CanadaCandian legal terms...

Thank-you! I wish people would refrain from giving opinions unless asked. Facts was what I was looking for, and your experience is proof enough. Thanks again, you have been very helpful!! :)

lol unfortunately this is a public forum with millions of people from all over. your going to get that whether you like it or not. Also you technically asked "everyone" as a specific name was not attached to that question :P All you can do is take it with a grain of salt and chose to ignore or not replay to any posts you think are irrelevant or not what you are looking for. Otherwise people will get there feathers ruffled and that just leads to other things. :)

Also text does have a way of making people read a post a certain way or the wrong way. Just remember, most of the people here on VJ are here to share similar experiences and offer advice.

CanadaWedding Anniversaires and what to do
so i guess our paper gift to each other is the signing of the papers for the house we put an offer on  We decided on Seafood. I haven't had any in forever, especially since his dad is allergic, so we are going out to a little place called Joe's Crab Shack, which i enjoyed the last time i was there for valentines day 2010. :D

CanadaWedding Anniversaires and what to do
aww thanks for all the ideas guys / gals :) since everything was such a rush affair last year i wanted to do something special and now i have some options lol. I think i'm a pick a nice restaurant and make us take a cab so we can enjoy a drink or too. usually one of us ends up being a designated driver when we go out, so it will be nice not having to worry about that this time. And maybe a movie as well. truth be told we haven't really gone on any real dates lol. most of the trips up to see me etc were short so we had limited amounts of time to do stuff and usually ended up only doing one thing...:P

CanadaWedding Anniversaires and what to do
Ok so i was wondering, did any of you do anything special for the first wedding anniversary? I mean like..lol are there any rules or anything for this kind of stuff?? :)

in a way for many of us, this is not just a wedding anniversary its an anniversary of getting our k1 and being able to cross as well. In my case i POE'D April 6th, and we were married on the 11th. And i dunno, lol i guess i just feel that there should be something special done lol.

Ok maybe i'm just dreaming in technicolor while i'm awake from no sleep lately :P

CanadaPOE by bus

They are some what required to stick to a schedule. I have seen them leave people at the border who were taking too long. It typically takes about 30 minutes at the border to go through a full bus load of people. With everyone getting off and unloading the bus.

I've traveled by greyhound a couple times to Chicago from Toronto. they will call their boss /depot whoever, if customs takes too long to get approval to ditch you if it takes too long. I've actually witnessed this happening when an older couple had brought food etc to the border. Even though bus is very cheap i would never do a POE by bus. my k1 took me over 2 hours to process due to various issues and computer problems. No way a bus would have waited for me during that.

Canadapregnant Canadian wife - any loopholes?

Sorry if I've got wrong impression... since nobody objects OP's conclusion that there isn't enough time for him to process the whole immigration paperwork for his wife, the only way for his wife to come to the US for a childbirth would be as a regulat Canadian visitor, that was my logic. There is some confusion probably since we're discussing the situation involving 2 problems: 1. immigration 2.insurance coverage.

As to your second point - just curious: usually such a provision means that the insurer will not check marriage papers but are you sure you can add to your plan A PERSON WITHOUT SSN?

My husband was able to add me, but coverage for the medical part of his plan wouldn't kick in until i gave them my SSN#.

Canadapregnant Canadian wife - any loopholes?

I've just been hired for a job in the US starting August 18, 2011. My wife of five years is pregnant with our second, due in October. We've resided in Montreal for two years, and I started looking into direct consular filing; but by the time frame people have set up, it looks like September/October (i.e. the time the baby is due) will be the first time she's allowed in the country, which cuts things way too close. She could potentially move back in with her parents, but they're in Ontario, and there's a three-month waiting period before you can go on insurance, so she'd have to be there as early as May; meanwhile I don't think my insurance from my new job would cover childbirth outside of the country. So either she has the baby without any insurance coverage, or she spends the last few months of her pregnancy couch-surfing in Montreal; either way our son doesn't see his mother for a few months, and I probably miss the birth of my second child. Is there anything I'm missing that could help us to avoid one of these ridiculous situations?

As someone who recently moved from Quebec to Ontario twice, i know exactly what your going through.

