Aussiewench ,I am not sure if I know what you mean by that my petition did not reach the processing date. If you see my timeline you will see that I am at 55 days and in NOA1 it said it will take from 30 to 45 days , I know that this is not always true but I need to know what is going on ,I need some info ,and if there are problems would like to know what kind and what I can do to fix them . I was patient so far but can not take it any more :help:

No, nothing like that... I received a packet containing the 864... affidavit of support, and about 4 sheets
of instructions on what is needed to prove you can support finace... along with an income schedule, which is when I realized I haven't made enough money. Haven't even filed K1 yet. Was getting close to having everything ready until this info came to light.

PS, HA!!! Thanks for the suggestion, but, I waited 7 years to get the hell out of the snow of NY... I will not be relocating to Penn anytime soon, no matter WHAT the salary. Judging by this info I've received, seems as though it wouldn't matter much anyway... I've had a bad FEW years, not just last year. Which makes me wonder, if I were magically offered a six figure salary tomorrow, would that suffice? Why are they asking for 3 years worth of income?


More importantly, what are his chances of self sponsoring? I can't seem to find anywhere on the site that show what he would need to do this. This seems to be our only hope. :(


Well, before you start freaking out about how you can't be with your fiance, do a little more research on this. You haven't even filed the K1 yet, don't over-worry about what MIGHT happen or what COULD happen. Do your best to find a co-sponsor (parents, aunts, uncles, brothers, sisters, friends) and in the meantime get a job. You can't support someone on a babysitting wage and there's a likelyhood you may have to support him for a while until he finds work there.

If you can't find a job that pays above the poverty line then maybe you should reconsider your relationship. Priority number 1 is always food,rent, utilities, etc... survival type things.

How have you been living off of 7K a year? Do you live with your family? If so, why won't they cosponsor?

I'm sure you don't want to see my timeline but VSC was very quick with our petition. Do you have divorces on either side or does your fiance have children?

It's possible you or your benificiary's name was a "hit" on the security check and they have to analyze your case more thoroughly than others. I'd just call the National Service Center again (you probably didn't talk to anyone in Vermont when you called the national call center and they only go by what's on their computer screen) and ask to speak to an immigration officer VERY nicely.

Do not piss these people off, they can easily "lose" your case if you touch them the wrong way.

Agreed... I think DCF would be the best choice in this instance. This would involve you getting married in China and filing the paperwork necessary to get the CR-1 visa in China, which will result in a GC at her entry to the US. A few questions...

1) Have you been filing US tax returns with the IRS. All US CItizens are required to report their worldwide income to the IRS.

2) What have you done to keep your domicile in the US. Do you still have a US Driver License, US Bank Accounts, etc. If you don't, you should take steps to reestablish your domicile during your next visit to the US.

3) Go to the DCF forum and ask some questions there. I believe that you'll have to file the I-130 in Guangzhou as this is the only consulate in China that has an Immigrant Visa unit. The CR1 visa interview will definitely be held there, but you may be able to file the I-130 at a more local consulate.



Just to clarify a couple of things:


1) You only need to report your income if you're making over a specific amount for your "household". If you're single and you make less than 8200$ you don't need to file or report anything to the IRS.

2) You only need to have a domicile when you file for AOS after your fiance enters.

And the K1 was created primarily for expats and military members living overseas, NOT just online/mail relationships.

I imagine so yes. As the Conof is rewiewing not only evidence and documents submitted at the interview but also documents and evidence that has been forwarded to the embassy. As you say, there are members who have been denied in what seems to be circumstances where they were not even asked to submit further evidence that they had on hand. That their mind had already been made up. I find it interesting on reading the link provided below when it comes to what a Conof cannot do, yet they appear to do just that.

provide the petitioner notice of intent to revoke, and to allow
the petitioner an opportunity to rebut the grounds for

I think i've already got all the documents ready. but i still have some questions about the i-134 supporting documents.

My fiance has mailed me the bank letter, employment letter and his stocks information to me. Is that enough? Do we also need his tax return? Do i also need anything my employer letter/tax return in HK?

You should treat the I-134 as if it were the I-864 which you will need anyway when you do your AOS. Search the site for the I-864, this form actually does request 3 years of tax returns. You will only need a letter if you're the foreign (to US) fiance and you plan on self-sponsoring, although I don't see how it would hurt to show especially if you have substantial assets.

It should depend on the reason for the denial. I have seen people being denied for K1 because of the CO's unwillingness to accept a co-sponser. In that case they have gotten married then applied for K3/Cr1. I think you half to be married to apply for K3. Hmmm someone correct me if I'm wrong. We did Cr1 and K3. Cr1 was fastest in our case.

Don't come over using your japan citizenship and then get married. You will probably be sent home and possibly even barred from the country for a time.

The K-1 process doesn't take that long in comparison to a spousal visa. The spouse visa could end up taking a long time. That's why we are using the K-1, we don't feel like waiting around here for possibly another year as I am living in Thailand with her.

Where are you hearing these things? I'm always surprised when I see things like this. The federal law clearly allows for a co-sponsor if the sponsor doesn't qualify financially. Search on the internet for more info.

I have a question...............will they have the photos I submitted for the k-1 at the interview? I made copies of all the photos I just didn't want to bring the same ones if they are already going to be looking at them. I had planned on bringing them as well as ones I did not submit anyway. I am just curious


I didn't see the photos we submitted with the I-129F at the desk of the interviewer. She had our file in front of her and I didn't see any pictures. Luckily we have digitals and we just had more printed before we went in case we needed them.

uhhh... maybe in the phillipines they'll ask you alot of questions like this but in most embassy's it's just a few simple questions.

They asked us:

1) How long I'd lived overseas with my fiancee
2) How we met
3) What degrees we had (probably for I-134 reasons)
4) What we wanted to do when we got to the US
5) She held up our pictures one by one (maybe 5 total) and asked us where they were and approximate timeframes

They were very friendly and it lasted a total of 5 minutes. The 4 hour wait for the interview was excruciating though, but the interview was a piece of cake..

It only needs to be "certified" at the georgian embassy is if YOU live overseas. Technically, they don't notarize it there at the embassy, they "certify" it with a special DOS embassy stamp.

How do I know this? Because I live in thailand and just went through the process. If you live in the US, you CAN have an immigration official certify it as well as have it notarized. The easiest thing to do is have it notarized at a bank since you live in the US.

I used my brother as a cosponsor just in case I needed it (I live and work overseas), and he chose "do not intend" to make specific contributions.

For my I-134 I checked "I do intend" and then wrote in "whatever my fiancee needs for basic subsistence"

We had no problems in the process and the I-134 was never brought up or asked about.

My US fiance had to have major surgery twice last year, the bill was way over $100,000, he had no health insurance and had no money to pay. It was payed by a charity I think, not sure of the details. Does this mean he was a public charge and will this go against me getting a K1 visa??? We have many things going against us I am afraid and this is just another I have thought of. We are already on day 112 waiting for NOA2. No nothing from USCIS.
Both of us have had nothing but heartache in our love loves, I guess no real love at all really, and to now find it but not be allowed to be together does seem to be a real possibilty to me with our case. I just can't stay positive any longer and I do hope my fiance does not read this, I am only pretending to be positive for him now.

This shouldn't affect your application because the public charge provision applies to the non-USC fiance and not the USC. If the bill was paid, why would you be worried?

Does he earn enough to make 125% of the poverty line? If not, he'll need a cosponsor. Make sure you prepare for that.
