I'm not sure that has anything to do with Vermont, but more to do with Texas which is where the application is received (and payment is processed) before sending off to the correct service center.

Shoot! We put the email notification right under the cover letter. I hope they see it! I'm a little worried about the NOA 1 as my American fiance is still in Canada until the 26th. He's been here on a work visa for 2.5 years. We made the current, moving and new address (in Texas) dates very clear so hoping it'll be understood. Looking for an email notification or check cash on Mon or Tues.....fingers crossed!!

Darn we put the email notification behind the cover letter too!


I wouldn't worry yourselves or stress about it. The fact is, even if you have the most organized application in the world, they are going to open it up and re-organize it in whatever way they need it for processing. As long as it's in there, they'll see it. (Hopefully. :whistle:)

As for the timing, it looks like (from the all of two e-mail notifications we have thus-far) that VSC is processing incoming applications a bit faster (faster e-mail and NOA1 mailing - not necessarily anything else).

Did you submit the form for e-mail notification?
If you did, I think you can expect something either Sunday or Monday. (Not sure if the Monday holiday will slow that down or not.) At least, that's how long it took for BenjAshley to get theirs and us to get ours for arrivals Thursday and Wednesday of last week respectively.

Congratulations on finding love once again! Is your ex-husband also from the UK?
I think you will need to file for a waiver since this would be your second petition.


My ex-husband was from the Netherlands.
I don't think that I need to have a waver. The instructions say: "If you have filed two or more K-1 visa petitions at any time in the past or previously had a K-1 visa petition approved within two years prior to filing this petition." This is my second application, so I have only filed one in the past. The previous petition was approved more than two years ago.

P.S. How long did the process take for your first K1, from sending the petition to interview?


It was 158 days from NOA1 to Interview.

I want to thank everyone for your kind responses.
I think I will briefly point out where the separation was just so that it is established in the paperwork and focus the rest on the meetings, dates, and events.

Hey everyone.

I feel a bit as if I'm in a strange situation, although I know I've heard of others who have gone through this twice so I know I'm not alone. This is my second account and my second time going through the K-1 process. My ex-husband and I only got divorced recently, but we've been separated long before that. We tried to reconcile a time or two, and finally decided it wasn't working around February. The official divorce got pushed off due to financial and family hardships on my side until recently, although we'd both moved on to other relationships. Due to this time-scale, most of my meetings with my current fiance' fall in the time where I was still married, but separated from my husband.

Should I mention about my separation from my husband during that timeframe when explaining these meetings or no?

I would assume that it would be better for me to simply focus on establishing that we have met and not really worry over the circumstances. From my understanding of the process from the last time through it, they tend to be more focused on the facts - like that you have met within the past two years. The rest will get covered by the proof of relationship part of the application.

Mostly, I'm just trying to see if this is the right way to go about answering this question.
Just the facts, not the circumstances.

I actually found the opposite. At first, it was excitement and confirming what I thought about him. The more I saw him, and the longer the trips were, the harder it became to say goodbye. We did that for 4 years straight and by the end, I was practically dragging along the bottom of his plane. :lol:



Yeah. I know that feeling all too well. It's one of those things, at least for me, where it's easier and harder. Harder because you don't want to let go, but easier because you know you'll see them again. You have your 'eyes on the prize' so to speak and you have goals for being together permanently. The letting go still hurts like hell, but the recovery is faster. Hopefully my next time, I'll be jumping strait from 'goodbye' at the airport to filing a K-1, so I'll at least have a feeling of moving forward to keep me from dwelling too long on it.

As many of the others have said, you will need to have met before filing.

As hard as it might seem to have to meet and be separated again, you will get through it. I'm actually an old time VJer back for a second-go round, so I've been through the separation phase twice now. First with my ex-husband, and now four visits (soon to be five) with my UK fiance'. The first few times you visit, it will be hell saying 'goodbye', but you'll live through it and it will get easier. If nothing else, meet not only to satisfy the requirement, but to see if you two really work out reality. There's lots of little quirks people have that won't come up until you see them in person.

As someone just preparing to go through this process (ugh, again), I really do wish you and your beloved the best of luck.
It isn't as scary as it seems, just take your time, prepare, ask questions, and be ready.

I would ask the court for a "Certified Copy" of your "divorce decree", then submit a photocopy of that. Though it would contain the same information, often what you receive from your attorney is NOT a certified copy of what is entered into the vital records of your State. If it doesn't say it's a certified copy, it's not one.


