Looks like the fee increases are going to increased paper and ink costs. It will be interesting to how many biometrics appointment letters are mailed to us.

The general trend for those of us that sent our packages to NSC end of July was about three weeks to cash the check and then the NOA1 arrives followed shortly after by the biometrics letter. Seems like the reason for the delay is that the cases are being transferred to CSC which should expedite the approval.

Well, according to the website and memos from USCIS the date they go by is the "date filed/postmark date" on the envelope. I am a little concerned too since we filed/mailed our package the Saturday before the increase took effect (July 28) but if they give us any problems I will fight it. Hopefully they prepared their people who receive the packages accordingly and there won't be an issue.



Sent in paperwork to VSC on 7/25. Received on 7/26. Have not received NOA and the check has not been cashed.

I am afraid that the packet will be rejected and I will be required to pay the new fee. Based on the USCIS 7/13/07 update letter, this should not happen, but I have a funny feeling it will.

Does anyone know if they date stamp the materials on the day they actually arrive or when they are actually opened for processing? I can show when UPS delivered it and who signed for it but what "counts"--actual delivered date or actual opened for processing date?

"USCIS would like to assure its customers that the delay in data entry and fee receipting will not affect Change of Status or Extension of Stay eligibility, assuming all other eligibility requirements are satisfied. USCIS wishes to assure all customers that the original received date (the date which the document is date stamped) will be honored and recorded on the receipt notice. This date will appear in the "Received Date" box on Form I-797, Notice of Action. The received date is different from the "Notice Date", which also appears on Form I-797. The Notice Date is the date the receipt notice was actually generated."

Did you send any joint bank account statemets, joint bills, joint health insurance, etc.? USCIS seem to like that kinda stuff the best. Pictures of trips are cool, but people normaly use them as secondary evidence.

Thank You to everyone for their response. I would disagree with the travel companion. If I had traveled a lot before, maybe they could make that point, but when you go back for family sickness, family death, and family weddings it should look like a family. The money it takes for my family to go to vietnam, and pay for hopitals, funerals, and some of the wedding is a major deal. However, I was not going to tell my wife sorry your mother is sick, or dead we can not spend that money. I was also not going to tell her sorry but we can not go to her only daughters wedding.

The problem with the bills is that I bought the house before she came over, and I have a very good rate of 5%. I had utilities, water and other hooked up before she got here. I did show the 401k, life insurance, her new 98 Saturn, one joint checking account plus our taxes, the health insurance cards. I really thought it was "no problem". My wife is only 2.5 years younger than me and I thought we had sent more than enough. I copies of our passports showing the different travel times. I guess after living together you forget that you have to prove we are husband and wife. They want to see birth certs from any childern we had together. My youngest is 22 her daughter is also 22, I have been fixed.

I have asked for affidavits from my boss, her school where she sudying nails, two of my friends, the family from next door, her Doctor we switched to him because he speaks Veitnamese, and school were I teach karate. We are going to vist friends later this month I have the tickets already and we went to las vegas together for a seminar after we sent in the paper work. I hope that well be enough. I can tell you this without a doubt we are a very close loving couple. She loves me and I love her, we do most things together and enjoy each other. Once again thank you for responses and I am sure this well pass.

I would apply as soon as you are able/eligible; you just never know how long they will be taking for NOA's at that point.

No, the K2 expiration date is 01/18/2008 and the K1 expiration date is 01/23/2008 and the application was mailed to USCIS on November 3rd, 2007. Furthest amount of time would have been 82 days for the K1 filling.

Apparently yes. My friend is over right now and they got their entire packet back with a handwritten note on a form stating "child must file separately because they entered before the parent".

The note appears to be written by a five-year old, but other than that here are the facts:

-The K-1 parent and K-2 child entered the USA on the same day, 11/30/2004.

-The K-1 parent and K-2 child applied for AOS at the same time.

-The K-2 child was approved first (huh?) and her CPR card has a resident date of 01/18/2006.

-The K-1 parent was approved second (huh again?) and her CPR card has a resident date of 01/23/2006.

So the question is are they saying they have to file separate because the K-2 child received her approval before the K-2 and that the "within 90 days rule" only applies if she is approved after the K-1 parent or;

Whoever processed the application doesn't know what they are talking about and assumed since the K-2's card was issued prior to the K-1's that she also entered the USA prior to the parent and therefore must file separately?

Any suggestions would be appreciated!

My USC friend called today and said they received their whole ROC package back saying that his step-daughter must file separately from her mother.

