K-1 Fiance(e) Visa Process & ProceduresService Centers

On here it says to file the forms to Texas : http://www.uscis.gov...00045f3d6a1RCRD

However I see people filing to different places, and I've read that where to file depends on where you live. I live in Maine...so where do I send my K-1 Fiancee Visa petition? I don't want to send it to Texas and have it sent back to me x]

You send your petition to the address in the instructions: Texas Lockbox.
When it arrives there, it will be sorted and sent on to the appropriate service center.

I believe that they will be sending yours on to Vermont based on where you filed.

K-1 Fiance(e) Visa Process & ProceduresI put the wrong previous marriage date on I-129F

Why did you send the divorce decree? Is it required to be filed with i-129?

If either petitioner or beneficiary have been married previously, they have to provide divorce decrees for all previous marriages to prove that they are 'free to marry' currently.

K-1 Fiance(e) Visa Process & Proceduresadjustment of status

do you need it for adjustment of status? I know this sounds like a stupid question but if you have the k-1 visa why do you need the NOA2

YES.

If you read the instructions for the I-485, you'll see that one of the required bits of initial evidence is:

12. Evidence of eligibility
...
...
B. Based on admission as a K-1 fiance(e) of a U.S. citizen and subsequent marriage to that citizen.
Attach a copy of the fiance(e) petition approval notice, a copy of your marriage certificate, and your form I-94, Arrival/Departure Document.

K-1 Fiance(e) Visa Process & ProceduresUK Medical Examination

Thanks for that! However, under the vaccination requirements it simply says MMR. It doesn't specify whether stage 1 and stage 2 are required. The reason I'd like to know if stage 2 is required is so that I can get this free from my GP prior to the medical (I really don't want to pay £35 for it at Knightsbridge Doctors).

I'm not sure which stage it is, but most people in the UK forums get their vaccinations before going for their medical from their GP. You can check out the thread for medicals at Knightsbridge under the UK regional forum.

K-1 Fiance(e) Visa Process & ProceduresUK Medical Examination

Hello!

I have a medical examination scheduled with Knightsbridge Doctors in a couple of weeks and am wondering what the MMR requirents are? I am currently waiting for my vaccination records, but know for a fact that I had "stage 1" of the MMR about 15 years ago. However, am I required to have stage 2 as well?

I'd appreciate feedback from anyone who has gone through the medical examination - especially in the UK.

Thanks!! :)

K-1 Fiance(e) Visa Process & ProceduresI didn't put my PO Box on I-129F

Well the thing is we live in a town and All mail gets taken directly to the Post Office, where all of our mail boxes are. If an envelope says 415 Smith Street the Post Office sends the letter back because it Has to say P.O. Box 222 (or whatever our box # is). I called our local post office and the lady said she sends all mail back if the Box # is not labelled. I can't believe this..blaah lol!!! Do they even send the benefiarcy anything in the mail? or just to our fiance in the US?

The beneficiary gets sent packet 3 (forms to fill out and return and a checklist), and an appointment letter (packet 4) I believe. You might want to check the Canada sub-forum and see what information is in the two packets and if you need to get them physically or if you can just fill out the forms and send them in and get your appointment date through DOS.

K-1 Fiance(e) Visa Process & ProceduresI didn't put my PO Box on I-129F

I just realized that I didn't put my PO Box on my K1 application. I just put my physical address but the post office doesn't deliver to my house just to our PO Box! What do i do? When and how do i notify USCIS? I still haven't received my NOA1 yet. I can't really follow the steps for "changing my address" as i'm not really changing it.

Would it be possible to go to your local post office and set up a mail-forward from your physical address to your P.O. Box? It may cost some money to set up and maintain, but it may be the solution to your issue.

K-1 Fiance(e) Visa Process & Proceduresreturn ticket with K1 Visa

Hello to everyone,

I'd like to ask to those that reserved the flight ticket prior entering the US with their Visa,if It's possible to buy a return ticket or you only can buy a one-way ticket. The reason I ask this is simply because of the price of the ticket..one-way tickets cost like 2 if not 3 times more then a return one! I want to highlight that of course I have no intention to come back until I will be allowed to,only to save money.

