Robert,

Interesting issue.

I see the instruction you cite in the consulate in Bangkok's instructions for immigrant visas and note that - except in DCF cases, which are rare in Thailand - DS-230 is submitted to the NVC in the case of immigrant visas, not the consulate, and the NVC's instructions are to sign Part I but not sign Part II.

In the consulate's instructions for K-visa applicants, which are included in the visa application packet but are not provided on the consulate's web pages, it says to complete and return DS-230-I but makes no specific mention of whether or not it is to be signed. It does specifically say that the checklist certification is to be returned signed, and it also specifically says that the other application forms are to be brought to the interview un-signed. But there is no instruction about signing or not signing DS-230-I.

My wife sent her DS-230-I signed.

Yodrak

Mike,

Where have you seen or heard that DS-230-I is to be sent un-signed?

Yodrak

Is leaving the DS-230 Part 1 unsigned something new? Does it make sense to you people?

Mike

YES, leaving the DS-230 Part I unsigned makes VERY good sense, since the Instrustions for Immigrant Visa Applicants clearly states "Application for Immigrant Visa: The beneficiary should complete part 1 of form DS-230. Please do no sign this form."

Robert

I'm not sure exactly what the requirement is, I was under the impression for some reason (maybe I read somewhere but don't remember where) that it should be unsigned. We submitted ours unsigned and had no problems scheduling the interview.

The walk-in allowance has been stopped, we had a friend drop our checklist off in person but was only allowed to submit the documents after a thorough chewing out by the staff at window 5 (not sure who it was). Luckily my friend is an american lawyer (but not immigration attny) and they let her submit probably because of that. The new procedures are to mail in the checklist and other forms...

As for Su and her interview we also had a successful interview. We were approved for the visa but still need a clarence letter from the Dr. It will take a little more time but hey we were approved.

Congratulations on the approval. Can I ask you what the deal was with the doctor's clearance letter? C is getting her medical on friday here in Chiang Mai, what letter are you talking about?

Thanks and congratulations again...

Ken,

I was not able to make an attachment to this website but I did find that statement from the amphur. It's just a statement that states her name , that she is the daughter of (her father's name) residing at (her address) and that she presently has never registered her marriage with anyone at registration Office of her district (amphur).

As Yodrak has mentioned the person must have someone go with her... my wife did have her father come along and he too had to sign some papers . And the document does have that Royal Thai Emblem 9the garunda?) on the top. With official's stamp and signature on the bottom.

Like I said earlier, we had it during the interview but was never asked for it!

regards,

George

PS: she had to show Thai ID and house registration documents

Ahh...thank you very much everyone for the info. C and I will go to the amphur office together this week and get the statement. Surprisingly, when I asked C about it she knew what I was talking about and had had a friend who moved to the US need the same document when she got overseas but said she didn't need it for the visa itself.

She pretty much confirmed exactly what you're saying, that we'll need to take the house registration and her ID. She said it's a free document given by the amphur. How's that for service, try getting a free document in the states!

Ken,

I am not sure, but I think that the other person has to be C's relative? ( I hope someone here can verify) , please let us know if she was able to get the document with just yourself and her. Or perhaps she can call the amphur to find out if a family member has to accompany her?

Well Good luck with the process and on the upcoming interview!

George

Thanks, we'll definitely keep everyone updated on everything. Now it's just the countdown to the interview. C is getting her medical, birth cert (and translation), and single "statement" all this week...

We're now just preparing for the exit out of the country. Booked a ticket for april 7th to JFK (to get EAD stamp) on Kuwait Airways for 500$ each w/ tax. We'll be driving to DC metro area where my family lives and we'll living in that area...

Looking forward to my return to the US.. :D

VISA APPROVED, YAHOO!

Congratulations! B)

As far as I know the Immigration Visa (IV) unit at the embassy will not take any phone calls. The operator will forward you to their voice message system which will tell you just that. You have to email them to get a response and sometimes that doesn't even work. If you are in bangkok, they will accept walk-in's from 1-3pm mon-fri except for the last friday of the month (learned that the hard way).

The pin system, as far as I understand and know, is only for NON-immigrant visas. K-1's are non-immigrant visas but are processed by the Immigrant Visa unit and are generally considered immigrant visas. I don't believe (but don't quote me) that paying for a pin and trying to access your case info will help for an immigrant visa case.

Email them if NVC has already sent your case to them, which according to your timeline they have. Their email is visasbkk@state.gov

Have they scheduled an interview for you? How have you been communicating with them in the past?

