Thank you for your responses!

I think Marina meets all requirements to apply late July 2008 then:

1. Has been living in the US continuously (no trips out of the country over 2 weeks) since 09/17/2004;

2. Has been married to me (USC since birth) since 11/20/2004;

3. Has been a permanent resident since 10/25/2005.

Does this sound right?

My hope then is that if Marina (mom) can get citizenship before Carina (K-2 daughter) turns 18 on 7/14/2009, then the CCA will enable us to skip applying for Citizenship through USCIS step for Carina and instead, like you stated, apply for a passport and/or certificate of citizenship.

Carina has also been living here with Mom and me since 09/17/2004.

The only thing that concerned me when reading the info on the CCA was that it seemed to set up more for adoptions from overseas as opposed to our situation. Almost like they have to be living overseas and then come here to qualify as "automatic citizens".

What do you think?

Hi all-

Just wanted to check and see:

1. Does Marina have to wait until she is a permanent resident and married 3 years before she applies for citizenship? She received her green card 10/25/05 and we were married 11/20/04 and she has not been out of the country except for short visits in Moldova.

Is there a 90 day rule for citizenship too where she can apply during that window prior to he 3 year green card anniversary?

2. If Marina does get her citizenship prior to our daughter (K-2) turning 18 does that mean that Carina can skip applying for citizenship (she is currently a conditional green card holder and living here), as she will automatically become a citizen due to the Child Citizenship Act when her mother becomes a citizen?

My stepdaughter was already 18 years old when she arrived in the USA as a K-2. She is now 22 years old. I have not looked into the Child Citizenship Act, but I think she is too old to derive citizenship through her mom.



Oh, ok. I think she does have to go the traditional route then as I am pretty sure it has to be before their 18th birthday to qualify via the CCA.

You voted in a local election. That in itself is no problem, as long as the election was not restricted to US citizens. What did the voting form state? Did you sign it?

Maybe you didn't do anything wrong! Determine that first before going through any more work trying to prove your innocence.

Thanks for your reply. Actually I did read the M-476 cover to cover before I posted. It was about as clear as the actual applications and instruction the USCIS puts out for us.

The section in the guide about submitting 90 days prior references only about having continuous residence, nothing about being able to apply 90 days prior the the 3 year anniversary of the PR card. This is what has us confused. I know others have said it is ok to appy during the 90 day window prior to the anniversary, but I just wanted to be sure so I was looking for some confirmation...written if possible.

As for Carina, again the guide does not seem to really pinpoint our situation. She was born to her mother who will be a USC, but her father is still overseas and has never been to the US. We did not see this particular situation in the guide, though we did see very close scenarios so I guess we'll just apply for the certificate once Marina becomes a USC and see what happens.

She would like to apply as soon as possible and if she is allowed to apply late July/early August that would help alot.

Also, Marina's daughter Carina is 16 and won't be 18 until July 2009. She is a PR also, and will be filing for removal of conditions this year. If Marina gets her citizenship prior to Carina turning 18, does that mean she automatically qualifies for citizenship and can apply for a naturalization certificate and/or US passport?

What part of this is confusing copied from the N-400 instructions?

If you are applying based on five years as a Lawful Permanent Resident or based on three years as a Lawful Permanent Resident married to a U.S. citizen, you may apply for naturalization up to 90 days before you meet the ''continuous residence'' requirement. You must meet all other
requirements at the time that you file your application with us.

The ''continuous residence'' requirement, is that if your wife is married to a US citizen for three years as a Lawful Permanent Resident meaning she has held a green card for at least three years, but you can apply 90 days before that date.

If you are confused now, wait until you read some of those questions on that ten page form, may have transgressed a day in sending our application in, but the required days out of the country and other employment and address dates were right on the money.

Still have to wait months before anything happens, but that has been consistent. But again, not nearly the tension of waiting for the conditional and ten year card.