Thank you

You can buy a return ticket with no problem at all.

K-1 Fiance(e) Visa Process & ProceduresWhere will my application go?

I'm getting everything together to submit my I-129F for my fiance. The instructions say to send it to a lockbox in Texas. Where will it go from there? I'm currently in Kansas. I'm just been reading so many nightmare posts about Vermont that I'm hoping mine won't go there. Does California do some states and Vermont do others or is it a lottery as to where you end up? I've tried to find this out for myself, but seem to be struggling. :help:

Yes, you submit your forms to the Texas lockbox.
However, it seems most cases are sorted according to the old definitions for the service center coverage areas.
Kansas is covered by California Service Center according to the information I've found.

K-1 Fiance(e) Visa Process & ProceduresK-1 First Packet Signature Checklist

I have seen far too many folks getting delays because they forgot to sign a form so below I have (hopefully) listed all the items that need signatures. Please feel free to use this as a checklist to ensure all forms are signed. If I have missed something, please let me know. Each one requires one signature.

-Cover letter
-Form I-129F
-Declaration of how you met
-Intent to marry letters (both)
-G-325A (both)
-Passport photos (printed name)
-Any supplemental pages you have

Hope this can ease some fears!

Another thing to keep in mind is to make sure each of these has original signatures and aren't photocopies.
What helped us a lot was to get another person to look over our packet. They caught a couple of small mistakes that we'd missed.

K-1 Fiance(e) Visa Process & ProceduresAlien Number?

Under what circumstances would someone have an alien number already to put on the form? My fiancee was an au pair here (US) for 9 months but said she never got an alien number.

I'm trying to figure out if that is true or she just didn't know she had one. I assume, as a US citizen by birth, I wouldn't have one...

K-1 Fiance(e) Visa Process & ProceduresPhoto evidence for I-129F question

When submitting the eveidence for proof of relationship and proof of being together in the last 2 years, can the photos be printed out on an inkjet printer, as the photos I have are all digital and I am just curious, will this be a problem with USCIS, or will they accept this as photo evidence? Also I mean printed out on computer paper, I do not currently have photo paper.

Thanks.

I printed out two photos per page, and included below each one the date, location, and a brief blurb explaining what the picture is and who is in it. It doesn't seem to be an issue to use photos on paper rather than printed on photo-paper.

Keep in mind that photos are considered secondary evidence. Make sure you have boarding passes/passport stamps and other information to prove that you've met in the 2-years.

K-1 Fiance(e) Visa Process & ProceduresG325A and I129F forms questions

Hello all,

Just getting underway, and am preparing the G325A and I129F forms. Some of the blocks to be filled in do not have enough room for all of the information to be displayed. I can enter all of the information but only part is displayed on my computer screen and a little "plus" sign is displayed at the end of the block. And that is all that is seen when the form is printed. I know that I'm missing something. Cany anybody tell me how to handle this?

If you can't fit it in, then leave the space blank and write the information in with a black pen.
If it's too long even then, make a note to (see attachment) and add the additional information as a separate page.
Don't abbreviate anything if you can.

K-1 Fiance(e) Visa Process & ProceduresSimple I-129f question

When filling out the petition, my fiance's name contains letter that aren't in the Latin alphabet. I still use their alphabet system, correct?

i.e: Sr?an (instead of the americanized spelling of Srdjan).

Use the Americanized Spelling.
There is a question specifically for using alternate letter systems:

16. If your fiancé(e)'s native alphabet uses other than Roman letters, write his or her name and address abroad in the native alphabet.

Enter the name/address in his alphabet there.

K-1 Fiance(e) Visa Process & ProceduresG-325A - No Father, Help Please!

The problem is he is known.. He's just not applicable because he's not in the picture nor has he ever been (hence the N/A instead of unknown). I don't want to lie and say unknown but will N/A not suffice?

I think what the others are saying is that 'N/A' is the incorrect answer. Everyone has a father, regardless of if the person is on their birth certificate or not, known to them or not. If someone put down 'N/A' I'd be tempted to ask them questions about their immaculate conception.

