Does anyone see the logic? VSC is moving pretty steady so far, today even 5 approvals already for VJers, but our estimated approval date is moving continually backwards. And since yesterday it moved another 2 days backwards :bonk: I'm getting nervous about our wedding date :(

It's based on the average number of days between NOA1 and NOA2.
So think of it this way:

There's a bunch of people waiting right now, who aren't being taken into account because they have no NOA2 date. Once they get an NOA2 date, their wait time finally gets included with the average and takes effect.

You should see a field that says 'Last Updated (mm/dd/yyyy)'.

It's the start of another week folks!
And not only that, but it's the end of February.
That means that we're at least a full month into the process, some of us close to two!

Last week was actually really productive for me.
I bought plane tickets to go visit Kata in April and we made plans to see Lion King in London.
We also made some plans for our honeymoon, which we're hoping to have up in the Wisconsin Dells.
And my weight-loss journey is still doing well - I've lost 26.6lbs so far in two months.

I hope everyone else had a good weekend.
Let's hope USCIS did too, an will buckle down and get some real work done this week. :bonk:

As I stated in a previous post, I am presently living and working in St. Lucia, where my fiance lives (i never left after completing my Peace Corps service). Now my family is saying that we should just get married in St. Lucia, and all of them will come to us for the wedding.
Does anyone know what happens if you get married in your fiance's country while your K-1 Visa case is being processed??
I know that for people who are already married, its a whole other application...


If you decide to get married, you'll want to contact USCIS and make sure that you withdraw your K-1 application. It will no longer be valid as you will now be married and will need to be filing for a spousal visa instead.

I think, cost-wise, you actually won't lose that much. The K-1 is all-around more expensive than a spouse visa, because of the AOS step. Where as with the CR-1/IR-1 you get a greencard when your spouse arrives, no AOS. So even if you have to re-file, you probably won't be risking spending much more than you would have already with the K-1.

The only thing that's really an issue is that you'll be starting again from scratch. That means it may take longer before you can enter the U.S. You might want to look at when you are planning on getting married, and how long the CR-1/IR-1 is taking right now, and then compare that to the K-1 processing time to get an idea of how long this might delay things.

Also, someone mentioned a while back that I should switch my timeline to the Vermont service center from the Texas service center becuase they transfered my application from texas to vermont. However, whenever I go to edit my timeline profile, it clearly states in bold by and astric to type the service center that you filed at, even if it was transfered to another....
what has everyone else done?

You filed your petition at the Texas Lockbox. Note the bolded word.
The lockbox is NOT the Texas Service Center.
It's just a sorting facility.

One was an expedite for Haiti.
The other two, we have no idea.

There are some theories, but no one really knows for sure.

You mentioned that you forgot to add your fiance's A#. Did she have an A# previously? even though she is Canadian?

Ill give everyone a little background..In my previous marriage, I applied for a CR-Spousal visa (got approved with a US resident card and all) and was assigned an A# during that application. When I divorced him, I gave back the residence card/status.

This time..I opted to do the fiance K visa..I wrote my previous A# on the forms (like the G325 form..even though it was from a previous case). Im actually getting quite nervous if this could be a good thing or bad thing in terms of the timeline. :unsure:

Has anyone been in a similar situation or heard of something similar??


I think, if nothing else, the fact that you relinquished the resident card and status and left the country would show that you aren't actually in the process just for immigration benefits. Which is a plus on your side.

I'm sure that they do know that you've been petitioned before, and questions about it may come up, but I don't think it'll be a major issue. Your Alien# would stay with you, so I'm pretty sure you did the right thing with including it.

Howdy mates!

Congratulations Kats on your diet. I lost myself 40lbs, but it took me 12 month and looking for more progress. From Igor's list 99% of cases are from August (for now it takes 6 month from NOA1 to NOA2). I think sitation in USCIS is all American filers (me including) fault. We voted or didn't for people who do this to us.

I have two Questions about it:

1. Why 15 minutes work takes 6 month to do with lock of customer service?

2. Why in country of the presumption of innocence I have to prove them that I am not crook? I just want to get married and be with my future wife.


I wish I had answers for you, but I don't. This is my second time through the process and I'm not any wiser than I was the first time. I do think the idea that it takes '15 minutes' is a bit of a misnomer, though. I've heard the number thrown around a lot, but I wonder where it comes from. Anyone know?

Warning: Another TwoCats series of number crunching is to follow. Ignore if not interested.

Anyways, if it /did/ take 15 minutes to complete a case, then a single adjudicator could complete 32 cases in a work day at max, if they did nothing that day other than work on cases. At 20 work days in a month, that means a single adjudicator could complete 640 cases at max in a month. Of course, this is assuming that they did /nothing/ else but work from log-in in the morning to log-out at night on cases, which I find very unlikely. I'm sure there are other things they have to do each day other than just nose-to-the-grindstone processing of cases. Meetings, coffee machine, water cooler, bathroom breaks, and of course - walking to the shelves to get a new box of cases!

