Homeland Security Paperwork Glitch Delays Citizen-Immigrant Marriages

The government says it plans to send out additional forms that should clear the way for thousands of couples to get married.


WASHINGTON (June 13) - True love waits for no one - except maybe the Homeland Security Department. Red tape has put wedding bells on hold for about 10,000 U.S. citizens seeking visas for their foreign brides and grooms as the department works on new paperwork for their applications.

The form change was required as part of a law, enacted in March, to protect foreign mail-order brides from abusive American spouses. But Homeland Security missed its deadline three months ago, putting the visa applications of thousands of law-abiding lovers in limbo.

The department said Tuesday it would send out additional forms to the visa seekers for more information that should satisfy the new law's protections.

But the bureaucratic entanglement has trashed wedding plans for many couples before they could get anywhere near the altar.

"We were ready to get married this year, but I can't really make a date until we get the approval," said Bill Hall, 41, a construction foreman from Burlington, Vt. He applied two months ago for a visa for his fiancee, Debbie, to emigrate from Canada with her two sons. In separate interviews, the couple said they have been dating for six years.

"We're just kind of here, in limbo," Hall said. "And it's kind of aggravating - it's a real simple thing they have to do, and they're making more of it than they need to."

He said his application, sent to Homeland Security in April, "never got approved. It's just sitting there."

The tale of these 10,000 belated nuptials illustrates a bureaucratic response to what all sides agree is a well-intentioned law to protect women.

Advocates estimate that as many as 15,000 foreign women annually meet their American husbands through for-profit marriage brokers. That number, provided by the Virginia-based Tahirih Justice Center, marks a sharp rise from a 1999 estimate by the former Immigration and Naturalization Services of 30,000 women who came to the United States through a marriage broker during the previous five years.

Spurred by stories of foreign women - largely from Eastern Europe and Asia - being abused or even murdered by their U.S. husbands, Congress in December approved new protections for mail-order brides. They included amending the application form for so-called fiancee visas with two new questions: Whether the romance was arranged by an international marriage broker, and had the U.S. citizen ever been accused of a violent crime or convicted of three or more alcohol- or drug-related crimes.

President Bush signed the law on January 5, putting Homeland Security under order to draw up the new paperwork. But the forms weren't finished by March 6, when the law took effect - resulting in the department shelving all fiancee visa applications written on the old forms that were received after that date.

Chris Bentley, a Homeland Security spokesman, said about 10,000 applications are currently being held because they did not address the criminal or marriage broker issues.

"They did not have all of the information needed to determine whether someone qualified or not," said Bentley, who works for the department's Citizenship and Immigration Services.

He added: "It's certainly an inconvenience brought about by the new requirements of the law."

Homeland Security said Tuesday it would send additional forms to the estimated 10,000 couples in wedding purgatory to get answers to the questions about criminal pasts and marriage brokers. But it said it was still waiting for the White House Office of Management and Budget for approval of those forms and the new application.

OMB spokeswoman Andrea Wuebker did not have details immediately on the additional forms, but said the new applications were approved Monday in an emergency clearance process. It was not clear when the new applications would be distributed to the public.

Sen. Maria Cantwell, D-Wash., rapped Homeland Security for getting cold feet about quickly processing the new regulations that she helped write.

"Security and safety should be their top consideration but their long visa process delays are putting a lot of people's lives on hold," Cantwell said in a statement.

Hall, the lovelorn Vermonter, said he's frustrated with the visa delays for people trying to follow the law at a time the Bush administration is grappling with giving other benefits to immigrants who have slipped into the U.S. illegally.

"I thought it was ironic," Hall said. "And I find it unfair."

No expedite requested, and no bribes, lol. We just faithfully did our research and made sure our evidence for the relationship/making sure we've seen each other in the past two years was solid. I think the wisest advice I've gotten from VJ was to file your petition as if the adjudicator knows NOTHING about your relationship (because they don't). We painted a very cohesive and chronological story about how we met, how we became friends and how we fell in love. All the evidence we submitted just supported our story in a very logical way.

First of all, thank you VisaJourney for taking the worry and the complexity out of filing the I-129F.

With that said, our petition was APPROVED! The California Service Center has just outdone itself. We filed in the middle of August, got our NOA1 around August 17, and just when I was getting worried that our case hadn't been touched in the month that it's been out in I-129Fland, we got our NOA2. They processed our petition in 26 days. We're an entire 1.5 months ahead of what I was expecting. I'm gobsmacked.

First of all, thank you all so much for contributing to this forum. I have been reading it for about 2 months now in preparation for our own VisaJourney. Keith just left to go back to London after a three week visit and we're now engaged. Of course we're very sad that we have to be away from one another, but we know it's only temporary. I'm hoping to get some support from this group to help us through the hard times and hoping to avoid pitfalls that may slow down our K-1 process.