I haven't seen the letter yet but I know his wife and her daughter received their CPR cards at exactly the same time, so I know she is not outside the 90 day window as stated in VJ's guide:

7.4) ..How to we file for lifting of conditions for my K2 child?
A..If your K2 achieved permanent resident status at the same time as the K1, or within 90 days afterwards, then include them on the joint petition. If the K2 achieved permanent resident status more than 90 days after the K1, or if the parents are NOT filing a joint petition (due to termination of the marriage), the K2 will file their own I-751.


Until I see the letter I won't know for sure but can anyone tell me where on the I-751 instructions/form/or the USCIS website that backs up what it says in the guide? I know I have seen it before but I have looked and don't see it written anymore.

What does everyone think about this:

1. Mom and daughter entered USA together as K-1 and K-2

2. Both filed for AOS (2 applications/1 envelope)...Mom approved 1/23/06 and daughter approved 1/18/06

3. Filed one application for I-751 ROC and USCIS sent it back saying they had to file separately since daughter "entered" before mother.

Why was mother's CPR card issued after the daughter's?

Why should they have to file separately and pay two fees for the I-751 just because USCIS approved the K-2 before the K-1?

I know the OP used the term "activated visa", but isn't the correct term "original greencard date"? I mean, to remove conditions you have to wait until 90 days prior to the 2 year anniversary of the conditional green card expiring. Or I am just plain wrong since they filed the I-130 (instead of the I-129F) and the visa turns into the green card automatically.

I am preparing our daughter's I-751 (she has to file separately since her mom's conditional GC was approved 11 months prior to hers) and was reading the instructions and affidavits of a bonefide marriage is listed under "should cover" as far as evidence of relationship.

We have loads of documentation and included affidavits with my wife's I-751 last year...is it really a requirement now? I thought the application instructions used to say "may" be included?

Date of Marriage/Place of Marriage-wrote in "NOT APPLICABLE" in both spaces

NO to all questions 5-10 except yes to #9 since we did move once; attached separate sheet of paper with note explaining dates of move as requested

Part IV

Wrote in all information about her mother (my wife and K-1 applicant)

Part V

wrote in "NONE"

Part VI

Had the kid sign and mailed it in with all supporting documents similar to what we sent in for her mother's I-751 with some extra stuff like report cards, and especially all of our documentation regarding the delay in the approval of her I-485 which is what caused her to file separately.

My real advice is to send it in the best you can...as I stated in a previous post this form was not created with the K-2 in mind, just have to do the best we can!

Unfortunately you are not going to find too many K-2 experiences on this board (believe me I have looked!) and even less that have had a case similar to your daughter's where she had to file the I-751 separately.

That said, we were in the exact same position (except my step-daughter is younger-17 right now) and we listed her mother (K-1) as the person "through whom she gained her conditional residence" on the application. The application is in no way set-up to handle the K-2 filing separately (with the exception of the first box where you can check "I am a child filing separately from my parent because of the 90 day rule") and it is indeed very confusing for K-2 applicants.

Anyway, I can't guarantee this is the correct way as technically my step-daughter became a resident through both my wife and myself...but listing her mother just seemed to make more sense.

We haven't received any RFE's and she has completed her biometrics so now we are just waiting for the approval.

Be sure to also include a separate page/letter stating why she has to file separately from you; just state that she came a year later and was not approved for residency within 90 days of you.

So we've been waiting 5 months for some action on Carina's I-751 and today we get a letter in the mail from USCIS stating they want Marina (K-1) to sign as "spouse", and for me to also complete section 4 of the form and sign as USC-also in the "spouse" section. They were nice enough to include page 2 of the original petition we sent in with Section 4 and "signature of spouse" highlighted. Gee, thanks.

Actually the RFE instructions were not as clear as above but like anything with USCIS you have to read between the lines and hope for the best.

On the original submission we completed the form the best we could considering there is no contingency instructions for filing for ROC as a K2, although they require the child files separately when their AOS is approved over 90 days past the K1 AOS approval.

Anyway, I modified page 2 of Carina's petition we have saved to the computer and replaced Marina's info in section 4 with my information and then I printed it out and both Carina and I signed it.

I will attach the 2 pages to the RFE with a note writen on it that we have completed section 4 of the 2nd form since there is no room for a 2nd person's information on the first form, and signed both forms as requested. We will send it off and see if Carina gets her 10 year GC before she gets her US passport. I know we probably don't need the card at this point but I don't want any problems with an "abandoned" petition, and also would like to actually touch the card we paid $500 or whatever for.

Immigration, you gotta love them.

My daughter's case status has not updated since 08/12/08 which was 4 days after she completed her biometrics. No touches either. What you are seeing is normal.

