I was just curious if you had an update on your returned petition.

it seems NVC also sent my approved petition back to uscis. it was at nvc for a week, and i was told it was in processing. i called today and was told they returned it to CSC and i would have to wait for a letter from uscis. and tat would take at least a weak for it to get to CSC.

and yes we have the actual approval noa2 that was sent to us, and copies of the approval email as well on august 7th. After being delayed at uscis i do no know what to do. we already had our congressman get involved at 5 months to get our petition moving at csc and now this.

what is weird is that today we got mail form nvc dated a few days ago that it was forwarded to the consulate.

i am so confused right now and upset. sad.gif

Accordingg to uscis when congress makes an inquiry on your behalf, uscis has 3 days to get back to them. However, when your congressman gets back to you really depends i guess. Everytime we spoke with ours, we had an answer withing 5 days.

i went though all of that..only to call to confirm the letter and be told my k1 petition was sent back to CSC. i was told the letter is a standard letter they send you so you have your new case #. alot of ppl in the stuck in ap thread got the letter as well and are still in ap. keep calling back to get a current answer.

Well i it's october 2nd almsot 2 months after my noa2, and i finally found out what is going on. Got this email today:

On October 2, 2009, your document I129F, PETITION FOR FIANCE(E) was processed and mailed to the address on record. If you have not received it within 30 days of October 2, 2009, contact our customer service at 1-800-375-5283. If you move while your case is pending, please call our customer service center at 1-800-375-5283.

This step applies to applications that result in an applicant receiving a card (such as a green card) or other document (such as a naturalization certificate, refugee travel documents or advance parole). Applications will be in this step from the time the order to produce the card/document is given until the card/document is produced and mailed to the applicant. You can expect to receive your card/document within 30 days of the approval of your application.

USC called and sure enough, almost 7 months later it's an RFE that CSC didn't tell us about or ask us for. Apparently what we are told now is that the paperwork made it all the way to the Consulate and it was them that returned it to CSC in August.

Oh and we know what the mistake is...it's something the lawyer was suposed to have fixed back in April but didn't. i know i know..dont use a laywer..well it wasn't my choice and my fiance has been yelled at alot for letting his family make him use one. i've also yelled at the lawyer as well and at my usc's family to fire him.

So now what i'm wondering is if i will for sure be stuck in AP when this eventually gets sent back to NVC..i'm also curious to know how long an RFE at CSC is taking lately.

I already know it will be next year before i get to actually move to chicago and get married. sigh.

Nvc sent our approved k1 petition back to CSC. yes it was approved..i have a copy of the noa2 dated august 7th.

Finally got some info out of nvc today, the words used were "documentation incomplete"

We have to wait for a letter from uscis now. Probably 2 weeks to get it.

What exactly is documentation incomplete? are they saying csc didn't send all the papers? is this some sort of RFE? And can NVC do this to a k1 after it's approved?

i've just about had it with this process and all the bs and stress. im going to lose my mind by the end of the week... crying.gif

Nope just a box unticked, they sent us the same paper as what was missing on the petition. Never trust a lawyer to proofread the papers before sending it in.

You should keep on top of this Dacko - it may be beneficial for you to contact your congressman .... unless you dont mind waiting the extra time as Kimbear has.

LOL trust me i did not wait. I had a lawyer, a congressman and my fiance and me calling like mad. Unforunteately they cannot do much. Alot of the waiting was due to the crappy us postal service which is bloody slow, and the time it takes for them to log packages in and get them to agents.

Please be very careful if you receive a reply from nvc or uscis that your case is under review. This does not mean you are in ap or that it was approved or anything past the NOA1 stage.

More often than not it means it is being reviewed due to a mistake somewhere and you will get an RFE.

My I129F was done March of last year. In august i got noa2, had not received hard copy and yet received an i-797c notice saying it was sent back to uscis for review by NVC in september. Turns out there was an error in the file and uscis never noticed what should have been an RFE. Suffice it to say we only received the RFE in October, and replied the same day. We got a New Noa2 or "reaffirmed" noa2 in November. August - November was the delay due to this.

The only way we got any information about this was from our congressman. Our lawyer was useless as was the wonderful misinformation line.

If you are in doubt please please get in touch with NVC, they are the ones who confirmed with me that my case was sent back for review and why, and then get in touch with your congressman.

the only mmr shot in my book was when i was in highschool, the booster. however they needed to see 2 shots in my book so i had to go for an mmr booster at my local clinic which was free, same with my TD shot i had to get a booster.

as dr. seiden explained it to me " we the cdn doctors know you got them as you would not have been admitted to school without it, however the U.S. doesn't care and wants to see a physical paper record of all the shots as a baby and as an adult".

as for the meeting..all you had to do was prove you met in person. pics passport stamps etc. relationship evidence is not needed at the initial stage with the i-129f application. I submitted a two line sentance with 3 pics and it was good enough.

Unfortuneatley there are only two consulates in Canada for Family Based Visas. Vancouver and Montreal. And only Montreal does the CR-1 spouse visa. Sucks I know.

