Not true at all. They will cash the checks soon after they receive them, but they may not actually look at your case for days, weeks, even months. When they do look through your paperwork they may find something insufficient or missing and will then issue an RFE. Our checks were cashed about a week after sending paperwork and we got an RFE two months after asking for more information.

Fresh question
I didn't want to create a new post for this since it's in the subject of the post anyway.

So I am currently living in the US with my boyfriend under a B2 visa (I just got my extension today :dance: ). We are working on getting all the K1 papers together.
So far as proof of ongoing relationship/having met in the past 2 years I have: 4 photos, itinerary from my last 2 trips here: dec 05 and august 06 and our trip to Hawaii for Christmas(+my boarding pass and his luggage sticker for Hawaii).
A copy of both our driving licenses with the same address when we were together during my internship in spring-summer 05.
A copy of my visa extension and a copy of proof of him living here (same address).
There is also my passeport stamps from my visits to the US in summer 04, march 05, dec 05 and August 06.

I feel that it is enough, especially since we both live together right now and can prove it. But I'm wondering if I should be adding copies of snail mail, emails and/or phone bills from previous years when we were on long distance.

What do you think? Is there enough proof since we currently live together? Or do I need to proof there was a relationship all the way back to 2004?

I think that should be enough. I never sent e-mails, mail, or phone bill records with my K-1. Basically you need to prove that you've met in the last two years (which all those documents will prove) and perhaps each of you have a signed statement explaining your intentions (marriage). The e-mails, mail and phone records may come in handy when you have your interview (but you should save the ones between filing for K-1 and having your interview.)

Just make sure your boarding passes have dates on them! I got an RFE because the boarding passes I had kept didn't have the year on them.

Put as much information as you know (what country they were born in, year date if you have it...the aunt should roughly know when her brother/sister was born, shouldn't she?) but also include an explanation either on the cover page or a page immediately following the biographic info sheets stating the circumstances. Perhaps give her aunt's information as well as she was her legal guardian.

I explained the situation well and gave precise dates for meetings, etc. but they felt it wasn't enough. Obviously this is your decision and if you'd like to go by what other people say, just write it in the box. However, if I had known there was a chance the process would be delayed because they want more information than you can fit in that tiny box, I would have taken the extra 2 minutes to type it out on its own sheet. Giving them more information and being proactive can save you some time and effort in the end.

It's really up to you.

Read the guide for specific requirements, but remember:

NEVER use staples...staples are such a pain the butt (I receive thousands of applications a year for my job and curse the people who use staples)
Don't use too many clips or anything...they'll likely put it in the order they like it in.
Tabs are a good way to separate parts of your application and supporting materials.
ABSOLUTELY include an index in front as well as a cover letter (they can be one in the same) and make sure all your documents are in the order you state in your index.

You know what I had the same problem. What I did I printed all 4 Forms out and filled em out with a fine Pen. It is just a pain doing that cos you have to really fill in all 4 with a pen and you get tired after the first two lol.

I would print them out and try to fill em in with my handwriting,if you do it that way use a black pen!!!


I had to do the same thing. Every time I would go in to type the date, it would cut it off with the little + sign, so I very clearly wrote in all the dates by hand in black pen and made a little notation on my cover letter saying something like (please pardon the handwritten dates on the G-325A application - the form from the USCIS websit cut off part of the dates).

As far as pictures go... I figure I'd save my original pictures for the interview itself. I scanned all the pics I'm using or I had them on CD when developed. I just printed 6 photos on each sheet of paper with dates and text of what the picture was of below each one.


Ok good! You don't want to lose those originals because they might come in handy at the visa interview.

Everything looks good, though. Don't stress it too much. If they need more information (which I can't see happening), they'll let you know. It doesn't delay the process that much.

That should definitely suffice. Just make sure you have an index either as part of your cover letter or right after it to state exactly what is in your package and what order it is in (tabs help, too). Don't staple anything, make sure the pictures you're sending have dates and locations on the back (pictures really aren't necessary, though...they would be better used at the visa interview). Clip your check to the front of the packet.

I received an RFE for something else, but they asked for different passport photos (and clearly stated they must be 2" x 2") in addition to what they needed, so my husband took a picture and I photoshopped it to the correct size and printed wallet-sized photos and cropped them down with scissors. :P While I'm sure they'll accept your original photos (as many people have had no problems), that's another option. It's much cheaper, too!

We didn't send in one photo, nor did my huband take any to the visa interview. If you have evidence that you were in the same place at the same time that is dated factual evidence, that trumps pictures big time.

We had Eurostar tickets to prove we went to Paris together. That was way better than any photos we might have taken on our vacation.

Send copies of receipts that you were in the country. Boarding passes with dates. Put in some pictures of you together (that were taken within the last 2 years) and write the date and location on the back, but those alone will not be enough.

DO NOT STAPLE. It's a pain in the butt and they'll just have to remove them all anyway.

Either use the ACCO fasteners that everyone talks about (with two-hole punches on the top of all papers) or use binder clips. Staples are never a good idea when dealing with important documents.