Technically there is a 3 month waiting period for OHIP, which is usually covered by your previous provinces medicare. The day you apply for Ontario OHIP (The first day of the third month) your Quebec card is cut up by them and you are immediately covered in Ontario. Note, If you will live in Ontario for LESS THAN 6 MONTHS they will not give you a card. I moved to Windsor Ontario on October 31st. i was waiting for my packets from nvc / consulate and knew I'd have an interview within 6 months. so i put temporary residence on my forms and that's when i was told you have to live in Ontario for more than 6 months to be covered by OHIP. Or you have to pay them back for anything you received.

However, NEWBORNS are exempt and are immediately covered if they are born in Ontario.

My recommendation is to let her stay in Montreal. Current info was obtained from the following two Ohip pages:

http://www.health.go.../ohip/wait.html

CanadaBuying a House
Definitely read those two threads, one of which is mine. depending where you live and what you can afford, it seems these days buying a home is a whole new ball game. Definitely not as easy as it used to be.

Oh and ya bank of America refused to give me a GFE too, i finally go them to cough up a closing cost worksheet, but it took two weeks..and there closing costs are alot higher. extra fees etc. Shop around and check out the articles on HUD etc.

CanadaDid I sent Package 3 to the wrong address?

Thank you for the information. I'm going to use Xpresspost or something similar. When I went through DHL the package was received and signed for at the address I sent it to. I have copies of everything so it's not a big deal to resend. However, I think I'm going to have to push back my wedding date. Does anyone know why Montreal still isn't booking appointments? I'm wondering if I can send things to Vancouver instead. I've always wanted to go out west and it might make for a nice vacation.

I can only answer that question with the " Its Montreal" answer lol. they are the worst consulate ever. who knows, maybe they fired the staff again like they did 2 years ago which in turn put the consulate back almost a freaking year sigh.

i know that doesn't answer your question really. but in all honestly if you go through Montreal NEVER make ANY wedding plans..its just not worth the hassle of them screwing every person over.

CanadaDid I sent Package 3 to the wrong address?
they must have changed the mailing address, as i sent my stuff to 1155 which was also the address for the interview. either way it will get there. just give it a few more days.oh and i think montreal was backlogged so it took literally a month for dos to see it was logged into the system.

CanadaShould I book my medical now ?

Ok i don't really know what pk3 and pk4 mean, I got my paper saying my case was reviewed and I can book my interview so whatever number that one is. Since the Montreal site is having issues with booking K1 visa appointments right now I was wondering if I can book my medical exam. Just incase their are any issues i can sort them out before the interview date. Or should I wait till i can actually book an interview ?

keep in mind the medical is only valid for one year. so depending on where you are in the process and when your interview and poe are you do not want to have paid 350 $ for a medical and again after you move to the u.s.a.
KimbearFemaleCanada2011-04-18 19:14:00
CanadaWhat do you do if your 129-F petition expires before you can get an interview?
my petition expired in December and my interview was almost 4 month after that. It gets automatically extended. as for switching to the Vancouver consulate, you can't do that unless you physically move there.

CanadaThinking of moving back to Canada
ok found out the big difference of inland vs outland:

It is usually faster to apply to sponsor a spouse from outside Canada. However, the requirements to immigrate to Canada are the same in both cases.

Some differences between the processes:

Inside Canada
  • average of 12 to 18 months to process routine applications
  • no right of appeal
  • you are advised to stay in Canada while your application is being processed (If you leave Canada and cannot re-enter, the application will be abandoned)
  • you can send an application for an open work permit with the sponsorship application (the permit will be issued as soon as you are eligible for it)
Outside Canada
  • average of 6 to 12 months to process routine applications
  • right of appeal
  • you can leave and re-enter Canada while your application is being processed as long as you meet all requirements to enter Canada
  • if you want to work in Canada while your application is being processed, you must apply for a regular work permit

CanadaThinking of moving back to Canada

We have started thinking of moving back to Canada. Having a family now, we realize that we would have a lot more support from my family than we are able to get here from Simon's. And we want to have another baby, so it will be nice to have the maternity benefits and not have to pay a ton of money in medical bills. We have a few issues that we have to look into before we can even start to see if Simon is admissable, but hopefully it will work out.

I know there are a few people on here who have gone back, so I was wondering did you do your application when you were still living in the US or do you have to move back then apply? Simon just doesn't want to have to sit around a wait before he will be able to work, so it would be nice if we could just move and be ready to go.