To my knowledge and doign it myself, the usc has to fill out the ar 11 and sign it and send it back..so unless you will be signing or faking her signature.....that would be ill advised.

Hi all, I have a few questions regarding our situation.

Just a bit of a background to our story: My fiance (petitioner) and I (beneficiary) filed our I129F (to VSC) on January 12th, and received our NOA1 on January 14th. She lives Oklahoma, and will be moving to Colorado sometime in April to live with family before I can enter on the K-1 (assuming it gets granted)

Just looking for some feedback on a few things:

1) I've registered as a customer on the USCIS website to check our case status and to receive updates. Is it ok for me, as the beneficiary, to file the Change of Address?
2) Is it ok to change her address before she actually moves? Our timeline says we should expect the NOA2 late April early May, and she will be moving mid April.
3) She is moving out of state (Oklahoma to Colorado) Is this a problem? Is there anything extra that needs to be done?
4) The address she will be moving to will not be permanent, as we'll get our own place once I can enter on our K-1, so I guess in the future we might have to change our address again during the AOS. Does this pose a problem?

Sorry about the questions, I just want more info before I go about doing this, and the VJ community has been nothing but the best source of info :)


at the beginning of the 1129f process up until NVC, the beneficiary does not need to inform uscis of their change of address. Only the petitioner does. You cannot fill out the change of form for your USC, they would have to file an AR 11 themselves. The beneficiary can call dos and nvc and update their address as it only pertains to the p3 and p4.

She can change her address whenever you want, the sooner the better though.

Moving out of state for an already filed petition will not alter anything. Yes at the nvc stage when you send back p3 you will have to put the residence you will be living at after your POE.

the date is based on when they would have sent it to the consulate
so try a few days before and after.

then you will get a list of all packages look for the ones going to the city/country of your embassy. most are around 3 lbs. some are more. that should work if i remember correctly.

Department of State can help you as well. Just make sure to call first thing in the am if you want to get through. 202-647-4000

Also, if your petition has already gone from NVC, you can use DHL track to see if it arrived at your embassy.

I do not quite remember the link, but there were a few posts about it with the links and what info to put. Try a search with DHL in the name, i remember the reference you use is EXP2010 or something like that.

Just replied to your pm. For the standard refusal such as insufficient ties (which happens quite frequently) you do not need a waiver. Just explain as you did in your earlier post and you'll be fine.

I would recommend calling NVC and get the info yourself. Based on my ex-attorney, I never knew or was advised of anything until 2 weeks after it happened. Thus why i kept calling NVC and DOS. I was more on top of my case then the lawyer was.

AS for the wait time. It is all dependent on many different things. However i would not panic. USCIS states on their site it is still an average of 5 months for an approval. Some people have recently gotten record time approvals however that is not always the case, as each petition is different and cannot be abjudicated the same way or in the same time frame.

you can check off the medical exam, most of the k1 do that on the checklist. they don't ask for the exam to be sent back right now they just want it when you go to your interview. same with the police check.

This is the CDN uscis approved site that most of us go to. depending on which province you are doing your medical, Dr. Seiden's is the only option. Montreal also has Medisys.

Secondary is where they dont let you across the border right away. it's also where you will ultimately go to activate your visa. Its a separate building next to where you cross and speak to the border guards.

The first two times i was refused i was photographed, fingerprinted etc. So on the third try to cross the border i was prepared to automatically go to secondary. Like you said NIk&Heather, being mentally prepared for that helps immensely.

I had everything organized paperwork wise and was handing it to the CBP officer inside before he even asked for it. Secondary is rather routine now for me and i'm very used to it lol.

We were just approved for our NOA2 I plan to go visit my fiance in Mexico and have him come back with me while we wait to go to his interview. I see you mentioned you did the same and said you are going to wait on your interview, did you have a return flight? Did they ask you any other questions?


the only thing they asked me ( btw it was in secondary every time) was how long i was staying for and when my interview was. And if my rent was paid for the month and proof of that.

and to be technical, it's 180 days total in a year. However there has been discussion on when the Year commences and ends for the purpose of visitation.

make sure to bring ties..like does he have an apt or a house he will have to pay rent for. is it a temp leave from his work and will he be going back? any children he will leave behind while he is in usa? Will he have enough money to support himself while he is in the usa?

these are all things they will probably ask. to be on the safe side i waited for my noa2, thus all i had to say was "i'm waiting for my interview date"

What Kizza said is correct. When i called NVC they always asked me out date of births as well. some times it is hard to get through to NVC, just keep trying, i went though an entire week of busy signals lol in fact we had a thread about how no one could get through! so just keep trying.

also you can ask teh specific date of when they received it, when they sent it to Montreal as well. Helps with the vj timeline. once that has happend you can start calling DOS and harassing them every week :P

make sure your using the latest version of internet explorer.

make sure you do the pic upload test even if you dont have one.

some ppl have reported issues lately with this form.

worse case scenario, start over from scratch it wont harm anything. keep saving every few mins. and make sure you look at the example forms on vj, and have all the info you need in advance to make it go faster so you wont have the timeout happen.