Don't waste your money on that automated system for a K1 visa. Like I said, I believe that's only for NON-immigrant visas (tourist, business, etc).

Has anyone tried contacting the embassy in Bangkok since they've set up the new visa system? I know they've got that 800 number but I've never gotten through. There used to be a regular number where you can call and find out whether your case has arrived or not. Does anyone know that number? I can't find it on the website and the general operator person that I've gotten through to doesn't speak any English. She keeps hanging up on me. I know they've got the new login system where you have to pay to get a pin number and get access to visa information. Is this really the case? We have to sign up and pay now if we just want to talk to a live person?! Someone please let me know. Thanks.

So your current wife went to the local amphur and got a statement. Do you remember what this statement is called in thai? Also, what office for the amphur did you go to? I believe there's a records office near my fiance's parent's mooban that might give out these types of certificates but I'm not sure.

Thanks for your help..

me,

All forms from packet 3 on what web site? This one has some of the packet 3 material that is not on the embassy web site
< http://web.archive.o...003/catalog.htm >

With regard to Krabi, you may be having a big wedding but you are not getting married. It's an important distinction to make when a K1 visa is involved. Scratch the word 'marriage' and its derivatives from your vocabulary until after you are back in the USA and really have gotten married. And for heaven's sake, no wedding rings going through the POE.

Yodrak

Remember I told you guys that the lady in window 5 would not give my fiance, Wi, packet 3? It turns out that she did take Wi's DS230 part1 form, a copy of her passport and two passport size photos that day. She still has not recieved a copy of packet 3 in the mail from the embassy, but oddly enough, she did recieve a letter confirming an interview date! March 17th, 2006 !

Can we do this without receiving packet 3 from embassy?

Is this a new way?

I have downloaded the checklist and all forms for packet 3 that are posted on the web site. I have sent her my I-134 form along with all required documents and letters. We have paid the 4000 baht at the post office and recieved the police information. All she needs is her doctors visit.

Has anyone had this happen to them?

Our one year anniversery is March 25th 2006, and we have made huge wedding plans to get married in Krabi on that day. With or without visa! ,,,,,To get an interview date one week before our wedding is truly fantastic!!!

Yodrak,

Have you heard of a "single certificate" that must be provided in the interview? I'm reading from that link you posted and he's got something called:
"Single Certificate (Official Document Certifying Marriage Status For The Fiancé(e)) " on the site but says he doesn't know where to get it.

Has anyone had to provide this or does anyone know if it might be asked for?

I've read other's experiences that there are times when the CO will ask for the applicant to get a statement /document from the local amphur stating she is single and/or has not registered a marriage.

I am not sure what will provoke the CO to request such a document, perhaps what Yodrak mentioned (quoted below) may provoke such requests.

Something of that nature may be required of someone who is foolish enough to let it be known they've had a Thai wedding ceremony and someone such as a US consular official or USCIS officer wants to be sure that they're not married.

Having read what others have gone thru and as a precaution....I had my wife (when she still in the K-1 process) I had her go to her local amphur and get such a statement.

But at the interview, it was never asked for.....hope this helps.

regards,

George

:D Hello All,

I just wanted to report a successful interview in Bangkok on February 2. :D
Today Meaw and I went to the embassy at 3:00pm and picked up her passport and K-1 visa along with the sealed envelope for US immigration. The interview was a piece of cake. The consular officer's name is Thomas, he was very nice. He asked Meaw only 2 questions: 1)How many times has your fiance come to visit you?, and 2)Where did you meet your fiance? The whole thing took about 2 minutes. The funny part came when he took Meaw's fingerprints. He asked Meaw to place the index finger of her right hand on the fingerprint thingy, no problem. Then he asked for her to do the left index finger. So, Meaw, not being familiar with the process put both her left and right index fingers on the thingy at the same time. After I stopped chuckling I explained that one at a time was what was needed.
On another subject, I don't think it behooves anyone to get to the embassy at 5 or 6 am in the morning. Unless you want to get up really early and spend more time hanging out on Wireless Road. They didn't let anyone in until 7:30am. The order in which you turn in your package in at window 5 does not dictate the interview order, it was completely random. The woman in front of us got lucky and just happened to be the first interview that day. Our interview was the eighth one. Neither she or us was first to turn in our respective packages. They do 17 interviews a day, everyday. We went to the interview with the man who has been helping us throughout the process and is at the embassy several times each week. He says, Thomas(consular officer) does not even start the first interview until 9am. Sure enough, 9:05, first interview. We got to the embassy at about 7:00am, tuned in our package, had our interview and were out of there at 11:00am.
The embassy is no longer accepting walk-ins for interview dates. The forms and checklist must be mailed in and the embassy mails you the interview date. Kind of a bummer. I don't have incredible faith that they can get the mail where it is supposed to go all of the time. Case in point, Meaw now has her visa in hand and we are still waiting for her Packet 3! Good Luck to all.

