Apparently the ppl at the border where he crosses keep askigng him why i dont go down there to visit instead of him comming here. well , with the two refusals i had i wasn't sure i'd get in, especially without an noa2. However, i'm starting to think maybe i can go there. So i have it in my head to try in dec around my bday, it will have been a year since my last attempted crossing. i live 5 mins from the Ambassador Bridge, so no biggie if i get sent back..and at this point, i do not think it will harm my k1. UScis wont help, DOS wont hep, NVC has no idea. Congress wont get back to us. And this week is thanksgiving so the offices will be closed for 2 days. I'm afraid my peition will expire before it gets anywhere and then i'll be sh1te out of luck. IF i could be sure it would get to my consulate by dec 6th, i wouldn't worry, but it was reaffirmed on Nov 12, and is still not at NVC. Thats about where i am. The only thing keeping me together is that i have seen David 3 weekends in the last month now that we live closer. For the long weekend he is bringing me my dogs who i haven't seen in a year. K-1 Fiance(e) Visa Case Filing and Progress Reports	March 2009 K1 Filer	so i guess i have a bit of good news. CSC finally sent me an email saying that prcessing has resumed on my case after my RFE. I'm just wondering how long it takes them to reaffirm their original NOA2. also i move saturday. got accepted for my apartment on a month by month lease. really nice landlords too. and david is comming up this weekend to help me get settled. we are both excited at the prospect of being able to see each other every weekend now instead of every few months. and not having to pay for plane tickets and hotels makes this so much easier to save up money. hopefully this trend can continue and i'll be joining the rest of you at the consulate interview stage soon. maybe i'm counting my chickens before they hatch but i do not see a reason they would not give me a 2nd noa2. right now i just want these positive feeling to continue!! We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283. For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations. i'm guessing that means my noa2 is no longer valid and they are reabjudicating it. I really wish they would have expedited her properly. well if i work in all the wait times etc, it looks like my interview if i get one will be in March, one year from starting this whole stupidity and 15 months after separating from David. 4 months which were added on by the lawyers mistakes. i've definately joined the do not get a lawyer bandwagon. Any new news on your front? yup. we noticed a mistake on our paperwork back in april and told lawyer to fix it. he never did. our paperwork made it all the way to the consulte and it was them that denied it and sent it back. after 7 months we are getting an RFE. i just got the email from CSC. and even though yes according to csc they made a mistake not noticing this, the expedite that the immigratin officer said they would do, was denied as well. all in all the lawyer costed us 4 months of total bullsh1te. csc is backed up now, and telling us 3 months to process an RFE. And because of this i just know i'm going to end up in AP, so i'm expecting this whole process to take 2 years now. it's already been 7 months and with the wait for interviews at montreal the way it is..shrug. As it stands my sister has to move, so i'm going to be without a place to stay so i'm a have to move provinces back to ontario since i can't get a job in quebec due to my french sucking. overall i'm completely demoralized atm. if i could go stay with David for a couple months i would..but i can't give enough proof of ties and i doubt noa2 would really make a difference since i was refused twice already at poe i'll get extra scrutinzed. The woman who gave us the paperwork (and passport with visa!) seemed very excited for us, and said that we should send them a picture of our kids. Cute, but why is everyone so focused on kids when we just want to be married first? As proof that they heard our pleas, there was a post it with "urgent case" written and underlined on the back of the passport. Anyway, now instead of stressing about immigration issues, we'll have 14 days to concentrate on stressing about the wedding! Keep the faith, everyone. There is good in the world of visas. K-1 Fiance(e) Visa Case Filing and Progress Reports	March 2009 K1 Filer	Thats the thing..nvc did originally have it..but the paperwork was borked.. csc did not send the stuff properly so nvc sent it back. because of this i am in a waiting line, and have to be reabjudicated. i'm not sure how this works compared to an rfe, but and rfe would have been quicker at this point. CSC said we'd get a letter within two weeks and nothing, i have had a touch on the case the 18th, but nada since. just frustrating ya know? finally had some closure when i got the approval and now i feel lost again. and i'm missing david more and more and i'm back to crying alot	Kimbear	Female	Canada	2009-09-24 13:09:00

Heh Kimbear, don't sweat the 4 month valid period on your NOA2. My approval from CSC was on July 24th...a month later NVC had still not received it so I contacted my Congressman and she contacted USCIS and it was sent the next day to NVC...it had been sitting after approval for 1 month. I then received ANOTHER NOA2 with a new date of August 18. I think that is likely what will happen with you...a new NOA2. We have 4 ppl working on this. I've a good mind to whip off an email to Hilary Clinton bitching at her..but alas i'm CDN, so i doubt it would do much...although NVC is under her domain. K-1 Fiance(e) Visa Case Filing and Progress Reports	March 2009 K1 Filer	so i found out what happend to my k1 after it was put in ap after my approval..according to Dos..Nvc lost it. dos is confused..uscis is confused, and nvc is confused. my noa2 was not revoked by nvc, or sent back to uscis. why i got that letter after telling me it was in AP i don't know, or the one saying it went to the consuulate is unclear,or the email from nvc saying it went back to csc. the only trace anyone has of it is when it was sent out august 7th to Nvc. and that nvc got it a week later. now it has vanished into thin air. DOS resolution specialist and visa specialist have contacted nvc and uscis, there is a service request..my congressman is calling every day as well as my fiance, and the lawyer. i am sooo peeved right now. it's been a months since my Noa2..... I'm really trying to stay sane right now without breaking down and crying again. i haven't even felt like eating in two days. i've been nautious, headaches from crying , and just feeling so lost. And i yelled at poor david and snapped at lawyer and kinda had a meltdown. how can they play with peoples lives like this..i just don't understand. first they tell us fbi background checks, and that it will take another 5 months from july, then we get congress involved and i miraculously have an noa2 within a week, now they decide nope were sending it back, and now i'm wondering if my file is going to get lost in a black hole being sent back and forth while one says approved and the other say no. and the whole while all we can get out of anyone is incomplete documentation. BLURGH! so help me is uscis fvcked up, grrrrrrrrrrrr. But at least my other march filers are doing better. glad to see some of you have your interviews and it's almost over for you!! My fiance cannot apply for another petition..or refile, or get married while this one is active, and if we do it would require a waiver of some sort, and from what i've read those are hard to get depending on what you are asking for. but first things first..we have to know why it was refused at Nvc.