Thanks

Ironically, David and I actually talked about this a week or so ago too. You and I both got our K1 the same time, and the maternity benefits have been a small prodding to look into it for us as well. With our trying to buy a house down here and seeing all the hurdles, i realized we could get so much more if we were up north, and i wouldn't be afraid to go see a doctor for anything. If this short sale does fail and make me miserable, i really want to look into this as well.

the only thing i know about inland vs outland is one takes more time i think. but i also though you could have him wait with you in canada, and that you could say as much as the Canadian poe and they would give him some stuff or stamp his passport..

course this is just me going off my memory of recent threads and reading the website http://www.cic.gc.ca...sor/spouse.asp. Others can correct me if i'm wrong.

CanadaBiometrics After Arrival to US ?

I entered the US on February 24, 2011 on a CR1 visa. On Monday I recieved a letter saying that I have a Biometrics Appointment on March 22, 2011. I thought that this was done before approval of the Visa. Is this normal ? From everything I have read on different posts on here, I can't find many posts on people having to do this. I changed my address after I moved here, could this be a reason why ?

If anyone can help ease my wondering mind it would be greatly appreaciated.

Not sure how it works for a cr1, but for my k1 i had like 3 bio appointments kinda. pic and fingerprints at the consulate interview, again at the POE and again for the EAD / Green card. But i thought for IR/Cr 1 it was already done before your POE. and you just had to wait a couple week for Green card to be sent to ya after POE? Address should not matter i dont think. in fact my green card pic was a recyled one they used a couple months earlier for my EAD.

Canada2010 Tax thread - For Canada and the U.S.
first off..Blargh..accounting degree or not..this years tax return is a PITA.

i guess i need to figure out if i'm a non resident / deemed non resident and file that type of return, or if i just file a normal general ontario return since i did live in ontario fro the first 96 days of the year.

i did pay rent for the first 3 months..so i'm wondering if i can still claim that rental rebate thing and the energy credit...although pro rated..or will i get screwed over like i did with my GST last year that they took away ? i moved in april and they even took away my january credit!! grrr :(

also, do i really have to put in davids net usa earnings on my CDN return? i entered the usa on a k1 visa, and we only got married in april.

i had zero income, zero EI, for all of 2009. i still dont have my green card and i haven't worked in the usa yet. no rrsp nada. totally zilch. i'm guessing that means i do not have to file a usa return this year, and that David can file married jointly on that? so it should be a simple return for him no extra foreign income for me etc.

normally i just use ufile for my returns. and i know i have to mail it out to the office in ottawa.

CanadaWhere's my money?!?

Hahaha, gosh I know...

But no, my refund check was mailed from Canada to Canada, at my parents address, and it supposedly left on April 21st.... Anyone out there ever had to deal with a lost refund check or anything of that matter? :(

OHHH is this canada? yeah i had that happen with a GST cheque. they had to wait a month to make sure i never cashed it and write it off or some such , then they reissued me a new cheque. took about 2 months just for that..bloody retarded if you ask me.

Yeah, I had requested a direct deposit to a canadian account...

i was told if my address is usa that they can't do direct deposit. so i'm going to assume they though it was a us bank and not a cdn bank...even though it really was a cdn bank.

note if you live in the usa i've heard it takes 6 months as they drag their feet since you are not longer living here. think i read that on one of the huge tax threads.

CanadaWhere's my money?!?

Well, actually the refund was mailed to my parents' address in Canada... That's why I think it's weird it's taken so long to get there

mail to Canada from the us taking long? no way really? /end sarcasm....

sorry im not being sarcastic at you but at the stupid retarded USPS. here in Chicago it takes OVER A MONTH for my td visa cheque to get to Toronto (which is like a 5 hour freaking car ride) and be cashed. every month i get a statement saying my payment was late...its absolutely retarded.

and yet..the day i pay comcast and comed...within 3 days i get a new bill ...ironic..bills to me get here fast..
KimbearFemaleCanada2011-05-13 08:11:00
CanadaCIBC SUCKS!!!!!!!!!!!!
i don't know if you can do this with your credit cards, but i have a TD VISA, that i've been making minimum payments on..well trying to put at least 10 extra plus the minimum. Anyways i get a statement saying I'm being charged a yearly annual fee etc etc..so i called up and had them close it.

its still active for me to make payments on, i keep my low interest rate i had, and i can still call in to find out balances etc. BUT i no longer have to worry about extra fees. And i still get a statement in the mail every month.