:D Peace, Evan and Meaw

How did you get your medical without packet 3? We have all the packet 3 doc's from the embassy website but were told by the hospital (Ram I in Chiang Mai) that we needed some form from packet 3. We just assumed that it meant there was some other special form that we couldn't download. We haven't received the "packet 3" from the embassy yet but were told it would be sent within a week of them receiving our case from NVC.

So what's the deal with this special form? We're going to call a different hospital tomorrow and try to schedule an appointment without the form from packet 3.

The biggest problem here is..She is 29 yrs old and has never been on her own. She is used to sleeping with her mom by her side her entire life. She does not want to go home because of me, but because she misses her mom too much.

Dan

P.S. Where is the darn spell checker :crying:

I think you said it all right there, 29years old and never on her own with her mom by her side. This is ingrained in the Thai culture, both the women AND the men will live at home until they're married and then sometimes even after they're married they'll live with their family (especially if they're Chinese-thai).

Being with a Thai woman takes aloooot of work on both sides and having a phone relationship with you for 2 years only made it harder for her to leave her family. She still had all the emotional support from you but didn't have to deal with the realities of having you with her physically while still having her family relationship as well. She had the best of both worlds in her view and now she's away from what she's gotten so comfortable with.

Get her to use religon as a support mechanism. Bhuddism can help but it only tends to teach suppression of feeling and emotions. This is why Thai people don't talk, they're not supposed to "feel". Also, the educational system here is the reason Thai people have a hard time thinking out of the box. It's hard to get a thai person to even give you their honest opinion about anything because of this! If you're Christian, take her to church. If you're bhuddist but you're christian, take her to a temple to get the emotional support but introduce the idea of a God to her. These things will definitely help you both. It will help YOU be able to live with her and it'll help HER to cope with whatever she's going through mentally.

Thai women are so complex, but simple at the same time. Remember this, YOUR 100% effort is going to be different than HER 100% effort and act accordingly. You're the man of the house, love your wife/fiance as if she were you. You, being the man, are required to take the lead and sometimes (if not always) be more understanding than your wife.

Try TNT instead of DHL or FedEx. Much cheaper and same reliable service. I use it every time I ship TO the US and have had no problems...

http://www.tnt.com

It's an Australian company but has been doing express in and out of the US since 1983 and in Australia since 1946

From my earlier post... I can seem to see how to edit a post now.

How can I overnight to Thailand? If anyone has any ideas please let know.

Thanks

Dan, I'm really sorry to hear about your troubles but please don't give up. Convince her to stay. You both went through alot to get the visa and to get her there.

You sound pissed off, maybe you guys need a few hours to calm down. Give her some time alone and let her think, whatever you do don't push her or you'll only argue more. The clamming up routine is a standard thai response and only means that she doesn't know what to say and needs time to forget about whatever argument happened.

Thai women are like Thai food, hot and spicey! Give her time man, she'll turn around. The adjustment to marriage/engagement would be tough even if you were with her in Thailand. 2 weeks is not enough time to be homesick, it just sounds like an adjustment issue and she's completely out of what she's known her whole life.

DOn't give up man....be patient and she'll come around...

Not even 2 weeks yet and I am sendning Ton back home to bangkok. She is too home sick and I can't deal with that every day. I have tried to talk to her about it, but she doesn't talk, she just clams up. I don't think I will ever date anyone from a non-english speaking country again.

Thanks for the site with the interviews. Some of them are a little outdated (2000) but probably applicable just as well.

Great info about the vaccinations and getting a copy of the DS3025, will do that definitely..

Looking forward to the interview and coming back to the states. I think it'll be a culture shock for both C and I to be in the US. I've forgotten what it's like there almost..

Ken,

To add to what others have written about vaccinations, it will be much cheaper to get them done in Thailand than in the USA. Although you might be able to find a county health organization clinic that will give free vaccinations (did that for my stepson, since the school district requires more than immigration does). Rodjanaa had her vaccinations done in 2 visits a month a part so as to have everything completed.