We will send off our application around the first week of August once he sends me the appropriate information, but I do have a question. Keith has had a few surname changes over the years due to adoptions, etc. and the surname he goes by in daily life is not the official surname on his passport, etc. We don't want to delay the process by having him get an official name change on his passport now. Once we're married, we both want to change our surnames to the one he goes by in daily life - will this cause problems when we file for his AOS/green card and social security, since his K-1 will be filed under the official surname? We planned to have him update his UK passport after we're married. I've read some of the name change posts, but have found them inconclusive. Your input is appreciated.

yes he got the letter saying nvc sent it to consulate

but they did not send it..that is an automated standard letter to give you your case #.
NVC revoked the noa2 approval and sent it back to uscis for reabjudication.

so i have no noa2. i have nothing. nada zip zero. i'm back to square one. the noa2 he got in the mail is not longer valid either apparently. now we have to wait for a letter from uscis and start all over again.

I called NVC today and my case was sent out to the consulate. Yours should be the same way kimbear.
I asked them about the necessity of K1 visa's going to the NVC and her response was that they do not handle
any paperwork for I-129f applications. The reason our K1's go to the NVC is just so they can enter the information into the
computer to switch the case number. Thats it. They do this so they can communicate case information to and from the consulate.
They send an electronic copy, and then send it DHL which she said takes no longer than 5 business days.

Hope that helps some. And to the rest of you who have yet to receive your NOA2 yet, hang in there.
Should be a bit of good news knowing that once that is done you only need a week or less at the NVC.


OMFG i'm totally freaking right now...

i called NVC and they sent back my petition to USCIS..####### wtf #######...and they gave me a phone number to call uscis from out of country and THE NUMBER DOES NOT EVEN WORK ITS DISCONNECTED!!!

we have a lawyer..and i just dont get this..nvc wouldn't tell me anything at all...i dont' even know what to think..i feel like i just got hit by a baseball bat..or car or soemething..

i just told david..he just got a letter saying it was forwarded to the consulate too from nvc..

how do people find out that their case has been touched? people seem to update that their case was touched on such and such date etc. i haven't seen any change on my online status, both the last updated date and all the info inside it are still the same since last four and half months.



Not everyone does get a touch. my case went over 4 months without one. some ppl have been married for a year and their case still says "pending" online. unfortunately their online system leaves something to be desired sad.gif

Binow..that is what they told me and jome. however they said specifically "fbi background check on us petitioner" and no there is nothing you can do to check that or look into it. however a week later i had my approval and a couple days after jome was told that he had his approval as well.

in our cases..i think it was a lie told to our congressman, cuz the one month it takes for the background check already happend or we would not have gotten the approval so fast after the inquiry. i think CSC is just giving that as a std reply to any govermental inquiries. the only thing you can do is ask your congressman /senator to keep checking up on it for you.

i wish you luck and hopefully you will get a touch / approval soon. i had 3 touches after my congressman contacted them. Good luck to you. i'll keep my fingers crossed.

I can confirm that Danu did get her noa2. Otherwise she would not have been able to have her medical a few days ago. Keep in mind..this forum thread is for California. you are in Vermont..and Vermont is behind in approvals. March is only getting started for you guys i believe. Hopefully you'll get yours soon too.

also not everyone has their online status updated..im lucky in that mine updated every single touch and approval at the end. but up until that point i was clueless.

Still "pending"....but it seems that a touch almost always leads to some type of action (even if it's an RFE) within a couple of days.

Whomever you send it off to will redirect it to the congressman in charge of the district where you live. Only they can help you. That is what happend to me. as my town is overlapped by two districts.

Vegabond: i think it's in the FAQ for k1. what the usc has to send etc. bascially i134 filled out, for usc and co sponsor if necesary, letter from work for the usc staing job title gross earnings how long you have worked there and in what capacity. also, tax transcripts w2's for last 3 years (not sure if is necessary for k1 but hey why not) and a letter from bank with total deposits for the last year with current balance.

complte original copy of entier 129f pkg, copy of noa2, proof of ongoing relationship, and i guess anything specific to the ukraine.

Gary&Alla have very good info for that area so you might wanna post in the regional forum and check with him he has some contacts there too from what i have read.

Mariposa: Don't worry i'm sure yours is comming soon! I am keeping my fingers crossed for you and giving you good vibes!! who knows..CSC is getting a lot of congressional inquiries from us marchies..maybe they will dedicate someone to getting the rest of you approved !!!