Also i was told i had 15 days past my due date to get a payment in before it would be considered late.
KimbearFemaleCanada2011-05-16 14:30:00
CanadaCanadian Credit

That would be really nice! I bank with Chase here, but would definitely open a US TD account if I go do cross country transfers!

that would be awesome for me as my visa is a TD visa card and would make payments so much nicer since i stupidly cancelled my Canadian bank account..figured why pay a monthly fee if i got nothing in it right? if i had of known i would have kept it so i could use customhouse to switch money and make payments..but ah well..hindsight is 20/20
KimbearFemaleCanada2011-06-01 10:50:00
CanadaMore questions...
As SF2007 stated, you don't have to wait for them to arrive by mail. You can even go ahead and schedule the immigration medical now that you have your MTL case number. Come the medical though, you will need the official letter with your MTL case number on it though if i recall, as they will want to take a photocopy of it.

CanadaGirlfriend denied at POE. Canada to US

Thank you everyone for your responses. You all were very helpful. I have some good ideas now BUT we do have a problem!!

The ties to Canada are an issue now. She is currently looking for a new job and recently left her apartment to go live with her parents to save a little money....So there goes the job letter and the lease :( In fact, I'm ready to file for a K1 visa...but I know that takes forever...

I need to figure out how to get her across...this is becoming ridiculous!

this is why my husband and i started the k1 process. i was refused entry 3 times even with proof of ties for the last 2 attempts. and yes you will be scritinized every single time you cross from now til you get approved. it is all in the computer no matter what crossing or airport you use.

if you don'have a job lease school its almost impossible to get through again. it took us a year before they let me cross and that was only once i had my appointment date in montreal for my interview.

Can you not go up to visit her? that would be much easier at this point.

DOH...responding to an old post FTL. sighhhh.

CanadaPhoto upload on DS 160

Hey all, another question...

Fr the DS 160 that is filed electronically for packet 3.....cannot for the life of us get the passport photo to upload and attach....any suggestions?

Was told to just bring an extra passport photo to interview but it looked to me like you could not complete the DS 160 to include in packet 3 without first uploading your photo

Thanks!!!,

dont worry about it..after a few attempts you can skip it..just bring the pic with you to the interivew.

ok, got that problem figured out....was not running Internet Explorer! How frustrating that was.

Next question, in registering for Courier Service....we are putting together packet 3 to send today hopefully...do I need to pay the $350 fee or is that not paid until we go ahead and schedule the interview in Montreal???
Want to make sure I am registered correctly and don't do too much too soon... :)

Lol the only thing i hate is having an open closet door in my bedroom..i can't sleep unless its closed!
KimbearFemaleCanada2011-04-21 13:22:00
CanadaI wish I would have known...
Vero i've been in Chicago for a year now. do i love it? no, do i like it..a little. do i miss Canada? oh hell yes! do i have a job..nope. do i have friends..ehhh i have acquaintances..and i have Davids family. And most importantly I have David and my two dogs.

Since our K1 took so long as well as the green card etc, i blew most of my savings as well. We tried living with Davids parents when i first came here, but as you can attest, being confined to one room with little to no privacy doesn't quite work. I lasted 2 months before i felt like i was going to kill someone. David's father is of old school mentality where women do not know anything and should be resigned to the kitchen. He is not so bad now that I've had a year to work on him but it can be annoying. Anyway, we moved out, got an apartment close to Davids work that costs us almost 850/month and we still pay utilities. But it was the only place that would take our dogs. If i had to do it again, i would have tried to stay with the parents a bit longer, as living here is actually worse. way more stress annoyances and just terribad neighbours. I haven't had a good nights sleep in over 6 months.

Would i get rid of my dogs if it made it financially easier?? ** no. they cost me 60/month..that's it. i don't see that being expensive. And when David is at work they keep me company, give me an excuse to go out for walks and talk to the neighbours. They are my kids and we have been through hell the last 4 years together. As for jobs, well, some places are really hard to find one, and here where so many are jobless its even worse.

I don't think its a necessarily a thing of the south, as i find here in Chicago alot of people are ignorant and just don't give a flying **. Like the drivers here..grrr they are all morons lol. Even when i go out shopping i find people are sooo damn rude. Like others have said, you think Americans and Canadians are alot alike, even the countries, then you actually move and live here in the U.S.A. and you slowly find out how much of a difference it is. And after a while, even the little things ad up and you start to feel homesick, and you miss the simpler things like watching Hockey Night in Canada. And if your like me you will catch yourself constantly saying "but its not like that up in Canada" etc.

