we decided to break it off. I never did cancel it but I am sure it was closed after the time limits. Now I have k1 in progress with NOA1 received expecting NOA2 by April or so. I read on here in another post about a limit on K1's. Is this true? Is a waiver necessary? Does my second K1 count since we never followed thru? If a waiver is required does it come back as an RFE?
It was much faster and easier in 2000, only 4 months from filing to the time she stepped off the plane in USA.


First, I would suggest finding out the status of that 2005 K-1 petition. You do not want it to come back and bite you in the rear end. You may want to call and see if you can inquire into the case's status, and make sure it has been closed/expired.

This is quoted from the I-129F Instructions:

If you have filed two or more K-1 visa petitions at any time in the past or previously had a K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver. To request a waiver you must submit a written request with this petition accompanied by documentation of your claim to the waiver.

So, based on the fact that you filed two K-1 petitions in the past, it does appear that you need a waiver. I am not sure what the process is at this point, but since the petition was accepted, it seems likely that you will receive an RFE for the waiver.

Also, did you answer honestly in question #11?
If so, you should have told them about both petitions. If you left one out, you could end up with some issues for not providing full/accurate information.

Just wondering if there are any other people who filed to VSC in August that still haven't received their NOA2? We had our NOA1 on 26th August but still no word. I've been waiting very patiently for some time now and am wondering if there's anyone else out there in the same boat? My patience is starting to wear thin!