I'd say put down what information you do have on him. Any information you don't have, just write 'unknown'. If worried, you could always note an attachment and explain that he is not in the picture and you have no way of getting x-information.

I have a boyfriend in USA, we already met in personal. But we r thinking if he will starting to file his petition on me, is it required that he needs to own a house so we can approved in the next step getting k1 visa? because he is living with his parent's house.thank you. i need your response.

He does not have to own his own house.
He does, however, need to have enough income to be able to cover the requirements of the affidavit of support. If he does not, then he should seek out a co-sponsor.

K-1 Fiance(e) Visa Process & ProceduresAddress and the I-129F

I am in the military and I don't really have a permamnent physical address, especially to receive mail but I have been told a PO Box is not a valid address for the form, if I were to put my parents address which I was told was ok, how can i receive information from USCIS such as hardcopies and RFE if needed to my PO Box?

If you are going to use your parents' address for it, can you ask them nicely if they could forward any mail from USCIS that arrives for you? That seems like the simplest solution, especially if that's the only mail you're sending to that address in your name. Your parents would know to give you a call that x-item came in, and then forward it on to you.

K-1 Fiance(e) Visa Process & ProceduresK1 Fiancee Visa From China Taking 8 Months Instead of 6 Months Now?
Your service center depends on what state you live in.

Right now, depending on the service center you're at, just getting an approval of your I-129F can take 5-6 months. After that, consider two weeks to a month to get from the service center to NVC and then to the embassy in your fiance(e)'s country. Then time for them to gather and return the paperwork for 'packet 3' and get an interview (varies by country), plus a week or two to get the visa itself once approved.

So, 8 months isn't actually too far off of an estimate.
In general, don't make any plans assuming it will be x-number of months.

I've found that it's actually hard to remember to take pictures of us together.
A lot of times, it's just the two of us going out somewhere and I'm far too shy to ask a random stranger to snap a picture of us. Luckily I have conscientious friends who helped me by making us pose or surprise-snapshotting pictures of us when they heard we were going to be going through this process. :innocent:

K-1 Fiance(e) Visa Process & ProceduresTo visit before or to be there for interview?

Thank God the big step is out of the way, but bigger ones to come! In order to make sure that our "evidence of an ongoing relationship" is intact, I really am wondering about my return to Chile. I originally wanted to return to be there for Vinko's interview, but I am wondering if it will look better if I visited between the time the I-129F was filed and the interview. The last time I was in Chile to see Vinko was in May 2010. Flying to Chile is expensive so I don't really want to do this twice. Any ideas?

We went back and forth about if I should come to visit my fiance' during the waiting period, or wait and come during the interview. Money is tight just right now, so I had some worries about being able to afford two trips. We decided to go ahead and try to do both, although if the choice came down to it, I'd chose to be there for his interview over coming for a visit.

K-1 Fiance(e) Visa Process & Procedureshow long to get noa1?

ive heard people get denied a noa2. why would that be though? im stressing out :/

the next step after the noa1 is the noa2? and that takes many months right? so thats more stressing....great.

The next step after NOA1 is either an RFE (if you forgot something, or they feel you need to include some additional information), or the NOA2 (approval notice). You may or may not get an RFE. It largely depends on if you left anything out.

Usually, as far as I've heard, the only reasons they would deny the NOA2 is due to not meeting one of the qualifications for the visa:
- Not being free to marry (must be single, or divorced at the time of filing)
- Not having seen each other in person sometime in the last two years
- Petitioner criminal record

If there are others, I'm not sure about them, but these are the main ones I've heard of.

how are you checking the status of the package without the numbers off your NOA1???

People from Vermont have been able to check their online status using the numbers on their acceptance e-mails lately. California doesn't seem to have put anyone from after January 4th into their system, though (at least not K-1s).

I am trying to get my us visa on the k1 we have applyed in October were still waiting for the next part. She has two kids and I have been in and out of work since i have been visiting so much I am going home in a week and will be working secuirty . Ay ideas on what to know about my soon to be wife when i go for a interview should i bring her should i go alone? Should i be scared of being denyed?

