Getting ready to send in I 751 to remove conditions for my wife and stepson. Can someone who recently filed just clarify one thing for me. The fee for wife and stepson who will be included on the same I 751 should be 505 which covers both wife and stepson and then 85 x 2 for a total of 675 to submit with the I 751. They make it so confusing. Thanks for the help. Good luck to all.

 

Didn't see this get answered yet, so I looked it up. This is from page 1 of the I-751 instruction PDF:

 

If you have dependent children who acquired conditional resident status on the same day as you or within 90 days thereafter, then include the names and Alien Registration Numbers (A-Numbers) of these children in PART 4 of this form in order to request that the conditions on their status be removed as well.

 

Also, under 'What is the filing Fee?'
 

The Filing fee for a Form I-751 is $505.
An additional biometric services fee of $85 is required when filing form I-751.

Each conditional resident dependent, eligible to be included on the principal petitioner's Form I-751 and listed under PART 4 of Form I-751, is required to submit an additional biometric services fee of $85.


 

So yes, it appears to me that $675 is the correct amount. $505 + $85 + $85.

Could anyone give me an estimated waiting/processing time for

 

  1. NOA
  2. Biometrics appointment
  3. Interview (if needed)
  4. New Permanent REsidency Card?

I sent my package yesterday at the California Center.

 

Unfortunately, there's no great answer to this question.

Any information from the timelines is just an average and can vary quite a bit from case to case depending on circumstances.

So please don't take any of this as definite, as it's all just guess-work based on current timelines, information, etc.

 

1. NOA - It's an average of 5 days from sending the application to the NOA1 date, based on current information. Which means you may receive your NOA1 letter as early as next week.

2.  A quick eyeballing of recent timelines shows 3-4 weeks wait between the NOA1 and the biometrics appointment. Not sure when people received their letters for that.

3. I can't find any recent information about interviews, so no clue there.

4. They are processing October applications right now, so I would estimate 5-6 months based on the current rate of approvals.

Apparently not! I forgot to write   "Attention: I-751 petition to remove conditions of status" in the address I wrote on my package. oops8rh.gif 

I just wrote down the USCIS california center address!! Do you guys think this would be a problem? Is there anything I could do now? 

 

 

We didn't put it on our packet, either.

A quick search through the forums shows plenty of people who forgot and had no issues.

My understanding of the process is, the P.O. Box in the address is specifically for I-751 applications anyways, so it shouldn't matter that much.

Our package was sent out yesterday. Due to arrive on Wednesday.

I haven't added us to the listing since it wasn't working right for me, so if someone could add us to the list, that'd be great.

 

Going off of memory, I think we sent:

 

- Affidavit outlining our housing situation (we live with family and pay a share of taxes/utilities).

- Pay stubs from both spouses showing shared address.

- Bank account statements from both spouses showing shared address.

- Driver's licenses showing shared address.

 

- Joint checking account statement.

- Joint savings account statement.

- Joint credit card photocopy.

- 2011, 2012 tax transcripts, 2013 tax return.

- 401k beneficiary form from my work.

- Life insurance beneficiary form from my work.

 

- Insurance enrollment from my work showing medical, dental, and vision insurance for both spouses.

- Car insurane showing both spouses as named driver.

 

- Two affidavits from our closest friends, personal letter from his mom.

- 7 photographs photographs from 2012-2013 (we aren't big 'photo' takers)

- Celphone record showing both names on separate phones under the same account.

- Joint membership cards to the local Zoo.

 

The last additions might kind of be 'fluff', but I wanted to just include whatever I could find just to be 'safe'.

We sent our K1 application on December 27th, we received an email from USCIS on January 3rd to confirm acceptance of our application. It's now being transfered to Vermont and we are waiting for the written confirmation they sent out at the same time as the email.

Maybe we can keep an eye on how our Visa applcation progress as we are both from the UK and filing at roughly the same time.


It's definitely nice to see others who are going through the same process from the UK.
Seems to be a little cluster of us right around the start of the year.
Could you fill in your timeline for us?

It's based on where you live.
Texas just forwards it on to the service center that covers your area. Either Vermont or California.