I am interpreting this to mean that while it is ok to apply 90 days prior to meeting the continuous residence requirement, it is NOT ok to apply 90 days before you meet the other requirements-such as being married for 3 years and having the PR card 3 years.

Yes, the guide is actually what is confusing me. It only talks about applying 90 days before she meets the "continuous residence" requirement; nothing about being able to apply 90 days prior to the PR card 3 year anniversary. This is the reason I was looking for some confirmation from some other sources hopefully. The part that states "You may send your application before you have met the requirement for continuous residence only." is the part that really makes me wonder if we should wait until the actual anniversary.

Marina's interview will be 5 days short of her PR 3 year anniversary...I for one would not be a happy camper if they denied her because of when THEY scheduled the interview for!

We definately consider ourselves one of the lucky ones and expect no problems as far as the date of the interview.

It's unlikely they'll schedule the interview before your three year anniversary. If they did, that would mean they'd have to process your N-400 in less than 90 days.

It HAS happened that way for a few lucky people who've posted here. That's not a problem. They go to the interview, take the test, and at the end, the officer says "Congratulations -- you've met all the requirements except the three full years of continuous residency. We'll schedule an oath ceremony for you after you've completed your three full years of residency".

Hi all-

Marina received her oath ceremony letter today and it is scheduled for November 10 at noon in Chicago. (yaaay!) Unfortunately on the back of the ceremony invite is a bunch of of the same questions they asked at the interview, and they want her to answer them in respect to anything that may have happened since her interview on October 20. Well, Marina rearended some poor guy this past Saturday October 25th, and received a ticket (citation) for failure to reduce speed to avoid an accident. One of the questions on the backof the oath letter of course is "have you been arrested, charged, cited, etc with any crimes including traffic violations since the interview date?" Well, she will have to answer "yes" of course and I assume bring a copy of the ticket and explain herself at the ceremony registration.

Our original plan was to request a court date and contest the ticket since the ticket will most likely be dismissed and not go on her record (and we won't have to pay the $75 fine) if the party she rearended does not show up to court which they probably won't since their car will be fixed (we have the same insurance carrier), and they felt pretty sorry for Marina at the scene of the accident.

Anyway, now we are thinking maybe we should just go to the courthouse and pay the fine and get her license back so there is a resolution to the citation, and they don't consider it "still open" at the oath ceremony since we would still be waiting for a court date.

Marina had an accident where she was ticketed three years ago and also a speeding ticket this past April and we brought documentation of the final disposition of each (the accident ticket was dismissed in court and we just paid the fine for the speeding ticket) to her citizenship interview and the officer said "these are just traffic violations?" and he kept the originals of the disposition papers and Marina's motor vehicle report (driving abstract) and said he would just keep them for the file.

So are we making too big a deal out of this and should just go to the ceremony with the ticket and explain what happened, or should we go pay it so it is a "closed case" and she has her license back? I know they are most likely looking for DUI's and such but we have come so far in this process and it would be a shame if her oath ceremony got screwed up over something so stupid like a unresolved traffic ticket.

Marina's interview was 5 days before the 3 year anniversary of her GC and there was no problem at the interview however she did not get an oath ceremony letter the same day as many others did. This is most likely because of the reason indicated on the previous post...they can't/won't produce the letter until after the 3 year requirement is met however Marina's oath letter was dated 10/23/08 so maybe a couple days doesn't matter. I agree that once you have completed the interview it will probably be mid-december when you get the oath ceremony notice. As a matter of fact Marina's IO said it would be 4 weeks before she received hers but it came in only 1 week.

Marina's on-line case status never changed for her N-400 either...still says pending. No rhyme or reason for USCIS...par for the course.

At Marina's interview he didn't even give her a choice-just went right into the questions from the old test. If given the choice I would opt for the old one as there is less detail to learn.

Sounds like things are moving along for both of you...good luck tomorrow and next week!

Marina already got her passport (10 days routine processing) and her certificate came back a few days later. Now we have to send the certificate again with Carina's passport application. The lady at the post office said "they don't like too many papers in one envelope" if you can believe that. I wanted to say just send it to immigration, they love paper!