First, it would really help a lot of us if you could fill in a timeline. Just click on the timeline link under your name and fill one in with your information. That will give us (and you) a better idea of your situation.

Don't get yourself worked up worrying over being denied at this point. You probably won't be looking at getting your NOA2 for another couple of months, so use the time wisely. Make sure you have a copy of the petition your US fiance' sent in and gather other supporting information to show your relationship. Start reading up on the guides for the next steps in the process. Perhaps read some interview reviews or check out the regional forum for your country.

K-1 Fiance(e) Visa Process & ProceduresMarrying while K1 process is ongoing

Can my fiancée and I get married (outside US) while the K1 visa process is ongoing? Do we need to file for any adjustment or can she just come when K1 is approved and we get married again in US? Please advise. Thanks.

The K-1 visa is for a fiance(e). If you are married, you are ineligible for the visa.

However - I believe you can have an unofficial ceremony for family and friends if you wish. Just make sure there is no paperwork filed and that the ceremony you have is not legally binding with the government of your fiance(e)'s country (be careful to check local customs as well). Consider it an 'engagement party' or something else of that nature.

If you get married, you would have to change to filing for a spouse visa and abandon the K-1.

K-1 Fiance(e) Visa Process & ProceduresWriting in Ink

Hi! This may seem like a shallow question, but i just want our documents to be perfect. I have three first names, and they are all long and they don't fit in the box on the i-129 and the g-325. is it okay if we type everything else and then write down my first name?

thanks!

This is /exactly/ what you should do if you have a field that is too long to be typed in.
Just use a black ink pen (not felt tip).
Otherwise, you could consider adding an attachment, but it doesn't seem necessary for a name.

K-1 Fiance(e) Visa Process & ProceduresWill file my I 129F today finally

Well, I'm ready to submit my package today. Just making some final copies and double checking everything. I noticed in the instructions that the address to Lewisville says 2501 South State Highway 121 Business. I would think it should say Business Suite 400 on the next line... Is everyone just writing it as is? Also, I've read, or I think I've read that people have used binder clip to keep everything tight. I'm sure the package will be fine the way I have it, but I want it to have an extra measure of reinforcement for when they start to go through it.
Thank you!

In general, I wouldn't bother using the express mail delivery option, or that address.

We just used the Postal Service (USPS) priority mail and had delivery confirmation (not signature), sent to the U.S. Postal Service address.

It got there fine, in about two days.

K-1 Fiance(e) Visa Process & ProceduresBirth Certificate file number

Question 10 asks if your citizenship was acquired through (check one),and I checked Birth in the US. They then asked for certificate number, date and place issued. So I wrote my cert. number, date of birth and place. But they ask for date issued, and my issue, or file date is different. Just curious if my date of birth is sufficient.

See this example form.

I was correct in what I said earlier.
If you check 'Birth in the U.S.' you do not need to fill out anything further in that section.
It is for naturalization only.

When I was double checking my I 129F, they ask for the date it was issued and mine was filed on a different date than my birth (like all...). Can I just type in the date I was born? Or would this matter?

I believe that only applies to if you are naturalized and have a certificate of citizenship through naturalization.
I don't think you need to fill that out if you are a citizen by birth.

Probably not the answer you are looking for, but if you don't want to lose the cost of the wedding, you might want to consider having him enter as a visitor, get married and have your big ceremony, and then have him return. You'd have to cancel the K-1 and look into the CR-1 instead, though.

I don't think your situation would fall under the expedite conditions.

I don't know if there's an 'official' correct way to handle this, but what I did was white-out the section that was incorrect, then write over it in pen and photocopy the page (so it just appears as if I wrote in the box on the copy), then signed the copy and sent that. (So the copy had the original signature.)

The problem with the positions on there is that they move, so it's not a great estimate tool.
For instance, when I started looking at CSC, there were only 32 December filers. Now there are 44. I'm betting that by the time we actually /get/ to December cases being processed, there will be 50+.

Still, it is so nice to see your number in the queue go down.