That is very true. I went to see my fiance over the summer and most people just assumed I would bring her back with me. I've had to explain the process to so many people. It's just not something that people are aware of; and I wasn't either until I started this journey.

As far as the difficulty of waiting; some people need to vent and others want encouragement. I guess we should just do what we can to help each other get through this the best we can.

And I am thankful every day for Skype.

Over the years, I've had a lot of trouble explaining to people that it is a very long (3-4 year from start to 10 year greencard) process to get a significant other into this country legally. And then, of course, once I've explained it, they all ask: "Well, why don't you just jump the border like the Mexicans do?" Which makes me face-palm every time.

The worst part is that because I have been through the process before, people tend to come to me for information and advice. It's hard to break it to someone that they either A) have a situation that won't work for immigration purposes, B) they don't have enough money to meet the poverty requirements, or C) that their expectations of having their beloved here in a couple of months are just not going to happen.

I realize that some of you think the wait is entirely reasonable and that the system is just fine. To you, happy waiting. Just please chill out on your contempt for those of us who find the wait to be patently ridiculous and the system horribly broken. We are entitled to speak out against this system just like you are entitled to speak out on how great it is.


I think it's almost a bit worse for some of us who have been through this twice. We know how much quicker the process /used/ to be. The first petition I put in for my ex-husband was approved in 91 days and that was back in 06'. Three months of waiting as opposed to looking at five months right now. It kind of makes me cringe.

After two weeks of fair progress (I would not go so far as to call it good), the Vermont Disservice Center gave us ZERO approvals on January 13, and so far ZERO for the January 14.

Have they had a relapse of the coma that prevented them from attending to their responsibility to United States citizens like the one they had in the last quarter of 2010?

What is their problem? Why don't they just do what we paid them to do?


Just to play devil's advocate for a moment.

Keep in mind that VJ's users represent maybe 7-9% of the total volume of K-1 applications going through any given service center. So it's entirely possible that they /are/ approving people, just no one from the site. It might also be good to compare the weekly numbers as opposed to daily, to get a better idea of how they are lining up with previously.

Besides, it's a little early to discount both the 13th and 14th. It sometimes takes a bit of time for people to trickle in here and update their information. By Monday, I'd guess most of the active people would have updated and you'll get a better idea of where things really lie.

It seems to depend on the service center that you're ending up sorted to.
Right now, California (where you would be since you're from Chicago) seems to be taking a while to get NOA1s out, but there's at least a week wait on just getting the e-mail acceptance. If you haven't heard anything in two weeks, then I'd start to worry.

You can check out the January information from the links in my signature and see some of the wait times. We don't actually have a lot of California NOA1s just yet.

There is a sort of oddity when it comes to myself and my fiance'. He sees things in the long term. That in less than a year we'll be together and then we won't have to be apart for the rest of our lives. Me? I'm much more the day-to-day person. I suppose I try to pass the time on here. I lurk the January filers thread (see links below in my signature if you'd like to join us for support) and try to keep my brain occupied elsewhere.

We spend every evening on Skype, talking until he has to go to bed. We play video games, listen to books on tape together, but right now we've only been apart about three and a half weeks (he left in early January). How hard it's going to be down the line, I have no idea. We go back and forth discussing me coming to visit him, but nothing is certain, and financially we can't afford it until late spring/early summer. I try not to think about it, mostly.

I was just wondering about the received date from USCIS. If my text message came in on the 20th of September but on the USCIS website it says that they have received the application on the 16th of September. What is the date that will mark my 5 months dateline? Is it 16th or 20th of September I am leaning towards the 16th? Any ideas? Thanks


The date you get the e-mail isn't your NOA1 date, it's just the date that the e-mail was generated in the system.

If you have your hardcopy, it should appear under the 'NOTICE DATE' field.
Otherwise, you should go with the one on the USCIS website if you don't have your hardcopy.

Usually these two are the same date, or within a day of each other.

My one huge huge beef with all this is that its amaizing how they can get 70 done in a few days which if multiplied by average fraction we represent 4% that would mean that about (25*70) 1750 apps in 1 week. So if they can do that many in one dam week then why do they do only 2000 per month? It couldnt be any more obvious that they are totally inefficient and it pisses me off becasue all government institution tend to be slopy like this, and this is from someone who is more liberal in viewpoints.