Then you consider that there are 400,000-500,000 cases going in every month. When I expand this out, it means that to just keep up with the cases in the queue, it would take at a minimum, 620 people working non-stop, every day, with no vacations to keep up with a normal month's worth of petitions.


End Number Crunching.

I have no idea how many people they actually have working as adjudicators, but it's sometimes hard to remember that we make up only 1% of the petitions that come in every month. For every one of us, 99 petitions of some other type pass an adjudicator's desk. It's not /our/ "15 minutes" that take a long time, it's theirs.

As for your second question: If you feel that way now, trust me, you'll feel it worse at AOS and ROC. By the time you've had to prove your relationship was real for a third time, you get a bit tired of having to prove yourself over and over again to the government.

Well, it's the start of a new week, folks. Unfortunately, due to the holiday, I don't expect much movement on petitions today. So I'm contenting myself with offering up some other successes that aren't visa related.

So far, I've lost 23.8lbs since the beginning of the year. Kata has lost about 20lbs as well. So we're both doing really well with our diets. I seem to see/feel more changes than he does with the weight loss, though. I wonder if that's a guy vs girl thing.

This is Kata's last week living with his ####### landlord. He's moving out on Sunday. Apparently, the remaining people in the building are getting together to write a 'sternly worded letter' to the council about the landlord's bad business practices. (To which a new insult has been added to injury. They are paying a flat fee for gas service. There /is no/ gas service.)

I'm not sure what to think about the couple of people being approved out of February. To be honest, I was mostly hoping that we'd start seeing Octobers getting approved this week. For now, I'm just playing the waiting game. It's two months until I get to see Kata again, and that's something to look forward to.

and now we are waiting - as patiently as possible. The official date on our NoA1 hardcopy is 1-31-11. I know that things in Vermont were moving slowly however I am quite pleased about getting the NoA1 notice in less than a week from mailing the application.

Well, I booked my flight to go visit Kata for my birthday in late April.
Kind of a mixture of emotions.

Hoping that CSC keeps up the pace and we're near the end of our wait by April.
Glad to have the flight purchased.
Looking forward to seeing him again.
Nervous because traveling alone on airplanes is always a little unnerving for me.
Scared of the inevitable break down on the way home.

I keep trying to tell myself that these next two times leaving won't be as bad. This time, because I'll know it's almost over, and the next time (I'm planning on going to the interview) we should know that it /is/ over and be planning our wedding.

Thanks for your help two cats, it is really appreciated! I did just what you said I included my name and my fiances name as stated on the noa1 and gave them my receipt number. Did they reply to your email or how did it end up working for you?


They replied to my e-mail within about 24-hours from when I sent it, and told me they were forwarding the information to the IT department to get it added to the online system. About 24-hours after that, it was in the system.

So it took about two days total from the time of e-mailing for me.
Best of luck with it! I'm not sure how it'll work with Vermont.

Hey everyone I got my NOA1 almost a month ago, I have been trying to enter my receipt number online and it says that my case can not be found, I know it happens to alot of people but is there anyway I can try and get it fixed by emailing someone? Also my fiance and I met when I went on a mission trip and well the place where he lives they don't get mail dropped at their house there is alot of poverty in that neighborhood, so I just put the names of the areas where he lives for his addresses and also under his work info we left it blank because he will do construction projects with other men when he gets the chance......is this bad? I put all the detailed information in for mine and I did put his phone number down, besides an RFE how could that affect our k1 application?


I had trouble being able to view my case status online as well.
My first suggestion is to call the service line @ National Customer Service Center (NCSC): 1-800-375-5283.
If the first representative cannot find your case status (which is very likely since it isn't available online) ask them to transfer you to a tier-2 representative. They will be able to provide you with case status information. You can then try to ask them if there is anything you can do to get the case available online.
People haven't had much luck getting them to do anything on the service line, but you can try.

After that, I suggest sending an e-mail to: vsc.ncscfollowup@dhs.gov
Inform them that you are 30+ days past your NOA1 date and you still cannot view your case online. Let them know that you have inquired using the service line and they were unable to help you. Ask them if there is anything they can do, or if they could let you know when/if your case will become available.

I can't promise this will work, but when I had this issue with CSC, I sent an e-mail to the followup address and it got resolved.
Worth a try.

Speaking of celtic designs, my engagement ring is basically this ring, except it has the heart in the middle taken out and the two sides of the knotwork brought together in the middle. Then, they filled in the center area and put a stone setting there.
I'm considering replacing the wedding band I got for Kata with one that has celtic knotwork as well.