To be honest with you I don't know what system they use to update the on-line case status; my wife's N-400 application was never updated even after her interview approval and naturalization ceremony!

Of course I am hoping we can semi-bypass this whole I-751 ####### tomorrow by applying for Carina's US passport (see timelines below) but it sure would be nice to have the 10 year GC too after paying for it.

And so we wait...all of us.

Hi all-

Does anyone know if the NVC has specific guidlines regarding how the DS-230 form and the supporting documents should be assembled? I will send the official cover sheet and then one of our own listing the contents but things like the original birth certificates, marriage certificates, photocopies, etc are all different sizes so I am not sure if they want us to use ACCO fasteners, paperclips, staples or what.

Just wondering if there is a standard for the NVC like with the USCIS service centers.

Our experience was that you can wait for the packet or also call the embassy to see if you can start sending them forms and prepare to schedule the interview. We called and they pretty much just told us what they needed to getthe ball rolling.

They were pretty responsive there both by phone and e-mail...give it a try!

1. Question #24 asks about prior military service. Will the fact that my father-in-law served his required 2 years of service in the Soviet army over 40 years ago be an issue?

2. Why is it that for the I-130 (and almost every other USCIS petition) you can send copies of documents but for the DS-230 you have to send in orginals or certified copies (which may as well be originals) to the NVC before the embassy interview is scheduled? I know the DS-230 is technically not a USCIS doucment (department of state), but it is frustrating because we are trying to get Mom and Dad here and trying to explain to them why they have to send their original birth & marriage certificates (copy for each to send for separate petitions) only to get them back when they have the interview at the embassy is not an easy task. It is a pain in the butt for them to get these documents in the first place (not to mention the cost) and then as soon as they get them they have to trust they won't be lost in the shuffle somewhere.

Not only that, they also want my wife Marina's original birth certificate and we only have one but of course we need two since she has two parents immigrating, and since she lives here in the US it is very difficult (if not impossible) to get another "original" without spending $1,500 on a plane ticket to Moldova so she can stand in line to get one for herself.

I suppose they want to make sure the documents are legitimate but it seems to me a copy should prove enough at least until they get to the embassy with the originals.

Just venting on that 2nd question but if you can add an opinion for the first question that would be great.

Thanks for all the replies! I must say Kez was right....I went to the actual application and right in the first paragraph it does say that you have to be a permanent resident and married for 3 years before applying for citizenship.

You can not apply for Citizenship until you have had your greencard for three years... regardless of how long you have been married... if your wife got her greencard on 10/26/05 then she is eligable for Citizenship 10/26/08.. she can file the paperwork 90 days before that date..

I have read the pinned FAQ's, etc but I just want to be clear.

My wife (K-1) and I were married on 11/20/04. She received her 2 year permanent resident card on 10/26/2005. We will apply for removal of conditions in July 2007.

So does this mean we can apply for citizenship for her anytime after 11/20/07 (3 years married) regardless of whether we have received approval on the pending I-751??

Her daughter (K-2) is age 15 now and will be 18 on July 14, 2009. She received her 2 year green card on 09/25/06 but arrived in the USA on 09/17/2004. SHe will apply for removal of conditions in June 2008. She will then be able to apply for citizenship anytime after 09/17/04?? (18 years old and in the US for 5 years)

Probably so. If the CCA applies, then when her custodial parent becomes a citizen, she'll become a US citizen whether she wants to or not. Nevemind whether her non-custodial parent wants it. Google "Child Citizenship Act".

And if she's not a minor, she's old enough not to need her father's permission.


So does that mean my step daughter Carina (K-2) will automatically become a citizen if my wife gets her citizenship before she turns 18?? That would be great since she is 16 now but won't turn 18 until July 2009 and with any luck Marina will be a citizen a few months prior to that.

I think Marina meets all requirements to apply late July 2008 then:

1. Has been living in the US continuously (no trips out of the country over 2 weeks) since 09/17/2004;

2. Has been married to me (USC since birth) since 11/20/2004;

3. Has been a permanent resident since 10/25/2005.

Does this sound right?

My hope then is that if Marina (mom) can get citizenship before Carina (K-2 daughter) turns 18 on 7/14/2009, then the CCA will enable us to skip applying for Citizenship through USCIS step for Carina and instead, like you stated, apply for a passport and/or certificate of citizenship.

Carina has also been living here with Mom and me since 09/17/2004.

The only thing that concerned me when reading the info on the CCA was that it seemed to set up more for adoptions from overseas as opposed to our situation. Almost like they have to be living overseas and then come here to qualify as "automatic citizens".

What do you think?