You may also want to insert tabs to separate the important pieces, with a directory in the cover letter. You should have an index of all the material included regardless of how you fasten/organize.

It's really not up to the Embassy right now. They are waiting for documentation so they can schedule his interview.

My husband comes from London as well and he got held up with the police check. He actually received it very early, but he had to move out of his apartment (lease was up and obviously didn't want to renew because he was moving here) and the police check was never forwarded to him. He sat waiting and waiting for it, then finally went to the police station, explained the circumstances and even though they said they couldn't do anything, he got a new one about a week later.

Have your fiance talk to the police station where he orginally sent his request. While it's still in the acceptable time frame, perhaps if he explains the urgency of the request they can speed it along. Then when the Embassy receives it (are you sending it to them or does the police station?), you can explain that you need an interview as soon as possible. My husband did the same and got an interview less than 2 weeks after receiving his police check.

Also - DO NOT GET THE MARRIAGE LICENSE UNTIL HE MOVES HERE. Even if you don't sign it, they sometimes expire and you have to go through it again. Have your wedding...make it a big to-do. If your fiance has to go back and wait for his interview, so be it. At least you'll have the wedding over and when he moves here you can get the official document and start the AOS process. Don't fret...it will work out either way and I'm sure you'll get your interview in time.

I moved shortly after we received NOA2 and before he got his Embassy interview date. I didn't fill in any special form with USCIS, just put in a signed statement with the documents I sent to support his interview (the affidavit of support) to notify them that my address had changed. Then when we filed for AOS, we used the new address.

Now, I'm not saying that's the correct way to go about it because there may be a certain process, but I believe that it's more important for the beneficiary to notify them of a change of address formally (through forms) than the petitioner. Here's what USCIS says:

So, basically because your petition has been approved (is not pending any longer) and you are the USC, I don't think you need to inform USCIS. If you wanted to be safe, you can do a change of address online easily enough.

Nope. We sent our signed statements and proof that we've met in the last two years. I don't think my husband was ever asked for proof of an on-going relationship at the interview (he had a signed statement by me that I still intended on marrying him).

While it wouldn't hurt you to have clear and understandable evidence that it is a real relationship, it's just filler. They aren't going to pay much attention to it...it's just extra paper they have to two-hole punch and put in your file. Only when they request it is it necessary to give them secondary evidence (photos, chat logs, phone bills, etc.).

Read the guides, but remember that PRIMARY evidence of having met is of the utmost importance. Primary evidence includes:

- copies passport stamps to each other's countries
- copies of airline itineraries (with names and dates - especially year!)
- copies of boarding passes (with names and dates - especially year!)

These are definitely the most important information that you will send to them to prove that you have been to his town or that he has been to yours.

Less important is secondary evidence such as photos, though it is a good idea to send a few to show that you've been in the same place together. If you do send photos, don't send dozens because they don't need to see that many. Also make sure that you have the date printed on your photos (if your camera does not allow this, write the date and place on the back of the photo. Other smart VJers have bought a newspaper from that date and held it up in their photo to show the date.)

Even less important are e-mails, phone logs, chat logs. These are filler and unless you have very little primary evidence, they will not add to your case or make it be processed any faster. The more paperwork they have to go through, the longer it takes. Photos and other secondary evidence are more useful at your visa interview.

Good luck! Use the guide religiously because it will be your key to a speedier K1 process.

We had this same problem. The first time we sent in passport photos, I cut down the UK size to almost match the 2x2 size. The second time (during AOS), we took his picture with our digital camera, shrunk them down to 2x2 size and put 6 of them on a 4x6 size document and printed the sheet at Walgreens. This cost us about 40 cents as opposed to $20+ for 4 passport photos.

Your fiance(e) could do this if you have a digital photo, know the photo requirements (which can be found here: http://travel.state....ition_874.html) and you can shrink them down in MS Paint or Photoshop. Then all s/he needs to do is go to Walgreens or anywhere else that has a print your own photos booth and print it like it's a 4x6 photo. There's no rule that these photos cannot be taken by yourself as long as they meet the requirements.

There were a couple times when we were upset and weren't as bubbly on the phone or write essay-long e-mails, but we were really good to each other throughout. You realize that it's a long and stressful process and you have to work on other things in the meantime to keep your mind off it.

I think this whole visa thing is the ultimate test of a relationship. During this whole thing we've stuck by each other, not arguing or anything and it just shows that certain people are truly meant to be. I'm lucky to have such a level-headed husband!

That is incorrect. AOS stands for Adjustment of Status. This happens when a non-USC comes to the United States on a visa (in most of our cases K1 or K3) and files to adjust their status to a permanent resident.

I-134 is simply an affidavit of support that the US citizen files to show they can support the intending immigrant. This is sent to the embassy for the interview.

Not sure about the language barriers. I would assume that his interview for K1 would be in portugese since the embassy is in Portugal, but he may want to start practicing English if he's going to be moving here.

This doesn't mean you'll be put through in 3 months...it could take longer due to name checks or if they get swamped with applications all of a sudden.