I think part of it has to do with the fact that I-129F applications make up a vast minority of the applications they receive. Looking at the data page offered up by USCIS, it looks like they get between 400,000-500,000 applications per month. Of these, less than 1% (aprox. 4,000) are I-129F applications.

They seem to move people around to working on petitions where it's more needed, and we make up a very small percentage of the total applications in the system. So I'm sure there isn't a lot of push to put our petitions as a high priority.

Not saying it's fair, just... the numbers are kind of stacked against us.

Look if 300 apps are aprouved in 1 day and you make up 5% of the population then you should have 15 out of those, the odds of having a sample of 5% and seeing 0 of your sample out of 300 are less then 1%.


Numbers fascinate me, so... I can't help but adding another comment to this.
It looks like the service centers, on average, get about 4000 I-129F applications per month.
Vermont gets around half of those (not exact measurement) so... approx 2000 new applications per month.
In an average month, let's say there are 20 or so working days.
That means to complete those applications, they need to process 100 applications per day.

I did some number crunching based on the data on the USCIS website a while back, and VJ seems to represent anywhere from 2-6% of the given population of a month (yes, it varied that much). So on an average day, we should see 2-6 application approvals if they are meeting the quota expected to prevent a backlog.

And, I'm done geeking out on numbers now. :blush:

Just when it seemed things were going in the right direction it looks like they are putting k1's aside again at VSC. I dont understand how they can process 30+ petitions in 1 days and then 15 total for the next 5 days?

If you look at the stats it looks like on the last day of January they did a whole bunch 30+ and even the few days leading up to that they did huge amounts, then as soon as February started they dwindled down to 5 a day even less on some day. Why are they doing this? They tried to pad thier stats for that month at the end of it and then the very next day its down to practically none. I just dont understand.


I think it's a bit early to start saying that VSC has gone to a 'stand still'.
If you look at the weekly statistics, this week has been their /best/ week for VJ NOA2s since March of last year. (63 at the time of this posting)
So I don't know how you can say that - at all.

My brother and his fiance' are planning on getting married this year, and they probably will end up doing the whole huge church wedding with bride's maids and a gargantuan reception. My soon-to-be sister-in-law's family is huge. (She was one of my longest term friends before she started dating my brother.)

As for me, my family is actually pretty small. We don't have much contact with cousins/extended family and generally it's my parents who get invited to the extended family's events, not us. So it's likely that we'll just be doing a small courthouse wedding with just my family (mom, dad, brother and sister-in-law) along with my one cousin and her daughter and some of my friends. Maybe 10-12 people total. I'm not sure if any of his family will be able to attend, but it seems unlikely for now. We may go back and have a reception there afterwards.

After that, we'll probably just go back to my mom's for dinner and then head off to a hotel. We both agreed on honeymooning nearby (so we can get back and work on the process quick), and that we wanted to go to a water-park hotel.

Actually...
I just got this fixed yesterday, myself.

After waiting 30 days...
I sent a very polite e-mail including my case # and NOA1 date to the CSC followup e-mail that you can find on the website under 'Contact Us'.
I explained that my case status was not available online and asked what it was, and when it would become available.

Since you have already tried calling them, I'd suggest including that information as well.

Within 24 hours I received a reply that they were forwarding my information to IT to get it added.
And within another 24 hours I had my case status.

There were a bunch on 7th, 14th, and 21st of January which were all Fridays.
But none on January 28th, or February 4th.

It's a little early still to make a judgement for today, though.
Vermont approvals tend to come in a bit earlier in the day, and California ones in the afternoon from what I've noticed.
So we've still got a while before we can declare that they've taken Friday off.

Please do some research before getting aggressive towards other posters who are trying to provide the correct information.

There are NO K-1 petitions being processed at Texas Service Center.
The K-1 I-129F petition is sent to the Texas Lockbox.
There, it is received, and forwarded to the correct service center (California, or Vermont).
There were some I-130 CR/IR-1 petitions forwarded to Texas, but NOT K-1 I-129Fs.

The people showing up on Igor's list are people who chose 'Texas Service Center' from the dropdown when setting up their timeline, and never updated with the correct information for their service center when they got their NOA1.