But what I'm trying to say is your not alone. We've all been there and are going though what your going through. does it get better? I believe it does, even if you are in a slump right now. Feeling the way you do, the way i have, the way others have, its 100% completely normal. Only a robot could adapt and not feel a thing. Keep in mind your emotions and your self being are still trying to adjust from an upside down roller coaster of a ride that is called immigration. Just make sure you keep the communication lines open with your husband, tell him how your feeling, ask him for support. You'd be surprised at how wonderful he can be and how much he can make you feel better.

CanadaCanuck Riots

Very true but they usually riot whey win.
Not a good trend

eh Im from Montreal, i've seen so many riots since i was born its not funny, even had my brother participate. I think the issue is that i'm now so desensitized to it. its like "meh..so what...another day another riot shrug".

Like most things going on in the news...i just turn the page and read the next story. Sad i know..but its how alot of society is nowadays :( Even if we could reverse all that i dont even know how we'd do it..prolly the only way would be to go Amish..lol.

Yes, it's definitely embarrassing for the city and country, but it's not a Canadian problem. There are idiots all over the world who take sports too seriously. In the US, we have riots when a team loses too, and wins for that matter. Stupidity is running rampant these days.

Remember some years ago, when the soccer player from Colombia kicked a goal in his own net, he was gunned down in the street for losing that game. Murder over soccer? C'mon...

SPORTS IS ONLY ENTERTAINMENT, WHY DO PEOPLE TAKE IT SO SERIOUSLY?

Have you seen any of the soccer moms or parnts at kids games lately? unfortuneately even the gradeschoolers crowds are almost as bad nowadays...its really sad.

I would definately go back when your ticket says. Also if you do, then the next time you cross they will see your still abiding by the rules. I was told by CBP that 24 year old white, blue eyed, women from Canada are entering the USA and staying at an " alarming rate ".

They almost stopped me even with full ties to Canada, job, family, money et. All I was doing was going to visit friends and had NEVER had problems before.

CanadaGot Denied at Border (Intended Imm)

And don't tell them that you are a 27-year-old playing video games; that sounds so weird that the may take you out of the plane, drag you into secondary inspection and slap you until the truth comes out.
:bonk:

....I'm 37 whats your point? :P

I did the same thing in 2008 when i met my now husband. he also lives in Chicago. But i took a greyhound buss ride from Toronto to Chicago...ugh 24 hours.. they asked how we met i told them on a game. lol. and that i was my first time meeting them in person.

I did the same thing, brought my pc router cables bag of clothes etc. was the first time i had ever used my passport as i had just gotten it too.

your info looks good. i would recommend using the same crossing, if you use a diff one ( as i did a few months later when i was originally denied) it may look suspicious. that's what i was told by the poe guys.

Either way you may just have to go through secondary again and be drilled again with questions. I did.

but you also have your evidence now with proof of ties..so it shouldn't seem that big a deal. the letter from your work and your lease is very important. but they will look at the lease end date. just explain your with your dad temporarily til you get back and find a new place.

CanadaExciting News!!

So back in March we moved to a cheaper apartment so that we could start saving up some money to eventually buy a house. But not even 2 weeks after that my husband lost his job, so that put off the home buying and burnt off all the money we had started to save. He has been working a temp contract at this distribution center that is closing down and moving to Nashville. A couple of weeks ago the facility manager pulled him aside and suggested that he apply for a management position in the new warehouse. So of course he did, and they told him tonight that he got the job!!! It is a very good opportunity for him, and since we really don't have any firm roots set here, it was an easy choice to move. The only thing is that it is the 4th time I will have moved in 1.5yrs!!!

Back in Sept he had applied for a VA home loan (in hopes of us buying a home this past spring) and we just got a letter in the mail that we were approved for that. So I am hoping that we will be able to actually buy a home there. When he was first told to apply I started looking at some homes, and you can get a pretty decently priced new homes there. After reading all the issues Kimbear is having, I think we will try to stick to new construction

We were starting to think of moving back to Canada, but I think that will be put on the back burner for now.

lol Congrats...and my issues were mostly cuz it was Chicago. Also beware of new contrustions, alot of them are being sued for being subpar and not up to standards...also i think its like a new car you have to pay tax on it..ugh lol.

But glad things are looking up for ya!

Congrats. In Kimbears situation its the type of deal--short sales (and foreclosures) that are causing the nightmare--not the age of the house. I bet my house bult back in Victoria in 1939 is a lot more constructionaly sound then new homes, lol Congrats and good luck

Actually my house isn't that old. It was build in 1985 only.