Hi guys-

We just got back from Marina's oath ceremony and we now have 2 new US Citizens in our family! Ours was a "2 for 1" deal as Carina automatically became a citizen as soon as Marina did.

We were of course a little nervous about the traffic ticket thing but when Marina got up there and mentioned it they just asked "have you been arrested?" and since her answer was no she was told to check the box that way too. Nice to see that being honest actually has it's rewards sometimes.

The ceremony itself was about 10 minutes long, however we waited in line from 11:30am to 1:00pm. They also had trouble finding a seat for me but finally I got one right up front before the judge came in. There were about 140 people being naturalized, and about 50 guests.

We stopped by social security on the way home and had Marina's card updated, and will go apply for passports on Saturday.

I can't believe this journey is actually over, and I am very proud of my wife and daughter...two of America's newest citizens!

Thanks to all on this site and especially those in this thread whom I wish the best of luck for the rest of the way.

I assume it's not an RFE but they want you to make the correction and send everything back as new.

I would be angry too and while the post offfice is at least partially to blame I think USCIS definately dropped the ball by not giving you this information when you called.

Sorry to hear about all of this...hopefully your case will move fast once you re-send the package.

I am going to go the post office and let out all of my frustration on them, cause they deserve it!!! I am sick to death of people who dont their jobs and to me most of the post office people fall under that category!!!
Anyway, I want to wish luck to everybody on this tread and I want to ask you to please take me of the time line list, since when I reapply I will have another date!!! That's it!

So you made an Info pass appointment? If yes I think that's a good idea. Seems to me the speed of the process for naturalization is very much dependent on the local district office and how fast they are. Just a thought since Chicago seems to be very fast. The place was packed when we were there and I was thinking if this is happening every day then alot of people are getting immigration benefits in this area!

I still have not heard any updates on my file. I made an appointment with the local office in November since that was the only date available. I checked the district courts that do the oath ceremony. There were none from June till Oct. dry.gif

I like your style KyngSilva...you do everything I would do if I were in that (stressful/not knowing what's going on) situation and have some fun with it at the same time. Back when my step-daughter was having problems with getting her greencard due to the name check I did anything and everything I could to get it done and ultimately it worked.

Marina received her oath ceremony letter today and it is scheduled for November 10 at noon in Chicago. (yaaay!) good.gif See my new post in this forum for the "but...." that goes along with the receipt of her letter. helpsmilie.gif

Hi everyone-

We just came back from Marina's citizenship interview downtown Chicago; the interview itself lasted 12 minutes however we did have to wait over 2 hours to be called.

Questions were easy and the officer was pretty brief...he kept the disposition papers for Marina's 2 traffic violations and said she would be getting the oath letter in a month or so. Many people were receiving oath ceremony letters on the spot but I think hers could not be given since she is still 5 days short of her 3 year PR anniversary.

Either way we have a paper showing she was approved so now it's just a matter of watching the mail...again!!

I have an associates degree in Criminal Justice but unfortunately I am stuck in the insurance business. I got that degree almost 20 years ago but I do remember how much I enjoyed the classes and if the money was better I might have gone in that direction. We just bought a house in January so I am spending much more time putzing around and fixing things then playing golf!

I 2nd your " glad when all of this is over" . I have to get a whole bunch of docs. Certified copies of childrens birth certificates, I'm the one getting naturalized and they need my kids certificates. I'll ever understand their processes. =) Atleast they are asking for docs. Could be a lot worse and not be doing anything with file. Which I suspect is what is going on right now. headbonk.gif I called the FBI fingerprint place last week. They stated they had recvd. my prints on the 28th, which was they day I did them and sent it back the same day. Atleast we know one branch of goverment is working rofl.gif .

So since we are all waiting for this great memorable process, What does everybody like to do in their spare time, besides waiting at the mailbox and watching the postman?