Make sure to get a copy of DS-3025 from the clinic that she can submit with her I-485 - if all required vaccinations have been marked off as either given or medically inappropriate it may save you from having to get (and pay for) an I-693 vaccination supplement from a Civil Surgeon here in the USA.

What about the vaccinations? Those are not required until AOS in the us right? And was the birth certificate a photocopy or a certified copy? C doesn't have her original BC but we plan to get a certified copy tomorrow. Applied for the police certificate on friday, will do medical next week and are preparing the other doc's right now.... Check with a travel agent in brazil, the cheapest fares are almost always found outside of the US. As far as travelocity and expedia.com go I have never found a good deal on those sites. Yes, I was being a bit judgemental I admit. I'm sure the OP was having an off-day which accounts for the spelling errors. no biggie.

Rohypnol is commonly known as the "date rape" drug and is prescribed for "SEVERE" sleep disorders in countries outside the US. Anyone who has this in the US with only a few pills is probably not in much trouble unless they were caught using it to try to rape someone (which your fiance just had them in his glove box so he isn't intending much with them as far as you know).

You'll know alot more about his situation regarding jailtime or fines on Thursday, just give it time and try to relax about everything. Worrying accomplishes nothing.

K-1 Fiance(e) Visa Process & ProceduresLawyers are a waiste of time and money!
PLEEEEASE do NOT ever liken an attorney for a surgeon. A surgeon must study very difficult pre-med material in undergrad where a lawyer can major in gymnastics and still get into law school. Law school is just reading and evaluating, med school is much more difficult that law school by far! A lawyer is nowhere NEAR as competent as a surgeon...

That is why zyggy is correct for basic functions; like fill out forms, mailing documents, gathering information from their client, etc, they suck most of the time because this is not what they study for, that is their thinking. They just like the easy money part of it. Where they shine if they somewhat value their jobs is in courts, litigations, problem solving, etc. This is not right but it is how it is. No one is going to put time and effort that the actual people involve in it, unless you are paying six figures.

There are knowledgeable VJ members that can help you with almost every part of the process.

Good luck,

Peter Miami

I liken immigration attorneys to physicians or surgeons. Most are very well educated, most are well-informed, many are superb, but all are only as good as the information they receive and the time they afford each case. Some are overworked, some don't keep abreast of changes due to that or to not having a compelling need to keep abreast. For every 100 surgeons that save a life, there's one buffoon that leaves a pair of forceps inside a patient. It's just a fact of life and the demands of the profession, unfortunately. The best thing to do if engaging an attorney is to advise him/her right off the bat that you will be checking in and wanting to know what, why and how. It'll keep him/her on his feet and you'll feel like you have some control in the process.

If your fiance doesn't speak English, do like Peter Miami did and do two. One in English and one in his/her native language. NOT for the USCIS or DOS but for your fiance, so they understand everything they're signing. I don't think it's wise to just verbally explain a legal document and then ask them to sign it. I wouldn't sign a legal doc in another language I didn't understand! would you?

K-1 Fiance(e) Visa Process & ProceduresCSC Email Response
Jeezuz CSC is slow. It looks like according to the timelines that yours *should* be done by Feb 15th. That 60 day email is a form email and is basically meaningless. I wouldn't use that for setting dates or let it get you down.

Thanks JaylenBrit,

I am really hoping it is this end of the 60 days and not after. 60 days takes us well past the original estimation of 120 days.

I am really hoping that it comes through soon, it seems like forever!

Do you know if the embassy in London is backlogged at the moment?

Thanks,

Tom

K-1 Fiance(e) Visa Process & ProceduresRules for K1 visas
Follow this link for some great information regarding what Consul officers should look for in applications and why they may deny someone a K1. These are rules from HQ to US embassies and consulates worldwide...

K-1 Fiance(e) Visa Process & ProceduresUS Embassy in Bangkok
Also, the new rules only apply to the NON-immigrant visa processing unit from what I understand. K1's are always processed by the Immigration visa unit and as far as I know the procedure for IMMIGRANT visas are the same. K1 is technically non-immigrant but is processed as if it were an immigrant visa.

They'll send you instructions on their procedure when they get your case..

Did you file personal income taxes or only taxes for your business? You will need to report whatever Gross salary you're paying yourself for your income. But you can use assets and real estate to make up the difference if you fall short in actual income.

K-1 Fiance(e) Visa Process & ProceduresK1 visa denials?
Thanks for the great info... very useful. So we must make sure we're completely prepared at the interview otherwise we face possibly significant problems.