Doing a bit of research, it looks like the only way to get that is to go to the county clerk's office in downtown Chicago and get one in person. I'll look into doing that. Glad I asked this question early, so I have a month to get down there and get that done.

We included a copy of the whole thing with the K-1 petition.

We were asked for the ENTIRE thing (original that he was given after finalization) at the interview including the final page. They did look at every page as well as check the final page. After he looked at it he gave it back to me.

Just as an C.Y.A.... ask your lawyer if he has a copy of your divorce decree with the judges signature and stamp... There is a possiblity you may have been sent a copy of the divorce prior to judges signature, and it would be good to double check just in case, since a possible RFE will only delay the current loing and drawn out process...


I was actually handed the packet in the courthouse by my lawyer just after the hearing with the judge.
She told me that the packet was all I needed and that was the final 'divorce decree'.

Right.
I believe the last page of the packet I was given has the final terms, the stamp, and the date.
However, it doesn't have a signature, just the judge/clerk's stamp. I assume this is normal?

I did a quick look around, but I wasn't able to find an exact answer to the question.

After my divorce, my lawyer provided me one packet of information.
It includes my original petition for dissolution of marriage, the division of marital assets sheets, as well as a final page which has the actual divorce decree and stamp from the judge. Do I need to attach copies of the entire packet, or just the final page with the stamp?

4) The fee now is $340 as opposed to $450+? The lowered the price? Am I missing something?

Yes. They lowered the price as of November 23rd, I believe. I think they raised the visa fee at the consulate level along with it (not 100% sure).

7) Question #11 on the I-129F says... "Have you ever filed for this or any other alien fiance or wife before. If "yes" give name of all aliens, place, and date of filing, A# and result. What do they mean by "result?" As in... did they give her the permanent resident card or As in... are we still married? My previous wife had lived in US for 15+ years illegally before we were married in 1996 and went through the INS permanent resident process, she was given her 10 yr permanent resident card in the year 2000. We divorced in 2006. Do they want to know if she got the card or do they want to know if she is still married when they are asking "result" in question #11. By the way if she refuses to renew her permanent resident card that doesn't affect my petition for my future wife that I am petitioning for, correct? Yes, I know "Why in the world would someone not want to renew their permanent residency card?" Stubborn. I actually think she is simply waiting to hit 65 or the age necessary to get her citizenship without having to take the English test. Yes, again I know... refuses to learn English. I quit fighting that battle 10+ years ago. Her thinking is "She hasn't need it for the last 25 years, so why learn now."

I'm not sure if there's an 'official' way of doing this, but I'm in a similar boat (second time around through the process)
The way I answered this question was to add an attachment (the information was too long to fit in the box) and I included:

Name: <insert name here>
A#: <insert alien # here if known>
Date of Filing: <insert date>
Place of filing: <service center name>
Result: Approved K-1.
Divorce Date: <insert date here>


I tossed the Divorce Date in there just to cover my bases on the attachment.
Signed and dated the bottom.

I was looking at information for this, myself, since my fiance' will probably be moving within the next two months (his current landlord is a jerk). This is what I was able to find, although it is a few years old.

Benificiary is not in the USA as an Alien Resident, AR-11 is only for aliens in the USA.

Wait until after NOA2 and then when NVC has the case, you contact NVC and get address changed, or wait until NVC sends it to consulate, and contact DOS Visa services and get address changed.

If you have filed two or more K-1 visa petitions at any time in the past or previously had a K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver. To request a waiver you must submit a written request with this petition accompanied by documentation of your claim to the waiver.

Since your case was in 2004, you should be fine without a waiver as long as you haven't had any other petitions.
You will need to note it in the question about other petitions, though.

But otherwise it should be okay.

Hello,

I joined here yesterday with my first post. My question about not having a glossy passport style photo (have a semi-glossy) for my fiancé was clarified (Thank you YuAndDan). My fiancé now will be having another one taken just in case. I'm almost ready to submit the package and am just waiting for one more signed document from Thailand. I would think I'll be ready by next week sometime. I'm hopeful everything will go through ok; though I'm prepared it could take 5-6 months. My paperwork has a coversheet and all relevant documents prepared in order. It might even be overkill, but I've included various photos (before, during, and after my visit), e-mails, receipts, boarding pass copies, stamps, etc. etc. Just to show that we're truly a couple and we met. I even took a picture of my fiancé signing happy birthday to me last week with her children and cake, for ongoing proof. It's taken almost 2 months to prepare (I visited her in early November), but that's pretty good going back and forth to Thailand with regular mail sometimes. Once I've submitted everything I'll start a timeline, as suggested here. I'm glad I joined VJ and look forward to sharing my experience with other's waiting to be with their loved one once again.