I just got off the phone with the congressional aide who was told that our file has been in background check since June and that it would take up to 90 days.
Personally, I think the "background check" line is kind of like their "5 months" line....it's their standard response, with the key difference being that a congressional contact usually generates some actual movement on the case in addition to the line of BS. On a side note, she suggested while stopping just short of recommending that, as long as she's here, we could get married and file for AOS and that, as long as she didn't over-stay her visa in the process, the only repercussion would be possible difficulty in getting travel visas for her family to visit here. (She specifically said it's not a deportable offense.) That's not my understanding based on the information I've seen here, and after all of this waiting, I'm not really inclined to test her assertion.

I'll be watching my inbox even more intently over the course of the next couple of days to see if we get that magical touch.

Will definitely keep you all updated so those still waiting know how big a grain of salt to take with the mis-information spouted by USCIS. Today has been a low point in terms of faith and patience, especially on Ingrith's end, so please keep us in your thoughts, prayers, whatever.

I'm a little disappointed, I'm 10 days close to the 5 month mark and nothing yet. I'm definitely looking into contacting the congressman. How did you guys do it? Phone, email, letter? Should I wait for the 5 months or should I go ahead and contact them now?

Also, my fiance is military and has moved around the US and overseas a lot, so that's why this probably takes so long... Do you think calling the Military help line would help more than inquiring at USCIS?


definately try and call your military line..maybe they can do somthing, if not call your congressman. it does seem to work as it has for both me and jome. do not wait for 5 months..figure it takes a couple days for the congressmant to contact uscis and then a week minimum for them to get back to the congressman..so thats two weeks right there..by then it will be 5 months.

we went to the website, printed out the authorization form filled it in and faxed it back.

ya it is a funny thing...like mine..was never touched til the senator inquired..then they force fed me to the fbi check so they coudl say that 'something" was being done to my case and it wasn't forgotten or lost..which was my biggest worry..i just hope this means we both get some good news this week!!!

i do not want to be alone for a 2nd Christmas sad.gif it almost killed me last time. bad enough our anniversary is sept 6th..and we can't see each other. crying.gif

The Senator was extremely kind and said he would do everything he could to help and keep following the case, but USCIS doesn't give a sh!t.

F... this process.

Im considering canning the whole thing and leaving.
Its bullshit that people can come illegally tomorrow, but try to do the right thing, and wait a year.

oww...that is complete utter BS..thats more or less what we are going through..but we didn't get that much detailed info from the congressman sad.gif just that our case was in FBI..i'm guessing our two touches on july 31, was cuz of congress calling and making them pull file off of dusty shelf, and 2nd was to give to fbi.

blurgh.ya we were sposed to get married in january 09..but we didn't knwo about visa process back then..now i wish we had of sad.gif

on a brighter note..i got another touch today..i can only hope this means we are out of fbi check...now i'm j ust waiting for more bad news..in the form of an RFE, or denial or something else..sad.gif i just have this gut feeling..blurgh!

no sad.gif and congressmen said nothing more he can do til we are past the 5 months mark for sure. at least he was able to tell us about the fbi check..ugh. this is rediculous. either approve me or deny me already but give me some deicision so i can get on with my bloody life...

give it about a week then call nvc they should have your file by then. usually you'll get a packet 3 letter / checklist in the mail or the bene will.

blurgh ok update..congressman got back to David..( wow that was fast..in less than a week)

He is stuck in an FBI background check..and they can't tell us how long it will take....

looks like i definately will not be making it home for christmas crying.gif

Oh hey...i got another touch today...hmm wonder what that could be. Still not getting my hopes up...seems due my usc's address change, our inquiry was forwarded to a diff congressman..ya...i just searched him online..doesn't look promising...

At least it's FRIDAY!.

My senator's assistant just called my father yesterday asking where my request was to push the USCIS along. If you have a congressman willing to help you with your application I would highly recommend doing it. Vindictive backlash is completely unreasonable. Remember, they work for us. In my opinion, it would get someone to locate the application at least and maybe even push it through a little. The only reason I didnt do it sooner was because of the 5 month mark, but remember, that mark is to have the petition completed by then.

No harm trying to find out, through a gov't offical, if its close or not.

To clarify.....I did contact my Senator and they were more than happy to check for me.


david already contacted the senator in chicago...we got the std response....although my case was updated with a touch. but it still says pending.

yep..david called nvc 3 times so far...funny thing was they told him a month ago it would be "this week the approval based on the other apps they got from CSC". He finally got to speak to a supervisor yesterday. that was useless. and he got the letter from his congressman saying they are looking into it and would get back to us with no time limit. checked today expecting to at least see a touch after all that..and nothing. he asked if there was an rfe..some sort of ap and they just said no your pending your pending your pending..each person said word for word exactly the same thing. like they were reading off a book.

we have a lawyer ( ya i know wasn't my choice..grr) and the congressman was already asked...and i think uscis lost our paperwork but just won't give anythign to anyone in writing stating that...and no matter what options david chooses he gets bounced from real people to the automated machien so he cna't even ask if we are in some sort of ap. sad.gif