It seems that they will only flatly deny someone if it's a case of fraudelent submission or if the beneficiary was involved in some type of criminal behavior. The bargirl example reported here is a case of her own admission of being a bargirl, but I wonder what was on her police report. Seems decisions are solely at the discretion of the interviewing officer so you better be nice to them when you interview!

Ken,

As some imply, and rhouni points out directly, be careful with use of the word 'deny'. 'Not approved' does not necessarily mean denied, and 'not approved' can come in two types. One type is a rhouni mentions, the Consular Officer has uncovered information that indicates the petition should not have been approved, or that indicates the applicant may not be admissable, and further review needs to be done by the appropriate people to resolve the issue. The other type of 'not approved' is that a required piece of documentation is missing or for some reason inadequate. In this case the applicant is given time to remedy the deficiency. Sometimes the deficiency may be on the part of the US government, such as an incomplete security check that must be completed before the visa can be issued.

My wife had an 'inadequate documentation' situation, the wife of a friend of mine had an 'incomplete name check' situation, in both cases issuance of the visas was delayed about 3 weeks from the day of the interview. These cases were in Bangkok.

I'm aware of 1 instance of a true denial in Bangkok that took place several years ago and I believe I read about it here on VJ. Petitioner's story was that his fiancee lived in an area of Bangkok that was a popular residence area with the bargirls. Applicant was taken to a back room for a more intense interview than normal, and under pressure apparently admitted to being a bargirl herself although according to petitioner she was not. Visa denied, never heard what if anything transpired afterwards.

I'm aware of another 'back-room' interview in Bangkok a few years ago, where K1 applicant and her K2 son were interviewed under pressure, separately, to confirm that they were in fact mother and son. (The consulate had recently been 'burned' by three unrelated people posing as a family to get B2 visas, using a Thai boy they had 'bought' from the boy's parents for the purpose.) The mother and son K-visa applicants 'passed' the interviews and were given their visas without delay.

Last year there was a case of a denial in Romania, I think? On the basis that the relationship was not bona fide but rather was entered into by the visa applicant for the sole purpose of getting himself into the USA. Petitioner then married applicant and I believe they started over on that basis. Haven't read any posts from Jaci in quite a while now, maybe someone else knows how that situation is going and can provide an update.

Yodrak

Has anyone on VJ been denied a K1 visa after the interview? Can you give us your experience so we can learn from it? After you were denied, did they give you an opportunity to fix it (i.e. get additional doc's, forms, etc) or were you flat out denied and had to start over?

If it's not you but someone you know, can you please post the info here? All of us who are in the process could benefit from this.

Thanks!

K-1 Fiance(e) Visa Process & ProceduresK1 visa denials?
Thanks for the link aussiewench, great info. Hopefully we can find posters who are willing to share their experiences. Seems that K1 visa denials for VJ posters, is pretty rare. But I'm sure there are many cases out there.

Can anyone share?

I dont have an experience but below is a link to 'GUIDELINES AND CHANGES FOR RETURNING DHS / BCIS
FOR APPROVED IV AND NIV PETITIONS'. It may help in understanding what happens under those circumstances.

K-1 Fiance(e) Visa Process & ProceduresHow can i prove ongoing relationship ?
I currently live with my fiance in Thailand also. We used emails, pictures and plane boarding passes to prove our relationship was real and had no problems with the VSC.

I wouldn't worry about it, you have the same address, that's pretty solid info that you've met if you know what i mean...

K-1 Fiance(e) Visa Process & Procedureschanging addresses during process of filing for K1
We did an overseas change of address while our application was at the VSC and had no problems. I used an e-fax website and they confirmed through the mail that they changed our address overseas. Not too much of a problem...

K-1 Fiance(e) Visa Process & ProceduresKept in Darkness !!
Not the National Visa Center, the National SERVICE center. They're the call center for all the regional service centers. Their phone number is: 1 (800) 375-5283

Call them and tell them it's been 2 months since you shipped it. Tell them all the details and they will help you. Ask to be transferred to an immigration officer VERY nicely.

Hello ,

I did not call National Visa Center ,because I thought that I need to receive NOA2 before calling NVC,but if they can help I WILL CALL THEM. Can you or anyone provide me their phone number ??

Aussiewench ,I am not sure if I know what you mean by that my petition did not reach the processing date. If you see my timeline you will see that I am at 55 days and in NOA1 it said it will take from 30 to 45 days , I know that this is not always true but I need to know what is going on ,I need some info ,and if there are problems would like to know what kind and what I can do to fix them . I was patient so far but can not take it any more :help:

Thank you,
Mr1nice