Keep in mind that the visa is valid for 6 months after issuance, so you can move here any time in that 6 months. In the meantime, it might not hurt to start gathering evidence and filling in forms. If you're not going to file until after your vacation, save evidence from that to show you traveled together.

CSC is swamped with all kinds of visa applications right now and seems to be having a massive slow-down. You'll likely get a notification of your receipt (NOA1) in the next couple weeks. It just takes a while for them to acknowledge it.

There are specific forms you fill out, supporting evidence that you give them and passport photos you need to send. Everything is straight-forward, and unless you have specific concerns (like overstays, felonies, etc.) you should be able to handle it yourself. It's overwhelming when looking at everything in the big picture, but if you break it down piece by piece, it's not that bad.

Likewise, if you get confused by forms or don't feel completely confident in doing this process yourself, seek advice of an immigration lawyer. They will cost you, but they will help.

There's nothing wrong with getting the initial planning done while you're waiting for your visa, just don't book anything or lock yourself into a date because, believe me, it will not happen on the date you plan. We filed for K1 in June thinking it would be approved lickity-split. :lol: Yeah...

What I did between NOA1 and when he arrived was talk with him about exactly what type of ceremony we wanted...how many people, where to have the ceremony, where to have the reception, and worked out all the logistics. I made many lists of things we had to do once he came to the US as well as how much it would all cost (so we know how much we have to save up before then). We looked at restaurants' menus online together, ruled out a lot of places, and did a lot of preliminary research that anyone getting married has to do.

There's no problem in doing that as long as you don't get so in love with a certain date because you have no idea when your fiance(e) may be here.

If he leaves before getting approval for Advanced Parole (AP), he will NOT be readmitted into the United States. Once he uses his K1 visa (which is a one-time only entry), he has to stay here until you adjust his status (since he will be adjusting status under the new fee system [after July 30th], the AOS package will include the Employment Authorization Document (EAD) and AP). AP takes up to 90 days to receive, so if you want to go to India shortly after marrying, you should get your marriage certificate and file for Adjustment of Status (AOS) immediately after he moves here. Expect to pay $1100.

3) Can you also explain the process of getting work permit..will he be able to work on K1 and then when we change status then how early work permit will be processed?

As a K1 visa holder, he is authorized to obtain a work permit. His K1 visa alone is not work permission. He can enter through only one Point of Entry (POE) to get a temporary work authorization: JFK. At this POE he may need to ask for the stamp as they don't always give them away automatically. Otherwise, like AP, he will need to apply for EAD as part of the new AOS package. EAD takes 80-90 days...usually closer to 90, so he will most likely be ineligible to work for a while (in between the K1/EAD stamp expiring and issuance of a new EAD).

4) how long will it take for greencard processing?

Varies wildly. Look at the timelines for an idea. http://www.visajourn...ne/aosstats.php It could be a few months if you're lucky. It could be a couple years if he's stuck in name checks.

5) Since he will be studying in uk can he appear in uk embassy for interview ? as he would have fulfilled 6months residency (unless its 1 yrs).

I think most online booking websites have itineraries that list the purchase history if you indeed booked the flight. I know Expedia does, and I've used Travelocity and printed the itinerary for business purposes. Combined with the passport stamp that has the same dates as the itinerary, it's fairly good evidence that you went to the country on that specific date. Of course a boarding pass with the date of travel is better, but if those have been lost, this is better than sending nothing.

You're right, though. Just printing off any old itinerary itself isn't going to be proof that you travelled to the country. You have to show that you actually purchased the trip and match it with your passport stamp to show that you went.

I submitted plane tickets for a holiday we had together to Croatia, plus a trip to Paris (Eurostar), my student visa (a HUGE flag that we were in the same city for years), etc, etc as I was living in London but I never thought NOT to submit pics since I had them...


They didn't ask for pictures, so we didn't think of it really. We thought the important part was giving them hard evidence that we've met. We had plenty of photos taken together, especially during my first visit there, but I never got them developed. Even if we had, we had no way of getting the date stamp on the photos to "prove" they were taken within the last two years.

Ultimately, we didn't send them because we didn't think they were important since the instructions never said "send photos", not because we were trying to squeak by with the minimal amount of information. In sending AOS, we didn't send photos because it seemed pointless and only necessary for the interview (which it appears we will not have).

I also want to point out that I don't want to discourage anyone from sending photos. I think it's nice to show you both in the same place together and gives it a more personal feeling. You have to make sure the date stamp is turned on and that you don't overload them with photos. They don't want to see 20 photos of the two of you.

Similarly, it's the primary evidence that is the most important and what you should really, really beef up. It won't hurt you to have 20 pages of primary evidence, and will only make your case stronger. When we originally sent our petition, we got an RFE because we didn't realize the boarding passes we sent didn't have the year on them. Duh...silly error on my part. When we sent back the RFE we sent them 20+ pages of primary evidence...all different kinds. If you're stressing about the evidence to send them, stress about this, not about pictures.