The first ring Kata ever gave me was a celtic knotwork ring from a castle we visted in Scotland.

My engagement ring is also knotwork and had to be custom done.

So it fits for us.

Has your check been cashed yet?

If your check hasn't been cashed at this point, I'd say there's a fair chance that something was wrong with your application and it is being sent back to you. I'd suggest giving USCIS a call and say that you haven't heard anything. You may want to see if you can talk to a tier-2 agent who might be able to see if the case was sent back to you.

Hey everyone I'm a January filer too, waiting patiently to get my NOA 2 do they always handle petitions based on months or are all january filers put in one stack I wonder how that works. Anywho I filed with a paralegal and I didn't include a cover letter or letter of intent we had my parents write a letter of intent and his parents both letters were notarized i sent alot of picture copies of both of our passports my fiances id card my birth certificate letters he had written me, my 538 dollar phone bill with the proof that my phone was calling Honduras where my fiance is, and we only had 2 letters he wrote me and 3 receipts of money I had sent him and also cards he sent me. My sister also wrote a letter on behalf of our relationship......I sent the correct fee and I-129f i brought 4 copies of the g325a to honruas and my fiance and i filled them out,,,i brought my entire package to the paralegals office and when i signed the application i was unsure if i actually sent in two copies of the g325a, when he gave me my copy of my packet i saw that the form wasn't there he said he didn't know if he had sent it and told me to wait for an rfe.....but like you all know who wants to wait for an rfe,, immigration told me to send a copy of my noa1 a cover letter explaining why i was sending the the g325a because my paralegal forgot possibly and so I also took advantage and wrote a letter of intent and sent in extra fotos that my friend had of us i had it notarized and I wrote my receipt number on every page ups said it would arrive today so i am planning on calling tomorrow to see if my case has been touched as I can't access my receipt number online. Honestly I don't know if they originally have my g325a , but i sent it in anyways the way uscis instructed me to. Do you think they will put the additional package with the my package? I've been a little worried...........Thanks for the support

Anyone can update their information on the list, so feel free to if you get touches or changes in your case status.

In general, they seem to handle petitions 'roughly' by NOA1 date. This varies for a lot of reasons, not least of which includes the speed of an individual adjudicator and RFE times. We're probably looking at June-ish before we start seeing regular approvals for our group, but I think everyone here is hopeful that it'll be sooner than that.

As for the situation with your additional information, I can't really tell you what will happen. I've seen a lot of people suggest just waiting for the RFE since it's hard for them to match up new information to a petition. You might get lucky with it, though. Mostly, just keep in mind that an RFE isn't the end of the world. If you get one, just return the information as quick as possible, and you should get through the process just fine.

Okay guys!
A little info you might find helpful.

I mentioned before that it had been almost a month since our NOA1 and that we still couldn't view it online at CSC.
So, when I hit 30+ days, I sent a very polite e-mail to the csc follow up e-mail and gave them my case #, my NOA1 date, and explained that it had been 30+ days since my NOA1 and I was unable to access my case information via the Online Case Status system. I asked if they could give me any information about my case's status, and when it would be available to view via the online system.

I received an answer within 24 hours of mailing that gave me my NOA1 date, and explained that they had sent notification to the IT department to make the case available online. Within another 24 hours, my case status was available.

Hope this helps some others waiting on case status!

Removing Conditions on Residency General DiscussionROC questions - dont want to do it wrong......

getting ready to send my package tomorrow........ but a few quick questions......

 

1) Children - we have one child together - born after I moved to the US so our daughter is a USC - do I have to list her?     Also I am pregnant and due the week that my green card runs out.....will I have to reapply then too?

 

2) Criminal History - I am the GC holder and have never had any issue with the law in any country.  My husband the USC has a criminal history from long before we met.   Do I need to include that?

 

3) payment - Do I send one check for $590 or one for 505 and an additional for the $85.00 biometric fee?

I'm not a lawyer/immigration expert, but I think this is right based on my experience:

 

1. The section on children asks you to list all of your children. So yes, you should list your USC daughter. You may want to include information about being pregnant and your due date, but as the child isn't born at the time of the application you wouldn't include them on it. I can't imagine your new baby will be any sort of issue for the application.

 

2. There are no questions specifically pertaining to your spouse's criminal history on the application, so I don't think you would need to mention it. It would have gotten brought up during your previous petitions more than likely, and already known/covered then.

 

3. You can send one combined check for $590.

Checked our bank account this morning and the check is 'pending' (aka. cashed).

At least I know they've got our paperwork and it's been accepted, now.

Our packet just got delivered yesterday, so I imagine it'll be a few days until the check gets cashed.

I'll feel a hell of a lot less anxious once the check is cashed and the NOA1 is in hand.