In the initial petition of the I-129F form for the K1 visa; are you supposed to send in your proof of meeting in person, proof of intent to marry, proof of ability to marry, etc...?

I'm seeing different places saying yes and no so figured I'd ask.


Simple answer: Yes.

You need to send proof of meeting in person in the last two years.
You need to send proof of intent to marry (2x letters of intent).
You need to send proof of ability to marry (divorce decrees if either of you have been married before).

You do NOT have to provide the proof of an ongoing relationship at this stage, but it doesn't hurt.
You also do NOT have to provide an Affidavit of Support and related documents at this stage.

I don't know for certain, but I don't think it would be a major issue. The field itself for parent birth city/country says (if known). I wouldn't worry too much about getting an RFE. If you get one, you gather the information and turn it back around quick. Otherwise, no use in worrying yourself sick in the meantime.

No, it is not. Film dating is a function of SOME actual film cameras. Digital cameras can put a date on the digital file but not on "film" as there is no "film". When USCIS says "film dated" they are not referring to digital photos. It's actually an outdated term.

Got my hard copy for my RFE yesterday, basically I did not send primary evidence that we met in the last two years. What I did send were pictures (not film-dated), and airline stubs (had date but not year). I have a feeling that all they are going to want are copies of all my passport pages, which the RFE did state was wanted, and I feel really dumb for not sending this in the first place. And what is a "film-dated" picture anyway? So will the passport pages be enough? I had someone tell me outside of VJ that I should have them notarized. Thanks!!


'Film-dated' is a function of many digital cameras.
It puts the date the picture was taken right on the image itself.
If your images don't have this already on them, my suggestion is to write the date, location, and names of who is in the picture on the back. Or if you have them digitally, put them in a word document and write that information below it.

Passport pages would be a good start.
Make sure you note who's passport pages it is (include photo page as well).

You could also try to get friends/family who have met you two together to write up an affidavit explaining that you've met in person in their presence.

I -think- that's most of the fees/costs you'll see for the process.
But I haven't had my coffee yet, so I'm not sure.

As for when you should file, I think that depends on what the financial status is of you and your U.S. partner. The wait times right now are about 5+ months for just the initial application review, which would put you into Summer or possibly early Fall before you get an interview. You won't need to provide the Affidavit of Support (I-134) until the interview stage, so there's time to increase your U.S. petitioner's income or to find a co-sponsor. If you wait until Summer to file, it may take you into Winter, or early next year.

It depends on your state.
Try doing a google search for '<insert state> marriage license cost'.
For instance, in Illinois it costs $30.00 for the marriage license.

Alright, so just to make sure I understood it right: My boyfriend and I can't get married in the States and then move to Denmark? Getting married in the States means we have to stay there and live for a while or?

I guess we are trying to figure out where we should get married. It has to be somewhere where it won't cost us a fortune, and then afterwards we'd like to move to Denmark (or possibly Sweden) for a while. But we still want to keep the option open of moving to the States eventually. How do you think we should do this?

I think you might be getting a bit confused by some of what's being discussed.

If you were to come to the US and get married with intent to stay here (you should look into a K-1 visa if this is the case), then try to adjust status (get a green card), then you would not be able to leave the country while you are adjusting status (until you get an approved AP). After you have a greencard, you would have to maintain your residency here in the US to keep that greencard, which means not living abroad more than 6 months in a year.

If you plan on coming to the US and getting married and do not intend to stay, I /believe/ (not 100% certain) that you should be able to leave the country without any issues. When you do plan on immigrating to the US, your spouse can file for a spousal visa for you at that time. It should not matter what country you get married in. Getting married in Denmark will not prevent you from immigrating to the US in the future.

However, I do suggest that before you make a decision, you do some research.

Investigate what the immigration process is in Denmark for getting your BF there for the few years you plan on living together there. Is he moving there on a spousal visa, work visa, etc? Figure out the process required for that move first. Figure out the requirements for getting married in your area of Denmark and in your BF's state. Each state/province tends to have slightly different rules/regulations for getting a marriage license and getting married.

If you are worried, you might also consider having friends/family who have seen you both together write up Affidavits affirming that they have seen the two of you together, giving dates/information about it. I had a couple of these my first time 'round through the process since I didn't have much documentary evidence.
